A RESOLUTION FINDING AND DECLARING A BUILDING
TO BE AN UNSAFE BUILDING AND ORDERING THE
BUILDING REPAIRED OR DEMOLISHED AND FURTHER
ORDERING THAT THE COST OF DEMOLITION BE
ASSESSED AGAINST THE PROPERTY,
WHEREAS, pursuant to the procedure established in Section 7-2
of the Code of Ordinances of the City of Clearwater, Florida, 1962, relating
to unsafe buildings, and the Standard Building Code, the Building Official of
the City of Clearwater has caused to be inspected the following described
real property and the building situated thereon:
Lot 11 and W1/2 of Vacated Street (formerly Ficht Avenue),
less and except right-of-way of Railroad Avenue, PALM PARK
SUBDIVISION, according to the map or plat thereof as recorded
in Plat Book 4, page 86 of the Public Records of Hillsborough
County, Florida, of which Pinellas County was formerly a part,
also known as 1103 Railroad Avenue, Clearwater, Florida.
The record title holder to said property appears to be
Elijah P. Jones, Jr., 1424 Barbara Avenue, Clearwater
Florida 33515; and Christine Miller (formerly Christine
Jones), 12337 Jefferson Circle, Apt, B, Largo, Florida
33540, according to the Public Records and the current
tax roll of Pinellas County, Florida;
and
WHEREAS, based upon said inspection, the Building Official determined
that said property and the premises were unsafe, unsanitary, unfit for human
habitation and such building is an unsafe building within the meaning and
definition of that term as set out in Section 7-2 of the Code of Ordinances of
the City of Clearwater, Florida, 1962, relating to unsafe buildings, and the
Standard Building Code; and
WHEREAS, on April 28, 1978, written notice was furnished setting
forth said deficiencies and violations and advising the owners that they had
until June 12, 1978, to properly comply and correct said deficiencies
and violations; and
WHEREAS, final compliance date for this correction has passed and
said deficiencies and violations have not been corrected; and

WHEREAS, the property owner has filed no appeal from the order of
the Building Official to the Building Board of Adjustment and Appeals; and
WHEREAS, the Building Official of the City of Clearwater has

recommended to the City Commission that the building situated on the above

described property be demolished pursuant to Section 7-2 of the Code of
Ordinances of the City of Clearwater, Florida, 1962, and the Standard
Building Code; and
WHEREAS, the City Commission scheduled a public hearing on
said matter for Thursday, July 20, 1978, at 12:30 P.M. at Clearwater City
Hall Auditorium, had notice of said public hearing published once a week for
at least two weeks, the first publication being at least ten days prior, and
has also had mailed a notice of the scheduled public hearing by certified mail,
return receipt requested, to the occupant at the street address of the property
and the owner of the property addressed as indicated on the current tax roll
of Pinellas County, Florida, said notice requiring all persons interested
to show cause why the occupant or owner, or both, should not comply with
the order and decision of the' Building Official;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. The City Commission, after proper notice and public hearing,
and having considered the evidence and testimony presented, finds that no
objections have been filed or presented or that the objections filed or presented
are deemed insufficient, further finds that the above described real property
and the building situated thereon are unsafe, unsanitary, unfit for human
habitation and dangerous and detrimental to the health, safety, morals and
general welfare of the community, and do not properly comply with the
requirements of Section 7-2 of the Code of Ordinances of the City of
Clearwater, Florida, 1962, relating to unsafe buildings, and the Standard
Building Code.

2. Further, that the City Commission does hereby agree and concur
with and in the finding and determination of the Building Official of the City of
Clearwater as set forth in the Building official's notice contained in Exhibit
A attached hereto and made a part herein concerning said real property and
the building thereon and the occupant, if any, and/or the owners, Elijah P.
Jones, Jr. and Christine Miller, or both of them, are ordered within thirty
(30) days after the passage and adoption of this Resolution to remove or
demolish such building in accordance with the requirements of the Standard
Building Code as referred to in Section 7-2 (8) of the Code of Ordinances of
the City of Clearwater, Florida, 1962.
3. That a certified copy of this Resolution shall be immediately
forwarded by certified mail, return receipt requested, to the occupant, if
any, at the street address of the property, and to the owners of the property
addressed as indicated on the current tax roll of Pinellas County, Florida.
4. Further, that if said occupant and/or owners fail to properly comply
with this said Resolution within the said thirty (30) day period, the City
Commission shall cause the removal or demolition of said building and shall
charge upon those benefitted and the property such special assessment of the
necessary costs incurred as determined by the City Commission and shall
provide that such assessment be a lien upon the real estate improved.

Dear Mr. Jones:

structure on the above described property is unsafe or dangerous as
defined by Section 103.4 of the Southern Standard Building Code as

Secure building against vandals and possible fires.
Provide .off-street parking.
Repairs exceed fifty percent of valuation of structure.
Period of Final Compliance ends on June 12, 1978.
This structure is placarded as unfit for human habitation and declared to
be a nuisance.
You are•Surther notified that you shall commence improving or repairing said
defect's:within fifteen (15) days of the above date and complete the improve-
ments and repairs within forty-five (45) days. In the event you fail to
commence improving or repairing the above described premises within the
stated time, you are hereby notified to demolish or remove said building or

You are further notified that you have the right to appeal the decision of
the Building Official and said decision shall be appealed to the Building
Board of Adjustment and Appeal. A notice of appeal shall be filed with
the Building Official on or before fifteen (15) days after the above date,
otherwise the appeal cannot be considered. The official form of Notice
of Appeal will be furnished by the Building Official upon request, and a
fee of ten dollars ($10.00) shall accompany such Notice of Appeal.
