7341-04 ORDINANCE NO. 7341-04 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, VACATING, ALL STREET RIGHT-OF-WAYS AND EASEMENTS LOCATED WITHIN THE NORTHEAST ONE- QUARTER OF THE NORTHEAST ONE-QUARTER OF SECTION 17, TOWNSHIP 29 SOUTH, RANGE 16 EAST, LESS THE NORTHERLY 50 FEET THEREOF, (DREW STREET) AND THE EASTERLY 33 FEET THEREOF, (BAYVIEW AVENUE); PROVIDING AN EFFECTIVE DATE. WHEREAS, Clearwater Housing Authority, owner of real property located in the City of Clearwater, has requested that the City vacate all right-of-ways and easements depicted in Exhibit A attached hereto; and WHEREAS, the City Council finds that said right-of-ways and easements are not necessary for municipal use and it is deemed to be in the best interest of the City and the general public that the same be vacated; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following: all street rights-of-way and easements located in the northeast one-quarter of the northeast one-quarter of Section 17, Township 29 South, Range 16 East, less the northerly 50 feet thereof, (Drew Street) and the easterly 33 feet thereof, (Bayview Avenue) is hereby vacated, closed and released, and the City of Clearwater releases all of its right, title and interest thereto. Section 2. The City Clerk shall record this ordinance in the public records of Pinellas County, Florida, following adoption. Section 3. This ordinance shall take effect immediately upon adoption. Vacate all Street Rights.OI-Way and Easements on Subject Property. n mance 7341-04 29]B ~ Parkview Village Right-ot-Wayand Easement Vacation Exhibit "B" The property contains approximately torty (40:1:) acres at the southwest corner of Drew Street and Bayview Boulevard in part of the northeast quarter of Section 17, Township 29 South, Range 16 East in the City ot Clearwater, Florida. The site is presently developed as a housing project known as Jasmine Courts, but was originally developed as Condon Gardens. The Clearwater Housing Authority is proposing to completely demolish the existing improvements and redevelop the site as "Parkview Village", a traditional, mixed-use development with single family lots, tee simple townhomes, rental apartments, a community center, and a neighborhood commercial area. As part of the redevelopment of the property, the following improvements will be removed: · All existing buildings, roadways, driveways, sidewalks, and parking areas. · Public utilities, including all sanitary sewers, storm sewers, retention ponds, gas lines, and water lines within the property that serve the existing buildings · All above ground and below ground private utilities within the interior of the property that serve the existing buildings. .
