RECOMMENDATION: Commission review the attached Ordinance and direct the City Clerk to proceed with advertising for Public Fearing. ? And that the appropriate officials be authorized to execute some. BACKGROUND: During the discussions of the Areawide Rezoning #1, Niid-Beach, the City Commission proposed that an amendment to the Zoning Ordinance be prepared which would allow for the replacement of existing density that was destroyed by natural causes. On October 2, 1980, the City Commission directed staff to prepare such an amendment. , The attached Ordinance, if approved, would provide a mechanism whereby a (nonconforming density damaged or destroyed by natural causes in excess of so% of the replacement cost may be reconstructed or replaced so as to provide stile same density that existed prior to such damage or destruction. - Regulations for documenting current density and replacement of the nonconform- ing density is detailed in the Ordinance. The term "density" as used in the ordinance means the number of units or gross useable floor area permitted on the property as of the passage of the zoning ordinance involved. BACKGROUND: Implementation of provisions included in the Community Re- development Act have resulted in previous actions by the City and County aimed at permitting use of tax increment financing to enhance downtown redevelopment efforts. A Further step, suggested for adoption this calendar year, is the adoption of the redevelopment plan. Clearwater has already made extensive strides in planning for downtown renewal. The approved "Plan for Downtown Clearwater" and the implementing Downtown Development District zoning ord-finance encompass the framework under which current and future redevelopment efforts will be conducted. The redevelopment plan consists of the vital previously-approved documents. Additions are large- ly limited to reflection of changes in downtown land use since 1976, considera- tion of relocation requirements and other provisions mandated by the state act, and adjustments in terminology to insure consistency between the downtown plan and downtown ordinance. The redevelopment plan considers two time horizons, the near-term (1981-1986) and the long term (1986-2000). Greater documentation is provided for near-term improvements due to the increased uncertainty associated with estimating later impacts; it is intended that the redevelopment plan will need re-evalua- tion near the end of the near-term time frame. it is expected that reviews by the Board of County Commissioners and Pinellas County Planning Council can be completed within 45-60 days. Since the P.P.C. (acting as the local planning agency) has already reviewed and approved the downtown plan and implementing ordinance, their staff estimates that the state- mandated consistency requirement is essentially met, and that their review will follow the less-complicated procedure adopted for ordinance reviews. The present recommendation to declare surplus another portion in the same vacinity is submitted as a result of discussions with representatives of Morton F. Plant Hospital. Although these people cannot speak for their organization, they voiced no serious objections. The area under consideration contains 1.58 acres M.O.L. The total park is developed with 132 mobile home units of which 25 are located within the area being requested for change. The density on the 11.05 acres M.O.L. of total park area is 11.9 units per acre.
