right of way of said Gulf View Boulevard; and

rights, rights of accretion and rights of reliction are owned by the respective
property owners, of record in Pinellas County, Florida, to a distance of

and said owners for a Dredge, Fill and Seawall Permit pertaining to the same
as is maze particularly eek forth in a letter datod March Z8, 1y68, togcthnr
with drawings preparrd by Leo M. Butler, some having been heretofore filed
with the City Commission in the form and pursuant to the requirements of
Chapter X53. 124, Florida Statutes, 1967, as amended; and this City Commission
having f ound that said lands and every part thereof (including submerged
lands} lie wholly within territorial limits of the City of Clearwater; and
WHEREAS, the City Commission finds that the addition of the sill
and seawall as contemplated by said owners will or should further protect
the existing right of way and street improvements ,and parking iota pertaining
to Gulf View $oulevard, together with the beaches lying adjacent to and
Northerly of the subject property; and further that said contemplated fill
and seawall of the subject property to a distance of three hundred and fifty
(350} feet Westerly of the right of way of Gulf View $oulevard should actually
cause the public beach referred to above, to extend further Westerly by
virtue of accretions to its upland shore; and
WHEREAS, it appears that it would be to the best interests of the
City of Clearwater to join in this application with regard to the public
parking lot which abuts this application on the North; and
WHEREAS, the improvements contemplated for Construction upon the
finished fill and seawall site will be of a material ad valoxem tax asset to the
City of Clearwatex and further, that the same will furnish additionally needed
tourist and convention facilities in the City of Clearwater, all of which are
necessary and essential for the further growth and progress of this City;

as defined in Section 253. 12, Florida Statutes, within such area, will arise
from the pxoposed construction, and that no harmful or increased erosion,
shoaling of channels nr stagnant areas of water will be created thereby,
and that presumably no material injury or monetary damage to adjoining lands
(including those of the City of Clearwater) will accrue therefrom or by reason
thereof.
5. It is further found that should the proper authorities grant a
permit pursuant to the request of the parties hereto and that shauld the
construction be done pursuant thereto that this will not interfere with the
conservation of fish, marine and wild life or other natuxal resources, to
such an extent as to be contrary to the public interest; and there was no
evidence before the Commission to cause the Commission to believe that
any oyster beds or clam beds or marine productivity would be involved
because apparently there axe none in the subject area. Likewise it was
established by testimony that there are no gxass flats suitable as nursery
or feeding grounds fox marine life, or established marine soils suitable
