A RESOLUTION OF THE CITY OF CLEAR WATER,
FLORIDA, FINDING THAT THE STRUCTURE LOCATED
ON THE PROPERTY AT 918 PALMETTO STREET,
CLEARWATER, FLORIDA, SHOULD BE DEMOLISHED
AND ORDERING THE SAME COMPLETED BY THE OWNERS
WITHIN THIRTY DAYS OR REMOVAL WILL BE ACCOMPLISHED
BY THE CITY.
WHEREAS, pursuant to the procedure established in Chapter 11A,
Housing, of the Code of Ordinances of the City of Clearwater, Florida, 1962,
relating to minimum housing standards, and the Standard Housing Code,
the Building Official of the City of Clearwater has caused to be inspected
the following described real property and the building situated thereon;
Lot 5, Pennsylvania Subdivision, according to the
map or plat thereof as recorded in Plat Book 21,
page 80 of the Public Records of Pinellas County,
Florida, also known as 918 Palmetto Street,
Clearwater, Florida.
The record title holders to said property appear to be
William . Turner, 315 South Washington Avenue, Clearwater,
Florida; Edward Turner, Jr., 315 South Washington Avenue,
Clearwater, Florida; and Aaron Turner, 902 Pennsylvania
Avenue, Clearwater, Florida, being heirs of Edward Turner,
Sr., deceased, according to the Public Records and the
current tax roll of Pinellas County, Florida;
and
WHEREAS, based upon said inspection, the Building Official determined
that said property and the structure thereon was unsafe, unsanitary, unfit
for human habitation and does not properly comply with the requirements of
Chapter 11A of the Code of Ordinances of the City of Clearwater, Florida,
1962, relating to minimum housing standards and the Standard Housing
Code; and
WHEREAS, on August 7, 1978, written notice was hand delivered
setting forth deficiencies and violations for the structure and advising the
owners that they had until December 7, 1978, to properly comply and correct
said deficiencies and violations; and

WHEREAS, on December 11, 1978, a follow-up official notice was
hand delivered to the owners reminding them that the final compliance date
was December 7, 1978; and
WHEREAS, on March 19, 1979, notice was hand delivered to owners
that since they had failed-to comply with said written notice and the deficiencies
and violations still existed, the matter was 'being turned over to the City
Commission for its action; and

WHEREAS, said structure is a nuisance, is sub-standard and constitutes
a fire, safety and health hazard, and the required repairs exceed fifty
per cent of the physical value of the building in its present condition; and
WHEREAS, the Building Official of the City of Clearwater has in
writing notified the City Manager that the building situated on the above
described property should be demolished pursuant to Chapter 11A of the
Code of Ordinances of the City of Clearwater, Florida, 1962, and the
Standard Housing Code and that the owners have failed to comply with the
order forwarded to them an August 7, 1978; and
WHEREAS, the City Manager, pursuant to Section 11A-4 has
scheduled a public hearing on said matter for Thursday, May 3, 1979,
at 1Zs30 P.M. at Clearwater City Hall Auditorium; and
WHEREAS, the City Manager has directed that notice of such public
hearing be given by publication in some newspaper publichsed in the City,
once a week for at least two weeks, the first publication to be at least ten
days prior to the hearing provided herein, and shall also cause to be mailed
a notice of the scheduled public hearing by certified mail, return receipt
requested, to the occupant at the street address of the property and to the
owner of the property addressed as indicated on the current tax roll of
Pinellas County, Florida, said notice requiring all persons interested to
show cause why the occupant or owner, or both, should not comply with
the orders and decision of the Building Official;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION REGULARLY AND DULY ASSEMBLED, AS
FOLLOWSr
1. That Aaron Turner was provided with a written order date
December 11, 1978, setting forth deficiencies and violations of a structure
at 918 Palmetto Street, Clearwater, Florida, and requiring the owners to
properly comply and correct said deficiencies and violations, and the owners
have failed to comply with the order.
x. That pursuant to Section IIA-4 of the Code of Ordinances of
the City of Clearwater, Florida, a public hearing was scheduled for May
r 3, 1979, and notice of such hearing was published once a week for at least
i two weeks, the first publication being at least ten days prior to said hearing.
I 3. That the City Commission having considered the evidence in
the form, of testimony and exhibits presented finds that a number of defects
exist in the structure located on the property, which defects are outlined
in the Housing Inspector's Report, a copy of which is attached hereto and
made a part herein as Exhibit A, and by reason of such defects the structure
is unsafe, unsanitary and unfit for human habitation and dangerous and
detrimental to the health, safety, morals and general welfare of the
community, and do not properly comply with the requirements of Chapter
11A of the Code of Ordinances of the City of Clearwater, Florida, 1962,
relating to minimum housing standards and the Standard Housing Code.
4. That the cost of all necessary repairs will be in excess of 500/6
of the assessed valuation placed on such property.
5. The City Commission further finds that no objections have been
filed or presented which are contrary to the inspection report relating to this
property and the structure thereon and that the owner of the property is to
have thirty (30) days from the passage and adoption of this Resolution within
which to demolish the structure or the City Commission will cause the
building to be demolished and the costs of such demolition assessed as
provided in Section 11A-5 of the Code of Ordinances of the City of
Clearwater, Florida.

6. - That a certified copy of this Resolution be immediately
furnished by certified mail, return receipt requested, to the occupant,
if any,. at the street address of the property, and to the owner of the property
addressed as indicated on the current tax roll of Pinellas County, Florida.
7. Further, that if said occupant and/or owner fail to properly
comply with this said Resolution within the said thirty (30) day period, the
City Commission shall cause the removal or demolition of said building and
shall charge upon those benefitted and the property such special assessment
of the necessary costs incurred as determined by the City Commission
and shall provide that such assessment be a lien upon the real estate
improved.
8. That this Resolution shall become effective immediately upon
its adoption.

Dear Mr. Turner;
It has been determined that you are responsible for the property referred to above. This depart-
ment recently inspected the property under the provisions of the Minimum Housing Code. Certain
violations were noted. The necessary remedial action and further explanations are Indicated on the
enclosed bill of particulars.
You must, under the law, correct all violations within 120 days. Work permits, if required, must
be obtained within 30 days from the issuance of this notice.
The period for final compliance ends on: December 7, 1978.
You have the right to appeal the finding of this department. If you desire to appeal, you must fill
out application for appeal at City of Clearwater Building Inspection office within 15 days from
receipt of this notice. You will then be notified when your case will be heard berore the Housing
Board of Appeals.
Periodic inspections will be made to determine compliance. Failure to comply may result in the
impairment of title and the imposition of other penalties as prescribed by law. For additional in-

the stated time as set forth in the notice, the Pui]ding nf.ficial'shall
institute such legal proceedings charging the person with aviolation
