The site is currently vacant and is zoned Rai'-28 (High nen:i.sty Multi-Family Use) District. The Land Use plan classification is Il.ibh Denisty Residential. The proposed project is for three 9-story apartment buildings and one 8-story building on two non'-contiguous tracts. The Resource Development Committee recommended to approve the Community Impact Statement at its meeting of April 11, 1980. The Commi.ttec further moved to express its concerns to the City Manager regarding the propriety of the existing zoning relative to density and utilization of the property and recommended that the City Manager initiate any appropriate action with regard to amendment of the zoning applicable to this property. The item was presented at the City Commission meeting on May 1, 1980. By request of the applicant, the item was continued for consideration to May 15, 1980. BACKGROUND: Clearwater has used Chase Manhattan Bank as Paying Agent for its bond issues for many years. For the past several years, the reporting by Chase of bonds and coupons paid and destroyed has been unsatisfactory to the City. Repeated phone calls, letters, and personal visits have not resolved the problems. In the most recent bond issues, the Exchange Bank and Trust Co. of 'Pampa has performed the paying agent's funtion, and the City is well pleased with their service. An additional consideration in the change is the provision to invest surplus balances at the paying agent bank for the City's benefit. The fees negotiated are higher at Exchange than Chase, however, investment earnings are expected to more than compensate for the difference. HUD has 11 million dollars available for this competition, and it is anticipated that between ten and twenty projects will be funded nationwide. The Cortonunity Development Department has been working; with John Peddy, our Energy Officer, in drafting the preapplication. Competition closes an June 23, 1980 and our preapplication must be submitted for A-95 review on AEay 23, 1980. If our proposal is considered to have sufficient merit, we will be invited to submit a final Application. As conditions to accepting an Innovative Grant under this competition, recipients will be expected to.- 1. vend at least one representative to two- national workshops of finalists, during; the project period and after closeout; 2. present oral presentations of Innovative Grant funded activities, as needed; 3. prepare a final report for national distribution; 'i. submit recommendations to HUD for revisions to basic CDRG policy and regulations that will enhance local capacity to carry out energy conser,vatinn strategies; and 5. develop a plan for monitoring of the program during; the implementation of the activities and assessment of the program after the Innovative grant close out. M And that the appropriate officials be authorized to execute some, BACKGROUND: In 1977, the Volunteers in Preservation conducted an historic survey of buildings in the downtown area. Among those buildings found to be deserving of special preservation efforts was the downtown post office. This structure was built during the depression with W.P.A. funding, and is a notable example of the Nediterranean influence in architecture. Subsequent efforts have led to nomination of this building to the National Register of Historic Places. Nomination to the National Register places certain obstacles to tho demolition of a structure, and provides incentives for adaptive re-use of buildings. BACKGROUND: Because of current economic conditions, John Mancini has requested that the City finance 90% of the purchase price of the Old #1 Fire Station, at a market rate because local financial institutions are reluctant to make commercial mortgage loans. Conversations with three major commercial banks in Clearwater confirm the restrictive lending policies and a market condition in which 16% plus two points is typical for long standing bank customers. Because of the value to the City of closing June 1, 1980 rather than September 1, 1980 (3 months interest at 14.5% x $133,000 = $4,821) and because of the shorter term for payment. (18 months compared to 36 to 60 months with the commercial banks), a concession of 1.5% and eliminating the two points is deemed appropriate. The execution by the City of the mortgage would be contingent on the purchaser providing satisfactory evidence of permanent financing. The staff recommends accepting the mortgage for the following reasons: 1. It will help assure the sale of the surplus fire station which has been offered for sale unsuccessfully for several years; 2. it will stimulate needed redevelopment of downtown Clearwater; 3. it will get this property on the tax rolls; 4. it will obtain superior investment return of the asset value as compared to current short term investments; 5. the downside risk, i.e. default, should leave the City in no worse condition financially than would result if the sale were not consummated. Janet Land Corporation, Circuit Civil No. 74- 329-7. ® And that the appropriate officials be authorized to execute some. BACKGROUND: In the early 1970'x, as part of its comprehensive development of the Countryside area, U. S, Home proposed construction of its Woodgate Subdivision. To accommodate the many new residents who would be living in Woodgate, to accommodate the increased runoff resulting from the proposed development, and to improve the drainage system in the entire region, the City decided to obtain a drainage easement over a portion of property owned by Janet Land Corporation and contiguous to Top of the World. In 1974, the City instituted an action in eminent domain, and in 1975, title passed to the City by order of the circuit court. The issue of compensation due to Janet Land Corpora- tion must still be tried. Because U. S. Home received a substantial albeit indirect benefit from the condemnation, U. S. Home agreed to reimburse the City for all its expenses and for any judgments in connection with the eminent domain action. U. S. Home has requested that Messrs. Macpherson and Helinger be appointed as Special Counsel. U. S. Home is not and cannot be a party to this action; nevertheless, it is U. S. Home which ultimately must bear the costs. Appointment of Messrs. Macpherson and Helinger would insure that U.S. Home is repre- sented by counsel of its choice, and would enable the City's legal staff to concentrate its efforts on matters in which the City has an ultimate stake. U. S. Home, of course, has agreed to compensate both Mr. Macpherson and Mr. Helinger for this appointment, and Messrs.
