A RESOLUTION REQUESTING THE GOVERNOR OF FLORIDA
TO CAUSE THE DEPARTMENT OF NATURAL RESOURCES TO
r
r CEASE ACTION TO IMPOSE A SCHEDULE OF FEES ON
RESIDENTIAL DOCKS BUILT OVER STATE-TITLED BOTTOM-
LANDS IN PINELLAS COUNTY.
WHEREAS, the charging of dock fees to Pinellas County residents,
W living as they do in one of Florida's most populous water-oriented areas,
would impose an unfair, discriminatory and disproportionate burden on these
y_r many homeowners whose docks are used solely as recreational adjuncts to
their immediate residences; and
Y1 WHEREAS, the increasing scarcity of waterfront homesites in Pinellas
County has already caused much higher assessed valuations and taxes to the
owners and residents of these properties; and

` WHEREAS, the fees in most if not all instances would be expended in

such distant areas throughout the State as to provide no direct or indirect
?r
r benefit to those Pinellas County homeowners being assessed; and

WHEREAS, numerous inequities will be heaped on dock-owning residents
on the same immediate waterways who may or may not be charged a fee,
# depending on whether the State or a municipality has title to the bottomlands; and

?s WHEREAS, the proposal to delineate the assessment of fees on an artifical
construction date of 1970 would not only be unfair but unwieldy to administer;
and
WHEREAS, Pinellas County residential dock owners would be confronted
with what amounts to double taxation since they have already been charged
substantial permit, construction and other related fees and taxes for the
building of their docks; and
WHEREAS, particularly in these days of steadily rising living costs,
it is the State's obligation not to levy new or additional taxes or fees which
are not clearly for the common good of those so affected; and

WHEREAS, the Department of Natural Resources has not provided for
a ample public discussion of its proposed residential dock fee schedules,
advertising as if has in an almost clandestine and covert manner;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA',
g IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:

1. That the City Commission hereby requests the Governor of the,
State of Florida to instruct the Department of Natural Resources to cease
and desist in its efforts to set and impose a schedule of fees for Pinellas
?s°•?
County owners of private residential docks built over State-titled bottomlands.
r•
2. That certified copies of this resolution be transmitted forthwith
to Honorable Reubin Askew, Governor, and to the Trustees of the Internal
Improvement Fund.
