August 3, 1964
The City Commission of the Cit.y of Clearwater met in resular session at the
City Hall, Monday, August 3, 1964 at 1:30 P.M., with the follo~ing members present:

In the absence of the Mayor, Commissioner Turner called the meeting to order and
requested a motion to appoint an Acting Mayor-Co~nissioner. Commissioner Fields moved
that Commissioner Insco be appointed Acting Mayor-Commissioner. Commissioner Smith
seconded the motion which carried unanimously. Acting Mayor-Commissioner Insco as-
sumed the Chair. The invocation was ~iven by Rev. Walter F. Hall, Peace Memorial
Presbyterian Church. The Acting Mayor referred to the Charter and requested that the
Commission excuse him and st.ated the reason for his absence from the meetings of
June 1st and 15th, 1964 for illness, and from the meetings of July 6th and 20th, 1964
for vacation and also to excuse Mayor Wea~herly from this meeting for vacation.
Commissioner Fields moved that the Acting r~ayor's request be approved. Notion was sec-
onded by Commissioner Smith and carried unanimously. Commissioner Turner moved that
the minutes of the regul~r meeting of July 20th, 1964 be approved as recorded and as
submitted in written summation by ~he Clerk to each Commissioner subject to the ap-
proval of Mayor Weatherly. Motion was seconded by Commissioner Fields and carried
unanimously. Commissioner Insco also approved the minutes of May 4th and lath, and
June 1st and 15th, and July 6th, 1964, which had been approved subject to his approval.
A publiC hearing was announced for the paving and drainage o~ Ewing Avenue, from
Druid Road to Jeffords Street. The City Engineer reported that t11e estimated cost per
front foot has been reduced from $6.24 to $4.96 per assessable rront foot for a 30 rt.
s~reet and $4.44- for a 24 ft. st,reet. The Acting rJ1ayor reported that it was agreed at
the work session that the policy now is to hold the publiC hearing, but ~ithhold the
decision until the next regular meeting, which will give the Commission more time for
study and review of the sit.uation. Nrs. John St.einmetz, Mr.. D. R. McLachrie and
Mr. H. W. Brooks objected to the 30 ft. street, but said t.hey would be in favor of the
24 ft. street. Mr. Kat Cerutti, spoke in favor of paving any way the City would choose.
Ivlr. James L. Donovan and f,lr. D\oJyer Green objected to paving. The City Engineer re-
ported that in this particular instance a 24 f~. street would be adequate as it is
only a 50 ft. right of way. Commissioner Turner moved t.o make an exception of the new
policy in this case and proceed to vote on the matter at this time. Motion was sec-
onded by Commissioner Fields and carried unanimously. Commissioner Turner moved having
heard no valid objections that the City be authorized to proceed with the pavin~ and
drainage of Ewing Avenue from Druid Road to Jeffords Street, with a 24 ft. wide street,
back to back of the curbs on an assessment basis. Motion was seconded by Commissioner
Fields and carried unanimously.
A public hearing was announced for the construction of sanitary sewers in Del Oro
Estates and Del Oro Groves subdivisions. Mr. Harry Hall, Associate Chief Sanitarian,
from the Pinel1as County Health Dept. gave a report. of a preliminary survey made in
conjunction with the City Engineer. He said t.here has been a history of complaints
from this area of septic tank failure, and t.hat it could turn into a public health
hazard. Mr. William M. MacKenzie, Attorney, represem,ed the original developers of
the area and objected to patching of the streets after installation. He also mentioned
that sanitary sewers were not needed since this was a high and dry area, and t.hat there
would be an additional cost to each property owner for running of the line from the
rear of the house, which would average ~n85, in addition to +.he assessment cost.
Mr. Paul J. Miller said one year ago he pu~ his sep~ic tank in at rear of his property
on advice of the City Engineer, and objected to sewer. 11r. Sigurd Sollie said the
majority of the homes in Del Oro Estates are less than 2 years old and have their
septic tanks in rear because they were informed that the sewers would be put in the
easements. Commissioner Turner moved to continue this hearing un~il the meeting of
September 8th, 1964, at which time the City Commission will conclude this matter and
t.ake a vote thereon. r.10tion was seconded by Cornmissione r Fields and carried unani- .
mously.
Commi~sioner Fields moved to deviat.e from the agenda to consider Item #15,
Ordinance ffl024, pertaining to Occupational Licenses and Regulations thereto. Motion
was seconded by Commissioner Turner and carried unanimously.
Va-. Wm. lliacKenzie, Attorney, representing the Standard Oil Distributor in
Clearwater, objected to the license fee of $25.00 per truck and cited a Supreme Court
case, the State Const.it.ution and Statut.es. Mr. John Williams, representing the Upper
Pine1las Fuel Oil Association, spoke in objection to the $25.00 fee per truck.
Mr. Robert Bickerstaffe, Jr., of Clearwater Flying Company, questioned and made com-
parisons of Items 9, aircraf't; 10, airport; 28, automobile and truck and 4-1, boat.s.
Mr. Robert Hilleboe, representing $ trailer parks in the City objected to the proposed
f'ees and proposed a fee of $1.50 per space with a minimum of $50.00 per mobile home
park. The Acting Mayor said consideration would be given to the above objections prior
to final passage of the ordinance.

The City Manager reported that a letter had been received rrom K. Whitney
Dalzell, Jr., the Architect, recommending Deeb, Inc., St. Petersburg for the con-
struction of the Public Utilities Bldg., at the NE corner of Prospect & Chestnut
Streets (a portion of Lots 5-10 Bll)ck C, Coachman Hei~hts) for the base bid of
$161,1.61.61 together with alternate #1, Floatin~ F100r for I~1 room $2,895; alter-
nate ~2, Drive-in window $4,200; and Roor Bond ~120, making a total of $168,376.61.
Commissioner Fields moved that the contract for the Utilities Building be a~arded to
Deeb, Inc., for the total sum of $168,376.61 which includes the base bid together
wi~h alternates 1 and 2 and Roof Bond, Which is the lowest and best responsible bid
and that the appropriate officials of t. he City be aut.horized to execute said con'tract
which shall be in accordance with the plans and specifications and bid. Motion ~as
seconded by Commissioner Turner and carried unanimously.
The City Manager recommended accepting the bids of 3 separate companies for
traffic signals, detectors and controllers for Electrical Dept., ror Highland & Dru1~,
Highland & Palmetto, Coronado & Gulfvie~, Keene & Druid and Highland & Drew Streets.
He also stated that IJir. Ort, Electrical Superintendent, had asked, since the bid was
considerably lower t.han his estimate, that he be allowed to order 24 additional signal
heads under Item 2. Comnlissioner Smit-.h moved upon to he recommendation of t.he City
Manager, Electrical Superintendent and Asst.. Purchasin~ Agent, t hat the cont. ract, for
traffic signals as follo~s:

The City Manager recommended accepting the bid of Raybro Electric Supplies, Inc.,
for sixty l500-watt mercury vapor floodlight fixtures for the Electrical Depar~ment
ror use at Little League Ball Park, Belmont Field and Marymont Park. Commissioner
Turner moved upon the recommendation of the Electrical Superintendent concurred therein
by the City Manager and Asst. Purchasing Agent t:.hat, the contract for floodlight ./,
fixtures be awarded to Raybro Electric Supplies, Inc., for the sum or $1,374, which is
the lowest and best responsible bid aTld t.hat t,he appropriat.e officials of the Cit-.y be
au~horized 'to execute said contract which shall be in accordance with the plans and
specifications and bid. Motion was seconded by Commissioner Fields and carried unani~
mously.
The City i-lanager recommended accepting the low bid, of Commercial Contractors for
construction of one hand ball court (at Sid Lickton Field South or Palme'tto Street).
Commissioner Smith moved upon the joint recommendation of the City Engineer and Asst.
Purchasing Agent, concurred in by the City t-!anager that the cont.ract be awarded to
Commercia1 Contractors, for the sum of $2,230, which is the lowest and best responsible
bid and that the appropriate oLficials be authorized to execute said contract, which
shall be in accordance with the plans and specifications and bi d. Notion was seconded
by Commissioner Turner and carr:ied unanimously.
The City r'!anager recommended accepting the low bid of A. A. Schult.z Construction
Conpany for the paving and curbing of Ewing Avenue from Court to Park Street.
Commissioner Fields moved upon the joint recommendation of the City Engineer and Asst.
Purchasing Agent concurred in by t.he Ci t-.y Io,'Janager that the cont,ract be awarded to
A. A. Schultz Construct.ion Company, for the sum of ~p8,773.65, which is t.he lo~est, and

The City Manager recommended accepting the low bid of Stuart Plastering Company,
Orlando, Lor the plastering or stuccoing of No. 1 Fire Station. Commissioner Turner
moved upon the joint recommendation of the Fire Chier, City Engineer and Asst.
Purchasing Agent, concurred in by the City Manager that t,he contract be awarded. to
Stuart Plastering Company, Orlando, wit.h a time limit of 45 days, for the sum of
$6,933, which is the lowest and best responsible bid and that the appropriate officials
be authorized to execute said contract ~hich shall be in accordance with the plans and
specifications and bid. Motion was seconded by Commissioner Fields and carried unani-
mously.
The City Manager read a letter from Owen S. Allbritton III, Attorney, representing
Norman Kirkland, Jr., and Forest. Dean, owners of a lot at the northwest corner o~
Hig;hland and Palmetto St.reet, being Tract "AU, Unit 1 Palm Terrace Sub., which t.hey
would like to exchange for Lot 7, Clearwater Indust rial Park. They guarantee to in-
itially erect on the lot in the Industrial Park a Commercial Building with a minimum
of 5,000 square feet, within 30 days f'rom exchange of deeds, with a reverter clause.
Commissioner Fields moved that the City accept the offer of !o1r. Kirkland and Mr. Dean
as set forth in their proposal and the prop9r orficials be authorized to execu~e it.

The City Manager requested authorization to spend up to $1200 f'or the Atlantic
Coast Line Railroad to perf'orm certain work at their Drew Street crossing, in connec-
tion with the widening of' Drew Street. Commissioner Turner moved that the request be
approved and that the proper officials be aut.horized to execute it. Motion was sec-
onded by Cornmissiore r Fields and carried unanimously.

The City Iv'lanager presented fe>r approval 5 requests for permits for commercial
advertising signs:
Two from Gulf Advertising Service - both ror Parliament House, one 4/10 of a
mile E. of U.S. Highway 19 on the N. side of Gulf to Bay Blvd., opposite
entrance to Sky Harbor Mobile Home Park; and the other one on South side of
Gulf to Bay Blvd., opposite Orion Avenue between Keene Road and Virginia Lane.
Two from Sunad, Inc., - one ~or Frisch's Big Boy Restaurant, on the South
side of Cleveland Street, West or Evergreen Avenue; and the other for
Pinellas Tire Company, at southwest corner of Pinellas Street, and
S. Ft. Harrison Avenue.
One from Sign Studio - at the southeast corner of U. S. Hiehway 19 and
Gulf to Bay Blvd.
They all meet the requirements of the Planning & Zoning Board. Mr. Arthur Kruse,
Chairman, Beautification Commit.tee, stated t,hat the Planning & Zoning Board has no
alternative, according to the ord~nance, but to approve these signs, and then said
there was getting to be too many of them and his Committee 'Would soon have a recom-
mendation to control the situation. He also objected to the last one, because the
Beautific at ion Committee had planned to beaut ify that corner and they did not kno'W
enough about the proposed sign. Commissioner Fields moved that the 2 requests from
Gulf Advertising Service and the 2 from Sunad, Inc., be approved as recommended and
action be deferred on the one fro~ Sign Studio. Motion was seconded by Commissioner
Turner and carried unanimously.

The City Manager presen~ed an Agreemen~ ~ith A. Waller Smith to purchase Lots
9 and la, Block 5, Gould & Ewings 2nd Addition (SW corner of Garden Avenue and
Park Street) for parking lot, for el15,OOO, (il,OOO down $14,000 on closing,
balance at ~lO,OOO per year for 10 years plus ~% interest~. He reported that both
the Wilbur Smith & Associates Parking Survey and the Parking Board recommended the
purchase. Commissioner Fields moved that the Agreement. be approved as recommended
and that the proper officials be authorized to execute it. Motion was seconded by
Commissioner Turner and carried unanimously.
The City Attorney read in full Ordinance #1026 requ~r1ng identification and
lettering on trucks or other vehicles used by contractors. Commissioner Turner
moved that Ordinance #1026 be passed on its first reading. Motion was seconded by
Commissioner Fields and carried unanimously.

Resolution #64-119 was presented requiring the owners of 31 properties to clean
their lots o~ weeds and undergrowth. Commissioner Flelds moved that Resolution
#6~-119 be adopted and that the proper officials be authorized to execute it. Motion
was seconded by Commissioner Turner and carried unaniTh~usly.
Commissioner Insco announced that he had been requested by Captain Blaine
Lecouris, Traffic Planner, Clearwater Police Dept., to speak at the Traf~ic Engineers
and Electrical Lighting Association Institute to be held at the University of Florida,
Gainesville, Florida, September 17, IS, and 19, 1964. Commissioner Smith moved that
the Board allow the necessary expenses. Motion was seconded by Commissioner Turner
and carried unanimously.
The City Commission now adjourned as the City Commission and acting as Trustees
of the Pension Fund heard a letter read from the Advisory Con~ittee recommending that
Char les E. Deas, Attendant, Ut.ili t jp.s Dept., Incinerator Di vi sion; Sarah T. Guerra,
Clerk I, Utilities Dept.; and William G. Vierheller, Attendant, Utilities Dept.,
Incinerator, be admitted to the Pension Plan. Commissioner Fields moved that the
employees named be accepted in the Pension Plan. Motion was seconded by Commissioner
Turner and carried unanimously.
A letter was read from Carl P. Michalski, Dock Attendant, Marina, requesting
retirement under the Employees Pension Plan, because of physical incapacity to perform
his duties. A letter ~as also read from the Advisory Committee recommending that
Mr. Michalski, be retired at a pension of $79.62 per month, beginning Augus~ 12, 1964.
Commissioner Turner moved that Mr. Carl P. Michalski, Dock Attendant, Marina, be re-
tired at a pension of $79.62 per month, effective August 12, 1964. Motion was sec-
onded by Commissioner Fields and carried unanimously.
There being no further business the meeting adjourned at 4:40 P.M.

This letter is my request for pension from the Employees' Pension Plan in
accordance with section 5, paragraph 2, which states as follows: Employees who
become, in the opinion o~ the Advisory Committee, permanently physically or mentally
incapacitated to perlorm their duties, may retire aft.er continuous service of the
City for a period of ten {10 years or more, provided that. such retirement shall
continue only as long as said physical or mental incapaci~y exists.
I have continuous 11 years service of the City of Clearwater. The date of my
original appoint ment 'vIas July 27, 1953.
Attached are two statements from doct.ors o~ my condition. I am at the present
time recovering from a recent heaFt attack. This is the second attack that I have
had and my doctor had advised me not to do any ~rk involving physical exercise.

In the absence of the Pdayor, Commissioner Turner called the meeting to order and
requested a motion to appoint an Acting Mayor-Commissioner. Couunissior-Qr Fields moved
that Commissioner Insco be appoinr,ed Acting Mayor-Cammissioner. Commissianer Smit h
seconded the motion which carried unanimously. Acting Mayor-Commissianer Insca a�-
sumed the Ch�ir. The invocation was �iven by Rev. Waltzr F. Hall, Peace Memorial
Presbyterian Church. The Acting Mayor referred to tne Gharter and requested that t he
Commission excuse him and stated the reason for his absence from the mee�ings oi
June lst and 15th, 1961� for illness, and from the meer,�n;s of July 6th and 20th, 1g64
for vacation and also to excuse M�y�r Weatheriy from this meeting for vacation.

A public �iearin� �aas announced For the paving and drainage of Ewing �venue; from
Druid Road to Jef�ords Street. The City En�ineer repor.ted that the estirnated cost per
front foot h�s been reducad from �6024 to �4.9� p�r. assessable frorrt fo�t for a 30 ft,
street and �4«44 for a 21� ft. street. The Act;ing P+�ayor reported that it was agreed at
the work sassion tnat the policy now is to hold tlle public hearing, but withhold the
decision until the next reoular meeting, which wili give the Corranission mor2 time for
study and reviaw of the situation. Mrs. Jnhn Steinmetz, Mr.. D. R. I�Icl�achrie and
Mr. H. W, Brooks objected to the 30 ft. street, but said they would be in favor of the
24 it. st;reet. Ifr, i3at C�rutti, spoke in favor of paving any wap the Gity would choose.
Mr. James Z. Donovan and P��r. Dwyer Green objected to paving. the City Engineer re-
ported th3t in this particular instance a 2�. ft. street would be adequate as it is
only a 50 ft. right of way. Commissioner Turner moved to make an exception of the new
policy in this case and proceed to vote on the matter at this time. tdotion was sec-
onded by Commissioner Fields and carried unanimously, Cormissioner 'Purner raoved having
heard no valid objections that the City be auth�rized to proceed wit h the paving and
drainage of E�ving Avenue from Dru�d Road to Jefiords Street, t�rith a 24 it, wide stree�,
bae�c to back af th� curbs on an assessment basis. Motion was seconded by Commissioner
Fields and carried unanimously.
A public hearing was announced for the construction of sanitary sewers in Del Oro
Estates and Del Oro Groves subdivisions. ?�ir. Harry Hall, Associate Chief Sanir,arian,
from the Pinellas County Heaith Depr,, �ave� a report of a preliminary surveX made in
conjunction wit h the City Engineer. He said there has been a history of coreplaints
from thzs area of septic tank failure, and that it could turn into a public health
hazard, Mr. William I11. NiacKenzie, Atto�ney, represenGed the original developers of
the area and ob�ected to patching of the stree�s a£ter installation. He also mentioned
that, sanitary sewers were not needed since this was a hijh and dry area, and #;hat there
would be an ac�.ditional cost to each pro�erty owner for running o£ the line from the
rear of tha hotzse, which would a.verage �pl$5, in addition to the assessmern cost..
NTr, Paul J. Miller said one year ago he put his sep+,.ic tank in at iear of his property
on advice of �lie City Engine�r, and objected to sewer. NIr. Si,�urd Sollie said the
majority of the homes in Del Oro �st;ates are less than 2 years old and have their
septic tanlss in rear because they were informed that the sewers would be gut in the
easements. GommissiQner Turner moved to continue this hearing until the meeting of
Sc;ptember �th, �96�., at which time the City Co�mnission will conclude this mat�er and
take a vote tlzereon. l��otion Was seconded by Coe�missioner k'ields and carried unani-
mously.
Commissioner Fields moved to deviat,e from the agenda to consider Item ,�15,
Ordinance �1021�, per�aining to Occupational Licenses and Regulatians thereto. Nlotion
was seconded by Commissioner Turner and carried unanimously,
�ir. Wm. N;acKenzie, Attorney, representing the Standara Oil Distributor in
Clearwater, object,ed to the license fee of �25.Q0 per truck and cited a Sugrsme Court
case, the State Canstitution and 5t;atutes. N�r, Jnhn Williams, repr^esenting the Ugper
Pin811as Fuel Oil Association, spoke in objection to the �25.OU fee per truck.
Mr. Robert Biclterstaffe, Jr., of Clearwater Flying Company, questioned and made com-
parisons of Items 9, aircraft; 1�, airport; 2$, automobile and truck and y.l, boats,
Mr. Robert Hillebee, representing $ t;railer parks in tlie City objected to the proposed
fees and proposed a fee of �1.5U per space with a minimtun of ��0.00 per mobile home
park. The Acting Mayor said c�nsideration would be given to t he above o�jections prior
to final passage o:F the ordinance.

with alternates 1 and 2 and Roof Bond, which is the lowest and best responsil�le bid

Trie City Manager read a letter from Qwen S. Allbritton III, Attorney, representing
Idorman Kirkland, Jr., and Forest Dean, owners of a lot at the northwest corner of
Highland and Palmetto Street, being Tract "A", Unit 1 Palm Terrace Sub., which r,hey
would lil�e to exchange for Lot 7, Clearwater Industrial Park. They guarantee to in-
itially erect on the lot in the Industrial Park a Commercial Building with a minimum
of 5,000 square feet, within 30 days from exchange of deeds, with a reverter clause,
Commissioner Fields moved that the City accspt the offer of T�;r. Kirkland and Mr� Dean
as set ferth in their proposal and the proper ofiicials be authorized to execut;e it.

The City Manager presenred an Agreement, with A. Waller 5mith to purchase Lots

Park Street) far �arking lot, for �115,000, (�1,000 down yr14,000 on closin;,
balance at �10,00(, per year for 10 years plus !�p interestj. He reported that both
