A RESOLUTION OF THE CITY OF CLEARWATER,
FLORIDA, FINDING THAT THE STRUCTURE LOCATED
ON THE PROPERTY AT 1561 TIOGA STREET SHOULD
BE DEMOLISHED AND ORDERING THE SAME DEMOLISHED
IMMEDIATELY BECAUSE OF ITS EXTREME UNSAFE
CONDITION,
WHEREAS, pursuant to the procedure established in Chapter IIA,
Housing, of the Code of Ordinances of the City of Clearwater, Florida, 1962,
relating to minimum housing standards, and the Southern Standard Housing
Code, the Building Official of the City of Clearwater has caused to be
inspected the following described real property and the building situated
thereon:
Lot 49, Carolina Terrace Annex, a subdivision of the City
of Clearwater, Florida, ccording to the map or plat thereof
as recorded in Plat Book 12, page 30 of the Public Records
of Pinellas County, Florida; also known as 1561 Tioga Street,
Clearwater, Florida.
The record title holder to said property appears to be
Rudy M. Tanner and Barbara Rose Tanner, his wife,
1453 Gulf to Bay Boulevard, Clearwater, Florida 33515,
according to the Public Records and the current -tax
roll of Pinellas County, Florida;
and
WHEREAS, based upon said inspection, the Building Official determined
that said property and the premises were unsafe, unsanitary, unfit for
human habitation and do,enot properly comply with the requirements of
Chapter 11A of the Code of Ordinances of the City of Clearwater, Florida,
1962, relating to minimum housing standards and the Southern Standard
Housing Code; and
WHEREAS, on July 26, 1977, written notice was furnished setting
forth deficiencies and violations, including fire damage, and advising the
owner that they 'should promptly comply and correct said deficiencies and
violations; and

WHEREAS, on September Z2, 1977, an additional notice was mailed
to the owner advising that a routine inspection revealed that they had not
complied with the previous written notice and that the deficiencies and
violations must be corrected by October 10, 1977; and
WHEREAS, said structure is a nuisance and no', damaged, dilapidated,
unsafe, and unfit for human habitation, that it creates a serious hazard to
the health and safety of the public, and the required repairs exceed fifty
per cent of the physical value of the building in its present condition; and
WHEREAS, the Building Official of the City of Clearwater has
in writing notified the City Manager that the building situated on the above
described real property should be demolished pursuant to Chapter 11A of
the Code of Ordinances of the City of Clearwater, Florida, 1962, and the
Southern Standard Housing Code and that the owner has failed to comply with
the order forwarded to them on July 26, 1977; and
WHEREAS, the City Manager, pursuant to Section 11A-4 has
scheduled a public hearing on said matter for Thursday, October 20, 1977,
at 12:30 P.M. at Clearwater City Hall Auditorium; and
WHEREAS, the City Manager has directed that notice of such public
hearing be given by publication in some newspaper published in the City, once
a week for at least two weeks, the first publication to be at least ten days
prior to the hearing provided herein, and shall also cause to be mailed a
notice of the scheduled public hearing by certified mail, return receipt
requested, to the occupant at the street address of the property and to the
owner of the property addressed as indicated on the current tax roll of
Pinellas County, Florida, said notice requiring all persons interested to
show cause why the occupant or owner, or both, should not comply with
the order and decision of the Building Official;

COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,

1. That Rudy M. Tanner and Barbara Rose Tanner, his wife, were
provided with a written order dated July 26, 1977, and again on September
22, 1977, setting forth deficiencies and violations of a structure at 1561
Tioga Street, Clearwater, Florida, and requiring the owner to properly
comply and correct said deficiencies and violations, and the owner has
failed to comply with the order.
2. Thatpursuant to Section 11A-4 of the Code of Ordinances of the
City of Clearwater, Florida, a public hearing was scheduled for October
20, 1977, and notice of such hearing was published once a week for at least
two weeks, the first publication being at least ten days prior to said hearing.
3. That the City Commission having considered the evidence in
the form of testimony and exhibits presented finds that a number of defects
exist in the structure located on the property, which defects are outlined
in the Housing Inspector' s Report, copy of which is attached hereto and
made a part herein as Exhibit A, and that by reason of such defects, the
structure in question is unsafe, unsanitary and unfit for human habitation
and dangerous and detrimental to the health, safety, morals and general
welfare of the community, and does not properly comply with the requirements
of Chapter 11A of the Code of Ordinances of the City of Clearwater, Florida,
1962, relating to minimum housing standards and the Southern Standard
Housing Code.
4. That the cost of all necessary repairs will be in excess of 5016
of the assessed valuation placed on such property.
5. That the City Commission further finds that no objections have
been filed or presented which are contrary to the inspection reports relating
to this property; that the property constitutes an extreme hazard because of
fire damage; that the owners of the property, in writing, agree that the City
of Clearwater should take the necessary action to have the fire-damaged
structure demolished, a copy of said consent is attached hereto and made
a part herein as Exhibit B; that the City Commission will immediately

cause the building to be demolished and the coste of such demolition
assessed as provided in Section 11A-5 of the Code of Ordinances of the
City of Clearwater, Florida.
6. That a certified copy of this Resolution be immediately furnished
by certified mail, return receipt requested, to the occupant, if any, at the
street address of the property, and to the owner of the property addressed
as indicated on the current tax roll of Pinellas County, Florida.
7. After demolition and removal of said building, the City Commission
shall charge upon those benefitted and the property such special assessment
of the necessary costs incurred as determined by it and shall provide that
such assessment be a lien upon the real estate improved.

It has been determined that you are responsible for the property referred to above. This depart-
mcnt recently inspected the property under the provisions of the Minimum.Housing Code. Certain
violations were noted. The necessary remedial action and further explanations are indicated on the
enclosed bill of particulars.
You must, under the law, correct all violations within 120 days. Work permits, if required, must
be obtained within 30 days from the issuance of this notice.
The period for final compliance ends on: November 11, 1977.
You have the right to appeal the finding of this department. If you desire to appeal, you must fill
out application for appeal at City of Clearwater Building Inspection office within 15 days from
receipt of this notice. You will then be notified when your case will be heard before the Housing
Board of Appeals.

306-4 Remove all, trash, rubhbish and debris from the premises.
308 This dwelling, unit is so fire damaged and deteriorated that it is
hereby designated as unfit for human habitation. Cost of repairs
exceed 50% of the physical valuation.
Electrical and plumbing work will require a permit by a licensed
contractor; all ether repairs will require a eland and specifications
by a licensed general contractor. If either building is demolished,
a demolition permit will he renuired.
If such repairs or demolition are not coluntari.ly completed within
the stated time, as set forth in the Official Notice, the Building
Official shall institute such laRal proceedings charging the person
or agent with a violation of the Pity of Clearwater Code of Ordinances.

Dear Mrs. Tanner:
It has been determined that you are responsible for the property referred
to above. See Official Notices hand delivered to you on 7-18-77 and 7-26-77
regarding this property.
On August 26, 1977, you stated to the City Housing Inspector that you %iould
not repair or demolish and that you had no objection for the City demolishing
the subject property in accordance with the City of Clearwater Code of
Ordinances.
The Building Official finds this structure a nuisance and so damaged,
dilapidated, unsafe, and unfit for human habitation, that is, it creates
a serious hazard to the health and safety of the public. No occupancy is-
permitted.
In accordance with Section 308 of the Minimum Housing Code adopted by the
City of Clearwater, you are hereby notified that you must repair, remove
or demolish this structure by October 10, 1977.
You have the right to appeal the findings of this department. If you desire
to appeal, you must fill out an application of appeal within 15 days from
receipt of this notice.

Because of the extreme hazards constituted by this dwelling,
request that the City Commission obtain demolition bids
and have the property cleared, as soon as possible, by
resolution.
Further, the Owners of Record of the property do not
object to the City Commission having the structure demolished.
