On October 7, 1982, the Commission approved the establishment of a CIP project to provide for the acquisition of certain parcels of land on Edgewater Drive. The $370,000 estimated cost of land acquisition and related professional fees was to be funded by the proceeds of a note. On February 211 3983, a jury awarded $550,000 to the property owners, resulting in a total estimated cost of $600,000. This additional cost can be financed by a combination of funding from three different sources: 1) Land Sales Revenues - $41,418 Proceeds of the sale of certain pieces of surplus land - Pending Commission approval. $ 71,072 Required to fund deficit in Land Sales Reserve (29 654) E 8 bl i ti t d il f N a on or appropr e procee s ava a e 2) Parkland Dedication Fees - $106,165 The balance in the Parkland Dedication Fee account is $108,165. Of this amount $53,840 has been collected from development in the Edgewater Drive area. If financing arrangements can be negotiated at 10%, the interest for the current fiscal year would be approximately $28,000 to be paid by the General Fund. Principal repayments depending an the terms of the notes would also be paid by the General Fund. These funds will be borrowed from the City's consolidated cash pool until a lease/purchase financing arrangement can be finalized. BACKGROUND: During the weekend of March 5-6, 1983 one (1) Ford Fairmont Police Cruiser was involved in an accident and damaged beyond economical repair. The cruiser must be replaced, as soon as possible to avoid impacting police law enforcement operations. On March 8 contact was made with Kenyon iDodge to determine if a replacement cruiser could be obtained in the current 1983 model year. Kenyon Dodge was the successful bidder on fifteen (15) police cruisers approved for purchase by the City Ccmmi.ssion on 12--9-82, IFB 15-83. Kenyon Dodge informed the staff that the production line for 1983 model police cruisers would accept no more orders after March 11. However, if the City elected to place an order for one (1) cruiser before March 11, Kenyon Dodge could guarantee production. Background Youth sports, specifically baseball and soccer, have and are continuing to grow rapidly in the Countryside area resulting in crowded athletic facilities and scheduling conflicts. Presently, soccer is played at Countryside Community Park and Woodgate Park, while youth baseball is scheduled at Countryside High school, Countryside Community Park and Frank Tack Park. The City Commission, several weeks ago, approved the construction of a permanent soccer area at Countryside Community Park with the provision of two temg?rary Little League baseball fields in two corners of the soccer area. Work is progressing on these facilities in hopes of having them ready for the opening of the Little League season on March 20th. However, as discussed in meetings with Countryside baseball and soccer officials, the temporary baseball fields were being built to satisfy an immediate need and plans were being formulated to construct a permanent four-field lighted baseball complex at another site by the 1985 season. The realization of the complex would satis- fy the needs of youth baseball for the foreseeable future. Simultaneous to the opening of the complex, the baseball fields at Countryside Community Park would be eliminated leaving this entire area-for soccer. Thus, separate locations would be available to each sport and conflicts with crowded schedules would be eliminated. II. Proposal Staff proposes to construct a complex of four lighted Little League baseball fields on property known as Countryside Tract 61. This property was conveyed to the City by U. S. Coachman Road between U.S. 19 on the east and the Florida Power right-of-way on the west. The site is undeveloped and contains 19.15 acres K.G.L. The Land Use Plan classification is tiedi um Density Residential. The zoning is RPD-14. A site plan approved by the City Commission on July 16, 1981 proposed 240 condominium units on this site. Plans are to now develop the site with 240 apartment units at a net density of 14 units per net acre. The attached agreement was approved by the City Commission in conjunction with the former site plan approval. The Resource Development Committee at its meeting of February 24, 1983 recommended approval of the Addendum to the Community Impact Statement and approval of the site plan subject to conditions which have since been met or are reflected in the recommended conditions of approval. The Planning and Zoning Board at its meeting of March 1, 1983 unanimously recommended approval of the RPD-14 zoning and master site plan for Coachman Road Apartments subject to the conditions reflected in the recommendation concerning billboard removal, permit time frame and the sewer moratorium. BACKGROUND: The proposed amendment addresses an issue of long standing concern with respect to the achievement of the purposes and implementation of specific objectives of the plan for downtown Clearwater. Beginning with the esta- blishment of the downtown taxing district in 1970's through the preparation of The Plan for Downtown Clearwater in the mid-1970's, leading up to the adoption of the Redevelopment Plan for Downtown Clearwater in 1981 and the provisions for tax increment financing, the amount of tax-exempt property and its potential increase, both as a real number and as a percentage of the total assessed valuation, has been a concern. In order to insure the continued viability of the downtown redevelopment area and, in particular, the financial soundness of the specific develop- ment plans which are premised in part on funding from the tax increment process, it is proposed to amend the Downtown Development District so as to preclude additional property from being removed from the tax rolls, other than for government use. In brief, only those uses which enhance tile tax base should be permitted, consistent with the redevelopment plans for down- town Clearwater. Specifically, it is proposed to amend Section 131.150 under the Downtown Development District so d S to specifically preclude additional tax-exempt uses and to provide for government buildings and facilities in replacement of the more general existing "Institutional" use classification. In order to clarify that this amendment will not preclude the expansion or renova- tion of existing tax-exempt organizations on and within the limits of property now owned by such organizations, exceptions to the otherwise applicable limits on non-conforming use are also set forth. BACKGROUND: In order to address two interrelated issues to which the Zoning Ordinance does not speak, the attached code amendments are proposed for consideration by the City Commission. The first amendment would establish the Coastal Construction Control Line (CCCL) as the point of measurement for building setback along the Gulf of Mexico. The present setback requirement of fifty (50) feet from the mean high water line is meaningless in most instances, given the amount of accretion which has occured naturally or through renourishment. The second amendment dealing with transfer of development rights (density and related improvements) has been requested in order that the Commission would have the benefit of a specific provision in the Code on which to rely and by which to be guided when considering requests for such transfer. The Planning and Zoning Board at its meeting of December 21, 1982 unani- mously recommended continuing consideration of the requested ordinance changes to its meeting of January 4, 1983. At the meeting of January 4, 1983, the Board made several suggestions for change to the proposal which have been reviewed and refined by staff. A memorandum considered at and minutes of the Planning and Zoning Board meeting of January 4 are attached. Staff has prepared a final recommendation for consideration by the Commission which incorporates several suggestions from the Planning and Zoning Board and additional changes proposed by staff.
