CITY CO~~ISSION MEETING

The City Commission of the City of Clearwater met in regular session at the
City Hall, Monday, May 18, 1964 at 1:30 P.M., with the following members present:

The Mayor called the meeting to order. The invocation was given by Willis
Booth, Chief of Police. Conmissioner Insco moved not to approve the minutes of the
meeting of May 4th and that they be redone and rechecked on the matter of the Modica
lease according to the recording machine. Motion was seconded by Commissioner Turner
and carried unanimously.
The City Attorney read Resolution #6~-S7 commending Hank McWhorter for serving
as instructor for the 1964 Softball Coaches Clinic for the U. S. Army in Korea.
Commissioner Fields moved that Resolution #64-87 be adopted and the profer officials
be authorized to e~ecute it. Motion was seconded by Commissioner Turner and carried
unanimously. The Mayor presented a copy of the Resolution to Mr. McWhorter.
Commissioner Insco moved to deviate from the agenda to present a few items to
the Commission. Motion was seconded by Commissioner Turner and carried unanimously.
Commissioner Insco moved to appoint David Korones as City Prosecutor, effective
as of today, at the salary provided for in the budget. Motion was seconded by
Commissioner Fields and carried unanimously. Mr. Korones was present.
Commissioner Insco reported the City had considered hiring an additional at-
torney or law firm to continue the suit between the City or Clearwater and the County
Commission regarding the water contract. Commissioner Insco moved that the firm of
MacFarlane, Ferguson, Allison, and Kelly, of the City of Tampa, be retained as associ-
ate counsel in the suit of Bonsey et al versus the City o~ Clearwater which is
commonly known as the water suit, to assist in the appeal of this case to the Court
of Appeals in Lakeland and if necessary to pursue the matter in the State Supreme
Court at Tallahassee, at a fee not to exceed $3,500 in the appeal to Lakeland and an
additional $1,000 to appeal the case to the Supreme Court in Tallahassee. Motion
was seconded by Commissioner Turner and carried unanimously.

Commissioner Insco commented the City now has a well-nourished beach but he had
a growing concern as a layman about the Gulf bottom dredging either to the north or
south of Clearwater as to whether or not that could have an effect on the natural
seeding of the Cit-y's beach. Commissioner Insco moved that the Oity Engineer be in-
structed to contact the U. S. Army Corp~ of Engineers at once to find out whether or
not the City might be in danger with that type of dredging as far as its own beach
is concerned and see what its position should be. Motion was seconded by Commissioner
Smith and carried unanimously.
The Mayor announced a public hearing for the installation of sanitary sewers in
Del Oro Groves west of Bayshore Boulevard and Del Oro Estates. The City Engineer
reported the preliminary hearing was held December 8, -1963, with 27 people present,
and that of the 131 property owners involved, 26 were in favor, 68 opposed and 37
expressed no opinion. The estirnat ed cost was given at $3 .86 ~r front foot installed
in the street right of way. The City Engineer also reported that ef~luent had been
found in the storm sewers within the area. He stated the County Health Department
was to have a representative at the meeting but no one was present. In reply to a
question, the City Engineer estimated that the sewer would cost about 20% more if
installed in the easements as it would take one more line and that there was no
record of platted easements in Del Oro Groves. ~tr. Aldo Chambers and Mr. Hans W.
Heinrich spoke in objection to the project. Mr. C. E. Segrest objected, but if it
was approved requested that the sewers be installed in the easement. Mr. Obert
Ohatham, Mr. Chas. De Blaker and Mr. Frank Schuch spoke in favor. A letter from
Del Oro Groves Estates Association signed by 62 persons objected since most septic
tanks were functioning adequately, because installation should be made in the ease-
ments, and ~or other reasons. Written objections were also received from six other
property owners. The City Engineer said he could conduct a survey with dye to de-
termine how effluent was getting into the storm sewers. The Mayor recommended that
the public hearing be postponed and that the County Health Department be requested
to have a representative present at the next hearing. The City Clerk was asked to
check out the property owners' names on the petition of objection to see how many
are home owners and how many own vacant lots. Commissioner Fields moved that the
hearing be postponed until such time as the Engineer can come back with the report
and that the project be readvertised at a public hearing at a future date. Motion
was seconded by Commissioner Insco and carried unanimously.
The Mayor announced a public hearing on the appeal of Mr. H. H. Baskin, Sr.,
from the decision o~ the Board o~ Adjustment and Appeal on Zoning concerning request
for transfer and storage establishments and limited rabricating and manufacturing on
the follOWing property: Begin at SE corner of N. 756' of the W. 1/2 o~ SE l/4 of
SE 1/4, Section 21-29-15, run S. 140', SW'ly 156', NW'ly 280', SE'ly 305' to POB.

The City r.lanager recommended the low bid of' J. B. Clow & Sons, for 3600 :ft. of
S" cast iron water pipe. Commissioner Fields moved upon the joint recommendation of
the Asst. Purchasing Agent, concurred in by the City Manager that the contract ror
cast iron water pipe be awarded to J. B. Clow & Sons, Birmingham, Alabama, :for the
sum of $8,046, which is the lowest. and best responsible bid and that the appropriate
officials of the City be authorized to execute said contract which shall be in ac-
cordance 'With the plans and specifications and bid. 1-1otion was seconded by
Oommissioner Turner and carried unanimously.
The City Manager recom~ended the one bid received .from Rodgers Building Wreckers
to raze City-o~ned buildings: 1. Eldrid~e house, 134 N. Ft. Harrison Avenue, SW
cornerj 2. Lawn bowling clubhouse, S. Osceola Avenue; J. Home Demonstrat.ion Building,
S. Osceola Avenue; 4. DAV clubhouse, S. Osceola Avenue; 5. Belmont Clubhouse, 1525 S.
Greenwood Avenue. Commissioner Turner moved upon the joint recommendation of the
City Engineer and Asst. Purchasing Agent concurred in by the City Manager that the
contract ror razing the buildings as above enumerated be awarded to Rodgers Building
Wreckers ror the sum of $1,995, which is the lowest and best responsible bid and that
the appropriate officials of' the Cit.y be authorized to execute said contract 'Which
shall be in accordance with the plans and specifications and bid. Motion was seconded
by Commissioner Fields and carried unanimously.
The City Manager recommended the low bid of Hahn Contracting Company, :for the
relocation of gas main extension on Drew Street.. Commissioner Fields moved upon the
joint recommendation of the City En~ineer and Asst. Purchasing Agent, concurred therein
by the City Manager, that the contract for Drew Street gas main relocation be awarded
to Hahn Contracting Company, Orlando, for the sum of ~9,099.00, which is the lowest
and best responsible bid and that the appropriate officials of the City be authorized
to execute said contract which shall be in accordance with the plans and speci.fications
and bid, 'With a t.ime limit of 40 days. I.lotion was seconded by Commissioner Turner and
carried unanimously.
The City Nanager recommended the low bid of Kenneth W. Moore, Inc., :for gas main
extension to Coachman Road for the Junior College and two proposed motels on U. S.
Highway 19 and Gulf to Bay Blvd. Corrunissioner Turner moved upon the joint recommen-
dation of the City Engineer and Asst. Purchasin~ Agent t concurred in by the City
Manager, that the contract for Gas Main Extension - Coachman Road, be awarded to
Kenneth W. Moore, Inc., Tampa, for ~he sum of $16,357.50, which is the lowest and best
responsible bid and that the appropriat.e officials of the City be aut.horized to e:>cecute
said contract 'Which shall be in accordance with the plans and specifications and bid,
time limit of 30 days. Motion was seconded by Commissioner Fields and carried unani-
mously.
The City Manager recommended the 10'W bid of Interbay Corporation ror the removal
of concrete at the new City Hall site (lots J, 4, 5, Block A, J. R. Davey Subdivision).
Commissioner Turner moved upon the joint recommendation of the City Engineer and the
Asst. Purchasing Agent concurred in by the City 1.1anager that the contract, 'With a time
limit of 15 days, ror removal of concrete at the new City Hall site be awarded to
Interbay Oorporation, Dunedin, for the sum of $;2,600 'Which is the lowest and best re-
sponsible bid and that the appropriate orficials or the City be authorized to execute
said contract which shall be in accordance with the plans and specifications and bid.
Motion 'Was seconded by Commissioner Fields and carried unanimously.
The Oity Manager reported that on March 16, 1964, the City Commission had adopted
Resolution #6~-54 vacating the West 180 ft. of a 20 ft. alley in Block B, Hibiscus
Gardens Subdivision, upon request of Clearwater Federal Savings and Loan Association
and Mildred H. Center, OWners o.f the property on both sides. Mr. W. J. Lang, operator
of the Spic 'N Span Laundry, 1249 Oleveland Street, (tenant of Clearwater Federal
Savings) objected to the alley closing and asked the Commission to reconsider its
action. Mr. Ralph Richards, representing Clearwater Federal Savings, stated that he
had assured Mr. Lang that his customers would be given an exit from his place of
business. The City Attorney asked if the bank would indemnify the City against any
lawsuit, and Mr. Richards agreed that it would. After listening to this request for
reconsideration and having heard much legal discourse relative to the City's position
on it, Commissioner Smith moved that this Board's action be sustained as voted on
previously and to dispose of it at this particular time until any further requests
should confront the Board. Motion was seconded by Commissioner Turner and carried
unanimously.
The City Manager presented a request of Rivers Advertising Company for a com-
mercial advertising sign on W. H. Phillips property on Gulf to Bay Blvd., East of
Kilmer Avenue, advertising Phillips Motel. The Planning & Zoning Board recommended
approval. Commissioner Turner moved that the request be granted. Motion was sec-
onded by Commissioner Fields and carried unanimously.

The City Manager presented a request of Sunad, Inc., for a commercial adver-
tising sign on Lot 2, Baskins Raplat, advertis:l.ng Massey Andrews Plymouth Inc. The
Planning & Zoning Board recommended approval. Commissioner Fields moved that the
request be granted. Motion was seconded by Commissioner Turner and carried unani-
mously.
The City Manager presented for approval plans for Belmont Trailer Park Addition,
located in the vicinity of Belleair Blvd. and Ewing Avenue, which had been approved
by the Engineering Dept. and the Planning & Zoning Board. Commissioner Fields moved
that the request be approved as recommended. Motion was seconded by Commissioner
Turner and carried unanimously.

The City Manager presented for approval plans from the Sun Oil Company for a
new service station on the Southeast corner of Crest and Gulf to Bay Blvd., which
have been approved by the Planning & Zoning Board and the Oity Engineer, with minor
driveway changes which have been noted on the plans. Commissioner Turner moved that
the request be granted, with changes as noted. Motion was seconded by Commissioner
Fields and carried unanimously.
The City Manager presented a copy of recommended changes to Civil Service rules
pertaining to employees' vacations, which clarified certain details as to longevity
vacations, etc. Commissioner Smith moved that the changes be approved. Motion was
seconded by Commissioner Turner and carried unanimously.
The City Manager recommended approval of Change Order ~3, for the Clearwater
East Interceptor sewers, Phase 2, increasing the contract with Paul Giuliani Co., Inc.,
by $11,71$.28. Commissioner Turner moved that the final Change Order on Clearwater
East Interceptor contract be approved as recommended by the City Manager and that the
proper officials be authorized to execute it. Motion was seconded by Commissioner
Fields and carried unanimously.
Resolution #64-88 was presented authorizing payment or $~a.oo to Pinellas County
Title Company for services in connection with Drew Street project, from Construction
Trust Fund, Utilities Tax Improvement Certificates, Series of 1960. Commissioner
Smith moved that Resolution 1/64-Sg be adopted and that the appropriate officials be
authorized to execute it. l,~otion was seconded by Commissioner Fields and carried
unanimously.
The City Attorr.ey read in full on its first reading Ordinance #1013 annexing
part of Section 19-29-16 (BBCC Inc.) and part of Section 14-29-15 (Live Oak Estates).

Commissioner Turner moved Ordinance #1015 be read and considered on its third

The City Attorney presented for approval Agreement for Purchase of rieht of way

proper ofricials be authorized to execute it. Motion was seconded by Commissioner
Turner and carried unanimously.
The City Attorney presented for approval Agreement for Purchase of right of way
for Myrtle Avenue Extension, from Otho Turner for $950.00 .for part of Section 10-29-15.
Commissioner Fields moved that the contract be approved and the proper officials be
authorized to e~ecute it. Motion was seconded by Commissioner Turner and carried
unanimously.
Resolution #64-$9 was presented authorizing payment o.f $404.33 to Edmond N.
MacCollin, Architect, for services in connection with Fire Station No.2, Clearwater
Beach, from Construction Trust Fund, Utilities Tax Improvement Certificates, Series
of 1962. Commiss ioner Fields moved Resolut ion /164-89 be ado pted and that the proper
officials be authorized to execute it. Notion was seconded by Commissioner Turner and
carried unanimously.
The City Attorney read a proposed resolution addressed to the Pinellas County
Commission asking a rebate in County road tax money to the City. Several amendments
were suggested by the Commission which were noted by the City Attorney. By consent,
it was decided to defer the resolution to anot.her meeting.
Resolution #64-90 was presented authorizing the Mayor and City Clerk to file with
the Pinellas County Clerk's office a copy of a map showing a municipal right of way
across property located in Government Lot 4, Section 16-29-16, together with a stat e-
ment that the title to the right of way has vested in the City according to Chapter
337.31, Florida Statutes, 1963. Commissioner Turner moved that Resolution #64--90 be
adopted and that the appropriate officials be authorized to execute it. 1.~otion was
seconded by Commissioner Fields and carried unanimously.
Resolution #64-91 was presen~ed authorizing payment of $1,$00.00 to West Coast
Engineering Corp., Engineers, for survey in connection with North Myrtle Avenue, and
Douglas Avenue Extension from Construction Trust Fund, Utilities Tax Improvement
Certificates, Series of 1962. Commissioner Fields moved Resolution #64-91 be adopted
and that the proper officials be authorized to execute it. Motion was seconded by
Commissioner Smith and carried unanimously.
Resolution #64-92 was presented requesting 57 property o~ners to clean their lots
of weeds and undergrowth. Commissioner Fields moved that Resolution #64-92 be adopted
and that the appropriate officials be authorized to execu~e it. Motion was seconded
by Oommissioner Turner and carried unanimously.
The City Attorney recommended that the City 1;1anager be authorized to have an
appraisal o~ the property still needed for Myrtle Avenue extension. Commissioner
Fields moved the City Manager be authorized to secure the appraisal. Motion was sec-
onded by Commissioner Turner and carried unanimously.
IfLr. Joseph Fletcher, representing the Clearwater Beach Resort Association ~hich
has over 50 members spok€ about the parking problem on Clearwater Beach. He said his
group suggested placing a 2 hour time limit on parkin~ spaces in all lots and streets
adjoinin~ public beach and provide strict enforcement on specified Sundays and holidays
except where longer or shorter periods are indicated by need or experience. The Mayor
asked Mr. Fletcher if he would present this suggestion from his group in the form or
a resolution for the Commission to study. Mr. Harry Shepard, Clearwater Beach resident,
spoke in favor of having parking meters restored in certain areas to solve the parking
problem.
Mr. Stanley Jones of Jones~~ahoney Corp., Tampa, contractor ror the incinerator
building, asked for final payment of approximately $7$,000 due after certificate of
final completion was issued on April 29, 1964. It was explained the City was not
completely satisfied with the operation of the plant as there were complaints of smoke
and soot from citizens in the area. After discussion, the Mayor recommended a payment
of not over $3$,000 be made. Mr. George K. Arrnes was present representing Briley,
Wild & Associates, Consulting Engineers. The r.1ayor suggested that a representative
from Plibrico Company, Chicago, Illinois, be requested to come here as soon as possible
to check the operation of the process equipment. Commissioner Fields moved to approve
a payment to Jones-Mahoney Corp. in an amount not to exceed $3$,000. Motion was sec-
onded by Commissioner Smith and carried unanimously.
The City Commission now adjourned as the City Commission and acting as Trustees
or the Pension Fund heard letters read from the Advisory Committee recommending that
Clarence Baird, laborer, Garage Division; Robert C. Miller, Laborer, Parks & Recreation
Dept., Parks Division; Charles J. Callaghan, Patrolman, Police Dept., Lloyd E. Anderson,
Pat~olman, Police Dept.; Richard I. Sheldon, Attendant, Utilities Dept., Sewage

The PZayar called the meeting to order, The invocation t��as given by Willis
Booth, Chief of Police, Gommissioner Insco moved not to approve the minutes o£ the
meeting of I�Iay 4th and that they be redone and rechecked on the matter of the Modica
lease according to the recording machine. I��otion was seconded by Gommzssioner Turner
and carried unanimousiy,
The City Attorney read Hesolution �6l�-$7 commendin� Hank McWhorter for servry.ng
as instructor for the 1964 Softball Coaches Clinic for the U. S. Army in Korea.
Commissir�ner Fields moved that Resolution �6�.-$7 be adopted and the proFer officials
be authorized to exe�ut e ita Motion was seconded by Commissioner Turner and carried
unanimously. The T�ayor presented a copy of the Resalution to I4r. McWhorter.
Commissioner Insco moved to deviate from the agenda tb present a few items to
the Commission. I�'Iotion was seconded by Commissioner Turner and carried unanimously.
Commissioner Insco moved �to appoint David Korones as City Prosecutor, effective
as of today, at the salary provided for in the budget. I+Totion was seconded by
Commissioner Fields and carried unanimously. P�Ir. Korones was presen'�.
Commis�ioner Insco reported the City had considered hiring an additional at-
torney or law firm to continue the suit between the City of Clearwater and the County
Commission regarding tlie water contract. Commissioner Insco nroved that �he firm of
MacFarl�ne, Ferguson, Allison, and Kelly, of the City of Tampa, be retained as associ-
ate counsel in the suit of Bonsey et al versus the City of Clearwater which is
commonly known as the water suit, to assist in the appeal of this case ta the Court
of A.�peals in Lakeland and if necessary to pursue the matter in the State Supreme
Court at Tallahassee, at a iee not to e�:ceecl �3,500 in tha appeal to I,akeland and an
additional �1,000 to appeal the case to the Supreme Court in Tallahassee. R4otion
was seconded by Commissioner Turner and carried unanimously.
Com.missioner Tnsco commented the City now has a well-nourished beach but he had
a growing concern as a layman aUout the Gulf bottom drzdging either to the north or
south of Clearwater as to whether or not that could have an effect on the natural
seeding of the City�s beach. Commissioner Insco moved that the City Engineer be in-
struc�ed to contact the U. S. Army Corps of Engineers at once to £ind ou� whether or
not the City might be in danger with that type of dredging as far as its own beach
is concerned and see what its posit?on should be. Notion was seconded by Commissioner
Smith and carried unanimously.
The Iti'fayor announced a public hearzng for the installation of sanitary sewers in
Del Oro Groves west of Bayshore Boulev,�?rd and Del Oro Estates. The City �ngineer
reportsd the preliminary hearing was held December $,�1963, with 27 peo��le present,
and that of the 131 property owners involved, 26 were in favor, 6$ opposed and 3'7
expressed no opinion. Th� estimated cost was given at �3.$6 per front foot installed
in the street right of way. T:�e City Engineer also reported that effluent had been
