A. Mo t io n was made by Hr. Hoga n, sec cnded by Nr. Sc hwob, to approve the
minutes of the November 29, 1988 and the December 13, 1988 meeting as
written. Motion carried unanimously (5 to 0),
Mr. Green arrived at 1:35 PM.
Chairman Johnson outlined the procedures for conditional Ilses and advised that
anyone adversely affected by n decision of the Planning ami Zoning Board, with
regard to conditional uses, has two weeks from this elate in which to file an
appeal through the City Clerk's Office. Florida Law requires any party
appea Ii ng a de cis i on 0 f th is Board to have a l'ecord 0 f the proceed ings to
support the appeal.

Mr. Will Alexander, III, representative of applicant, stated the reason the

provide parking spaces that were lost during condemnation of a portion of the

stated the applicant should clarify why vehicle service is requested as the
plan appears to be only for display. Ms. Harvey advised staff recommends
approval of the request for outdoor retail sales, displays and/or storage
subject to the following: 1) That the rezoning and Land Use Plan amendment be
fin a 1 i zed for the par t ion 0 f pro per t y now z 0 n e d R S - 8; and 2 ) Th a t a
Certificate of Occupancy be obtained within 6 months.
Atty. Emil C. Marquardt, representative of applicant, stated the requests are
made to use the lots in furtherance of the dealel.ship. He stated the reason
applicant is requesting vehicle service is to have all options open as to how
the property will be used. He added that currently the property would largely
be used for display but applicant j,ntends at a later date to construct a
building for vehicle service.
Ms. Harvey felt applicant should make the request for vehicle service at such
time that applicant knows what the specific request for vehicle service will
be.

The Board felt, Slnce there is no site plan for vehicle set"vice and since the
Board is required to consider specific service to be done, i.t should not make
a decision at this meeting regarding vehicle service.

the site plan shows there will be no access to Bamboo Lane
subject properties.
Mr. Marquardt advised applicant's request is consistent with what is currently
owned by the applicant. After questioning by Mr. Hogan, Hr. Marquardt advised
('r.!"_ applicant is not far enough along in its plans to describe a proposed building
and its specific uses to the Board. Hr. ~1arquardt had no objection to vehicle
service not being considered at this time.
Ms. Harvey Cldvi.sed that one letter of objection was l.'eceived from a
neighboring resident just prior to the meeting (see attached).
In opposition to the above request, the following person appeared to glve his
comments:
Mr. James McDiarmid, 530 Bamboo Lane, stated there are gasoline pumps ill llse
on Lots 2 and 3. He also stated that he signed an agreernent with applicant
that there would be one entrance on each side of Bamboo Lane and that stop
signs would be insts lIed. He aclvi sed that the stop sign was in pl ace only two
days unt i lit was knoc ked d own and it was nevel' rep laced. Hr. He ni a rmi. d
submitted a letter addressed to him from applicant which outlined a release
(see attached letter). After questioning by Hr.. Schwab, Hr. ~1cDiarmi.d stated
he had no objection to outdoor retail sales, displays and/or storage.

After questioning by Hr. Hogan, Mr. Marquardt stated applicant r.eceived a
permit from the City for the gasoline pumps.
Ms. Harvey clarified that the installation of gasoline pumps does not requ1re
approval as a conditional use. She added that the request for vehicle display
would not mean other permitted uses are not allowed on a property and if all
requiremeTlts aee met, a permi.t can be approved by the Ci.ty.
After questioniTlg by Mr. Schwob, Ms. Harvey advised the zoning was originally
established as General Commercial 300 feet from the center line of Gulf-to-Bay
Boulevard. She added that since the zoning line falls in the middle of onc of
the platted lots it is necessary to have the RS-8 property rezoned. She stated
the rezoning request will be before this Board and the City Commission and she
felt there would be no problems with the rezon1ng.
Motion was made by Mr. Schwob, seconded by Mr. Hamilton, to approve the above
requests subject to the following: 1) That the rezoning and J~and Use Plan
amendment be finalized for the portion of property now zoned RS-8; and 2)
That a Certificate of Occupancy be obtained within 6 months. Motion cat-ried

Mr. Richard Reszczynski, applicallt, stated he took over the operatioll of the
subject gas station and would like to sell beer to make his business better.
He stated he pl;eviously had a license on St. Petersburg Beach. After
questioning by Board members, Mr, Reszczynski advised as follows: ~le hours of
operation are from 6:00 AJ1 to 10:00 PH; the operation iB !lot open all night;
he is present most of the time; he wi 11 have more of a mini market rather than
a convenience store; and, the Chevron station across the street has no
alcoholic beverage license.
In support of the above request, the Eollowing person appeared to glve his

Hr. Kenneth Delarbre, 1618 South Highland, adj oilling property owne r to the
south, stated he has practiced as a CPA at his location for many years and the
area has been developed as professional. He expeessed concern that as the
intersection has developed there has been an increase in traffic accidents and
he felt the sale of alcoholic beverages will not make the intersection safer.
He felt the sale of alcoholic beverages would not be in the best interest of
the neighborhood.
In support rebuttal, ~r. Lazzara stated that because of development elsewhere
traffic will be increased and he did not feel traffic would be cllanged too
much by alcoholic beverages being sold at the above location. He advised that
applicant is required to keep the property clean and neat.
In opposition l.'ebuttal, Mr. Flammia stated the residents are concerned with
the j ntersec t io n, the ne i ghborhoo(l, and a lcoho 1 ic b ever age sales in the area.
He stated the residents strongly object to alcoholic beverage sales at the
subject location.
In opposi tion rebuttal, Mr. Chi sholm stated the Central Church of Chris t is
directly across the street. He stated there is no minister assigned to the
Church and no aile is here to object. He felt Churches should be taken into
consideration.
In opposition rebuttal, Ms. Hale expressed concern about the Ilumber of pLaces
selling alcoholic beverages. After questioning by Ms. Hale, Mr. Hogan advised
there is no quota for the number- of places selling beer and wille.
