CITY COMMISSION MEETING
July 3, 1967
The City Commission of the City of Clearwater met in regular session at the
City Hall, Monday, July 3, ~967, at 1:30 P.M., with the following members
present:

The Mayor called the meeting to order. The invocation was given by the
Reverend R. L. Dozier of the Church of the Reconciler.
Commissioner Brumfie1d moved the minutes of the regular meeting of June 19th,
1967, be approved as recorded and as submitted in written summation by the Clerk
to each Commissioner. Motion was seconded by Commissioner Blackstone and carried
unanimously.
The continuation of the pub~ic hearing on paving, curbing and drainage of
Engman Street from Holt Street to Betty Lane was announced. The City Engineer
reported that on the basis of the low bid received the revised estimate of cost
would be $2.94 per assessable front foot. It was explained the City is assuming
the cost of the base as City trucks use the street hauling to the incinerator and
the paving was necessary to protect a sewer line. The Clerk read a petition from
three property owners objecting to the previous estimated cost as the City trucks
and the school buses would benefit more from the paving and opposing the project
unless the City assumed some of the cost. Commissioner Stephens moved that since
no valid objections have been fi~ed and the objections filed are insufficient, that
the paving, curbs and drainage of Engman Street project as outlined by the City
Engineer be accomplished and the City Manager and the City Engineer be directed to
forthwith proceed with the improvements as an assessment project. Motion was
seconded by Commissioner Blackstone and carried unanimously.
The Mayor announced a public hearing on paving, curbs and drainage in Duncan
Avenue from 175 feet south of Jeffords Street to Brentwood Drive. The City
Engineer explained that 12 property owners of the 13 involved were in favor. He
estimated the cost per assessable front foot as $4.25. Mr. Arthur J. Ultz,
Mrs. Edwin Price and Mr. Sidney Blackett spoke in favor. There were no objections.
Commissioner Brumfield moved that since no valid objections have been filed the
paving, curbs and drainage in the streets and areas described be approved and the
City Manager and the City Engineer be directed to forthwith proceed with such
improvements as an assessment project. Motion was seconded by Commissioner
Williams and carried unanimOUSly.
The City Manager recommended accepting the bid of Martins Uniforms, Tampa,
for summer uniforms for Fire Department. Commissioner Williams moved upon the joint
recommendation of the Fire Chief and Assistant Purchasing Agent, with the City
Manager concurring therein, that the contract for Fire Department uniforms be
awarded to Martins Uniforms for the sum of $917.40 which is the lowest and best
responsible bid and that the appropriate officials of the City be authorized to
execute said contract which sha11 be in accordance with plans, specifications
and bid. Motion was seconded by Commissioner Stephens and carried unanimously.
It was recommended by the CLty Manager that the bid of Norris and Lake Pump
Service be accepted for installation of new gas pumps at the Marina on Clearwater
Beach. Commissioner Blackstone moved upon the joint recommendation of the City
Engineer and the Assistant PurchasLng Agent, with the City Manager concurring
therein, that the contract for the gas pump installation at the City of Clearwater
Marina be awarded to the Norris and Lake Pump Service for the sum of $~,400,OO
which is the lowest and best responsible bid and that the appropriate officia~s
of the City be authorized to execute said contract which shall be in accordance
with plans, specifications and bid. Motion was seconded by Commissioner
Brumfield and carried unanimously.

The City Manager recommended accepting the bid of K & K Company of Clearwater
for paving, curbs and drainage in ~ngman Street, Holt Street to Betty Lane.
Commissioner Williams upon the joint recommendation of the City Engineer and the
Assistant Purchasing Agent, with the City Manager concurring therein, that the
contract for paving, curbs and drainage in Engman Street, be awarded to K & K
Company of Clearwater for the sun of $6,702,38 which is the lowest and best
responsible bid and that the appropriate officials of the City be authorized to
execute said contract which shall be in accordance with the plans, specifications
and bid. Motion was seconded by Commissioner Blackstone and carried unanimously.
The City Manager reported he had received a request from the South Clearwater
Community Club and the Missouri Club asking a change in City policy to per.mit the
playing of Bingo in City-o~ed facilities. Commissioner Brumfield moved the City
Manager be instructed to permit any organization requesting the use of City

facilities the privilege of using them for playing Bingo. Motion was seconded
by Commissioner Blaokstone. Upon the vote being taken, Commissioners Brumfield,
Blackstone and Mayor Hougen voted "Ayo". Commissioners Williams and Stephens
voted "No". Motion carried.
The City Manager presented a request from King Car Truck Rentals for a
variation in the sign ordinance to pennit moving a 4' x 8' sign from the setback
of 25 feet to the front property line at a Texaco service station, 1824 Gulf to
Bay Boulevard. As the service station is the primary business with the rental
business being secondary use of the property, the sign ordinance requires the
25 foot setback. Mr. Harold P. Krumrei, operator of the service station, was
present and e>cplai,ned the request more in detail. Commissioner Brumfield moved
the request be denied. Motion was seconded by Commissioner Williams and carried
unanimously.
The City Manager reported receiving a request from Frederick and Richard
Stelzer for annexation of Lot 1, Major's Manor; Lots 18 thru 23, incl., Block 3,
Bayview Terrace, and that portion of Carolina Street lying immediately south of
the foregoing lots. (The applicants requested business zoning on the property.)
Commissioner Blackstone moved to approve the request for annexation and direct
the Legal Department to prepare the proper ordinance. Motion was seconded by
Commissioner Brumfield and carried unanimOUSly.
The City Manager explained it was necessary to submit an actuarial report
on the City's pension plans once a year to the State Comptroller; therefore he
recommended renewal of a contract with the Wyatt Company for actuarial services
at a maximum of $l~OO.OO per year. Commissioner Brumfield moved the contract with
the Wyatt Company be approved and the proper City officials be authorized to
execute it. Motion was seconded by Commissioner Stephens and carried unanimously.
Regarding the policy of allowing two downtown on-street parking spaces for
each taxicab company regardless of the number of cabs in operation, the City
Manager stated that he and the Police Department recommend changing the policy to
permit ~ive taxicab spaces on the south side of Cleveland Street between the
loading area for Clearwater Transit buses and Garden Avenue. He explained that
all companies could use these spaces on first-come, first-served basis with not
more than two cabs of anyone firm to occupy the spaces at one time; that the taxi
space on South Fort Harrison Ave. in front of Peace Memorial Church for use of all
companies would be retained; that all companies would be required to operate from
private property and remove telephones from downtown streets. Commissioner
Brumfield moved to accept the recommendation of the Police Department and the City
Manager and allow the operating companies a thirty day grace period to comply with
this policy. Motion was seconded by Commissioner Williams and carried unanimously.
A request was presented from Mr. George Kersey for two additional taxicab
permits. Mr. Kersey was present. The City Manager reported the Police Department
found no reason to deny this request. Commissioner Stephens moved that Mr. Kersey's
request for two additional cabs to be operated in the city be granted. Motion was
seconded by Commissioner Blackstone and carried unanimously.
The City Manager explained the Civil Service Board had previously adopted
general rules and regulations for operation of personnel functions which had been
approved. He stated the Civil Service Board had now submitted for approval rules
and regulations for the Police and Fire Departments. Commissioner Williams moved
the rules and regulations of Police and Fire Departments be approved. Motion was
seconded by Commissioner Brumfield and carried unanimously.
The City Manager announced the National League of Cities Annual Conference
would be held in Boston, Massachusetts, from July 28th to August 2nd, 1967.
Commissioner Brumfield moved to approve travel expenses of City Commissioners
wishing to attend the conference. Motion ~as seconded by Commissioner Stephens
and carried unanimously.
The City Manager requested permission to be absent from the City from July 19th
to August 7th. He explained he planned to attend a seminar to be held by the
International City Managers' Association in Chicago and join the Commission in
Boston later. Commissioner Blackstone moved to approve the City Manager's request.
Motion was seconded by Commissioner Williams and carried unanimously.
Commissioner Williams requested permission to be absent from the meeting of
July 17th as he would be out of town. Commissioner Brumfield moved the request of
Commissioner Williams be granted. Motion was seconded by Commissioner Blackstone
and carried unanimously.
The City Attorney presented Ordinance Mo. 1111 adopting a m~n~mum housing
code for its third and final reading and outlined certain amendments which had
been suggested for incorporation therein. Commissioner Blackstone moved that
Ordinance No. 1111 which has been read on its first and second readings, be amended
prior to the third reading in the following respects:
Page 1, the title, on lines 2, 3, 4 and 5 from the top of the page, insert:
"adopting the Southern Standard Housing Code, 1965 Edition, subject to
certain exceptions amending Section 30~ pertaining to minimum requirements
for electrical systems;" and

Ordinance No. 1111 was read in full on its third and final reading.
Mr. Talmadge Rutledge representing the Clearwater Chapter of the N.A.A.C.P. objected
as he had done previously to the penalty sections of the ordinance and recommended
more lenient provisions. Mrs. Josephine Davis and ~r. Leroy Smith asked questions
about the ordinance. Mr. Elmer Shafer, Chairman of the aousing Committee, Senior
Citizens Service, spoke in favor of the ordinance stating that he believed that the
ordinance was very fair and particularly emphasized the operation of the proposed
appeals board. Commissioner Blackstone moved Ordinance ~o. 1111 as amended be
passed on its third and final reading and adopted and that the appropriate offic-
ials of the City be authorized to execute it. Motion was seconded by Commissioner
Brumfield and carried unanimously.
The City Attorney read on its first reading Ordinance No. 1113 annexing
acreage in Section 19-29-16 (H. Bolling) and Lot 12, Block E, Oak Acres Addition
Unit 2 <C. Jackson) into the City limits. Commissioner Stephens moved Ordinance
Mo. 1113 be passed on its first reading. Motion was seconded by Commissioner
Williams and carried unanimously.

The City Attorney read on its first reading Ordinance No. 1115 autnorizing
the issuance of $1,250,000.00 Utility Revenue Certificates, Serias of 1967,
Commissioner Williams moved Ordinance No. 1115 be passed on its first reading.
Motion was seconded by Commissioner Brumfield and car~ied unanimously.

The City Attorney presented a right of ~ay easement from the Atlantic Coast
Line Railroad Company described as the easternmost 20 feet of the ACL right of way
between Cleveland and Park Streets. Commissioner Br~field moved that the easement
as outlined by the City Attorney be accepted and that the City Clerk be directed
to record the same in the public records of Pinellas County, Florida. Motion was
seconded by Commissioner Stephens and carried unanimously.
Resolution No. 67-6~ was presented authorizing payment of $1.35 to the First
National Bank as Trustee's fee from Utility Revenue Certificates, Series of 1965.
Commissioner Blackstone moved Resolution No. 67-64 be passed and adopted and tne
appropriate officials be authorized to execute it. Motion ~as seconded by
Commissioner Brumfield and carried unanimous~y.
Resolution No. 67-65 was presented authorizing payment of $61.63 to the Bank
of Clearwater as Trustees's fee from Utilities Tax Inprovement Certificates, Series
of 1960. Commissioner Blackstone moved Res01ution No. 67-65 be passed and adopted
and the app~opriate officials be authorized to execute it. Motion was seconded by
Commissioner Brumfield and carried unanimously.
Resolution No. 67-66 was presented requesting tne owners of 56 properties to
clean their lots of weeds and undergrowth. Commissioner Brumfield moved
Resolution No. 67-66 be passed and adopted and the appropriate officials be author-
ized to execute it. Motion was seconded by Commissioner Stephens and carried
unanimOUSly.
Resolution No. 67-67 was read authorizing the Cit~ Legal Department to defend
the suit in Circuit Court against City Manager James R. Stewart filed by Carroll C.
Garretson. Commissioner Blackstone moved Resolution ~o. 67-67 be passed and
adopted and the appropriate officials be authorized to execute it. Motion was
seconded by Commissioner Williams and carried unanimo~sly.
Resolution No. 67-68 was read urging the Florida Board of Parks and Historic
Memoria~s and members of the Pinellas County Legislative Delegation to appropriate
funds as soon as possible for development of Caladesi Island as a State Park.
Commissioner Brumfield moved Res01ution No. 67-68 be ~assed and adopted and the
appropriate officials be authorized to execute it. Motion was seconded by
Commissioner Blackstone and carried unanimously,
The Mayor presented an Ambassador-at-Large card ~o Alan Reamont a U. S.
Marine Corps nelicopter pilot from Clearwater.
Commissioner Williams asked that the City Manager be instructed by consent of
the Commission to review the leases of the City facilities where admission is
charged to see if rent is adequate to cover the costs to the City.
Commissioner Brurnfie~d moved the meeting be adjour~ed at 4:50 P.M. Motion
was seconded by Commissioner Williams and carried unanimously.
The City Commission then met as Trustees of the Pension Fund with the Mayor
calling the meeting to order and heard letters read from the Advisory Committee
recommending that Marilyn J. Sparks, Clerk It Investiga~ion Division, Police
Department, and Barbara Ruth Coleman, ~ibrary Assistant I, Library Department, be
admitted to the Pension Plan. Commissioner Stephens moved on the recommendation of
the Advisory Committee that the above-named employees be accepted in the Pension
Plan. Motion was seconded by Commissioner Brumfield an carried unanimously.
