BACKGROUND: in July 1980, the City received a letter from R.P. Young, District Sales Manager of Shell Oil Company, which put the City on notice of a potential hazard because of the age of underground gasoline storage tanks. Mr. Meissner was informed he could appeal to the City Commission regarding tank replacement and lease transfer. On August 10, 1981, Mr. Meissner requested the City consider executing a 10- year lease with Risser Oil Corporation in order to continue the service station operation. Mr. Risser would install the required vapor recovery system, and repair or replace the underground gasoline storage tanks. When Resource Development Committee members discussed the subject service station, they recommended a formal bid process be followed should the City Commission determine a lease operation to be the best use for this site. Should Mrs. Falzone cancel her lease in accordance with paragraph 9, the City Attorney's office is of the opinion she is responsible for at least the minimum rental ($575.000) for six (6) months from the date of her written notice to cancel. BACKGROUND: Kendall Property (K) : In 1971 the City received $150,000 from the Department of Housingand Urban Development to purchase beachfront property (174 x 140 ft.) for eventual development as a parking lot. Avalon Property (A): In 1975 the City purchased the Avalon Apartments for $264,000 from Parking Revenue funds. This beachfront property (240 x 87 ft.) is immediately north of the Kendall site. The City's intention wa.s to demo- lish the improvements on the site and construct a parking lot in conjunction with that proposed for the Kendall site. The attached drawing is a proposed parking lot design which will not encroach on the portion of the properties which are presently being used for beach purposes and will provide an area i:or.public picnic tables. Parking space for 68 automobiles will assist significantly in alleviating parking problems in this area of the beach. The City's Building Official recommends demolition of the Avalon apartments or their complete renovation. No estimate of renovation cost has been com- piled because the intention has always been to use the property for public parking. Demolition will cost approximately $7,500. Department of Housing and Urban Development which provided for the cooperative processing of housing discrimination complaints. The Fair Housing and Equal Opportunity Office of HUD has in- vited the City to apply for $26,000 which is to be used to improve our housing enforcement capabilities as contemplated by that Memorandum. This level of contribution for two years is intended to result in a complaint processing capability sufficient to enable the City to process housing complaints in future years with a level of HUD support based on direct reimbursement (presently estimated to be $350 to $500 per complaint). There was some discussion about retaining the 10 foot easement along the South side of the property. It was suggested that a new request for vacating the South 10 foot easement be brought back to the Commission. If this vacation is approved, then an ordinance will be prepared vacating the easements approved on May 7 and today. This vacation request has been reviewed by various City Departments concerned with vacation requests and there are no objections, provided a new easement is given to the City to cover existing ditch.
