fifty per cent of the property owners within a given unincorporated geographic
area, or (2) when the Florida Division of Health shall officially notify the
municipality that a health hazard exists within a given unincorporated geographic
area that is hazardous to the municipality as determined by a field survey
and appropriate tests of the State Division of Health; and
WHEREAS. the City of Clearwater has received a petition requesting
such service signed by over fifty per cent of the property owners within the
unincorporated geographic area of Terra Alto Estates, according to the map or
plat thereof as recorded in Plat Baok 45, page 5 of the Public Records of
Pinellas County, Florida;
NOW, THEREFORE, BE iT RESOLVED BY THE CITY
COMMISSION OF THE C1TY OF CLEARWATER, FLORIDA,
iN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That in accordance with House Bill 5436 (Chapter 70-906} passed
by the Florida State Legislature, whose effective date was October 1, 1970,
the City of Clearwater hereby declares its intention to hold a public hearing
to determine the need and necessity to construct sanitary sewer lines and
facilities in the unincorporated geographic area of Terra Alto Estates, according
to the map ar plat thereof as recorded in Plat Book 45, page 5 of the Public
Records of Pinellas County, Florida. an the 17th day of May, 1971, at
1:30 P. M. in the City Hall Auditorium, 112 S. Osceola Avenue, Clearwater,
Florida. '

2. Natice of the hearing shall be published in iho Clearwater Sun
once a week for at least two (2) weeks; tho first publication of the notice to be
not less than ten X10) days prior to the hearing provided for in the notice.
In addition, the City Clerk shall send written notice to all property owners
within said geographic unincorporated area ae determined by the current
Pinellas County tax roll at least ten (lp) days betore the scheduled hearing.
The notice shall require all persons interested to ahaw cause why said sewer
lines and facilities should not be constructed.
