ORDINANCE NO. 4505-8'1
AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, ANNEXING A PARCEL OF LAND LOCATED
ON THE NORTH SIDE OF JOHN'S PARKWAY,
APPROXIMATELY 800 FEET WEST OF BA YSHORE
BOULEVARD, PINELLAS COUNTY, FLORIDA, INTO
THE CORPORATE LIMITS OF THE CITY, AND
REDEFINING THE BOUNDARY LINES OF THE CITY TO
INCLUDE SAID ADDITION; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Com mission of the City of Clearwater, Florida, received a
sworn petition from Daniel J. Cummings, requesting the City to annex a certain parcel
of real property described herein, owned by him, tnto the corporate limits of the City;
and
WHEREAS, the City Commission, after due consideration of said request for
annexation, at a regular meeting held on August 20, 1987, voted to accept the petition
and authorized th~ preparation of an ordinance to annex the property; and
WHEREAS, on October 1, 1987, the City Commission held a public hearing upon
the proposed annexation; and
WHEREAS, the Local Government Comprehensive PlaMing and Land
Development Regulation Act (the Act) requires that all development regulations and
amendments thereto related to an adopted comprehensive plan or element thereof be
reviewed by the Local Planning Agency (LP A) for conformance with plans adopted
pursuant to the Act; and
WHEREAS, the Pinellas County Planning Comcll (PCPC) has been designated the
Local Planning Agency for Pinellas County and this Ordinance has been referred to and
considered by the PCPC in accordance with its guidelines;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Pursuant to Section 171.044, Florida Statutes, the following described
property is hereby annexed into the corporate limits of the City of Clearwater,
Florida, and the boundary lines of the City are redefined to include the following:
The West 100 feet of the East 186.05 feet of the North 85 feet
ot the South 165 feet of the West 1/'1. of the Northeast 1/4. of
the Northwest 1/4 of Section 16, Township 29 South, Range 16
East, located in Pinellas County, Florida.
Section 2. The City of Clearwater does hereby certify that the mee.sures
contained in this ordinance are consistent with the City's Comprehensive Plan and
individual elements thereof adopted pursuant to the Act, and directs that a copy
hereof be forwarded to the LP A tor their receipt and appropriate action.

Section 3. The City Commission hereby accepts the dedication ot all easements,
streets, parks, plazas, places, rIghts-of-way and other dedications to the public which
have heretofore been made by plat, deed or user within the areas so annexed.
Section 4. The City Engineer, the City Clerk and the Planning Director are
directed to include and show the property described herein upon the official maps and

records of the City.
Section 5. This ordinance shall take effect immedIately upon its adoption. The
Cily Clerk shall file one certlCfed copy with the Clerk of the Circuit Court of Pinellas
County, Florida, and shall file another certified copy with the Florida Department of
State within 30 days of adoption.

AN. ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING THE ZONING ATLAS OF THE CITY BY ZONING
PROPERTY LOCATED ON THE NORTH SIDE OF JOHN'S
PARKWAY, APPROXIMATELY 800 FEET WEST OF BAYSHORE
BOULEV ARD, PINELLAS COUNTY, FLORIDA, AS DESCRmED
MORE PARTICULARLY HEREIN, UPON ANNEXATION INTO 'rHE
CITY OF CLEARWATER, AS SINGLE FAMILY RESIDENTIAL (RS~8);
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on October I, 1987, the City Comrn Issioll of the City of Clearwater
held a public hearing for the determination and establishment of zoning classifications
for certain property annexed into the City; and
WHEREAS, certain of the amendments to the zoning atlas for establishing the
zoning for such newly annexed real property were approved by the City Commission
after its evaluation of all evidence presented at the public hearing; and
WHEREAS,
the
Local
Government
Comprehensive
Planning
Development Regulation Act (the Act)
requires that all development regulations and
amendments thereto relating to an adopted comprehensive plan or element thereof be
reviewed by the Local Planning Agency (LP A) for consistency with the plan; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been designated as
the LP A, and the zoning change which is the subject of this ordinance has been
referred to and considered by the PCPC;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 1.
The following described property in Clearwater, Florida, is hereby
zoned as indicated upon annexation into the City of Clearwater, and the zoning atlas
ot the City is amended accordingly:

WHEREAS, on October 15, 1987, the City Commission of the City of Clearwater
held a public hearing on certain proposed c.hanges to the zoning atlas of the City; and
WHEREAS, certain of the proposed changes ~to the zoning atlas were approved by
the City Commission after its evaluation of all evidence presented at the public
hearing; and
WHEREAS, the Local Government Comprehensive Planning and Land
Development Regulation Act (the Act) requires that all development regulations and
amendments thereto relating to an adopted comprehensive plan or element thereof be
reviewed by the Local Planning Agency (LPA) for consistency with the plan; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been designated as
the LPA, and the zoning change which is the subject of this ordinance has been
referred to and considered by the PCPC;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSON
OF THE CITY OF CLEAR W A'l'ER, FLORIDA:
Section 1. The following described property in Clearwater, Florida. is hereby
rezoned as indicated, and the zoning atlas of the City is amended accordingly:

FLORIDA, RELATING TO THE CODE ENFORCEMENT
BOARD; AMENDING SECTION 22.61fa), CODE OF
ORDINANCES, RELATING '1'0 THE JURlRDIC'I'ION OF
THE BOARD, IN ORDER TO CONFORM WITH REC'1'ION
162.02, FLORIDA Rl'ATU1'ES (1986 SUPPLEMENT);
PROVIDING J\.N EFFECTIVE DATE.
WHEREAS, Section 162.02, Florida statutes, \Vas amended in 1986 to provide that
municipal code enforcement boards may impose administrative fines and other non-
criminal penalties in the enforcement of municipal codes and ordinances, without
regard to whether such codes and ordinances have criminal penalties; and
WHEREAS, Section 22.61(a), Code of Ordinances, provides that the Clearwater
Code Enforcement Board shall have the purpose of conducting hearings relating to the
enforcement ot' codes and ordinances which have no criminal penalties and such
provision is inconsistent with Section 162.02, Florida Statutes, as amended; now,
therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF 'rHE
CITY OF CLEARWATER, FLORIDA:
Section 1. Subsection (a) of Section 22.61, Code of Ordinances, is amended to
read:

(a) The Clearwater Code Enforcement Board shall have the purpose of

AGREEMENT FOR PROFESSIONAL SERVICES
THIS AGREEMENT made this day oC November, 1987, between the
CITY OF CLEARWATER, a Florida Municipal Corporation, (hereinafter referred to as
"City"), and FRANK WALKER ASSOCIATES, INC., Consulting Industrial Psychologist,
of 1300 North Westshore Boulevard, Suite 140, Tampa, Floridn 33607-4618,
(hereinafter referred to as "ProCessional");
WITNESSETH
City is currently engaged in the project of screening and selection of a candidate
for the position of City Manager and desires to engage the services of the Professional
to assist in such project and to render services on the terms and conditions provided in
this Agreement;
The Professional is a Consulting Industrial psychologist, duly licensed to practice
in the State of Florida, and desires to render professional services for the City as
herein provided.
THEREFORE, the City engages the services of the Professional and, in
consideration oC the mutual promises contained in this Agreement, the parties agree as
follows:
1. Term. This Agreement shall be effective commencing as of the date
hereof, and shall continue in effect until successful completion of selection of a
candidate for the position oC City Manager, or until it has been terminated by either
party giving fifteen (15) days prior written notice to the other party at its address at
the time of entering this Agreement or at another address chosen subsequent to
execution of this Agreement and duly communicated to the party giving notice.
2.
Services.
Professional shnll render the fOllowing services:
(a) receive responses and/or resumes submitted by applicants for the
position oC City Manager;
(b) review and screen the responses and/or resumes according to criteria
established for the position by the Professional in consultation with the City;
(c) select the 10 most qualified candidates based on the responses and/or
resumes received from the applicants;
(d) check the resumes of the 10 selected candidates by checking the listed
references and otherwise verifying the qualifications of the selected candidates,
reducing the above-referenced list oC selectees by that number Which have questions
about credentials;
(e) submit the remaining selectees to the City Commission, as well as all
other responses and/or
Commission of those
resumes received by the Professional, for selection by the City
candidates to be invited for testing;

(e) provide testing at Professional's office by means of valid psychological
measures and interviews of those candidates selected by the City to be invited for
. testing;
(g) provide to the City a report on each candidate in terms of background
information, findings on scorable measures, and a discussion of strengths and
weaknesses. These reports shall not include opinions as to honesty, character, or
alleged defalcations or mischief, but will supply opinions within the scope of the
program consistent with the usual professional standards concerning performance,
using information provided and discovered during the process.
3. Decisions. The parties agree that the City will make all final decisions and
that those decisions will be on the basis of professional qualifications and will be non-
discriminatory. The Professional specifically disclaims any responsibility for decisions
made beyond the screening and reporting of findings and discussion, with all screening
and examlning done by Professional on the basis of professional qualifications and non-
discriminatory basis.
4. Compensation. For the services to be rendered under this Agreement, the
Professional shall be paid by the City the rate of $100.00 per hour, on a time as used
basjs for all work performed on the City's behalf on the above-described project,
including attendance at meetings on a portal-ta-portal basis. In addition, the
Professional shall be entitled to reimbursement for expenses incurred for such
expenses as, but not limited to, telephone, postage and travel. There will be a cost
charge of $350.00 per person for the examination and reporting of results for each
qualified candidate invited by the City for testing. The Professional shall submit
statements at the end of each month as the project progresses.
5. Attorney's Fees. If any action at law or in equity is brought to enforce or
interpret the provisions of this Agreement, the prevailing party shall be entitled to
reasonable attorney's fees in addition to any other relief that may be available.
6. Assignment. Neither this Agreement nor any duties or obligations under
this Agreement shall be assignable by the Professional without the prior written
consent of the City. In the event of an assignment by the Professional to which the
City has consented, the assignee or the assignee's legal representative shall agree in
writing with the City to personally assume, perform, and be bound by the covenants,
obligations, and assigns of the respective parties.
7. Successors and Assigns. Subject to the provision regarding assignment, this
Agreement shall be binding on the heirs, executors, administrators, legal
representatives, successors and assigns of the respective parties.
8. Governing Law. The validity of this Agreement and any of its terms or
provisions, as well as the rights and duties of the parties to this Agreement, shall be
governed by the laws of the State of Florida.

9. Amendment. This Agreement may be amended by the mutual agreement of
the contracting parties in writing to be attached to and incorporated in thi9
Agreement.
10. Legal Construction. In case anyone or more of the provisions contained in
this Agreement shall for any reason be held to be invalid, illegal, or unenforceable in
any respect, this invalidity, illegality, or unenforceability sholl not affect any other
provision of this Agreement, and this Agreement shall be construed as if the invalid,
illegal, or unenforceable provisions had never been contained in it.
