O And that the appropriate officials be authorized to execute same. BACKGROUND: In the approved 1980/81 budgets, the City anticipates the acquisition of certain capital equipment through lease/purchase financing (totaling approximately $122,680). on January 30, 1981 the City opened bids to provide this financing. The following bids were received: Term Interest Cost* Exchange Leasing, Inc. 5 years 9.5% Barnett Leasing Co. 4 to 7 years 11.125 to 11.5% First Municipal Leasing 5 years 13.35% to 13.70% *The quoted interest rates are based on 20% prime rate; all bids include provisions for adjustments based on money market conditions at the time equipment is leased. The approval of this proposal will establish a Master Lease Agreement for 1981. At the time equipment is purchased an addendum will be added to the master lease providing a schedule of payments and fixing the interest rate. The Exchange Leasing bid provides for a fluctuating interest rate based on changes in the Exchange Bank prime rate between an established floor and coiling. The floor is 9%. The ceiling will never exceed the 1.5% in excess of the 20 "Bond Buyer" Average Yield Index. S. 19 and Northside Drive and the Force Main which runs from that station, Easterly to its connection with the gravity sewer system. U. S. Home had agreed at that time to provide an enlarged site to support the larger Lift Station 1/10 and the engineering required for the expansion of the Lift Station at no cost to the City. U. S. Home was to contract for and construct the enlarged Lift Station with the City sharing 49% of the cost with U. S. Home. At that time, the estimated cost of the Lift Station was $240, 000. 00. Actual bids, however, for the Lift Station #10, amounted to $327, 522. 01. The City Engineering staff has reviewed the bids and compared with other current projects, and determined that the bids were acceptable. The City's share, or 49% of $327, 522. 01, is now $160,485. 78, or an increase of $42, 885. 78. While this cost increase was not easily foreseen six months prior to bid award, the money has been budgeted and is available. The staff recommends, and the Consulting Engineer, Briley, Wild and Associates, concur in the recommendation to authorize an increase in the 49% share of the Pump Station #10 enlargement for the City. Approximately 13% of the work had been completed by the end of October. The Director of Public Works concurs in this recommendation. CIP Code 349-1-6225 should, therefore be increased by $58, 934.36 to create a new authorized amount of $176, 534. 36 including 10116 for contingencies to be approved only by City Manager for the enlargement of Pump Station #10. Harrington, Inc. has provided consulting and management services to employers for over twenty-five years in unamployment compensation claims administration and cost control. This company has submitted ra•proposal to the City to administer a comprehensive Unemployment Claims Program for the City at a cost of $1.60 per employee per year. The company's proposal calls for providing education and training of City supervisory/ managerial personnel; review of C1,6y personnel practices as related to unemployment compensation claims management; atclai,ms administration program; and the provision of management reports. Services will include conducting a hearings program wherein the company will evaluate each claim, appeal as appropriate; evaluate subsequent state agency decisions initiate further appeal as appropriate; and counsel City personnel in preparation for appeal hearings. The Personnel Department of the City is not adequately staffed to effectively administer an unemployment compensation claims cost control program. It has been able to effect appeal of the more obvious questionable claims, but does not have the capability to monitor two major areas where cost can be controlled by continuing review and analysis: (1)unwarranted claims by employees who quit or who are fired and are not supposed to draw benefits, and (2) governmental errors (e.g., state agency may overpay an amount, overpay beyond the appropriate period). The potential cost savings to the City if the company is able to controvert claims or dis- cover errors in payments amounts or lengths of time for which payment is made to a former employee could easily far exceed the annual service fee. In addition, the provision of training to supervisory/management personnel, the provision of an educational manual relative to unemployment compensation, and review of personnel policies add to the value of services that would be received. Training alone could conceivably result in significant reduction of costs under unemployment compensation by providing data to the supervisory staff throughout the City as to the effect of Cheir actions in discipline and supervision on unemployment compensation, thus precluding actions which would allow employees to receive benefits for which they should not otherwise be entitled. I ® And that the appropriate officiais be authorized to execute some. B A C K G R O U N D: In 1940, the Blackburn Lumber Company sponsored a softball team in the local City league. This team changed sponsors in 1948 and became known as the Clearwater Bombers. Since 1948, the Bombers have participated in over 30 regional tournaments, hosted 9 national tournaments, won approximately 22 regional championships, won 10 National Champion ships and placed over 14 players in the National Softball Hall of Fame. The Bombers have been playing all of their home games and tournaments at Jack Russell Stadium since around 1955. According to our records, no formal agreement has ever been formulated between the Bombers and the City for use of the fields. Informal or verbal agreements were used from year to year. 'Part of the previous understanding has been that the Bombers were to submit to the City 11? per adult ticket and 5C per child ticket for use of the stadium. The Parks and Recreation staff does not find this unreasonable and the Bomber Boosters have been paying these rates since around 1955. The staff does feel however, that a flat 10% fee of adult and children's tickets would be easier to monitor and that it would be more in line with existing policies and contract such as the Phillies (10% of gross) The 10% figure is not a substantial increase over what the Boosters have been informally submitting to the City during the past years. Staff has met with the President of the Bomber Boosters, Doug Mason, to discuss the proposed agreement. Mr. Mason met with the Booster Board and reported that the board agrees to the terms of the contract with the exception of the 10% fee on tickets. The Boosters would like to have totally free use of the facilities, without having to pay any percentage or ticket price to the City. Since a healthy working relationship exists between the School system and the City, and since various uses both by the City and the School Board are basically equal, the attached recip- rocal agreement was created. The agreement allows both the City and the various schools flexibility needed in order to offer the citizens quality educational and recreational oppor- tunities. It further enables the City and the School Board to use each other's facilities at no charge, provided the use conforms with regular staff working hours. The School Board, at its meeting of January 28, 1981, approved the renewal of this Joint Use Agreement with the City for the 1981 year. Staff and Little League officials recommended this action since the cancellation was of benefit to both parties. Little League benefitted by being relieved of having to pay the City $259.13 a month for nine more months. (They have encountered financial difficulties, but have made the payments for approximately nine years under the 1970 Agreement) The City benefitted by no longer having to secure Little League permission to use the building during .-Little League season as stipulated in the cancelled Agreement. The Parks and Recreation Department can now program the recreation room on a twelve month basis rather than just six months. With a desire to continue to provide facilities for the Little League baseball program, and in recognition of the fact that Little League has contributed a sizable amount of money toward the construction of Fred Cournoyer Recreation Center ($Z1,0G5.98), the attached new two year Agreement has been prepared. Section 13C•-7 has been changed to provide for a review of continuing viola- tions by the Energy Advisory Board (an ordinance establishing the Board has been prepared). 3.
