(5) The ordinance fails to recognize that the City of Clearwater and
other mun i c i pa 1 it ies in the county have adopted comprehens i ve plans and are
implementing concurrency management systems as required by law. Instead, the
ordinance declares that its purposes include the establishment of standards for
the regulation and control of vehicular access to city roads, as well as to
county and state roads, and to ensure that connections to the roadway system
conform wi th city standards as we 11 as county and state standards. wi thout
into consideration the standards and procedures establ ished by the

municipalities in the county.
(6) The ordinance requires that applicants for access
collector roads on city street systems shall
to an "access management rev iew conunittee"
standards and "countywide management access
delegates to the committee, to be composed of traffic engineers and planners,
the legislative power to develop access standards for city streets and for
property located within municipalities to further the goals, policies and
objectives of the county comprehensive plan. 'The ordinances also provides that
the new standards "shall bell incorporated into the ordinance by amendment.
Nothing in the ordinance recognizes the existence of city standards governing
access to the city street system or the development of property within the city,
nor does the ordinance articulate reasons why the city standards should be
subordinate to the county comprehensive plan.
(7) The ordinance fails to recognize the existence of the Pinellas
County Planning Council (the "PPC") or the role and function of the PPC in the
development of a countywide comprehensive plan pursuant to Chapter 73-594, Laws
of Florida, as amended by Chapters 74-584, 74-586, 76-473 and 88-464, Laws of
Florida (the "Special Act"). The ordinance fails to recognize the existence of
a countywide comprehensive plan, as distinguished from the county comprehensive
plan, and fails to recognize that the PPC is charged by law with developing a
traffic circulation element as well as rules and standards for implementing the
countywide future land use plan. The ordinance is inconsistent with the Special
Act.

amendment.
(2) Such nonconforming use shaH not be expanded, added to or enlarged in any way

structures, land or water not previously, directly and continuously devoted to such

(4) Such nonconforming use, once replaced by a conforming use, shall not thereafter be

replaced, except that a use which is identified as permitted or conditional in the
zoning'district assigned to the property and which is damaged or destroyed by
natural causes (such as fire, wind or tidal surge) in excess of fifty (50) per cent of the
replacement cost may be reconstructed or replaced so as to provide the same densit:,'

the preparation and adoption of appropriate ordinances.
Sec. 136.056. Designation of Historic Properties and Districts; Removal
of Historic Designation.
(1) The City Commission shall have sole authority to designate any
property or district as historic, or to remove the historic designation from a
property or district.
(2) Each such designation shall be made following a recommendation from
the Board and from the planning and zoning board. A property owner may request
the designation of a property or district as historic by applying to the Board
for a recommendation. The Board shall review each application for historic
designation. The recommendation of the Board shall be based upon a report
prepared by or at the direction of the Board which inr,ludes, as a minimum, the
following:
(a) The location and boundaries of the property or district:
(b) The historic, architectural, or archeological value of the p~operty
or district, and its relationship to the history,' government or culture of the
City:

(c) Present and projected economic trends and conditions relating to the
maintenance, development or redevelopment of the property or district; and
(d) A 1 ist of contributing and noncontributing properties within a
district.
(3) The Board shall conduct a public hearing regarding the proposed
designation of a property or district as historic prior to deciding upon its
recommendation. Notice of the date, time and place of the hearing shall be
given to the affected property owner at least 14 days prior to the hearing. At
the conclusion of the hearing, the Board shall decide upon its recommendation
using the criteria set forth in section 136.057.
.(4) Copies of the recommendation of the Board, including the report
required by this section, shall be transmitted for review and recommendation to
the planning and zoning board, which shall hold a public hearing thereon.
Notice of the date, time and place of the hearing shall be given to the affected
property owner at least 14 days prior to the hearing.
(5) At the conclusion of the pu.bl ic hearing, the planning and zoning
board shall transmit a final report with its recommendation, as well as the

approval of a certificate of appropriateness by the Board.
(5) Applications for certificates of appropriateness shall be reviewed
at a public hearing by the Board. Notice of the date, time and place of the
hearing shall be given to the affected property owner at least 14 days prior to
the hearing. At the conclusion of the hearing, the Board shall determine
whether the proposed alteration or demolition is compatible with the historic,
architectural, and archaeological qualities that resulted in the designation of
the property or district as historic, and whether a feasible and prudent
alternative to the proposed alteration or demolition exists.
(a) If the Board determines that the proposed alteration or demolition
is compatible with such qualities, it shall approve the issuance of the
certificate of appropriateness.
(b) If the Board determines that the proposed alteration or demolition
is incompatible with such qualities and that no feasible and prudent alternative
to the proposed a lterat i on or demo 1 it i on ex i sts , the Board may grant an
exemption from the requirement for a certificate of appropriateness upon
establishing that the owner will take timely steps to avoid or mitigate the
adverse effects of the alteration or demolition.
(c) If the Board determines that the proposed alteration or demolition
is incompatible with such qualities and that a feasible and prudent alternative
to the proposed alteration or demolition exists, it shall disapprove the
issuance of the certificate of appropriateness.
(d) In each case, the Board shall state. upon its record the reasons for
its decision and shall furnish a copy of its decision, including the reasons
therefor, to the applicant.
(6) Any person aggrieved by a decision of the Board may appeal the
decision to the City Commission, which shall hold a further public hearing and
either affirm, modify, or reverse the aecision of the Board. No decision of the
Board shall be deemed a final administrative decision of the City unless and
until the decision has been affirmed or modified by the City Commission. The
City Commission retains the authority to make the final decision on any
application for a certificate of appropriateness.
Sec. 136.060. Notices. Whenever notice is required by this Article to
be given to an affected property owner, such notice shall be given by mailing
a copy thereof to the current property owner at the address of record according

BACKGROUND: On June 15. 1989, the CIty Conmission awarded a contract to Kloote Construction and Engineering CorporatIon
to construct Phase I of Coachman RIdge Park consisting of a basketball court. parking lot and bicYcle paths. AdditIonal park
amenitIes including drInkIng fountain. lights. playground equiplOOnt. fencing. landscaping, signage and bridge to Center
Foundation were installed by others. The cost for Phase I was approximatelY $95.000.

This contract consists of constructing two tennIs courts, two three walled handball/racquetball courts, tennis batters wall and
additIonal sidewalks. lIghting and landscapIng to be completed by the city. The two handball/racquetball courts desIgned for
this park will be the first in the city to meet standards recommended by the UnIted States lIandball AssocIatIon. The eIght
existing cIty courts cons'st of a variety of desIgns. wall heIghts ranging from 16 feet to 20 feet and sidewalls of 20 feet In
length. The new courts will have 20 foot high walls, with sidewalls 40 feet in len9th.

The City currently has budgeted $100,000 of Penny for Pinellas funds for 1989/90 and $55.000 of Penny for Pfnellas funds for

transfer $45,800 from elIgIble Recreation Impact fees and use this money first. With thIs 'transfer. the avaIlable balance in
thIs project is sufficient to provIde funds for this contract.
