WHEREAS, pursuant to the procedure established in Chapter 11A,
Housing, of the Code of Ordinances of the City of Clearwater, Florida, 1962,
relating to minimum housing standards, and the Southern Standard Housing
Code, the Building Official of the City of Clearwater has caused to be inspected
the following described real property and the duplex structure situated thereon:
Lot 1, Block "C" of Palm Park Addition to Clearwater,
Florida, according to map or plat thereof as recorded in
Plat Book 4, page 86 of the Public Records of Hillsborough
County, Florida, of which Pinellas County was formerly
a part, also known as 1209 Roosevelt Street, Clearwater,
Florida.
The record title holder to said property appears to be
Ella Benbry, formerly Ellas Rhodes, 1211 Roosevelt
Street, Clearwater, Florida, according to the Public
Records and the current tax roll of Pinellas County, Florida;
and
WHEREAS, based upon said inspection, the Building-Official determined
that said property and the premises were unsafe, unsanitary, unfit for human
habitation and do not properly comply with the requirements of Chapter 11A
of the Code of Ordinances of the City of Clearwater, Florida, 1962, relating
to minimum housing standards and the Southern Standard Housing Code; and
WHEREAS, on July 5, 1974, written notice was furnished setting
forth deficiencies and violations and advising the owner that she had until
November 5, 1974, to properly comply and correct said deficiencies and
violations; and
WHEREAS, further investigation revealed that one unit was still occupied
and the owner was quite elderly and financially unable to rehabilitate or demolish
the structure and therefore, on December 3, 1974, a letter was mailed to the
owner's son, Leroy Rhodes, Ft. Pierce, Florida, explaining the minimum
housing case to him; and

WHEREAS, on October 13, 1975, the remaining tenant was relocated
and on October 14, 1975, notice was mailed that a routine inspection revealed
that she had not complied with said written notice and the deficiencies and
violations still existed; and
WHEREAS, said duplex structure is a nuisance, is sub-standard and
constitutes a fire, safety and health hazard, and the required repairs exceed

"fyc WHEREAS, the Building Official of the City of Clearwater has
=•.?;•',? recommended to the City Commission that the building situated on the above
described real property be demolished pursuant to Chapter 11A of the Code
of Ordinances of the City of Clearwater, Florida, 1962, and the Southern
Standard Housing Code; and

P>.., •? WHEREAS, the City Commission scheduled a public hearing on said
matter for Thursday, December 18, 1975, at 12:30 P.M. at Clearwater City
Hall Auditorium, had notice of said public hearing published once a week for
at least two weeks, the first publication being at least ten days prior, and has
also had mailed a notice of the scheduled public hearing by certified mail,
return receipt requested, to the occupant at the street address of the property
and the owner of the property addressed as indicated on the current tax roll
of Pinellas County, Florida, said notice requiring all persons interested to
show cause why the occupant or owner, or both, should not comply with the
order and decision of the Building Official;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION REGULARLY AND DULY ASSEMBLED, AS
FOLLOWS:
1. The City Commission, after proper notice and public hearing,
and having considered the evidence and testimony presented, finds that no
objections have been filed or presented or that the objections filed or presented
are deemed insufficient, further finds that the above described real property
and the duplex building situated thereon is unsafe, unsanitary, unfit for human
habitation and dangerous and detrimental to the health, safety, morals and
general welfare of the community, and does not properly comply with the

2, Further, that the City Commission does hereby agree and concur

with and in the finding and determination of the Building Official of the City of
Clearwater, concerning said real property and the duplex building thereon and
the occupant, if any, and/or the owner, or all of them, are ordered within
thirty (30) days after the passage and adoption of this said Resolution to rePair

alter or improve said premises and the building thereon or remove-or demolish
said building in accordance with the determination of the Building Official so

3. That a certified co of this Resolution shall be immediate)

furnished by certified mail, return receipt requested, to the occupant,
iyy if any, at the street address of the property, and to the owner of the property
addressed as indicated on the current tax roll of Pinellas County, Florida.
4, Further, that if said occupant and/or owner tails to properly comply
with this said Resolution within the oaid thirty (30) day period, the City
Commission shall cause the removal or demolition of said building and
shall charge upon those benefitted and the property such special assessment
of the necessary costs incurred as determined by the City Commission and
shall provide that such assessment be a lien upon the real estate improved.
