WHEREAS, pursuant to the procedure established in Chapter 11A,

the following described real property and the building situated thereon:
That part of Lot 51 of Sunset Highlands, Unit No. 1
as recorded in Plat Book 41, page 68 of the Public
Records of Pinellas County, Florida, described as
follows; From the SW corner of Lot 50 of said Sunset
Highlands, Unit #1, run thence S 0110109" E along the
Easterly right-of-way of Highland Avenue 219.62 feet
for a P.O. B.; thence run N 89°49'51" E 150 fect;thence
S 0°101091' E 70 feet; thence S 89°49'51"1 W, 150 feet to
the said Easterly right-of-way line of Highland Avenue;
thence run N 0°10109" W along said right-of-way line
70 feet to the P.O. B. (Tract "D"), also known as
1927 North Highland Avenue, Clearwater, Florida.
The record title holder to said property appears to be
David Brown, 15110 S. U. S. Highway 19, Clearwater,
Florida 33516, and James Walker, Z128 Pine Forest Drive,
Clearwater, Florida 33516, according to the Public Records
and the current tax roll of Pinellas County, Florida;
and
WHEREAS, based upon said inspection, the Building Official determined
that said property and the structure thereon was unsafe, unsanitary, unfit
for human habitation and does not properly comply with the requirements of
Chapter 11A of the Code of Ordinances of the City of Clearwater, Florida, 1962,
relating to minimum housing standards and the Southern Standard Housing
Code; and
WHEREAS, on May 8, 1978, written notice was handdelivered
setting forth deficiencies and violations for the structure and advising the owners
that they had until September 11, 1978, to properly comply and correct said

WHEREAS, on July 11, 1978, a follow-up official notice wao hand
delivered to the owner reminding them that the final compliance date was
September 11, 1978; and
WHEREAS, on September 13,' 1978, notice was hand delivered to
owners that a routine inspection revealed that they had not complied with said
written notice and the deficiencies and violations still existed; and
WHEREAS, said structure is a nuisance, is substandard and constitutes
a fire, safety and health hazard, and the required repairs exceed fifty
per cent of the physical value of the building in its present condition; and
WHEREAS, the Building Official of the City of Clearwater has
in writing notified the City Manager that the building situated an the above
described property should be demolished pursuant to Chapter 11A of the
Code of Ordinances of the City of Clearwater, Florida, 1962, and the
Southern Standard Housing Code and that the owners have failed to comply
with the order forwarded to them on May 11, 1978; and
WHEREAS, the City Manager, pursuant to Section 11A-4 has
scheduled a public hearing on said matter for Thursday, October 5, 1978,
at 12:30 P.M. at Clearwater City Hall Auditorium; and
WHEREAS, the City Manager has directed that notice of such public
hearing be given by publication in some newspaper published in the City, once
a week for at least two weeks, the first publication to be at least ten days
prior to the hearing provided herein, and shall also cause to be mailed a
notice of the scheduled public hearing by certified mail, return receipt
requested, to the occupant at the street address of the property and to the
owner of the property addressed as indicated on the current tax roll of
Pinellas County, Florida, said notice requiring all persons interested to
show cause why the occupant or owner, or both, should not comply with
the orders and decision of the Building Official;

NOW, THEREFORE, BE IT RESOLVED 8Y THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION REGULARLY AND DULY ASSEMBLED, AS
FOLLOWS=
1. That James Walker was provided with a written order dated
may 8, 3978, setting forth deficiencies and violations of a structure at
1927 North Highland Avenue, Clearwater, Florida, and requiring the owner
to properly comply and correct said deficiencies and violations, and the
owner has failed to comply with the order.
2. That pursuant to Section IIA+-4 of the Code of Ordinances of
the City of Clearwater, Florida, a public hearing was scheduled for October
5, 1976, and notice of such hearing was published once a week for at least
two weeks, the first publication being at least ten days prior to said hearing,
3. That the City Commission having considered the evidence in
the form. of testimony and exhibits presented finds that a number of defects
exist in the structure located on the property, which defects are outlined
in the Housing Inspector's Report, a copy of which is attached hereto and
made a part herein as Exhibit A, and by reason of such defects the structure
is unsafe, unsanitary and unfit for human habitation and dangerous and
detrimental to the health, safety, morals and general welfare of the
community, and do not properly comply with the requirements of Chapter
11A of the code of Ordinances of the City of Clearwater, Florida, 1962,
relating to minimum housing standards and the Southern Standard Housing
Code.
4. That the cost of all necessary repairs will be in excess of 5016
of the assessed valuation placed an such property.
5. The City Commission further finds that no objections have been
filed or presented which are contrary to the inspection report relating to this
property and the structure thereon and that the owner of the property is to
have thirty (30) days from the passage and adoption of this Resolution within
which to demolish the structure or the City Commission will cause the
building to be demolished and the costs of such demolition assessed as
provided.in Section 11A-5 of the Code of Ordinances of the City of
Clearwater, Florida.

b. That a certified copy of this Resolution be immediately
furnished by certified mail, return receipt requested, to the occupant,
if any, at the street address of the property, and to the owner of tha property
addressed as indicated on the current tax roll of Pinellas County, Florida.
7. Further, that if said occupant and/or owner fail to properly
comply with this said Resolution within the said thirty (30) day period, the
City Commission shallcause the removal or demolition of said building and
shall charge upon those benefitted and the property such special assessment
of the necessary costs incurred as determined by the City Commission
and shall provide that such assessment be a lien upon the real estate
improved.
8. That this Resolution shall become effective immediately upon
its adoption.
