A RESOLUTION OF THE CITY COMMISSION ESTABLISHING
A LIMITED SZLF-INSURANCE PROGRAM APPLICABLE
TO CITY OF CLEARWATER POLICE AND DETECTIVES
FUNCTIONING FOR THE PINELLAS COUNTY SHERIFF
AND THE STATE ATTORNEY FOR THE SIXTH JUDICIAL
CIRCUIT AND EXTENDING SELF-INSURANCE COVERAGE
TO THE STATE ATTORNEY AND PINELLAS COUNTY
SHERIFF,
WHEREAS, the City of Clearwater has investigated the availability
of insurance to apply in the situation where Clearwater police and detectives
must function outside the City limits; and
WHEREAS, such investigation has demonstrated that such insurance
coverage is either unavailable or the cost of providing the same is prohibitive;
and
WHEREAS, on occasion City police and detectives must conduct
investigations outside City limits to solve crimes that have occurred within
the City; and
WHEREAS, the authority of these officials as City officials terminates
in investigative matters at the City limit line; and
WHEREAS, individual detectives and police officers have in the past
been given temporary powers to act as special investigators for the State
Attorney and alternatively deputies of the Sheriff of Pinellas County by these
officials in important investigations; and
WHEREAS, the City Commission desires to establish a self-insurance
program to apply in the situation described herein;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
I.. That the City Manager be and he is hereby authorized to establish
a self-insurance program to apply to the City of Clearwater and its police
officers and detectives where such City police officers and detectives must
conduct investigations outside the City limits relating to crimes that occurred
,within the City.

2. That the City's self-insurance protection afforded by reason of
such a program is herewith additionally extended to include the State Attorney
o£ the Sixth Judicial Circuit and the Sheriff of Pinellas County, under the
following combined circumstances only:
(a) When the City police officials are investigating crimes
which occurred or might occur within City limits outside
those limits.
(b) When the City police officials are acting either as State
Attorney investigators or as deputy sheriffs.
(c) When the City police officials are the primary instrumental
force behind such investigation (as opposed to aiding in an
outside matter at the request of the State Attorney or the
Sheriff, the main interest of which is county-area crime,
as opposed to Clearwater area crime.)
3. That a certified copy of this Resolution be provided to the State
Attorney of the Sixth Judicial Circuit and to the Sheriff of Pinellas County,
Florida.
4. That this Resolution shall become effective immediately upon
its adoption.
