BACKGROUND: The property is located between Gulfview Boulevard and Coronado Drive, south of Third Street and north of fifth Street. The site is developed and contains 1.237 acres At.O.L. The Land Use Plan classification is Commercial/Tourist Facilities. The zon- ing designation is CTF-28 (High Density Commercial-Tourist Facilities Use) District. The City Commission on January 4, 1979 approved a site plan for a 35-unit apartment building on this property which was then zoned RNI-28 (High Density Multi-Family Use) District. On July 2, 1981 the City Commission approved a request for rezoning by the property owner to CTF-28, subject to the approval by the Commission of a-revised site plan for any change in use. A revised site plan has been submitted by the owner which proposes,a conver- sion of the newly constructed building from 35 dwelling units to 48 motel units. The multiple-.family residential structure was constructed consistent with the then applicable RM-28 district requirements. The existing structure is inconsistent with the building height and setback limitations for the CTF- 28 district. The existing five-story building is 46 feet 2 inches high whereas a maximum height of 30 feet would be permitted; the existing side yard setback from the south property line is 15 feet, whereas 26.5 feet is required. Additional questions relate to the design of the units in the south wing as related to density and in turn parking, the managers "office" and the large, unimproved undesignated area previously proposed for restaurant use on the ground floor. The Clearwater Housing Authority is now developing through a Turnkey contract with Eastern Project Developers, Inc., an assisted family )sousing project (FL 075-'002) directly to the north of the VOA project as indicated an the attached map. CONSIDER PARKS AND RECREATION BOARD RECOMMENDATION TO NAME THE FORMER CLEARWATER YACHT CLUB PROPERTY (YOUTH MARITIME CENTER) THE "CLEARWATER BEACH RECREATION COMPLEX." O And that the appropriate officials be authorized to execute some. BACKGROUND'- Resolution No. 80-82 establishes criteria to be utilized in selecting names for City parks and recrention facilities. (copy attached) It also allows the Parks and Recreation Board to evaluate and make recommendations to the City Commission in this regard. The former Clearwater Yacht Club property (located immediately adjacent to the Youth Maritime Center on Clearwater Beach) presently contains three tennis courts, a playfield, playground apparatus, and beautification. There is, however, no established, name for the site. This is needed so that an identification sign could be erected letting people know that is is a public facility. When the property was originally purchased, site plans were prepared and it was referred to as the Mandalay Marina and Recreation Complex. After reviewing the criteria in Resolution No. 80-82, the Parks and Recreation Board recommends the name "Clearwater Beach Recreation Complex." The hoard feels that "Clearwater Beach" is more descriptive as to location than "Mandalay." Also, the word "Marina" is not included since the Board feels that the name should be as definitive as possible, and there is no marina on the site. !Vote is made that the City Harbormaster and Marine Advisory Board have concerns and oppose the name "Clearwater Beach Recreation Complex." They feel that the word "Marina" should be included since a marina was originally discussed for the site and since the possibility of marina on the site still exists. Attached is a copy of a letter from Mrs. Anne M. Garris (Clearwater Beach Association) supporting the Parks and Recreation Board's recommendation. Also attached is a letter from the Marine Advisory Board opposing the recommendation because of "Marina" not being a part of the name. MEMORANDUM TO: Meeting Date: 8/19/82 The City Commission of the City of Clearwater SUBJECT: Acquisition of Spring Lake RECOMMENDATION: Pass the attached resolution recommending the acquisition of spring Lake by the Southwest Florida Water Management District (SWFWMD) to preserve it as a natural body of water. ? BACKGROUND: Spring Lake is a large undeveloped body of water which lies in Pinellas County along the edge of the northwest corner of the City of Clearwater. The lake occupies an area of approximately ten acres, with the adjoining wetlands covering an additional five to eight acres. The lake is in the Clearwater service area. Pressures to develop the lake and use it for purposes other than wetland are building. The result would be the loss of a largely unspoiled body of water which supports a significant habitat for wildlife, acts as a natural drainage area and is a source of recharged water for the aquifer. Because the unchecked development of the areas surrounding the lake could result in the loss of these benefits, the lake with its connecting tributaries and surrounding wetlands should be acquired to preserve it. The attached resolution recommends that this actionr:be taken by the Southwest Florida Water Management District to preserve it for the beneficial purposes outlined. it is recommended that the attached resolution be passed by the City Commissia and provided to all local governmental bodies involved, including Pinellas County, City of Dunedin, and the Southwest Florida Water Management District. This action is concurred in by the Environmental Section of the Public Works Department, the Public Works Director, and the Director of Utilities. Hoiaever, on August 4 the staff reported that no additional work could be done until new electrical service was installed and operational. The complexity of the work involved; the lack of "as--built" drawings and the uncertainty regarding future changes in facility design and construction, made it both impractical and inpossi.ble for the staff to develop specifications suitable for competitive bidding within current time and manpower constraints. Moreover, the Police Chief has certified that this project is urgent, requiring immediate authorization to proceed with contract work. The staff requested Cornett Electric Co. Inc, to develop a detailed proposal identifying work requirements and pricing. Cornett Electric was selected because they have done quality work at reasonable prices for the City previously; they stated that they would give the project the priority needed; and they stated that they would respond to additional changes as re4ared to meet future design and construc- tion requireaents. Cornett's initial proposal covers labor and materialsto provide new conduit, feeders and fixtures for both nom=inal and emergency power to operate computer and communications equipmment at a total estimated cost of $13,820. BACKGROUND: Division 15 of the Zoning Code provides for the creation of planned develop- ment districts allowing optional methods of land development which encourage imaginative solutions to design, enhanced land utilization and reduction of conflicts between land uses. Presently the zoning code provides for four such planned development dis- tricts: residential (RPD), recreational (Rei:PD), commercial (CPD) and in- dustrial (IPD). The attached application requests the creation of an additional category of planned development district, office planned development (OPD). The OPD zoning district would be established to provide for development of professional and business office projects on a minimum parcel size of five (5) acres. The maximum building coverage and maximum impermeable lot coverage in an OPD is proposed to be 45 percent and 70 percent, respectively The attached application proposes the addition of congregate living facili- ties, nursing homes and like facilities as uses to be considered complemen- tary to an RFD (Residential Planned Development) district. Additional changes are proposed to the required minimum parcel size of re- creational planned.developments (RecPD), commercial planned developments (CPD) and industrial planned developments (IPD). The minimum area would be five (5) acres as required for the proposed office planned development (OPD) district. Section 131.108 now states that six (6) copies of the planned development district plan must be submitted for review. BACKGROUND: Currently the Zoning Code limits a home occupation to an occupation, craft or profession carried on entirely within a dwelling unit. The"attached application proposes amendments to the definition and conditions of home occupations and proposes the addition of a new section to the Code outlining supplemental regulations governing home occupations. The changed definition and conditions would allow consideration of home occu- pations, the operation of which was other than exclusively within the resi- dence. The proposed amendment also provides for a system of administrative review by the Building Department of those current occupational licenses issued to post office box numbers and like addresses which would qualify as home occu- pations under the proposed regulations so as to permit them to continue in business without application and review by the Board of Adjustment and Appeal on Zoning. No new occupational licenses would be issued to post office box numbers and any new requests for home occupations would continue to be re- viewed by the Board of Adjustment and Appeal on Zoning. The Planning and Zoning Board at its meeting of August 3, 1982 unanimously recommended approval of the zoning ordinance text change subject to an amend- ment to the proposed language in Section 131.016(h)(17)(f) revising trips per day of commercial vehicles to or from a residence from two (2) trips to four (4) trips. BACKGROUND: Since 1972, Peerless Florida Company, Inc. has leased the subject property from the City. The first lease was approved for five years at $90 a month. The lease was renegotiated in 1977 for a three-year term at $110 a month with the requirement that the lessee fence the portion used for storage and provide a stable surface for the portion ?ssed as parking. In 1980, the City Commission again approved a lease at $110 a month, but this time, for two years. Staff was instructed at that time to investigate the possibility of declaring this property surplus with an access easement to the water tower. Such consideration was wade, and it has been determined that this property is not surplus to City needs in that it is ideal for a future water treatment plant should one be necessary. The lease presented to you for your approval is for two years at $110 per month. Paragraph seven has been changed to require a $500,000 insurance policy. This is the only change from the previous lease which required $300,000 of liability insurance. The Assistant to the Public Works Director for property matters concurs in the recommendation.
