of the City of Clearwater that it wished to donate a tract of land to the City
to be used for the construction of a performing arts center; and

WHEREAS, Kapok Tree Inn, Inc. has presented a deed for such tract
to the City of Clearwater; and

WHEREAS, the City Commission of the City of Clearwater desires

understanding that it is the intention of the City of Clearwater

NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater, P'lorida,
on behalf of the City hereby accepts the donation of land contained in those
certain deeds dated December 27, 1977, and December 28, 1977, respectively,
from Kapok Tree Inn, Inc. to the City of Clearwater, and further agrees an
behalf of the City that development and utilization of the land for a performing
arts center will commence within two (2) years of the date of this resolution.
Copies of such deeds are attached hereto as Exhibit 1 and made a part of
this resolution as if fully set forth herein. The performing arts center site
shall be known as "Richard B. Baumgardner Center for the Performing Arts.
