naintained by the Parks Division. SOurces of sandy soil are limited because the
soil must be ,of proper mixture and consistency to l::e suitable for a ballfield
playing surface. tobreover, there is a limited rrarket for this type of soil.
For these reasons, many contract 'dirt haulers are not interested in bidding on,
this requirarent. The Parks Division Superintendent recornrends award. to the

RECOMMENDATION: Authorize city Manager to "turn down" a $14,109 grant

Department of Natural Resources for a Florida Recreation Development Assis-
tance program (FRDAP) grant for $250,000 to construct a park and three-field
Little League baseball complex on Curlew Road. However, 72 applications were
submitted from around the State and DNR can only fund our project to the ex-
tent of $14,109.
The City will shortly be receiving a "Letter of Approval" at which time we
must either accept or reject the $l4,I09. The decision made in this respect
could lead to one of the following courses of action relative to the status
of the Little League Complex.

BACKGROUND:
On November 14, 1983 the City Manager terminated Mr. Donald Geeck,
Customer Service Supervisor in the Utilities Department. Mr. Geeck appealed this
decision which was subsequently heard by a Hearing Officer assigned to' this case by the
State Division of Administrative Hearings. During the Hearing, Chief Assistant City
Attorney Frank Kowalski represented the City Manager and the City as Petitioner.
The Recommended Order of the Hearing Officer to sustain the dismissal was rejected
by the Civil Service Board. The Board provided an'Order to the City Manager based
on the following motion of the Board: IIthat we reject the Administrative Order and
its Recommendations, that Mr. Geeck not be dismissed and be reinstated within five
.(5) days; and that as a penalty for the infraction that no back pay be allowed." The
City Manager has exercised his right to appeal this Order through appropriate court
action. In that the Chief Assistant City Attorney has indicated he can not represent
the Board due to his advocacy in this matter for the City's position, and consistent
witb provisions of Section 25.04 (d) of the City Code, the Civil Service Board
passed the following motion at its March 19, 1984 meeting:

The City Commission approve the attached resolution that reaffirms the
City's commitment to permit only residential usage along McMullen-Booth
Road.

BACKGROUND:
On March 20, 1984, ~he Board of County Commissioners considered a report
from their staff which would have introduced office zoning on the west side
of McMullen-Booth Road, approximately 1/2 mile south of Curlew Road.
Clearwater's Land Use Plan for the subject area carries a low density
reaidential designation. Based on the City's previous poliCY actions,
recent actions by the Commission consistent with the plan, and the extreme
difficul ty of arresting expansion of commercial strips along arterial roads
once they are permitted a foothold, the Planning "Department registered an
objection to the proposed County zoning action. Unplanned commercial
development is a key factor in creating traffic congestion, a condition
Which the ecenic/non-comercial corridor designation seeks to mitigate.
The Board of County Commissioners continued action on the staff report and
zoning amendment. Their continuance expressly called for the cities of
"Clearwater and Safety Harbor to reaffirm their previously stated intentions
to retain a non-commercial character on McMullen-Booth Road. The attached
resolution does this, nnd will be transmitted to the Board of County
Commissioners as requested input for their deliberations on April 17,
1984.

City, 2) parking calculations should be shown to reflect current Code
requirements for the individual restaurant and retail uses rather than on
the requirements for a shopping center - this project does not constitute a
shopping center, 3) indication of a permanent easement from Florida Power
Corporation will be needed if this right-of-way is to be used for required
parking, 4) any division of the subject property for the purpose of lease
or sale will require the submission of a preliminary plat with the final

Commission subject to the considerations noted below, including preliminary
authorization to proceed with the requested transfer of density as provided
for in Section 131.226 (c)(2) of the Zoning Code.

BACKGROUND:
The property is located at the southwest intersection of Countryside
Boulevard and Curlew Road. The site contains 5.0 acres M.O.L.
The Land Use Plan classification is Medium Density Residential. The zoning
designation is RM-12 (Duplex-Apartment Residential) District.
Plans are to develop a condominium project on the property containing 68
units at a net density of 15.5 units per acre. Access is proposed from
Countryside Boulevard. Some on-site drainage retention is proposed to be
retained within a retention basin located at the corner of Curlew Road and
Countryside Boulevard.
The applicant is requesting a transfer of density (16 units) to this site.
A maximum of 52 units could be constructed on the site under the present
RM-12 zoning. In 1979, the City agreed~ in principle, to a transfer of 39
units from a 4.9 acre parcel (M&B 6-4) located south of State Road 590,
east of U.S. 19 which was owned by U.S. Horne and donated to PACT. The
transfer was proposed to be made to an adjacent site located north of the
donated parcel (M&B 6-3). Development of the northern parcel (M&B 6-3) did
not utilize any of the requested transfer ,of 39 units.
In 1981, the City agreed~ in principle, to allow the transfer of the 39
units to Tracts 62~ 63 and' 64 of Countryside owned by U.S. Home. Such a
transfer could not exceed a resulting density on any Tract exceeding 16
units per net acre. Development of Tracts 63~ 64 (St. Tropez Condominium)
under an RPD 15 zoning utilized 20 units of the 39 available for transfer.
Tract 62, the subject parcel for Countryside Woods could be considered for
the remaining 19 units available for transfer in accordance with the
agreement as described in the attached correspondence. Approval of this
site plan will utilize 16 of the units eligible for transfer. No further
density transfers from the PACT site donation have been indicated.
Preliminary staff review notes the following considerations which must be

units from a 4.9 acre parcel (M B 6-4) loca ed south of State Road 590,
east of U.S. 19 which was owne by U.S. Home and donated to PACT. The
trarisfer was proposed to be m e to an adjace t site located north of the
donated parcel (M&B 6-3).' .Development'of the orthern parcel (M&B 6-3) did
not utilize any of the requested transfer of 3 units.
In 1981, the City agreed, in principle, to' allow he transfer of the 39
units to Tracts 62, 63 and 64 of Countryside owne by U.S. Home. Such a
transfer could not exceed a resulting density on a Tract exceeding 16
units per net acre. Development of Tracts 63, 64 ( t. Tropez Condominium)
under an RPD 15 zoning utilized 20 units of the 39 a ailable for transfer.
Tract 62, the subject parcel for Countryside Woods could be considered for
the remaining 19 units available for transfer in accordance with the
agreement as described in the attached correspondence. Approval of this
site plan will utilize 16 of the units eligible for transfer. No further
density transfers from the PACT site donation have been indicated.
Preliminary staff review notes the fOllowing considerations which must be
addressed with the submission of a final site plan: 1) a community impact
statement will be required to be submitted with the final site plan. 2)

City Commission honor the request for withdrawal of the applications for
Zoning Atlas and Land Use Plan amendment without prejudice.

BACKGROUND:
The property is located along the west side of Glenville Drive, south of
Sunset Point Road~ oast of Belcher Road. Total acreage of the parcels is
.33 acres M.O.L.
The two subject parcels are classified as Low Density Residential on the
Land Use Plan and zoned RS-75 (Single Family Residence) District. The
request is t~ amend the Land Use Plan classification and zoning designation
in the same manner as requested in the petition for annexation of the -
adjoining parcels on the west.
In revieWing the ownership documents for the requested annexatton of the
adjacent property by the applicant, it was determined that the small strip
of property along Glenville Drive was under the same ownership and
currently within the City limits. The subject strips of property are to be
utilized as part of the developments proposed on the larger M&B 7-3 parcels
which are currentlY being processed for annexation. The request of the
applicant for PS zoning with a Residential/Office Land Use Plan
classification on Parcell and lSP zoning- with a Public/Semi-Public Land
Use Plan classification on Parcel 2 is made in light of these development

This item was continued from the City Commission meeting of March 15, 1984
by request of the applicant. The Planning and Zoning Board on March 20J
1984 recommended by a vote of 5 to 0 with one abstension denial of the
requested amendments. The Board as in the previous annexation request for
the adjncent parcels, recommended that the northern parcel be classified
ISP and the southern parcel be rezoned to RM-8.
The applicant has submitted a letter requesting withdrawal of the applica-
tions for Zoning Atlas and Land Use Plan amendment and has requested the
City Commission honor the withdrawal without prejudice.
