Brown Max Battl e Willis Booth City Mamger City Attorney City Engineer Police Chief The Mayor called the meeting to order. The invocation was given by Reverend Ed\'lard C. Chalfant, Episcopal Church of th e Ascension. Commissioner Insco moved that the minutes of the regular meeting of August 16th, and the special meet- ings of August 21st, August 30th, and September 2nd, 1965, be approved as recorded and as submitted in written summation by the Clerk to each Commissioner subject to addition of the motion to adjourn the meetings. Motion was seconded by Commissioner Smith and carried unanimously. The Mayor announced that the first item on the agenda was a public hearing appealing the decision of the Board of Adjustment & Appeal on Zoning denying the request of Charles A. and Marion L. Snipes to establish beauty shop in fonner car- port attached to residence on Lots 49 to 52, incl., Block B, Belmont 2nd Add., zoned R-4 (multiple dwelling). The Clerk read a petition with approximately 18 signatures in favor. Nrs. Snipes spoke for the request, stating that her husband was totally disabled, that she has three children under school age and ~ould like to earn her living at home so she can care for them. Mr. Thomas Peterson, 1517 s. Scranton Ave. and Mr. Martin Oppegard, 1522 S. Scranton Ave., spoke in favor of the request. Mr. H. H. Baskin, Sr., representing the applicant presented a Veterans Administration Statement rating Mr. Snipes as being 100% disabled; he quoted from the zoning law regarding home occupations and stated that the applicant migpt have to go on relief if not allowed to make a living in this way; that the request is ~or permissive use only to the applicant and is not to be passed on to future owners of the property. There were no objections. Commissioner Stephens moved that the action of the Board of Adjustment and Appeal on Zoning be reversed and that the application of Charles A. and Marion L. Snipes to operate a beauty shop in the car- port of their home at the corner of Woodlawn and Scranton Ave. be granted, it being understood that it is personal in nature to them and not transferable, that all State and City laws must- be complied wi tho Motion 1'las seco nded by Commissioner Smith. Commissioner Hougen moved to affirm the action of the Board of Adjustment and Appeal on Zoning denying the reque st. r,:otion was s eco nded by Commiss ioner Smith and carried unanimously. The City Manager recommended accepting the bid of International Harvester Co., St. Petersburg, lor two (2) refuse trucks vath refUse packer bodies, less 3 trade-ins for the Utilities Department, Refuse Division. Commissioner Smith moved upon the joint recommendation of the Utilities Mans ger, Refuse Superintendent and Asst. Purchasing Agent, concurred in by the City ~~anager tha t the contract be awarded to International Harvester Co., for the sum of $21,350, which is the lowest and best responsible bid and that the appropriate o~ficials of the Gity be authorized to execute said contract ~hich shall be in accordance with the plans and specifications and bid. The City Manager recon~ended accepting the bid of Graybar Electric Co., St. Petersburg, for four 10" x 27' metal traffic strain poles for traffic signals ~or the Electrical Department. Commissioner Hotgen moved upon the joint recommenda- tion of the Electrical Superintendent and the Asst. Purchasing Agent concurred in by the City Manager that the contract be awarded to Graybar Electric Co., for the sum of $1,254.00, which is the lowest and best responsible bid and that the appropriate officials of the City be authorized to execute said contract which shall be in accord- ance with the plans and specifications and bid. Motion was seconded by Commissioner Stephens and carried unanimously. The City Manager requested that item #~ on the agenda, bids for street sweeper, be postponed due to Paul Kane, Public Works Superintendent, being on vacation. The City Manager recommended accepting the bid of Mathews Development Corpora- tion, Inc., of 'rampa, for exterior wall covering for the Gas Plant Building on Hart St. Commissioner Stephens moved upon the joint recommendation of the City Engineer and Asst. Purchasing Agent concurred in by the City Manager that the contract be awarded to Mathews Development Corporation, Inc., ror the sum of $4,927.00, which is the lowest and best responsible bid and that the appropriate officials of the City be authorized to execute said contract which shall be in accordance with the plans and spec~fications and bid. G. Wm. Boswell, President of the firm said he would like to meet the requests of their customers. There were no objections. Commissioner Hougen moved that the City Attorney be instructed to draft an ordinance changing the liquor zonin~ whereby the Market would be permitted to sell beer and wine for off premises consumption. Motion was seconded by Commissioner Stephens. Upon the vote being taken Mayor Turner, Commissioner Smith, Commissioner Hougen and Commissioner Stephens voted "Aye". Corrunissioner Insco voted "No". Motion carried. The City Manager presented a request from Park Terrace of Clearwater, Inc. for change in the liquor zoning ordinance to permit the sale of beer and wine for on premises consumption, (Lots 33 and 46 Court Square Sub.). Mr. Fred J. Wilder, Attorney representing the owners of the Park Terrace Grill explained that the Garden Avenue side of the property permitted on premises consumption of beer and wine, but the Ft. Harrison Ave. side, where the main entrance is, only permitted off premises consumption and they wished to change the Ft. Harrison Ave. zoning to coincide with the Garden Ave. zoning. There were no objections. Commissioner Insco moved that the request be denied. Motion was seconded by Commissioner Smith and carried unanimously. The City Manager presented a request from Mr. Wm. W. Ward, to operate a second hand jewelry store at the NW corner of Garden and Park St. The usual investigation had been conducted by the Police Departnlent and no reason was found to deny the request. Commissioner Smith moved that the request be granted. Motion was seconded by Commissioner Stephens and carried unanimously. The City Manager presented a request from Mr. R. L. Williams to operate a second hand variety store at 110 N. Garden Ave. The usual investigation had been conducted by the Police Department and no reason was found to deny the request. Commissioner Insco moved that the request be granted. Motion was seconded by Commissioner Smith and carried unanimously. The City Manager read a resolution from Pinellas County Board of County Commissioners offering their assistance in locating and developing public beaches with adequate parking and access. Commissioner Insco moved that the resolution be received. Motion was seconded by Commissioner Smith and carried unanimously. The City Manager read a resolution from the Edgewater Drive Association, Inc., requesting the City Commission of Clearwater to undertake a permanent means of erosion control and beautification of the Edgewater Drive waterfront. Commissioner Insco moved tha t the resolution be received. Motion was seconded by Commissioner Hougen and carried unanimously. Resolution #65-102 was presented authorizing reimbursement of $11.38 to the Special Improvement Fund, from Construction Trust Fund, Utilities Tax Imp,rovement Cer~ificates, Series of 1960. Commissioner Smith moved that Resolution #65-102 be adopted and that the appropriate officials of the City be authorized to execute it. Motion was seconded by Commissioner Stephens and carried unanimously. Resolution #65-103 was presented authorizing reimbursement of $219.90 to the General Fund, from Construction Trust Fund, Incinerator Revenue Bonds, Series of 1963. Commissioner Insco moved that Resolution #65-103 be adopted and that the appropriate officials of the City be authorized to execute it. Motion was seconded by Commissioner Stephens and carried unanimously. Resolution #65-104 was presented authorizing the payment of $746.58 to the Bank of Clearwater, for Trustee's compensation from Construction Trust Fund, Utilities Tax Improvement Certificates, Series of 1962. Commissioner Insco moved that Resolution #65-104 be adopted and that the appropriate officials of the City be authorized to execute it. Motion was seconded by Commissioner Stephens and carried unanimously. Resolution #65-105 was presented authorizing payment to the General Fund of $2,706.07 for new Utilities Building project; $834.27 for new City Hall project; and $910.06 for new #2 Fire Station, making a total of $4,450.40 to be paid to the General Fund from Construction Trust Fund, Utili ties Tax Improvement. Certificates, Series of 1962. Commissioner Ho~en moved that Resolution #65-105 be adopted and that the appropriate officials of the City be authorized to execute it. Motion was seconded by Commissioner Stephens and carrie d unan imously. The City Attorney read in full Resolution #65-106 commending Mr. Floyd T. Christian on his appointment to Superintendent of Public Instruction of the State of Florida and extending cooperation to him. Commissioner Stephens moved that Resolution #65-106 be adopted and the proper officials be authorized to execute it. Motion was seconded by Commissione r Smith and carried unanimously. The City Attorney read in full Resolution #65-107 comrnendin~ Mr. Fred O. Dickinson, for his appointment as Comptroller of the State of Florida, and extending cooperation to him. Commissioner Smith moved to accept this easement as outlined by the City Attorney and the proper of.ficials be authorized to record it. Motion was seconded by Commissioner Insco and carried unanimously. The City Attorney read in full on its first reading Ordinance #1062 adopting the National Electrical Code, 1962 Edition and amending Section 7-66 of the Clearwater City Code of 1962. Comnissioner Smith moved that Ordinance #1062 be passed on its first reading. Motion was seconded by Commissioner Stephens and carried unanimously. Commissioner Smith moved Ordinance #1062 be read and considered on its second reading by title only with the unanimous consent of the Commission. Commissioner Smith moved that Ordinance #1062 be passed on its third and final reading and adopted and that the appropriate officials be authorized to execute it. Motion was seconded by Commissioner Stephens and carried unanimously. Resolution #65-108 was presented requiring the o~ers of 119 properties to clean their lots of weeds and undergrowth. Commissioner Insco moved that Resolution 1165-108 be adopted and t ha t the a ppropria te officia Is be authorized to execute it. Motion was seconded by Commissioner Ho~en and carried unanimously. Mr. Charles E. Browning, operator of the Colony Marina Restaurant', asked ques- tions regarding a report that a restaurant was ~oing to be located on the second floor of the Marina Building, directly above his place of business. The Mayor stated that it was discussed at the work session but the request had been turned down. Mr. Arthur Kruse, Chairman of the Planning & Zoning Board, commented about the development of Edgewater Dr., with the State, County and the City of Dunedin being involved. Commissioner Insco also mentioned the invo1vment of private property owners and that the State Road Board was interested a f'e'W yeHrs ago. He also sugges- ted further study of a second causeway from Sunset Point Road to Clearwater Beach. Commissioner Smith inquired about the realtors' report on the sign ordinance and the City Manager replied that he had received a letter from them stating that the Committee had made its recommendations to the Executive Board of the Clearwater-Largo Board of Realtors and the report should be received by the City next week. Commissioner Cleveland Insco brought up the matter of stores being open for business on Sundays and suggested that the City Attorney investigate a St. Petersburg ordinance regulating Sunday business. Commissioner Insco moved that the expenses be a~proved for City officials to join the "Philliesll booster trip to Philadelphia; for attendance at the Suncoast League of Municipalities Conference in Naples, September lSth; the Florida League of Municipalities October 24-26 in Miami; and also the expenses of the City Manager at the International City Managers Association in Montreal, Canada, September 19-22nd. Motion was seconded by Commissioner Hougen and carried unanimously. Commissioner Hougen recommended all possible haste by the Planning & Zoning Board and the Beautification Committee to bring before the Commission suggestions for beautifying Edgewater Drive. The Mayor read a letter from the Board of Pinellas County Commissioners regarding a Governmental Study Commission they have created for the purpose of' studying pro- \ posals to improve local governmental structures and services in Pine11as County. ~ Clearwater has been designated as one of the appointing authori ties to have two rep- ~-~O -, S' resentatives. A meeting will be held on Thursday, September 9th, at 10 A.M. and the lf~yor recommended Commissioner Insco and Commissioner Ho~en to represent the city. Commissioner Smith moved that the recommendations be approved. Motion was seconded by Commissioner Stephens and carried unanimously. The Mayor recommended that the City Attorney study a Tampa ordinance covering the financial responsibility or credit rating of contractors to protect subcontractors, and bring a report back to the Commission at a later date.
