A RESOLUTION OF THE CITY COMMISSION OF THE -
CITY OF CLEARWATER REQUESTING THE PINELLAS
COUNTY LEGISLATIVE DELEGATION TO DELAY UNTIL
1980 TAKING ACTION ON EMERGENCY MEDICAL
SERVICES LEGISLATION.
WHEREAS, efforts by the Pinellas County Legislative Delegation
to address County-wide Erne rgency Medical Services has produced at least
four drafts of proposed lagi.slation; and
WHEREAS, it is the belief of the City Commission of the City of
Clearwater that a delay In adopting legislation until the next term of the
Legislature could provide the time within which both the County and the
various municipalities can agree on legislation using the drafts of legislation
that have been submitted; and

WHEREAS, given the fact that a County-wide Emergency Medical Services
System is very important to the County as a whole and given the number of
drafts that have been produced, it is the belief of the City Commission that
allowing an additional period of time will allow formulation of legislation
that can be accepted by all governmental entities involved;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater hereby
requests the Pinellas County Legislative Delegation to delay action until the
next term of the Legislature on proposed EMS legislation for Pinellas County.
Such request is made because of the need for more debate relating to the
various drafts of legislation that exist and because of remaining unanswered
questions, particularly with respect to funding of the program.
2. Should the Delegation feel that a one year delay cannot be granted,
then the City Commission would request the Delegation to consider the
attached proposed bill submitted by, the City of Clearwater.

A 23 Be It Enacted By The Legislature Of The State Of
' 24 Florida:
25 Section 1. There is hereby created a
26 countywide emergency medical service authority
27 hereinafter called the "authority. 11 The governing
28 body of the authority and its membership shall be the
29 Board of County Commissioners of Pinellas County,
30 Florida. Three members of the authority shall
31 constitute a quorum. The authority shall keep a

Section 2. The authority shall have the
following powers and duties:
(1) To employ ouch personnel, consultants and
technical and professional assistants as i' wkvy64eem

compensation to be based upon recommendations of

(2) To make and enter into such contracts and

agreements as are deemed necessary bX the Council;
(3) To hold public hearings and sponsor public
forums;
(4) To sue and be sued in its own name;
(5) To accept apse funds, grants and services
from the federal, state, county or municipal govern-
meets, or an agency thereof; and to use said monies

emergency medical services have been expended;

Florida Statutes, as it relates to Emergency Medical

may hereinafter be amended.
(11) To establish and from time to time amend
service areas for all of Pinellas County;2

Section 4. No existing emergency medical services
department within Pinellas County may be abolished
without the express consent of the governing body of
that department. Further, nothing contained herein
shall prohibit any emergency medical service ?rovtder
from providing_ service _outside the boundaries of
Pinellas County. 2
Section S. There is hereby created an Emergency
Medical Services Advisory Council to consist of not
fewer than fifteen (15) nor more than twenty-four (24)
members. Members shall be appointed by the authority.
Terms of appointment shall be at the discretion of the
authority. Members shall constitute a broad spectrum
of county representation and shall Include members
from all phases of the emergency medical services

less than five (5) members shall be representatives of

the Council of Mayors. The Director of Civil
Emergency Services for Pinellas County shall be a non-
voting momber of the Emergency Medical Services

2 Section 6. The Board of County Commissioners
3 may call an election within all of Pinellas County for
4 the approval of the establishment of a special taxing
5 district to provide emergency medical services. Such
4
6 election is to be held in March. 1980, in the manner
7 prescribed by law for elections to issue bonds. The
8 question on the ballot shall be worded in substantially
9 the following form:
10 EMERGENCY MEDICAL SERVICES
11 Shall there be created an emergency medical
12 services district covering the entirety of Pinellas
13 County to provide a comprehensive emergency
14 medical services system.. The services to be
15 provided shall include but not be limited to
16 the operation of ernergeryouc- advanced life
17 support vehicles, communications, and trained
18 paramedics necessary for a complete emergency

19 seseue advanced life support capability
20 throughout the entire county. All real property
21 within said special taxing district shall be
22 subject to ad valorem real property tax suf-
23 ficient to pay the cost of providing this
24 service but not to exceed a maximum of .999
25 mills the first year with such increases in
26 subsequent years as the EMS Advisory Council
27 may deem necessary due to increases in
'28 population or inflation, to a maximum of 1.5

Section 7. Upon the approval of the emergency
medical service special taxing district as provided by
this act, the board of county commissioners shall
cause to be levied an ad valorem tax not to exceed 1.5
;mills on all real estate within Pinellas County suf-
ficient to pay the costs of the emergency medical
services as determined by the emergency medical
service authority. Notwithstanding any provision of
this act to the contrary, the ad valorem tax levy shall
not exceed the tonal countywide cost of emergency medical
service, as submitted b emergency medical service
roviders and a roved b the authors . 2
SectIbn S. Severability. If any section, sub-
section, sentence, clause, phrase or portion of this
act is for any reason held invalid or unconstitutional'
by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of
the remaining portion thereof.
Section 9. Chapters 74585 and 75492, Laws of
Florida, are hereby repealed.
Section 10. Effective Date. This act shall take
effect immediately upon becoming a law.
