This Y.M.C.A. pgogram will establish 5 levels of fitness far the depart- ment, with level 3 being considered physically fit. The apparent low bid was not accepted because the accompanying Bid Band was not in the amount required by the ad- vertisement for bids. The lowest responsive and responsible bid submitted by Clark & Logan, inc., in the amount of $41,873.00 exceeded the engineers estimate range of $35,000.00 - $40,000.00, and exceeds the Project Budget by $3,073.00. I The Police Department is proposing the conversion of a currently owned van type vehicle to be equipped in a manner that will permit it to be used for long-term criminal surveillance situations, as well as for daily use to observe, monitor, and record other crimes in progress or of a conspiratorial nature. The vehicle could be used as a Command Post during such investigative activities. The past and future impacts of such urbanization threatens this biological productivity which helps to provide commercial and recreational fishing, boating, swimming, and the aesthetic enjoyment of our coastal waters. It is time to recognize the importance of these "life support systems" to both the economic and ecological well-being of this City and begin a course of action designed to enhance and restore these vital resources. BACKGROUND: On July 21, 1983, the Commission approved Change order #1 to the P.A.C.T. Parking Area Development Contract authorizing an incentive bonus to the contractor in the amount of $673.00 per day for final acceptance prior' to March 13, 1984, not to exceed $70,000. Maximum incentive would be earned by final,acceptance on or before November 30, 1983. P.A.C.T. has since ne- gotiated a relocation of the entrance roadway, as set out in the attached correspondence, subject to extension of the full incentive qualification completion date from November 30 to December 15, for the parking area exclusive of the road work and, to January 1, 1984, for the roadway im- provements. Change Order #2 accomplishes these conditions. Note that final acceptance of the parking area work by December 15, 1983 and the roadway by January 3, 1984 earns the maximum bonus, while any delay in either part of the project reduces the bonus earned. The unexpectedly heavy use of the construction site by the public during construction hours together with the realignment of the entrance road during construction justify this change order. **The total project cost is not increased hereby, however, the time exten- sions inherent herein equate to a cost of $22,882 (34 days, Nov. 30-Jan. 3, x $673). BACKGROUND: At the City Commission meeting of October 6, 1983, the Commission reviewed five demands made by attorney Timothy A. Johnson, Jr., on behalf of his client, The Mills Development Group. A copy of the demand letter and a summary of City contact on this matter are attached. Subsequent to the October meeting, the City awarded a bid to Norfolk Dredging Company to complete a portion of the Clearwater Pass Dredge Program. Mr. Mills, through his attorney, 9 has taken exception to the bid specifications and asserts that they are not in accordance with the City's contract with the Sand Key property owners. Specifically, Mr. Mills alleges that the feeder beach will not perform the-function implied by its name. While the original contract is silent with respect to the concept of the slope of any portion of the beach, a coastal engineer hired by Mr. Mills to -review the matter be- lieves a slopeof 20 to 1 should be utilized. Also, he estimates 117 feet of dredged material will be relocated before the feeder beach is stabilized and this relocation will not feed the properties North of those owned by Mills. Plans are to develop the site with 172 multi-family units, with each unit located on a lot owned in fee simple, with the remaining property designated as common area to be maintained by a homeowners association. Overall net density on the site is 11.58 units per net acre. On January 23, 1981 an agreement was entered into between Fred 3. Bullard, Jr. and the City of Clearwater providing for a transfer of density which would permit 18U dwelling units on the subject parcel, subject to the otherwise applicable site plan review considerations.
