CITY COMMISSION MEETING
April 26, 1965
The City Commission oE the City of Clearwater met in special session at
the City Hall, Monday, April 26, 1905 at 1:30 P.M., with the following present:

The Mayor called the meeting to order. The invocation was given by Chief
Booth. The Mayor announced that the purpose of the special meeting was to hold
a public hearing to consider various proposed zoning map changes and zoning
ordinance changes, and then asked to deviate from the agenda to hear a request
for approval of plat first. Commissioner Smith moved to deviate from the agenda
as requested. Motion was seconded by Commissioner Hougen and carried unanimously.
The City Attorney reported that the Legislature has acted on redefining the
City limits which included all the rroperty that is in the City of Clearwater
plus several other parcels, one of which is Mornineside Estates Unit 3A.
Commissioner Smith moved that the plat for Morningside Estates Unit 3A be approved
as recommended and the proper officials be authorized to execute it subject to
legislative action annexing the area. Motion was seconded by Commissioner
Stephens and carried unanimously.
The City Engineer left the meeting at this time.
ITEM #l ~as the request of Fred I. Culler. The Clerk read a letter in favor
of the request from Trinity Presbyterian Church. There were no objections. Com-
missioner Insco moved after having held this public hearing, having considered the
proponents and objectors, having considered the recommendations of the Flanning &
Zoning Board and having heard no valid objections to the same, that the property
owned by Fred I. Culler, described as: Begin 330 ft. N. and 30 ft. E. of the SW
corner of the SW 1/4 01 NE 1/4, Section 13-29-15, for a P.O.B. run E 220 ft., N
101.64 ft., W 220 ft., S 99.80 ft. to P.O.B. be changed from R-4 (multiple dwelling)
to PRS (professional & related services) and the City Legal Department is instructed
to include this matter in an ordinance amending the City's zoning laws. Motion was
seconded by Commissioner Smith and carried unanimously.
ITEM #2 ~as the request of Lt. Col. Fred S. Manter (F & E Realty Co.) and Adam
A. Hillebrand, et ale A petition in Eavor of the request with 6 signatures was
presented, from some of the property owners in the block. ITEM #3 - the City Planner
suggested that it also be considered with Item #2, being part of the same block.
There ~ere no objections. Commissioner Smith moved that after having held this pub-
lic hearing, having considered the proponents and objectors, having considered the
recommendations of the Planning & Zoning Board and having heard no valid objections
to the same, that the property owned by Lt. Col. Fred S. Manter (F & E Realty Co.)
and others described as Lots 1-11 inclusive, Lots 14-22 inclusive, Block A of
Westover Sub. and Lots 12 and 13, Block A of Westover Sub. be changed from R-2 to R-4
(multiple d~elling) and the City Legal Departmen t is instructed to incl ude this matter
in an ordinance amending the City's zoning laws. Motion was seconded by Commissioner
Stephens and carried unanimously.
ITEN #4 ~as the request of Theodore J. Johnson to change Lot 30, Woodmere Heights
from R-2 to R-4 (multiple dwelling). The Clerk read a petition with 27 signatures in
opposition to the request. Mr. Charles F. Barber, Attorney, representing the appli-
cant stat ed ths. tit would provid e abetter buffer zone between th e busi ness and the
duplex area. Mr. Richard F. Salamone, 220 N. Mars Ave. and Mrs. G. A. Stavros, 307
& 309 N. Mars Ave. spoke in objection. Commissioner Insco moved that after having
held this public heari~ and having considered the pleas of the proponents and objec-
tors and the recommendation of the Planning & Zoning Board, that the application of
Theodore J. Johnson be disapproved. Motion was seconded by Commissioner Hougen and
carried unanimously.
ITEM ~5 to Amend Section 26-6B (4) (a) to permit lumber yard and/or mill work
in "HB" (he avy business distric t), and
ITEM #6 to delete Section 26-6B (4) (c) pertaining to certain prohibited uses in "HB"
(heavy business district) and amend Section 26-6B (3) (a) to allo~ light industrial
and processing uses in an enclosed building as a special exception in "HBlt (heavy
business district), were the recommendations of the Planning & Zoning Board. There
were no objections. Commissioner Smith moved after having held this public hearing
and having heard no valid objections and after considering the recommendations of the
Planning & Zoning Board, that Items 5 and 6 be approved and that the City Legal De-
partment is hereby instructed to include these items in an Ordinance amending the
City's zoning laws. Motion was seconded by Commissioner Ho~en and carried
unanimously.

ITEM 11 - Amend Section 26-17 (5) (a) pertaining to Board of Adjustment and Appeal
by adding subsection (11) to provide criteria for considering a drive-in
theater &S !l special exception in an "HB" (heavy business) or "M"
(manufacturing) zone.
The Clerk reported receipt of 4 letters objecting to a drive-in theater in the
area of Highland Ave. and Lakeview Rd. Mrs. George Collins and Mr. Fred J. Wilder,
Attorney, representing the Clearwater Medical Arts, Inc., and others spoke in
objection to a drive-in theater in the above area. Commissioner Insco moved after
ha ving held this public hearing and ha ving heard no val id objections and after
consid ering the recommend ations of' the Planning c/; Zoning Board tha t Items 7 through
11 incl us i ve be approved and t ha t the City Ler;al Department is instruc ted to incl ude
these items in an ordinance amending the City's zoning laws. Motion was seconded by
Commissioner Smith n nd carrie d una nimous ly. Conunissioner 8mi th stated that the
Commission had no knowledge of an application for a drive-in theater building permit,
but that the proposed ordirnnce change had been considered by the Planning &, Zoning
Board for a number of months, a nd that the Commi ssion had directed the City Manager
to instruct all Dep:lr0ments to hold permits in abeyance until the new ordinance was
approved .
ITEM 1112 to Amend Section 26-6A (3) (i) pertaininp; to "B" (business district)
to update mobile home reference in prohibited use list. There were no objections.
Commissioner Smith moved tha t after ha ving held this public hearing and having heard
no valid objections and after considering the recommendations of the Planning &
Zoning Board, that Item 12 be approved and that the City Legal Department is hereby
instructed to include this item in an Ordinance amending the City's zoning laws.
Motion was seconded by Commissioner Stephens and carried unanimously.
ITEM #13 to amend Section 2b-6A (3) (g) pertaining to "B" (business district) to
require a barrier between an approved service station and abutting residential district.
It was discussed that this item should specify the type of barrier, not signs or other
unsightly barrier. There were no objections. Commissioner Smith moved after having
held this public hearing and having heard no valid objections and after considering
the recommendations of the Planning & Zoning Board, that Item #13 be approved subject
to clarification by the Legal Department relative to the type of barrier and the City
Legal Department is hereby instructed to include this item in an Ordinance amending
the City's zoning laws. ~otion was seconded by Commissioner Stephens and carried
unanimously.
ITEM #14 to amend Section 26-11 (14) pertaining to location, height and area
regulations, etc., to require special minimum building setbacks on Highland Ave.
from south City limit north to Union St. There were no objections. Commissioner
Smith moved after having held this public hearin8 and having heard no valid objections
~d after considering the recommendations of the Planning & Zoning Board, that Item
#14 be approved and that the City Legal Department is hereby instructed to include
this item in an Ordinance amending the City's zoning laws. Motion was seconded by
Commissioner Hougen and carried unanimously.
ITEM 1115 to amend Section 26-6A (1) pertaining to "B" (business district) by add-
ing subsection (i) to permit railway terminal and/or freight office. There were no
objections. Commissioner Insco moved after having held this public hearing and having
heard no valid objections and after considering the recommendations o~ the Planning &
Zoning Board, that Item #15 be approved and that the City Legal Department is hereby
instructed to include this item in an Ordinance amending the City's zoning laws.
Motion was seconded by Commissioner Smith and carried unanimously.
ITEM #16 to amend Section 26-17 pertaining to Board of Adjustment & Appeal by
repealing subsections (6), (7) & (8) and replacing by Florida Statutes 176.16 through
17.20 to provide for appeals from Board of Adjustment and Appeal to be submitted to
the Circuit Court instead of the City Commission. Commissioner Hougen stated that the
Mayor and City Commissioners ~ere elected to represent the people of the City of
Clearwater and in zoning matters to enforce zoning laws; that an absolute delegation
of authority to the Board of Adjustment & Appeal without any review by the City Com-
mission is an undesirable feature and would not want to have it incorporated in the
City zoning laws, and did not think a taxpayer should be put to the expense of going
to Circuit Court ~ithout the matter in controversy being reviewed by the City Com-
mission, and therefore moved that Item #16 be rejected. Motion was seconded by
Commissioner Stephens and carried unanimously.

ITEM #17 to amend Chapter 26, Zoning Ordinance, to provide for Residential
and Comrnercial--Industria1 planned unit developments and the processing and
regulation thereo~. There was considerable discussion, questions asked and
comments made. Mr. Jack Wolle, City Planner,explained the proposed plan for
unit developments, the process and regulation thereof. Commissioner Smith
m~ed to deny Item #17 at this time and table the proposal for further consid-
eration by the Commission. Motion was seconded by Commissioner Hougen and
carried unanimously.

Mayor Turner announced that word had just been received that Senator Young
reported the Clearwater bill regarding redefining the boundaries o~ the City
had been passed am signed into la w by the Governor.
The City Commission commended the Planning & Zoning Board for their efforts.
Commissioner Insco moved tha t the City PIa nner, the PIa nning & Zoning Board
arid the City Attorney give further study for recommendations ~or barriers between
any business area and residential areas. Motion was seconded by Commissioner
Smith and carried unanimously.
There being no further business the meeting adjourned at 3:25 P.M.
