That it is hereby declared to be the policy of the City Commission r of the City of Clearwater, Fbrida, that in the acquistion of real property :_ n . .. h Xe rj. :4~ l~, RESOLUTION No. 70 - 74 Declaration of Policy WHEREAS, Section 402 0[ the Housing and Urban Developmont Act ,- of 1965 requires that, as a condition eligibility for assistanco under the Open,3pace Land Program, the Applicant must satisfy the Department that it will follow cerGlin prescribed acquisition policies; and WHEREA5~ the City of Clearwater is willing to submit an acceptable Land Acquisition Policy Statement: which is assisted under the Open Space Land Program that: 1. It will make every reasonable effort to acquire the property by negotiated purchase before instituting eminent domain proceedings (including administrative takings and similar proceedings for the compulsory acquisition of real property). Z. It will not require any owner to surrender possession of the property until the applicant pays, or causes to be paid, to the owner the agreed purchase price arrived at by negotiation, or in any case where only the amount of the payment to the owner is in dispute, not less than 75 per cent of the appraised fair value as approved by the applicant or, if subsequent to HUD concurrence in the acquisition price for the property, as concurred in by HUD. 3. It will not require any person lawfully occupying property to surrender possession without at least 40 days written notice from the applicant of the date an which possession will be required.
