7428-05 ORDINANCE NO. 7428-05 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, VACATING THE EAST FIVE FEET OF THE TEN- FOOT UTILITY EASEMENT LYING ALONG THE WEST PROPERTY LINE OF LOT 32, CEDAR HEIGHTS SUBDIVISION; PROVIDING AN EFFECTIVE DATE. WHEREAS, Thomas Strauser, owner of real property located in the City of Clearwater, has requested that the City vacate the utility easement depicted in Exhibit A attached hereto; and WHEREAS, the City Council finds that said easement is not necessary for municipal use and it is deemed to be to the best interest of the City and the general public that the same be vacated; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following: Vacate the East 5 feet of the 1 Q-foot utility easement lying along the west property line of Lot 32, Cedar Heights Subdivision as recorded in Plat Book 81, Page 85 of the Official Records of Pinellas County, Florida is hereby vacated, and the City of Clearwater releases all of its rights in the servitude as described above to the owner of the servient estate thereto. Section 2. The City Clerk shall record this ordinance in the public records of Pinellas County, Florida, following adoption. Section 3. This ordinance shall take effect immediately upon adoption.
