Motion carried unanimously (7 to 0). Chairman Johnson outlined the procedures Ear conditional uses and advised that anyone adversely affected by a decision of the Planning and Zoning Board, with regard to conditional uses, has t.wo weeks from this date in which to Ei Ie an appeal through the City Clerk's Office. Ms. Harvey advised as follows: This request is for package sales of alcoholic beverages In the Resort Commer.cial "Twenty-Eight" zoning district; the specific state license being applied (or is a l-APS license; the governing sections of the Land Development Code ar(~ Sections 136.025(b) and (c)(2); this application is being reviewed under the provisions of Ordinance 4470-87 which requires a 500 foot separation and the procedures to procure a variance by the City Commission; thi.s request is being reviewed U11der the terms of the Code prior to the adoption of Ordinance 4420-87 and Ordinance 4529-87; the Traffic Engineer had 110 comments; and, the Police Department saw no reason to deny license to applicant. Ms. Harvey advised that this Board reviewed and denied a request on June 2, 1987 for a 2-APS license submitted by applicant. Ms. Harvey stated staff tound nothing different with this application and recommended denial of the request, t \ \ ......" Mr. James Tracey, applicant, stated the information submitted by the Traffic Engineer at the previous hearing was in error. Mr. Tracey submitted a petition signed by surrounding businesses and residents within 500 feet who support his request (see attached). He advised they intend to sell beer only to the proper people. He added that since the previous review some establishments that sold alcoholic beverages have closed. Mr. Tracey stated the closest establishment selling alcoholic beverages is 1/4 mile distant. He also submitted another petition that had been signed by people who have requested beer and have not been able to purchase it (see attached), After questioning by Mr. Schwob, Mr. Tracey stated the hours of operation are from 7 :00 AM to 9:00 PM. He added his family does not want to be open past 9:00 PM. He also stated the operation is a typical convenience store type operation but he does not sell sandwiches. Ms. Harvey advised she does not know what was done by thl~ Traffic Engin.eer i.n order for applicant to meet requirements to open the store but applicant now has an occupatlonal license which would have been signed off on by t:he Traffic Engincp.r. Customs; the Traffic Engineer had no comment; the Harbormaster stated there would be no adverse impact on r-' navigation and the parking has bel~n assigned for users; and, Environmental had '., no objection. Ms. Harvey advised sLaff recommended approval of the above request subject to the following: l) That the Building Permit be procured wi th in 6 months. William Held, Harbormaster for the City of Clc'!.:ll"water, stated the request is for the construction of two (2) docks that will basi.cally b(~ extensions of e}{isting docks. He advised the 12' x 100' dock would be tor use by the u.s. Coas t Guard and the 10' x 100' dock would be for use by U. S. Cus toms vesse Is. He also stated that the parking has recently been changed from angle parking to parallel parking and the change added 14 parking spaces. He added then~ should be no impact on navigation. After questioning by Mr. Schwob, Mr. Held advised the controlling depth of the docks is approximately 12 to 14 feet. He added there are no plans to decrease either fleet size and the City has a long term lease with the U.S. Coast Guard and U.s. Customs. He further felt there will be boat speeders to contend with and questioned what the long range effect this request will have on future requests. Sioeno, 322 Bayside Drive, expressed concern regarding consumption of alcoholic beverages on the dock and encroachment of traffic. She felt if this request is approved more reques ts will follow. Hr. R.andall Reed, 1826 Magnolia, expressed concern that approval of the dock is too much. Ms. Harvey advised one additional letter was received ~n opposition to the above request. He stated that, according to the Code, he is required to look at dock applications with regard to navigation. In rebuttal, Mr. Seaton felt this request would not have an adverse impact on the neighborhood. He added he has not asked for any variances. After questioning by Mr. Hogan, Mr. Seaton stated there would be overnight boat parking at his 16-slip marina but no overni.ght boat parking at the pier. \~; With regard to comments made by per.sons in opposition, Ms. Harvey clarified as follows: There was a discussion regarding parking during the public hearing in which approval for the 16-s1ip marina was requested and it was determined that P & Z Minutes 5 02/16/88 . / < . .... , .
