ENVIRONMENTAL ADVISORY COMMITTEE
May 15, 1991

The meeting was called to order at 4: 05 P.M. by Chairman, Mr.
Jonson, in the ORe Conference Room at the city Hall Annex on May
15, 1991.
Several corrections were noted to the ~pril minutes. Correction was
made to members present at the April meeting. Mr. Ed Mazur as
present and Ann Garris as absent.
Page one, paragraph 5 replace "detaining ofll with "delay in" also
remove first was from page 3, line 6.
Mr. Foley, in reference to page 2, paragraph 3, stated that
modifications to the Stevenson Creek ~atural Plan in the form of
maintenance areas were nade at the suggestion of Mr. Baker and
wanted the minutes to reflect that. Other committee members
recalled differently. Mr. Miller suggested that the May minutes
reflect more detail regarding that area of discussion. Thorough
review of the tapes indicates that Mr. Mazur originally presented
this item for discussion. Mr. Baker was asked if the creek could
be adequately maintained under the natural plan, as designed with
maintenance access restricted to the channel alone. He stated that
it would not work as presented and explained why. Mr. Baker
further indicated to the committee members that most of the
property along stevenson Creek is a dra inage easenent and not
right-of-way, and that it is essential to have sufficient easement
for maintenance. .

Mr. Perry asked Mr. Baker to suggest proper wording for this issue.
Mr. Baker suggested that the right of way should be used to the
fullest extent possible. Mr. DeBlaker suggested modifying the
paragraph to read "All channel improvements will be constructed
within the limits of the access easement while retaining a minimum
8 I access lane on one side tl. Mot ion was made seconded and
unanimously passed by the committee.
There being no further changes or corrections, motion was made to
the approve minutes and seconded. Motion carried unanimously.
otber Business
By-Laws
Mr. Miller distributed out the most current Operating By-laws
regarding Terms of Office, and stated that the original letters
received in packets had the correct expiration dates, that is three
appointments for two-year terms and two for one-year term.
Nomination and Election of Officers
Nomination for Chairman: Ms. Garris nominated Mr. Jonson, Mr.
Mazur seconded. Mr. Hunt moved for nomination to be closed I
seconded by Mr. Davis. Motion Carried unanimously.
Nomination for Vice-Chairman: Mr. Perry nominated Mr. DeBlaker,
and Ms. Garrish seconded. No additional nominations, Mr. Hunt
moved nominations be closed. Motion Carried unanimously.
Nomination for Recording Secretary: Mr. Foley nominated Ms.
Garrish. Ms. Garris declined. Mr. Hunt was nominated, but he also
declined. Ms. Garrish requested volunteers. Discussion followed
regarding the need for a secretary since staff provided a recording
secretary to maintain public records. Committee members reviewed
the Bylaws noting that Article II, Item (b) required a chairman
and a secretary to serve on the committee but no vice-chairman.
Mr. DeBlaker made a motion to eliminate the recording secretary's
position from committee Bylaws. This was amended by Mr. Foley to
replace reference to a secretary position with that of a vice-
chairman position. The motion was seconded by Mr. Hunt.
Therefore, article II, Item (b) shall read "The committee shall
select a Chairman, Vice chairman, and such other officers as it may
find necessary from its membership. Item (d) to have first sentence
removed "Each off icer shall serve for a term of one year. The
Chairman shall be limited to a one year term of office and shall
not serve consecutive terms of office during appointment to the
.commi ttee." With No further discussion, the amended motion passed
unanimously.

Publio Works Agenda
Mr. Miller informed the committee of the vast amount of yard waste
debris collected because of the storm of April 25. Mr. Miller
informed the committee lllembers that the City has set up an
emergency burn, located at the Campbell property on Hercules, in an
attempt to resolve the disposal of debris. This process is expected
to take approximately 3 '\aleeks or more. A discussion ensued on
other options. Mr. Miller agreed to look into County burning for
electricity.
The Chairman requested that Mr. Miller give an update of staffing
for Environmental Management. Mr. Miller informed the committee
members that the city Manager and personnel have authorized all
positions, and positions have been officially requested. Testing
and evaluations for these positions will be completed in a couple
of weeks.. Personnel informed Mr. Miller that it would take
anywhere from 10 to 14 weeks from present time to fill all
positions.
OLD BUSINESS
stevenson Creek
Mr. Burke of Camp Dreser and McKee, distributed to comrni ttee
~embers stevenson Creek Flood Profiles, included profiles for both
the City Plan and Natural Plan. Mr. Burke gave a presentation to
summarize, on a channel by channel basis, how an attempt was made
to hydrologically demonstrate the intent of what the committee
requested through the natural plan within the existing right-of-
way, while also providing the maximum flood protection possible.
Further discussion entailed with Mr. Taylor explaining the
difference between City plan and Natural Plan. Mr. Taylor stated
the Natural Plan did not provide a sufficient solution to the
flooding problem.
Following Mr. Burke's opening remarks and at the committees
request, Mr. Taylor provided specific, section by section, detailed
discussion regarding differences between plans along each reach of
stevenson Creek.
Copies of the stevenson Creek Flood Profiles are to be sent to all
committee members.
Mr. DeBlaker made motion to approve the City's Plan for stevenson
Creek, Mr.. Perry seconded. Motion made to approve the City's flood
design plan since the natural plan alternative did not achieve
desired goals. Vote taken, 5 - 4, the opposing votes were Mr.
Jonson, Mr. Foley, Mr. Reuter, and Mr. Hunt.

Mr. Foley notified committee that he has requested information on
reclaimed water from st. Petersburg, and will share that
information with committee.
Next meeting was scheduled for June 19, 1991 at 4:00.

BACKGROUND:
As requested by the City Commission, staff has given consideration to the creation of a
citizens' group to be formed to advise staff and the Commission on environmental programs
for the City of Clearwater. In the near future, there are several major environmental
initiatives which the Commission will be asked to implement, including the development of
a reclaimed water irrigation master plan, a stormwater utility for 'f/ater quantity and

In addition, several State environmental programs, such as the Surface ~ater Improvement
and ~1anagement Act Program (S.~L 1.r"1.) VJith the Southwest Florida \Jater i'1anagement
District) have created new opportunities for grant-funded environmental mitigation
projects and studies such as those currently funded by the District for water qual ity
improvements at DelOra Groves Park on Upper Tampa Bay, along with the recent designation
of Tampa Bay as a national estuary, one of 16 in the United States.

As the City plans for these initiatives, a proper and representative role for citizen
input can be created through the formation of a Clearwater Environmental Advisory
Committee. The purpose of this committee would not be limited to reviewing completed
program and projects but, rather, would be pro-active in nature. Such a group would be
utilized to assist in the early formulation of strategies and alternatives to accomplish
water quality projects and to advise on the best means to respond to new regulatory
r~quirements for monitoring and enforcement of pollution violations within the City of
Cl ear'water.
Tne organization of the citizens' group can be structured much in the same fashion as the
Budget Advisory Committee currently providing input in their respective areas of
expertise to the staff and City Commission. Citizens selected for this Committee should
have an interest in the environment of Clear,o/ater and have some knowledge of the basic
principles, opportunities, and constraints faced by government as it manages
environmental programs.

The following organizational components are proposed:
I. Membership and Terms:
Staff recommends that a body of ten (10) citizens who are permanent residents of
Clearwater be appointed by the Commission. Following an advertisement for interested
parties filed by the City Clerk, a pool of interested citizens will be developed. Each
Commissioner will appoint one (1) representative for a 3-year term. The remaining five
(5) members will be appointed by a vote of the full Commission. Three (3) of the five
(5) members selected from the pool and affirmed by a vote of the Commission shall serve
for a~year term. Two (2) remaining members selected from the pool and affirmed by a

The City Commission shall have the power to remove any member of the Clearwater
Environmental Advisory Committee for misconduct, any conflict or neglect of duty. In
addition, the City Manager shall have the power to remove any member because of the
unexcused absence of the member from meetings of the Committee as provided in Section
22.06 of the City Code (i .e., three (3) unexcused absences in a calendar year).

The Clearwater Environmental Advisory Committee shall be supported by City staff and may
review and make recommendations to the City Commission concerning all water, wastewater
and stormwater programs or projects initiated by the City exceeding $50,000 in

At the Committee's option, these other programs would include but not be limited to:
(1) Upland and wetland habitat preservation and creation.
(2) Natural shoreline restoration.
'(3) Wetlands restoration to include fresh water and marine systems.

(4) Purchase of properties for preservation of unique ecosystems.
Requests for information and staff work shall be by consensus of the Committee and in
keeping with the City Commission policy regarding projects and requests for staff work,
i.e., staff projects or reports generated at the majority request of the Committee
requiring more than eight (8) hours of work must also be approved by a majority vote of
the City Commission.

SCOPE OF PROJECT
2~1 PROJECT OBJECTIVES
2.1.1 The first objective of this project is to prepare a comprehensive
watershed based surface water management and ecosystem rnana~ement master plan
for the Allen's Creek Drainage Basin, to be known as the Allen's Creek
Watershed Management Plan. The development of the Wcltershod Ma.nagement Pla.n
is mandated by Policy 3.1.4. of the Conservation Element of the Comprehensive
Growth Management Plan for Pinellas County. The Watershed Kanagernent Plan is
to be prepared in such a manner as to aid the County in meeting Goals 3, 7,
and 9 of the Conservation Element and Goal 1 of the Drainar;e Element of the
Comprehensive Plan. These have been reprinted below, \

2.1.2. The second objective of this pr-oject is to secure watershed based
conceptual pe~it approval from the appropriate environmental agencies,
particula~ly the Southwest Florida Water Management District (SWFWHD) and the
Flor-ida Department of Environmental Regulation (FDER).

gathering requirement~ of the Nat.iona::" Pollutant Dischar-ge Elimination System
(NPDES) Municipal Part ~ ?enrnit Applicatio4, for submittal by ?inellas County
prior to November, 2991. The CONSULIAN! is not expected to prepare this

2.2 ~ORK EFFORT REQUIREMENTS
2.2.1 The wo~k effort calls for three staged plannine submittals. Stage
one, the Preliminary Draft Report (Section 4.2), is to be Ii general management
plan outlinio[, Euidance, Eoverning principles, concepts, Best Management
Pr.actices (BMP), and other recommended policies desitjnea to impr-ove the
water-shed consistent with other concerns (Section 3,2.3). The Preliminary
Draft Report shall also set targets for ar-eas which need improvement such as
pollutant load reduction, nutrient load reduction, habitat impr-ovements,
invasive species removal, buffer establishment, floodplain establishment,
among others.
2.2.2 Stage two, the Draft Repor-t (Section 4.2), shall be based on the
accepted guidance of the Preliminary DI."aft RepoI."t., This report shall set
forth performance criteria for hydr-aulics, restoI."ative\measur-es, BMP's, etc.
All feasible methods of relieving flood conditions and imp~oving water quality
will be consider-ed. The effectiveness of improvements considerec. \..'ill be
demonstrated by computer modeling to demonstrate ~mpac:s to water quality and
quantity, Each of the alternate solutions must b~inE :he drainage system into
compljance with a" regulatory criteria. The CONSULTANT shall use nata
provided by the Pinellas County Department of Env~~onmental Managemen: as pa~~

CONSULTANT will measure flow at least once at all appropriate sites, using

specific priorities, conceptual schedules, time lines. and overall
implementation coordination.
2.2.3 Stage three, the Allen's Creek Watershed Hanagement Plan shall
incorporate the P!:'el imi nar.y and Dt"aft repor.ts in an in tegI.'"a ted fash ion. The
~atershed Management Plan shall be submitted in hard copy and as diskette in a
fo~at consistent with County word processing software systems, including hard
copy and magnetic maps compatible with the County GIS system. The maps shall
accurately represent cu~rent conditions based on existing and supplied
information as well as pr'oject areas and detailed predicted basin
characteristics at completion of the plan implementation.

The Watershed Management Plan will also include r'ecomrnendations for ongoine.

considerations brought about as a result of recommended projects. Sufficient
documentation. including models not commercially available. will be provided
by the CONSULTAN'T to allow the COUNTY to recalibrate and reverify the water
quality model if implementation of recommended projects results in significant
changes to boundary conditions or model coefficients.
All reports, data and specimens, if applicable, w~ll be the property of
Pinel1as County and cannot be released except througll. and with the permission
of the County.
2.3 LIMITS OF WORK
2.3.1 The PROJECT limitE shall encompass all areas requirec fo~ the
improvements oeser-ibee. in Section :.::: anc. shall extend, latera.lly anc

practice, to renQe~ the proposed improvements compatible wi~h abutting

2.3.2 It is desired that proposed improvements be contained within the
limits of e;:isting publicly owned lands, rights-of-way, or easements where
"practical and feasible. The CONSULTANT shall detennine the dimensions and
location of all recommended additional rights-of-way. The COUNTY shall
provide the CONSULTAN1 with current land values fot" estimating the cost of any
additional ri{;ht-o.f-way acquisition. Final Right-of-Way determinations shall
be subject to approval by the Director of Public Works.
2.3.3 Far the pur.-poses of this agreement ~he tern "PROJECT" shell include
all areas of proposed. improvements, all areas whi ch may reasonably be jUdged
to have an impac: on the PROJECT, and all PROJECT development pnases and the
services and act17ities attendant thereto. It lS not the intent of this

communities along the creek and qualitative analysis of
the wetlands. The mapping will include the approximate
limits of wetland communities, the composition of each
community. the degree of disturbance present within

the course of the survey.

The CONSULTANT shall conduct the meetings and prepare all necessary

3.8.1 The CONSULTANT shall furnish s soils/geotechnical investigation
and analysis for the PROJECT. in accordance with the following requirements:
