BACKGROUND: This project was completed in early 1978; however, during the final stages of the work, the contractor CPM Plumbing & Mechanical, Inc., experienced a business failure and was unable to complete certain warranty repairs which were necessary before the project could be finally accepted. The City, being aware of the contractor's problems, held the retain age funds to be assured that all warranty work would be completed. Since March of `1978, the City Attorney has been working with representatives of the American Insurance Co., the bonding company, for the contractor, to assure that work would be satisfactorily completed before funds were released. This Change Order will deduct the amount spent by the City for warranty re- pairs and release the remaining retainage to the bonding company. *Funds previously allocated. BACKGROUND: In 1973, the Commission, recognizing the necessity of a child day care center at Condon Gardens, adopted Resolution No. 73-77 whereby the City agreed to provide the necessary local matching funds for the operation of the center. Since that time, the City has provided a local cash match to the Clearwater Housing Authority in an amount equal to 1211% of the contractual cost of that service. The Authority, by contract with the State, agreed to provide the day care services and entered into a sub-contract with Creative Care, Inc. who agreed to provide these services for the Authority. This procedure resulted in the City paying funds to the Authority, who paid these funds to the State, who paid those funds, together with Federal and State Title XX funds, to Creative Care, Inc. for the day care services actually provided. The State has requested that this procedure be simplified so that the City provides the local cash match directly to the State, who will contract directly with Creative Care, Inc. for day care services and has requested the City execute the attached Public Donor Contract form. Sufficient funds are contained in the current City-budget to pay the first quarterly payment clue July 1, 1980. The funding for the balance of the contract amount is subject to adoption of the City budget for fiscal year 1980-81. The proposed contract may be terminated at any time, without cause, upon thirty days written notice by either party. BACKGROUND: On numerous occasions the Parks and Recreation Department finds it necessary to install or replace fences on recreation properties for the safety and well being of participants and spectators. Two such projects requiring fences are the Belmont Park renovation project and the development of a new park on Montclair Road. In order to receive a fence permit and proceed with installation of a fence, a current legal survey of the property must be secured. Since the city does not have a current legal survey of Belmont Park or of Montclair Park, the city would have to pay anywhere from $200 to $500 to secure such a survey for each park. It should be noted that this type of situation could repeat itself over and over again since the city owns considerable properties with extensive fencing that`periodically needs repairing or replacing. City staff is currently studying the entire fence ordinance and will get back to the Commission at a later date with recommendations. However, since the study is not completed and these two parks are of immediate concern, we request your consideration of them at this time. BACKGROU N D: On July 5, 1979 the City Commission awarded a contract to Diversified Auto Parts/Bob Lee's Garage, Inc., Clearwater,,Cla. to operate a tutor vehicle parts store in the City Motor Pool complex. The contractor occupies space provided by the City at no cost, lie purchases all motor vehicle parts, and these parts belong to him until they are issued and charged to the City against a Motor Pool maintenance work order. The contractor maintains a ready stock of fast-moving parts and a select inventory of slow-saving parts. All parts are sold as either price-listed or non-price-listed parts. On price-listed parts, the contractor is paid at the jobber or dealer net price leas fixed discounts ranging from 10•-25% depending on the type and category of part involved. On non-price listed parts, i.e. parts for which there is no published price list available to the industry the contractor is paid at his invoice cost plus transportation and phone charges if any. In addition, he receives a handling charge ranging from 20--25% based only on the total dollar volume of non- price listed parts purchased each month. 'Phis contract has been in effect since September 1979. It was initially approved and funded at $285,000. As of May 31, 1980, $168,980.65 has been billed and paid. With three (3) months remaining on the first contract year, we estimate total first year parts purchase costs at $235,000. Contractor performance to date has been very satisfactory. Both contractor and Motor Pool have worked well together, considering this was a first time venture for both. Motor vehicle downtime has decreased; total. parts costs have cone in well under original estimates; and other savings to the City in personnel, inventory costs, administrative paperwork and accounts payable have been substantial. The total inventory was valued at $105,599. using stock record card pries, current price lists and by estimating current market values when no other pricing guides were available. Approximately 46% or $48,576. represents "dead stock", i.e. stock whose usage is both unknown and unpredictable but which must be kept on hand as insurance to'cover unforseen emrgencies,"Dead stock" usually consists of "one-of-a-kinds" items which are hard to get and which must be either rebuilt for spares under a service contract or ordered from the Original Equipment Manufacturer (OEM). The remaining 54% or $57,023. represents "live stock" i.e. daily use shop hardware and fast rmving parts which turn over at least 4-6 times a year. `Ilse contractor has offered to purchase all inventory for $79,200, or 75ro of current estimated market value, payable in eighteen (18) monthly installments of $4,400. reflected as a credit to the city against his monthly invoices. His offer represents 100% of the current ur3rket value of the "live stock" and approximately 50% of the value of the "dead stock". The "live stock" can be integrated into the contractors active inventory and disposed of through normal useage with no problem. The "dead stock" can also be integrated into the contractors inventory but its disposition presents different problems for the contractor. 5one "dead stock" may never be used and will eventually become obsolete. Sane has little or no use to anyone outside the city, hence: the contractors options on disposal are limited. Moreover, so long as the City owns the equipi)ont to which "dead stock" applies, the contractor cannot sell or otherwise dispose of it, even if he had the opportunity, without jeopardizing his ability to support the Motor Pool. After weighing these factors, the City staff felt that it would be inequitable for the contractor to pick up 100% of the cost of "dead stock" and unfair to require that he do so. Both the contractor and the City staff felt that the 46% share proposed by the contractor was fair under the circumstances. Under the conventional housing program the Housing Authority acts as developer, selecting an architect to prepare plans and specifications and bidding the construction contract. Such a project is constructed on land acquired by the Authority. The present application indicates the Henderson site on East Druid Road as a possible site for this project. Along with its application the Authority has requested a preliminary loan from HUD to cover the cost of preliminary surveys and planning, which will not exceed $10,1000.00. Such a loan is included in the developmental cost of the project to be repaid from development loan funds. Development and construction loan funds are normally financed through the sale of tax exempt notes through the Authority backed by a federal guarantee. HUT? requires the local governmental bodies adopt a Resolution indicating the need for such low rent housing and approving the Authority's application for a preliminary loan. This approval does not impose a financial obligation on the City. BACKGROUND: Traffic Engineering is preparing to begin Phase I of its program to replace 260 automatic parking motors on the beach with manually operated meters. One-half of the meters will be replaced under Phase 1. In response to this requirement, sealed bids were solicited from the only two (2) remaining suppliers of parking meters, POM, Inc. and Duncan Industries. Bids were opened on May 8, 1980, and bid results are attached. The Director of Traffic Engineering recommends award to Duncan Industries wnose bid met all technical specifications as verified by representatives of his staff, for the following reasons: (1) For the second year in a row POM, Inc. has failed to meet the specifications on type of materials acceptable. (2) POM, Inc. has continued to use plastic parts that are causing a maintenance problem that requires us to replace these parts once a year. They have offered a three year warranty on parts but this does not compensate us for the manhours spent to replace these parts. BACKGROUND: On May 30, 1980, the City Commission received the Amended City Manager's Annual Report and Budget. The purpose of the Mid-Year Review is to re-evaluate budget projections based on 6-period data. For the most part the operating budgets are showing an increase. The primary reasons for this increase are inflation and impact of salary adjustment for employees. Sufficient revenues are available to cover these increases, either through increased current operating revenue or prior year unappropriated retained earnings. The mid-year report recommends two additional positions which were proposed in the original recommended budget. The City Commission placed a monetary cap of $300,000 on new positions for fiscal year 79/80. After extensive study, approximately 15 positions were eliminated from the proposed budget. BACKGROUND: On December 31, 1978, the present lease with Pier Pavilion, Inc. expired without the City and the lessee agreeing on renewal provisions. Since that time the City and the lessee have been negotiating under terms outlined in the lease in an attempt either to conclude the matter or go to arbitration as provided. On January 17, 1980, the City Commis- sion authorized litigation to break the lease. The court ruled that the lease's arbitration clause must be used as agreed upon by the parties in 1953. Negotiations were delayed by the illness and unfortunate death of the lessee's counsel. Lessee engaged new counsel and June 16 and 17, 1980, were selected for the arbitrators to hear the matter. Representatives for the City and Pier Pavilion, Inc. continued to negotiate and on June 4, 1980, reached agreement on provisions to be included in the lease renewal. The Clearlyater Land Use Plan designation is Commercial/Tourist Facilities. A bowling alley with restaurant and cocktail lounge as a secondary use currently exist on the property. In 1968, a Restrictive Covenants Agreement was signed between the City and Shore Lanes, Inc. The covenant called for annexation after lien years from the date of such covenant. The owner, having been contacted by the City Attorney's office, has now filed the Petition to Annex. The City Attorney's office advised the applicant that a recommendation would be made to the City Commission to waive the park dedication or cash equivalent requirement. In order to avoid confusion in the future and to assure the more orderly processing; of site plans, it is suggested that written policy be provided in the Code to govern the process. The Planning and Zoning; Board at its meeting on tilay 6, 1980, recom- mended approval of the Zoning; Ordinance text change. This item has been continued from the Commission meetings of May 15, 1980 and June 5, 1980. To further ciarif)r tile preliminary site flan review procedures, an additional change is being; prepared to amend the Zoning Ordinance in Article XXXIV, Section 34.03.
