BACKGROUND: At the City Commission meeting of June 17, 1982 the City Commission gave consideration to the purchase of a portion of the subject property, generally referred to as the north 330 feet and directed staff to negotiate with the property owner for purchase at a price not to exceed $125,000. Subsequent negotiations with the owner were unsuccessful. The refusal of the property owner to sell or negotiate further for the sale of the property at the upset figure established by the Commission was reported to the City Commission at its meeting of July 1, at which time the Commission directed an appraisal of the property be prepared. The summary page of the appraisal report, prepared by James A. Millspaugh, M.A.I., has been excerpted and is attached for the information of the Commis- sion. The northern tract has been established to have a market value of $95,000; the southerly tract a land market value of $225,000, for a total land value of $320,000. Staff points out that any expenditure for such purchase is not budgeted. In fact the purchase of this property was not recommended for inclusion in the Parks and Recreation capital budget, which as now proposed eliminates some $766,790 of projects assigned a higher priority by both the Parks and Recrea- tion Department and Board. Were the property to be' purchased, a commercial note could likely be obtained to finance the purchase. It is estimated, by way of example, that such note would be for not more than eight (8) years at an interest rate of approxi- mately twelve and one-half (12.5) percent. On a purchase price of $320,000 (which would not include the considerable additional expense of an eminent domain proceeding) annual payments would approximate $65,600 per annum. The first annual installment on such obligation would be available from monies paid in lieu of parkland dedication. Subsequent annual payments would rely on as yet 'unidentified sources. Consistent with the direction of the City Commission, an offer of $384,000 has been made to the property owners and is under consideration. BACKGROUND: The Platted Clearwater Beach Park subdivision has an area, identified on the Plat as Beach Drive, which has been under ownership dispute for some time. As this area has been maintained by the City for a number of years, and as this area is utilized by the public at large for recreation and beach access, and as this area was platted as a streat right-of--way,,the City has long considered this area to be. a-public area. However, litigatioti'on the issue of clear title to this land, lying between the westerly lots of the subdivision and the Gulf of Mexico, has left the question in perpetual doubt or dispute. At present, the administration believes the public, via the City, continues to hold title to this disputed area. Hence, it appears this dispute must be resolved to the full interest of the public in the near future. The manner proposed to assert the public's interest in full is to determine the public's interest, seek an amicable purchase of any claims proven to be valid and, if necessary, institute condemnation proceedings to fully and finally resolve the disputed claims to said lands. The Public's interest is best determined at a Public Hearing. Efforts to seek an amicable purchase of other claims should be pursued by public advertisements. The services of an appraiser are suggested to provide a value judgement basis for comparison ,to determine a reasonable price for any valid claims. And should these efforts fail to . fully resolve the issue, the administration will return to the City Commission for direction to pursue relief by condemnation. On February 4, 1982, the City Commission approved subject to corlditia:ts a site plan for the development of a 4,200 square foot restaurant on the property, On July IS, 1982, the City Commission approved the removal of one condition of approval which would have prohibited the location of a billboard on the restaurant site. Approval by the Commission to locate a billboard on the property required the submission of a revised site plan indicating the proposed location of the billboard, such revision constituting a minor plan change. A revised site plan has been submitted to staff for review proposing the location of a billboard on a parking island at the northeast corner of the building. The sign itself would project eastward across the front parking lot and internal drive. Staff review has resulted in several objections to the proposed billboard location. Specifically the objections concern potential safety hazzards to traffic, the additional principal use of the property in conjunction with an approved principal use, and the interference with the restaurant on the site and the restaurant on the adjoining site. Entitlement to a billboard on the Pat Boy's Bar'-B-Q site was established byth City Commission approving the removal of the condition to the approved site plan. As the review authority for the specific location of the billboard on the site, it is the recommendation that the proposed billboard location as shown on the revised site plan be denied. BACKGROUND: The City's current Street Sealing Contract with the Campbell Paving Co. has approximately $60,000 remaining before the contract is com- pleted. The current contract affords the City the right, as in the past, to extend the present contract by 50% volume override at current prices. Fifty percent (50%) of the current contract of $503,000 is $251,500. Of this amount approximately.$140,000 is'remaining in the current Street Sealing budget un- encumbered. This amount, is available and can be combined with the $581,000 budgeted in the fiscal year 1983 budget to provide the additional amount for the 50% increase. It is the City's best interest to extend the Sealing Contract at existing prices to avoid price increases that are sure to occur with initiation of a new contract. The extension of the contract with Campbell will not effective- ly preclude others from competing for the FY '83 Sealing Contract. That budget will have approximately $470,000 remaining after the extension of the current contract at present prices. The 50% increase/decrease clause allows the City to include additional projects in their street maintenance activity such as the PACT site and Utilities Parking Lot paving. The 50% override allows flexibility in the present contract to meet these unforeseen require- ments. It also enables the City to react rapidly when citizens call in to state that their street needs maintenance. It is, therefore, recommended that the current contract be extended by volume in the amount of $251,500 to gain the benefit of the current year's prices and accommodate the additional projects which were accomplished within the fiscal year 1982 contract. BACKGROUND: The City and Downtown Development Board have cooperated in establishing a design competition for a bandshell to be erected in Coachman Park with private funds. Over 40 Florida architectural firms have entered the competition, which closes on September 17. Judging is scheduled for October 4, 1982.. A panel of independent judges is an integral component of the competition procedure. Community input was received during the preparation of the compe- tition rules and specifications, and one member of the community will be placed on the panel. The recommended panelists are David L. Perkins, Sr., F.A.I.A., Lafayette, Louisiana Jerome 14. Cooper, F.A. I.A., Atlanta, Georgia Alan Bomstein, Clearwater, Florida Mr. Frank Mudano, F.A.I.A. is serving as the professional advisor to the panel. The professional members of the panel have both earned the designa- tion of Fellow in the American Institute of Architects. Mr. Bomstein serves as the chairman of the bandshell fundraising committee of the Downtown Devel- opment Board, and is an active local contractor. Brief resumes of the pro- posed panelists are attached. The budget previously approved includes funding for compensation and travel expenses for the professional members of the panel. The City Commission of the City of Clearwater SUBJECT: Sanitation Workers - Utilities Sanitation Division RECOM MENDATIOW Authorize ten permanent Sanitation worker positions in the Sanitation Division of the Utilities Department. BACKGROUND: During the past five years the total tonnage collected by the Sanitation Division has increased 30% from a total of 69,000 tons per year in 1977 to 90,000 tons per year in 1982. During this same period of time employees in the Sanitation Division increased from 104.9 in 1977 to 115.1 in 1982 or a 9.8% increase during the same period of time when the tonnage increased 30%. Several years ago we began hiring temporary workers during the summer period -^ releasing them at the end of the summer. As the workload increased, instead of releasing these people, they were retained and used as regular workers. Over the past three or four years the temporary workers have almost constantly been a part of the regular work force. This places temporary workers with no benefits working elbow to elbow with permanent workers who have all City benefits. This has decreased morale and has had an effect on the production of the entire division. in addition, each six months temporary employees have been discharged and a new set of unknown workers have been hired to fill the temporary slots. Sanitation workers, in general, have the highest accident rate in our particular industry. Having new and untrained workers working on and behind our heavy equipment does nothing to improve that safety record. Also, production during the training period often lags. In many cases, the new workers are not as good as the workers terminated when their time ran out. At the present time we have ten temporary workers who have been doing a good job and are now well trained in the City's activities. Their temporary status is due to terminate in the immediate future. The positive effect of the approval of these positions as permanent positions will be to continue a trained work force, improve morale, correct a longstanding inequitable situation, save money in recruit- ment cost,-save money in training cost, save money in accident cost and provide better production because of the utilization of trained workers. As automation progresses in our Sanitation Division, these last employees hired will be laid off. However, unto that occurs, all employees in the Sanitation Division will share equal benefits. The site is vacant and contains 14.01 acres M.O.L. The Land Use Plan classification is Medium. Density Residential. The zoning is RPD-15 (Residential Planned Development) District. On March 4, 1982, the City Commission revalidated a site plan initially approved on Hay 7, 1981 for this property. The proposal was to develop 228 condominium units within fourteen buildings resulting in a net density on 12 net acres of 19 units per acre. On January 23, 1981 an agreement was entered into between Fred B. Bullard, Jr. and the City of Clearwater pro- viding for a transfer of density which resulted in a density of 19 units per acre in the RPD-15 zone. The owners are now proposing a mixed use development on the property con- sisting of 60 townhouse units and 168 condominium units for a total of 228 dwelling units. There will be eighteen (18) buildings constructed on the site. A preliminary subdivision plat is being submitted for that portion to be developed with townhouses. The Resource Development Committee at its meeting of August 12, 1982 recom- mended by a vote of 6 to 3 to approve the site plan and preliminary plat ' sub ec t to conditions which have since been met. The concerns of those t me r es voting in objection were the proposed setback provided from the adjacent elementary school, which has since been increased, the townhouse lot width, and the townhouse lot area.
