RESOLUTION
No. 74 - 113
WHEREAS, pursuant to the procedure established in Chapter 11A,
Housing, of the Code of Ordinances, City of Clearwater, Florida, 1962,
relating to minimum housing standards, and the Southern Standard Housing
Code, the Building Official of the City of Clearwater has caused to be inspected
the following described real property and the buildings situated thereon;
Lots 9 and 10, Block 2, Lake Belleview Addition, as
recorded in Plat Book 9, page 141 of the Public Records
of Pinellas County, Florida, also known as 813 Lakeview
Road, Clearwater, Florida.
The record title holder to said property appears to be
Estate of Virdie E. Lively, deceased, Milton D. Jones,
Executor, subject to an Agreement for Deed between Virdie
E. Lively, a widow, and Willard Thomas and Barbara Thomas,
his wife, dated December 15, 1961, and recorded in O. R. 1321,
page 639 of the Public Records of Pinellas County, Florida,
which Agreement for Deed was assigned to Early B. Thomas
and Lavada Bell Thomas, his wife, PO Box 534, Cross City,
Florida, according to the Public Records and the current
tax roil of Pinellas County, Florida;
and
WHEREAS, based upon said inspection, the Building Official determined
that said property and the premises were unsafe, unsanitary, unfit for human
habitation and do not properly comply with the requirements of Chapter 11A
of the Code of Ordinances of the City of Clearwater, Florida, 1962, relating
to minimum housing standards and the Southern Standard Housing Code; and
WHEREAS, on January 9, 1973, written notice was furnished setting
forth deficiencies and violations and advising the owners that they had until
May 9, 1973, to properly comply and correct said deficiencies and violations; and
WHEREAS, on March ZZ, 1973, written notice was furnished that no
work had been started and that the final compliance date was May 9, 1973; and
WHEREAS, on May 6, 1973, the owner obtained Demolition Permit
#827ZA, and subsequently on July 3, 1973, requested an extension of time
because of illness; and
WHEREAS, on February S, 1974, notice was received that this
property was to be sold and the new owner would demolish the building as
soon as the sale was completed; and

WHEREAS, on July 9, 1974, the prospective buyer advised that because
he could not got a zoning variance that he was not interested in purchasing the
property; and
WHEREAS, on July 9, 1974, written notice was furnished advising the
owner that he had until July 29, 1974, to completely clear the property under
Demolition Permit #8272A; and
WHEREAS, on September 10, 1974, written notice was furnished the
owner advising that Demolition Permit #8272A was cancelled; and
WHEREAS, said structure is a nuisance, is sub-standard and constitutes
a fire, safety and health hazard, and the required repairs exceed fifty
per cent of the physical value of the building in its present condition; and
WHEREAS, the Building Official of the City of Clearwater has
recommended to the City Commission that the building situated on the above
described real property be demolished pursuant to Chapter IIA of the Code
of Ordinances of the City of Clearwater, Florida, 1962, and the Southern
Standard Housing Code; and
WHEREAS, the City Commission scheduled a public hearing on said
matter for Monday, October 7, 1974, at 1:30 P. M. at Clearwater City Hall
Auditorium, had notice of said public hearing published once a week for at
least two weeks, the first publication being at least ten days prior, and has
also had mailed a notice of the scheduled public hearing by certified mail,
return receipt requested, to the occupant at the street address of the property
and the owner of the property addressed as indicated on the current tax roll
of Pinellas County, Florida, said notice requiring all persons interested to
show cause why the occupant or owner, or both, should not comply with the
order and decision of the Building Official;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION REGULARLY AND DULY ASSEMBLED, AS
FOLLOWS:
