COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:

RESOLUTION
No, 76 - 1,59
A RESOLUTION REQUESTING THAT PINELLAS COUNTY
COMMISSION ENTER INTO DISCUSSIONS AND NEGOTIATIONS
LEADING TOWARD THE EXCHANGE OF LAND LOCATED
ON SAND KEY TO PROVIDE A SITE FOR THE COAST GUARD
STATION.
WHEREAS, the City of Clearwater acquired land located on Sand Key
which was proposed for use by the United States Coast Guard; and
WHEREAS, the United States Coast Guard had requested that such land
be donated for such use, and
WHEREAS, the City Commission submitted the question relating to
whether or not it could donate or give away the land in question to the Circuit
Court of Pinellas County; and
WHEREAS, the Circuit Court concluded that the Charter of the City of
Clearwater, specifically Section 7, would not permit the City of Clearwater to
donate or give away such land; and
WHEREAS, it is imperative that a place be provided wherein the
Coast Guard can construct a permanent station; and
WHEREAS, the Sand Key site provides a logical place where the permanent
station should be constructed; and
WHEREAS, the construction of the station can be accomplished through
an exchange of land with Pinellas County and through such an exchange the Sand
Key site could be made available for use by the Coast Guard; and
WHEREAS, the City Commission believes that the immediate establishment
of a permanent station would be of benefit both to the City of Clearwater and
Pinellas County;

?.. 1. That the City Commission of the City of Clearwater, Florida,
hereby requests the County Commission of Pinellas County to enter into
discussion and negotiations for the purpose of exchanging County land of
comparable value for land now owned by the City of Clearwater and loctLted
on Sand Key in order that Pinellas County as owner of the property could make
the same available to the United States Coast Guard as a permanent facility.
2. That a certified copy of this Resolution be forwarded forthwith
to the County Commission of Pinellas County, Florida.
PASSED AND ADOPTED this 16th day of December, A. D. 1976.
