A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF CLEARWATER CALLING A SPECIAL ELECTION FOR
DECEMBER 12, 1978, FOR THE PURPOSE OF SUBMITTING
TO THE ELECTORATE OF THE CITY OF CLEARWATER
THREE ORDINANCES CONTAINING A NEW CITY CHARTER,
CIVIL SERVICE SYSTEM AND AMENDED PENSION PLAN;
AND PROVIDING AN EFFECTIVE DATE,
WHEREAS, the current election code of the City of Clearwater,
specifically Section 8-2, requires the City Commission to adopt a resolution
where it is necessary to call a special election; and
WHEREAS, the voters of the City of Clearwater on February 7,
1977, approved a new Charter and Civil Service System for the City and
part of the amendments to the existing Pension Plan; and
WHEREAS, such election was overturned by the Circuit Court on
June 3, 1977, and such result is currently under appeal; and
WHEREAS, it is the desire of the City Commission to resubmit such
ordinances to the electorate in light of the fact that the matter has been
before the Courts for over a year; and
WHEREAS, in order to submit the new Charter, Civil Service System
and amendments to the Pension Plan to the electorate, it is necessary to call
a special election;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
Section 1. A special election of the qualified electors residing in
the City of Clearwater is hereby called to be held on December 12, 1978,
and the City Clerk is hereby directed to do all things necessary to prepare
for and conduct such election, to determine whether or not the existing City
Charter, Civil Service System and Pension Plan shall be changed by approval of
a majority of the electors voting in such election on each of the issues as
follows;

(1) to amend in its entirety Chapter 9710, Special Laws of Florida,
1923,, as amended, to provide a new City Charter relating to the existence
of the City; form of government; terms of elected officers and their manner
of election; the distribution of power.
(2) to amend Chapter 21153, Special Laws of Florida, 1941, as
amended, to establish a new Civil Service System relating to the removal
of department, division and agency heads from civil service; maintaining
a civil service board; providing a hearing officer to conduct employee
disciplinary and grievance hearings; providing for permissible political
activities of civil service employees; permitting civil service employees
to join and participate in employee organizations; continuing civil service
status of present civil service employees and providing a referendum require-
ment on all future changes beyond the ordinance.
(3) to amend Chapter 23214, Special Laws of Florida, 1945, as
amended, either in whole or in part, to provide for vesting of employee
pension rights; total return of employee contributions; pension benefits for
children of deceased employees; broadening authority of trustees to invest;
trustees to administer plan; employee pension advisory committee; forfeiture
of pension; workmen's compensation exclusion; pension rights of members
of armed forces; requiring funds to be on deposit before payment of pension;
providing a -referendum requirement on future changes beyond the ordinance;
protecting rights of employees under any other pension and additional amend-
ments contained in a second question relating to providing increased pension
benefits by increasing their contribution from six to eight per cent of salary;
increasing the municipality's contribution; providing an increase in the pension
benefit formula from 2 to 2.5 per cent times number of years served and
providing increased benefits for on the job disability.
All qualified electors residing in the City shall be entitled and permitted

clerks for the special election shall be designated as provided by the Coda
of Ordinances of the City of Clearwater, and by applicable State Law. The
polls will be open at the voting places from seven (7) o'clock A. M. until
seven (7) o'clock P,Ma on the same day.
Section 2. Official Ballot. Votomatie voting punch card system shall
be used at such special election and the form of ballot to be used shall be
in substantially the following form:

Shall Chapter 9710, Special Laws of Florida, 1923, as
amended, be further amended by Ordinance No. 1830 to
provide a new charter which deals with the following:

limitations on the exercise of legislative power; terms of
office of elected officials; powers of the City Manager; a
system of revenue management; an initiative or referendum
ordinance procedure; a recall procedure; the conduct of
municipal elections; and referendum requirement on all
future changes to the charter?
Shall Chapter 21153, Special Laws of Florida, 1941, as
amended, be further amended by Ordinance No. 1831 to create
a new civil service system dealing with the following:

Shall the amendments to Chapter 23214. Special Laws of
Florida, 1945, as amended, as contained in Sections 2-46
and 2-48 of Ordinance No. 1832 relating to providing increased
pension benefits for municipal employees by increasing
employee contributions from six per cent (676) to eight per
cent (876) of salary; increasing the municipality's contribution;
and providing for an increase in the pension benefit formula
from 2 per cent to 2. 5 per cent times number of years
served be approved?
The ballot and Votomatic punch card system shall be so arranged that the
voter may vote "For" or "Against" with respect to each issue.
Section 3. Absentee Voting. Paper ballots shall be used at such
election for absentee voting. The form of ballot to be used in the election for
absentee voters shall be in substantially the form provided in Section 2
above.
Section 4. Printing of Ballots. The City Clerk of the City is authorized
and directed to have printed on plain white paper a sufficient number of the
aforesaid ballots for use of absentee electors entitled to cast such ballots in such
special election, and shall also have printed sample ballots and deliver them
to the Inspectors and Clerks on or before the date and time for the opening
of the polls for such special election for the voting places at which Votomatic
punch card equipment is to be used; and further is authorized and directed
to have printed on plain white paper and delivered in accordance with law
the official ballot for use in such voting equipment and to make all appropriate
arrangements for the conduct of such special election.
Section 5. Election Procedure. The special election shall be held
and conducted in the manner provided by law, except as herein provided.
The Inspectors and Clerks shall in accordance with the procedure to be
authorized for the Votomatic punch card system return the ballot cards to
the City Clerk. Such returns shall show the number of qualified electors
who voted at such special election. The return of the Inspectors and
Clerks shall within twenty-four (24) hours after the close of the polls be
canvassed by the City Commission of the City, which shall declare and
certify the results of such special election.

Section 6. Election Results. If a majority of the votes cast at
such special election in respect to any referendum issue, such referendum
issue, either in whole or in part, shall be approved.
Section 7. Notice of Special Election. The notice for this special
election shall be headed:

C. Such notice shall be used for Ordinance Nos. 1830, 1831 and 1832. Such
notice shall be published in a daily: newspaper published in the City once a
week for five (5) weeks immediately preceding the special election with the
first such publication to be at least thirty (30) days prior to the special election.
Section 8. Severability. In the event that any word, clause, phrase,
sentence or paragraph hereof shall be held invalid by any court of competent
jurisdiction, such holding shall not affect any other word, clause, phrase,
sentence or paragraph hereof.
Section 9. Repealing Clause. All resolutions or other actions taken
by this Commission in conflict or inconsistent herewith are hereby repealed
insofar as there is conflict or inconsistency.
Section 10. This resolution shall take effect immediately upon its
passage and, adoption.

NOTICE OF SPECIAL ELECTION
CITY OF CLEARWATER, FLORIDA
TO BE HELD ON TUESDAY
DECEMBER 12, 1978
NOTICE IS HEREBY GIVEN that a special election will be held
in the City of Clearwater, Florida, on Tuesday, December 12, 1978, to
determine whether Chapter 23214, Special Laws of Florida, 1945, as
amended will be further amended as more specifically described and
provided in ordinance No. 1832 to provide a revised pension plan for
employees of the City of Clearwater. This issue will be divided into two
questions on the ballot as follows:
Shall the amendments to Chapter 23214, Special
Laws of Florida, 1945, as amended, as contained
in Sections 2-44, 2-45, 2-47, 2-49, 2-50, 2-51, 2-52,
2-53, 2-54, 2-55, 2-56, 2-57, 2-58, 2-59, 2-60,
2-61, 6-62 and 2-63 of Ordinance No. 1832 relating
to employee pension qualification; vesting of employee
pension rights; total return of employee contributions;
pension benefits for children of deceased employees;
trustees to administer pension plan; broadening in-
vestment authority of trustees; an employee pension
advisory committee; forfeiture of pension; workmen's
compensation exclusion; pension rights of members of
armed forces; requiring funds be on deposit prior to
payment of pension; protecting rights of employees under
any other pension plan; providing increased benefits of
not less than 7576 average salary for on the job disability; and
a referendum requirement on all future changes beyond
Ordinance No. 1832 be approved?

Shall the amendments to Chapter 23214, Special Laws
of Florida, 1945, as amended, as contained in Sections
2•-46 and 2-48 of Ordinance No. 1832 relating to providing
increased pension benefits for municipal employees by
increasing employee contributions from six per cent (6%)
to eight per cent (8%) of salary; increasing the municipality's
contribution; and providing for an increase in the pension
benefit formula from 2 per cent to 2. 5 per cent times
number of years served be approved?

Pursuant to this notice Ordinance No. 1832, containing the
