Commissioner Smith moved to deviate from the apenda. Motion was seconded by Commissioner Insco and carried unanimous]y. The City Attorney said he would inform the Pinellas County lerislative delegation. The City Kanaper announced the public hearin~ on pavin~, widening, curbing and replacing sanitary sewer in Grove Street, Missouri Avenue to Betty Lane. The City Engineer explained at the preliminary 11earinr the costs were estimate~ at $3.07 per front foot for the property owners and $3.78 Der front foot for the C1ty; the prop- erty owners to pay for curbin9. and \.Jideninp, only, except the tlrJO property miners who have never harl sanitary sewer service will be charped an additional $3.98 per front foot for the sanitary sewer. The City Manapcr read a petition sipned by 15 property owners, objecting to the improvements unless pArkinp is limited to two hours on Grove Street from Missouri to Bettv Lane, from 8:00 A.M. to 6:00 P.M., Monday through friday and unless the contract as a~arded is no more t~an 5% hirher than the City Engineer's estimate. Mrs. Ed Kramer, Mr. D. C. Turner and Mr. Ai Vasconi spoke in favor of the project. Mr. W. S. Shannon s~oke about the proximity of ~eneral Telephone Company and the fact that its employees are parkinp in these l)locks on Grove Street. Commissioner Insco sUggested the parkinr problem be referred to the Police Department for control. Commissioner Turner moved that the City Manaper and the City Enrineer be instructed to proceed with the project of pavinp Grove Street from Missouri Avenue to Betty Lane, after a public hearinp in Vlhich no valid objections, to the project, were heard. Motion was seconded by Commissioner Fields and carried unanimously. The City Manager recommended the bid of Pan American Linen Service, Tampa, for furnishing uniform service to the following divisions of the Utilities Department: Service Division, Meter Readers, Gas Division, Water Division, Sewer Plants, Refuse Division. Commissioner Turner moved upon the joint recommendation of the Utilities Manaper and Asst. Purchasin~ Arent, concurred in by the City Manaper that the lowest bid in the total yearly amount of $10,843.92 submitted by Pan-American Linen Service, Inc., Tampa, be accepted which is the lowest and best responsible bid and that the appropriate officials of the City be authorized to execute said contract which shall be in accordance with plans, specifications and bid and further that the City employees shall pay 75~ per week as their share of the cost for the uniforms. Motion was second- ed by Commissioner Fields and carried unanimOUSly. The City Manager recommended the bid of Fountain Fire Equipment Co., Tampa, for 500 ft. 2-1/2" fire hose and 500 ft. 1-1/2" fire hose. Commissioner Fields moved upon the joint recommendation oJ the Fire Chief and Asst. Purchasing Agent concurred in by the City Manager that the contract for fire hose be awarded to Fountain Fire Equipment Co. for the sum of $985.00 with 2% discount, which is the lowest and best responsible bid, and that the appropriate officials of the City be authorized to execute said contract which shall be in accordance with the plans, specifications and bid, with additional foota~e of hose to be nurchased up to the amount of appropria- tion. 1'1otion was seconded by Commiss ioner Turner and carried unanimously. The City Manager recommended the bid of Truck Lquipment Inc., for one vacuum type pavement cleaner for Public Works Department. Commissioner Turner moved upon the joint recommendation of the Public Works Superintendent and Asst. Purchasing Agent, concurred in by the City Manager that the contract for pavement cleaner be awarded to Truck Equipment Inc., Lakeland, for the sum of $9,595.00 which is the lowest and best responsible bid, and that the appropriate officials of the City be authorized to ex- ecute said contract which shall be in accordance y/ith the plans, specifications and bid. Motion was seconded by Commissioner Fields and carried unanimOUSly. The City Manager recommended the bid of McWane Cast Iron Pipe Co., for 3600 ft, of 8" cast iron pipe for Utilities Department, Water Division, Commissioner Turner moved upon the joint recommendation of the Utilities t1anager, Water Superintendent and Asst, Purchasing Agent, concurred in by the City Manager that the contract for cast iron pipe be awarded to McWane Cast Iron Pipe Co., Birmingham, Ala., for the sum of $6,732,00 which is the lowest and best responsible bid and that the appropriate ...,.....,. ., ',.' Mr. Georpe Routh, Attorney, representinr Clearwater Flyinr Company, stated if there were any specific actions, in the opl'!ration of the Airpark, which were causinp, a nuisance, the Company vlould be r,lad to cooperate with the City in e1imi~atinp' these practices. f'1r. It was the opinion of the Commissioners that they did not wish to act on the matter until it was determined in the court if the Clearwater flyinp Company Ilad a valid lease with the City. The City l1anarer reported that one of the rarbar.e trucks needed repairs, caused by normal vlear and tear. The es timatec1 cost for repairs is $685.10 and permission to have the work done under the emerrency clause was requested. Commissioner Smith moved the request be Eranted for the vlOrk to be done. Motion was seconded by Commissioner Insco and carried unanimously. ^ request from Lester Bernard, Dock Attendant II, Marine Division, was presented for 12 days' additional sick leave which had been approved by the Civil Service Board. The City Hanaper recommended Item 9, fIOrd. 1J9G3 - Intent to Anne~ Portion of Sec. 14-29-15 - Sam Davis (Jeffords & Hillcrest)" be deleted because the legal description has not been worked out. The City Attorney presented for approval the followine two easements needed in connection with Clearwater East Interceptor Sewer Line from M. Lester Harn: one tem- porary and one permament in Lots 25, 26 E 27, HE 1/4\ Lots 29, 30, 31 & 32, NW 1/4; Lots 1, 2. 3 G 4 SW 1/4; Lots 7 E 8, SE 1/4, Pinellas Groves, Sec. 19-29-16. Commissioner Turner moved to accept the two easements for the Clearwater East Interceptor Sewer Line. Motion was seconded by Commissioner Fields and carried unanimously. Resolution #63-23 was presented authorizing payment of $20.00 to Pinellas County Title Co. for abstract of title to property of Emil Weber and Florida Power Corp., from Construction Trust J'und, Utility Revenue Certificates, 1962. Commissioner Fields moved that Resolution #63-23 be adopted and that the proper officials be authorized to execute it. Motion was seconded by Commissioner Turner and carried unanimously. ,The City Attorney read a letter fT'om Mr. Roy C. Gurley stating that for health reasons he is forced to dispose of his leasehold interest in Rooms 2 and 2A, Marina Building, being used for a boat sales and brokerage office and marine hardwaT'c sales. The City Manager recommended approval of assignment of the lease to E. L. Richards. Commissioner Smith moved to approve transfer of the lease to E. L. Richards and that the proper officials be authorized to execute consent to assignment. Motion was sec- onded by Commissioner Fields and carried unanimOUSly. Resolution 1J63-24 was presented authorizinp payment of $2,811.95 to Briley, Wild & Associates, Consultinr. Engineers, for eneineerinp, services in connection with Beach Water Mains and certain work items from Construction Trust fund, Utility Revenue Certificates, 1962. Commissioner Turner moved that Resolution "63-2~ be adopted and that the Drooer officials be authorized to execute it. Motion was seconded by Commissioner" Fields and carried unanimously. Resolution #63-25 was presented authorizinp. payment of $178.66 to J. E. Greiner Co., Consulting Engineers. from Construction Trust Fund, Bridge Revenue Bonds, for services in connection with Clearwater Pass ilridp,e. Commissioner Fields moved that Resolution #63-25 be adopted and that the proper officials be authorized to execute it. Motion was seconded by Commissioner Turner and carried unanimously. The City Attorney recommended the appointment of Hr. Norris Gould, the present City Prosecutor. as an Assistant City Attorney at a salary of $400.00 per month to serve at the pleasure of the City Commission. Commissioner Fields moved the City Attorney's recommendation be approved. Motion was seconded by Commissioner Turner and carried unanimOUSly. For the vacancy created ~n the position of City Prosecutor. the City Attorney recommended Mr. Charles Barber, Attorney. Commissioner Insco moved that Charles Barber be appointed as City Prosecutor at the same salary as received by his pred- ecessor and that he serve at the pleasure of the Commission. CITY COMMISSION MEETING March 18, 1963 The City Attorney reported that he had received a letter from Mr. John Bonner, Attorney, offering to assist the City in defending the suit of Emil J. Metz et ux vs. the City concerninr. zoning of property in Section 12-29-15. He explained that Mr. Bonner would receive no fee and that he would incur no expense in connection with the suit without prior approval of the Legal Department. Commissioner Smith moved to proceed along those lines ~s stipulated by the City Attorney. Motion was seconded by Commissioner Turner and carried unanimously. Mr. Leonard C. Merrell complained of a situation at the northeast corner of Mandalay and Bay Esplanade statinr, it is difficult to turn, due to the narrowness of the street as a result of the sidewalk on Mandalay projecting into Bay Esplanade. The Mayor recommended he discuss the problem with the City Manager. Mr. Arthur Kruse speaking for the Clearwater Beach Association stated a letter had been written to the City Manager and the City Commission requesting a traffic and parking survey be made and asked if the City Mananer would need authority from the City Commission to instruct the parking authority to have that survey prepared. The Hayor said the City t1anager could bring a roe commenda tion to the Commiss ion for action. Mrs. Cyril Budge representing the Clearwater Woman's Club spoke about how much the new street lighting program was appreciated. It was mentioned by the City /1anap,er about the possibility of the new Memorial Causeway east bridge opening this week; however, he stated there was some difficulty with the mechanism. Commissioner Insco asked if the City Engineer had made any progress in setting up a conference with the County Engineer to discuss the drainaee in southeast Clearwater. Commissioner Insco requested that rates be posted in all taxicabs for the benefit of the public. The Mayor stated that while he was in New York City to sign the incinerator revenue bonds he and the other Commissioners arranged a luncheon and invited represen- tatives of major investment firms in order to present them with factual information on revenue certificate issues and general information about the City. He stated the Commission was informed, by these representatives of the bond houses, that Clearwater is in good financial shape. The City Commission now adjourned as the City Commission and acting as Trustees of the Pension Plan, heard letters read from the Advisory Committee of the Pension Fund recommending that Alvin T. Ross, Patrolman, Police Department; Antonia DeRose, ~ailer, Police Department; Forrest Saylor, Jr., Collector, Utilities Department, Refuse Division and David A. Elworth, Attendant, Sewage Treatment Plant, be admitted to the Pension Plan. Commissioner Insco moved the employees named be accepted in the Pension Plan. Motion was seconded by Commissioner Fields and carried unanimously. A letter from the Advisory Committee of the Pension Fund was read recommending Emily Ann Danks, Asst. I, Library, be admitted subject to attached waiver. Commissioner Turner moved that the employee named be accepted in the Pension Plan, subject to the waiver.' McNulty, Circuit Judge in and for pinellas County, Florida, has determined and has so ruled that the plaintiffs in the above mentioned suit must make a demand upon the city officials of Clearwater, requesting they abate the nuisance now existing as a result of the operation of the Clearwater Airpark as aforesaid, hence, please consider this as such demand; and that this request be placed on the agenda to be heard at your next regular meeting on March 18, 1963. We further request that the city officials of Clearwater consider on MarcD 18, 1963, our request that they, as the City Commissioners of Clearwater, re-capture the Clearwater Airpark under the terms of the lease as aforesaid; and that this request be placed on the agenda to be heard at your next regular meeting on March 18, 1963. Mr. Ceorge Routh, Attorney� representing Clearwatex Flying Company, stated if there were any sAecific actions, in the operation of the Airpark, ti*liich were causing a nuisance, the Gompany would be glad to cooperate with the City in eliminating these practices. Mr. William Coetz and Mr. i�illiam Gray spoke in favor af the recapture, It was the opinion of tha Commissioners that they did not wish to act on the mattes until it was determined in tt�e court iP the Clearwater Flying Company had a valid lease with �the City.
