The City Commission of the City of Clearwater met in special session at the
City Hall, Monday, March 30, 1964 at 1:30 P.M., with the following members present:

The Mayor called the meeting to order. The invocation was given by the City
Attorney. The Mayor announced that the purpose of the special meeting was to hold
a public hearing to consider various zoning map changes and zoning ordinance changes.
Item #1 was the request of Emil J. Metz for the North 100 rt. of S. 300 ft.
of E. la8.93 ft. of E 1(2 of W 1/2 of SW 1/4 of SW 1/4, Section 12-29-15 to be
changed from R.1E and R-2 to B (Business). Lloyd Phillips, Attorney, representing
Mr. Metz, spoke in detail explaining the request and stated that the Board of
Adjustment had no Authority to grant the variance, regardless of court order.
John R. Bonner, Attorney, representative of the property owners in the vicinity,
quoted from the Judge's decision and filed a petition opposing the request. Mr.
Kenneth Walters and Mr. Thomas Raines spoke in opposition. Commissioner Smith
moved that the request of Emil J. Metz, for rezoning of the above described property
be denied. Motion was seconded by Commissioner Turner and carried unanimously.
Item #2 - The Clerk read a letter from Mr. A. E. Mann, withdrawing his request
for Govt. Lot 2 in the SW 1/4 of the NW 1/4, Section 10-29-16 and that part of the
SE 1/4 of NE 1/4 east of Bayshore Blvd. (County Road 30) in Section 9-29-16 be
changed from R-1E to B (Business). Commissioner Insco moved that the letter be
received and made a part of the record and the ~ithdrawal be granted. Motion was
seconded by Commissioner Fields and carried unanimously.
Item #3 was the request of Clearwater Medical Arts, Inc. to change from R-~ to
FRS the following property: Begin 1374.07 ft. East and 33 ft. South of NW corner
of Sec. 23-29-15, run th E 660.11 ft., S 209.38 ft., W 33 ft., S 12.69 ft., W 627.63
ft., ~ 222.04 ft. to POB. Fred Wilder, Attorney, represented Clearwater Medical
Arts, Inc., and spoke in favor or the request. There were no objections.
Commissioner Smith moved that the request of Clearwater Medical Arts, Inc., to
change the above described property from R-4 to PRS be granted. Motion was seconded
by Commissioner Fields and carried unanimously.
Item #4 was the request of D. A. Salls, ror the N 330 ft. of W 1/2 of SE 1/4
of SW 1/4 less Streets, Sec. 14-29-15, to be changed from R-lE to R-4 (Multi-family).
James A. Baxter, Attorney, represented Mr. Salls and explained the request in detail.
Mrs. Tersa Platana, Mrs. Gladys Morgan and Mrs. Gladys Pinder spoke in opposition
to the change of zoning. The Clerk read a letter of objection from Mr. James A.
Smith, 1470 Jasmine Way. Commissioner Fields moved that the request of D. A. Salls
for the above described property to be changed from R-1E to R-4 be denied. Motion
~as seconded by Commissioner Smith and carried unanimously.
Item #5 was the request of Mario Di Meo for the N 125 ft. of Lot 1, Elk 23,
Magnolia Park Sub., to be changed from R-2 to R-~ (Multi-familyl Mrs. Dick K. G.
Martin, 1430 Rose St., part owner of the property explained that it was now a garage
with apartment upstairs and they wished to convert the garages into an apartment.
Mrs. Frank Delamater, 605 Prospect St., spoke in objection to the request. The
Clerk read a letter of no objection from Mr. J. F. Kelly. Commissioner Turner moved
that the request or Mario Di Meo for the above described property to be changed from
R-2 to R-4 be denied. Motion was seconded by Commissioner Fields and carried unani-
mously.
Item #6 was the recommendation of the Planning and Zoning Board for Lots 13 to
16, incl., Block 17; Lots 1 to 4 and 13 to 16, incl. Block 22, and Lots 1-4 and 13
to 16 incl. Blk 25, Magnolia Park Sub. be changed rrom R-4 and R-2 to PRS (Prof. &
Related Services). H. H. Baskin, Jr., Attorney, represented Mary Dudley, owner of
property in Block 22, Magnolia Park, and asked for B (Business) but approving PRS.
Mr. Frank E. Photiadis spoke in favor of B (Business) also. Mrs. Frank Smith, BOB
E. Turner Street, spoke in objection to PRS. Mr. Carl Anderson, a05 Pine Street,
did not object to PRS. Mr. G. G. Bergeson questioned whether the change of zoning
would affect taxes. Mrs. Elma Scaff spoke in favor of PRS and asked Mrs. Dudley'S
property be PRS also. John Bonner, Attorney, representing Nick Sagonias, spoke
requesting PRS in accord with good planning. Commissioner Turner moved upon the
recommendation of the Flanning and Zoning Board that the above described property
be changed from R-~ and R-2 to PRS. Motion ~as seconded by Commissioner Smith and
carried unanimously.
Item #7 was the request o~ R. J. Henderson, et al, for Lots 15 to ~, incl.,
Block 24, Marymont Sub. to be changed from R-4 to B (Business). Mrs. Henderson
asked if there was opposition and stated they wanted a fair chance to sell their
property. Mr. J. Jannelli also requested B (Business) zoning for the property.

request. Maurice Coleman, Realtor, 1915 Drew Street spoke in favor of the change
to B (Business). Commissioner Insco moved upon the recommendation of the Planning
and Zoning Board tho request of R. J. Henierson, et al, for the above described
property to be chang ad from R-4 to B be denied. Moti on was seco nded by
Commissioner Smith and carried unanimously.

changed ~rom R-1E to R-4 (Multi-family). Lloyd Phillips, Attorney, representing
Leon Shankman, et al, explained the request. in detail. Mr. Dennis Dubois, 1826
Pine Street, ~r. Michael Connelly, 526 BrookSide, Mrs. Molner, who is building on
Lot 36, Hollingsworth Estates, am Mr. Leo Kotraschek, 604 Brookside Drive, spoke
In opposition. The Clerk read two letters of objection, one from James H. Coomes,
1840 Pine Street, and one from John Horrochs, 520 Bruokside Drive. Commissioner
Fields moved that the request of Leon Shankman, et al, for the above described
property to be changed .from R-1E to R-4 be denied. Moti on was seconded by
Commissioner Ins co. Upon the vot e being taken Mayor Weatherly and COfliJlissioners
Fields ani. Insco voted "Aye". Conunissioners Turner and Smith voted "No". Motion
carried.

M (Manufacturing to B (Business) the follo~ing property: Lots 3 to 7, incl.,
Blk B, Norwood Sub., all of F. Bruhn:: Sub.; all of Block 5, Linm In Place; all
John Williams Sub., all or Block A, Palm Park Sub. and M&B described lard between
John \\Tilliams Sub. an d Block A, Palm Park Sub. Mr. Herbert Coburn, owner of a
light assembly plant in the area, spoke in opposition. Mr. Albert T. Smith, Mrs.
Dai&y Edwards, Mr. Charle s E. Logan, and rlir. O. Z. Wilson spoke in .favor of the
change. Conmissioner Insco moved that the recommendation of the Planning & Zoning
Board to change the a bove described property from I>1 to B be grant ed. Motion was
seconded by Conmissioner Field s and carried unan imous1y.
Item #11 ~as the recommendation of the Planning & Zoning Board to Amend
Section 26-5C by adding paragraph to permit continuation of nonconforming restric-
tions in existing Mobile Horne Parks. There were no objections. Mr. Bob Hilleboe
spoke stating that he had contncted all Mobile Park O~ner5 in the area and they
were in favor of Items 11, 12, 13, 14, 15, and 16. Commissioner Turner moved that
the recommendation or the Planning & Zoning Board as described above be approved.
Motion was seconded by Commissioner Insco and carried unanimously.
Item #12 was the recommendation of the Planning & Zoning Board for the W 1/3
of E 3/5 o:f NE 1/4 of NW 1/4 of NW 1/4 less a/w, Section 27-29-15, known as Belmont
Trailer Park, be changed from B to MH (Mobile Home Park). There were no objections.
Commissioner Turner moved that the recommendation of the Planning & Zoning Board be
granted. Motion ~as seconded by Commissioner Fields and carried unanimously.
Item #13 was the reco~nendation of the Planning & Zoning Board that the
E 195 ft. MOL of NW 1/4 of NE 1/4 of SE 1/4 less N 330 ft. thereof, Section 13-29-15,
known as Clearwater Trailer Park, be changed from R-1E to MH (Mobile Home Park).
There were no objections. Commissioner Turner moved that the request to rezone the
above described property be approved as recommended by the Planning & Zoning Board.
Motion ~as seconded by Commissioner Fields and carried unanimously.
Item #14 was the recommendation of the Planning & Zoning Board that the
E 200 ft. of W 1180 ft. of SW 1/4 of NE 1/4 less S 330 ft. and SW 1/4 of NE 1/4
less W 1180 ft. and less S 330 ft. Sec. 17-29-16, known as Glen Ellen Mobile Home
Court, be changed from R-IE to MH (Mobile Horne Park). There were no objections.
Commissioner Turner moved that the request to rezone the above described property
as recommended by the Planning & Zoning Board be granted. Motion was seconded by
Commissioner Fields and carried unanimously.
Item #15 was the recommendation of the Plannin~ ~ Zoning Board that the E 1/2
o~ ~ 1/2 of NE l/~ of SE 1/4 less N 330 ft. and S li2 of NE 1/4 of SE l/~, Sec.
13-29-15 less roads, known as Lakeside Trailer Park, be changed from R-M and R-lE
to MH (Mobile Home Park). There were no objections. Commissioner Turner moved
that the request to rezone the above described property, as recommended by the
Planning & Zoning Board be granted. Motion was seconded by Commissioner Fields
and carried unanimously.
Item #16 was the recommendation or the Planning & Zoning Board for Lot 9,
F. E. Hanouseks Sub., less E 75 ft. of S 100 ~t. & less streets, known as Plaza
Pines Trailer Park, be changed from R-1E to MH (Mobile Home Park). There were no
objections. Commissioner Turner moved that the request to rezone the above described
property be granted as recommended by the Planning & Zoning Board. Motion was sec-
onded by Commissioner Fields and carried unanimously.

207 & 208, Morningside Estates Unit 1, to be changed from R-ID to P (Public) to
permit establishment of a Eire station. There were no objections. Commissioner
Turner moved that the request to rezone the above described property be granted as
recommended by the Planning & Zoning Board. Motion was seconded by Commissioner
Fields and carried unanimously.
Item #lg was the recommendation of Wm. G. Blackburn to Amend Section 26-11 (7)
SChedule, to change R-1C rear setback to 15 ft., R-1D rear setback to 10 ft. and
side street setback for R-IC and R-1D to 20 ft. on corner lots. The Planning &
Zoning Board recommended approval of the requested rear setbacks and disapproved
of the side street setbacks. There were no objections. Commissioner Insco moved
that the recommendation of the Planning & Zoning Board be approved. Motion ~as
seconded by Commissioner Fields and carried unanimously.
Item #19 was the recommendation of the Planning & Zoning Board to Amend
Sections 26-4 (3) R-l District, 26-5A (3) R-2 District and 26-5A (11) R-4 District
to allow model homes as permitted use therein as provided 1n Section 26-17, Board
of Adjustment and Appeal. There were no objections. Commissioner Turner moved
that the change be granted as recommended by the Planning & Zoning Board. Motion
was seconded by Commissioner Fields and carried unanimously.
Item #20 ~as the recommendation of the Planning & Zoning Board to Amend
Section 26-17 (5) (a) (9) (b) pertaining to model homes allowable as special ex-
ception by Board of Adjustment & Appeal on Zoning. There were no objections.
Commissioner Turner moved that the change be granted as recommended by the Planning
& Zoning Board. Motion was seconded by Commissioner Insco and carried unanimously.
Item #21 ~as the recommendation of the Planning & Zoning Board to Add Section
26-17 (5) (a) (10) to provide that building of~icial may allow model homes in sub-
divisions 1ess than 3 years old subject to certain requirements. There ~ere no
objections. Commissioner Turner moved that the change be granted as recommended
by the Planning & Zoning Board. Motion was seconded by Commissioner Fields and
carried unanimously.
Item #22 was the recommendation of the Planning & Zoning Board Adding Section
26-5F establiShing a Parkway Business Use District Classification and setting forth
permitted uses and regulations in connection therewith. There were no objections.
Commissioner Smith moved that request be granted as recommended by the Planning &
Zoning Board. Motion was seconded by Commissioner Fields and carried unanimously.
Item #23 was the recommendation of the Planning & Zoning Board to Amend
Section 26-11 (7) pertaining to summary schedule o~ lot and building regulations
to include respective requirements for MH, PHS, PKB, SC(A), SC(B), HB, and Muse
district classifications. There were no objections. Commissioner Turner moved
that the above described request be granted as recommended by the Planning & Zoning
Board. Motion ~as seconded by Commissioner Fields and carried unanimously.
Jl.1r. Jack Wolle, City Planner, briefly outlined and explained the suggested
amendments contained in Items #24 through 37, which included the following:
Item #24 Amending Section 26-2, Definitions, by adding thereto definitions of
the following: Townhouse Structure, Townhouse Structure-Site Development Plan and
Townhouse Subdivision Plan.
Item #25 Amending certain Sections to allow Town Houses as permitted uses in
R-4, R-M, PRS, B, HB and M use district classifications subject to certain require-
ments.
Item #26 Establishing requirements and regulations for To~n Houses in R-4, R-M,
PRS, B, HB and M use district classifications.
Item #27 Repeal in its entirety Section 26-8 UZ use district classification.
Item #2g Amend Section 26-3 pertaining to use district classifications to
reflect new use district classifications which have been added and old use district
classifications ~hich have been deleted.
Item #29 Amend Section 26-2 Definitions (18) Home Occupation, by deleting the
words "or other service performed" from said definition.
Item #30 Amend Section 26-2 Definitions (24) Motel, by deleting the words
"which building is not more than two stories in height" from said definition.
Item #31 Amend Section 26-5A (3) R-4 District by deleting the words "elemen-
tary and high" and adding in place thereof the words "not including trade or business
schools".
Item ff32 Amend Section 26-10 pertaining to Nonconforming uses for the purpose
of clarification thereof.
Item 133 Amend Section 26-11 (6) to permit fences and walls to 6 ft. in height
as prescribed.
Item 134 Amend Section 26-11 (7) Schedule, and Section 26-11 (9) by establish-
ing,and clarifying lot and building regulations in R-M use districts.

Item #35 Amend Sections 26-5A (3) R-4 use district and Section 26-11 (7)
Schedule, by providing for minimum size site for Churches.
Item U36 Revise Section 26-6 Business Use District ClaBsification by adding
list of permitted uses & special exceptions & add said special exceptions to Section
26-17, Board of Adjustment & Appeal on Zoning.
Item #37 Add Section to establish a Heavy Business Use District Classification
& setting forth permitted uses & special exceptions & adding said special exceptions
to Section 26-17, Board of Adjustment & Appeal on Zoning.
There ~ere no objections. Commissioner Turner moved Items 124 through #37 as recom-
mended by the Planning & Zoning Board be approved. Motion was seconded by
Commissioner Fields and carried unanimously.
Commissioner Insco moved that the City Attorney and other appropriate City
officials be instructed to prepare an ordinance incorporating all the changes that
have been approved here this afternoon and bring back to this Board at an early date
for their consideration and approval, and further that the zoning maps be changed in
accordance ~ith the items approved here affecting the zoning map changes and that
the ordinance make mention of the changes in the zoning map in the usual fo~.
Motion was seconded by Commissioner Fields and carried unanimously.
The City Manager read a letter of resignation ~rom Charles Barber as City
Prosecutor, efrective March 27th, 1964. Commissioner Insco moved that the letter
be accepted with regret. Motion was seconded by Commissioner Turner and carried
unanimously.
The Mayor suggested that the Legal Department be instructed to handle prose-
cutions to the best of their ab~lity until a successor has been named. Commissioner
Turner moved that the Mayor'S suggestion be approved. Motion was seconded by
Commissioner Insco and carried unanimously.
There being no further business the meeting adjourned at 5:27 P.M.
