The City CommisQion of the City of Clearwater met in re~ular session at the City
Hall. Monday, January 21, 1963, at 1:30 P.l1. with the followinr, members present:

The Mayor called the meeting to order. The invocation was given by the Reverend
Paul M. Kinports of St. Paul's Lutheran Church, Clearwater. Commissioner fields moved
that the minutes of the ranular meeting of January 7, 1963, be approved as recorded and
submitted in written summation by the Clerk to each Commissioner. Motion was seconded
by Commissioner Turner and carried unanimously.
Commissioner Smith reported that this was the 75th anniversary of the Amateur
Athletic Union in the United States and introduced Nr. Gene Shea, Florida President of /
the Amateur Athletic Union, and t1r. John Zenuch, a national officer, who presented the
Mayor with a commemorative pin.
Rep,arding bids for one 750 GP;l pumper type tank truck for the Fire Department, the
City Manager recommended acceptinr the low bid of $18,997.36 from the Seap,rave Corpora-
tion, Columbus, Ohio, since the bid of $18,538.45, submitted by Central Fire Truck Corp-
oration, St. Louis, did not meet the City's specifications and was irregular. Fire
Chief W. Manning was present. Commissioner Turner moved upon the joint recommendation
of the Fire Chief and the Assistant Purchasinr ^p,ent, concurred in by the City Manager,
that the bid of the Se~prave Corporation, Columbus, Ohio, in the amount of $18,997.35
be accepted, said bid beine the lowest and best bid meetinp City specifications, that
the appropriate officials of the City be authorized to execute said contract which shall
be in accordance with plans and specifications and bid. Motion was seconded by Com-
missioner Fields and carried unanimously.
The City Manager recommended acceptinp the low bid of $2,998.30 from Oconee Clay
Products for clay sewer pipe of various sizes for the Public ~orks Department. Com-
missioner Fields moved on the joint recommendation of the Public Works Superintendent
and the Assistant Purchasinp, Arent, which the City r-lanap.er concurred therein, that the
contract for clay sewer pipe be awarded to the Oconee Clay Pipe Products, Milledgeville.
Georgia, for the amount of $2,998.30 which is the lowest and best bid and the appropriate
officials of the City be authorized to execute said contract which shall be in accord-
ance with the plans, specifications and bid. 11otion was seconded by Commissioner Turner
and carried unanimously.
The City t1anager recommended the bid of $44,972.02 from t1r. Robert Nidy for con-
struction of 52 shuffleboard courts at Stevenson Creek Park be accepted as the lowest
and best bid rather than the bid of $43,657.65 from Mr. J. II. BlankenShip, Clearwater,
since Hr. Nidy has had more experience in construction of multiple unit shuffleboard
courts. Commissioner Turner moved upon the recommendation of the City Engineer which
was concurred in by the City Hanaper that the bid of $44,972.02 submitted by Robert K.
Nidy, Winter Park, Florida, which is the lowest ~nd best responsible bid and that the
appropriate officials of the City be authorized to execute said contract which shall be
in accordance with plans and s~ecifications and bid. Motion was seconded by Commission-
er Fields. Upon Commissioner Insco's request, Commissioners Turner and Fields withdrew
the motion to allow time for the Commission to inspect other shuffleboard courts. Mr.
John Bonner, attorney, representinp, Mr. BlankenShip, pointed out there would be con-
siderable savinr in acceptinp, his client's bid. Hr. Robert Benson, and Clearwater
Shuffleboard Club President Tom KirkWOOd, recommended Mr. Nidy's work. The City
Engineer explained that he had asked the bidders to submit proof of experience, that
actually the low bid was an irregular bid, and stated that if the Commission would con-
sider rejecting all bids he would chanre a few items in the specifications and advertise
the bids to be returned before the next meetinp. Commissioner Turner moved that all
bids be rejected and that the City Enp,ineer be instructed to draw new specifications on
the shuffleboard courts. Motion was seconded by Commissioner Fields and carried unanimously.
The City Manager recommended the low bid of $14,940.80 from W. L. Cobb Construction
Company, St. Petersburg, be accepted for resurfacin~ East Avenue from Turner to Drew and
Chestnut Street from ACL Railroad to SAL Railroad. Commissioner Fields moved on the
joint recommendation of the City Engineer and the Assistant Purchasing Agent with the
City Manager concurring therein, that the contract for the sum of $14,940.80 submitted
by W. L. Cobb Construction Company, St. Petersburr, be accepted which is the lowest and
best responsible bid and the appropriate officials of the City be authorized to execute
said contract which shall be in accordance with the plans and specifications and bid.
Motion was seconded by Commissioner Smith and carried unanimOUSly.
It was reported by the City Manager that a request had been received from Mr. Joe
Everett, attorney. representing Mr. John F. Gilbert who presently operates The Beer Mart
at ~34l South Missouri Avenue (Lot 5, Block A, Salls Second Addition, owner Mr. Howard G.
Warren). He requested that his client's leased property be zoned to permit selling beer

and wine both for consumTltion off premises only. Commissioner Turner moved the re-
quest be granted and that the Attorney be authorized to draw the proper ordinance.
Motion was seconded by ~ommi9sioncr Fields and carried unanimously.
An application W~5 considered from Mrs. Betti Yerxa Opden for permission to
operate a second hand store at 115 North Osceola Avenue. The City Hanaper stated the
Police Department had checked and found no reason to deny the license. Commissioner
Fields moved the application be approved. Motion was seconded by Commissioner Smith
and carried unanimously.
The City !-1r1nap,er reported he had received information from the Florida Power Corpo-
ration as to the cost of aluminum painted streetlipht poles versus the ordinary black
ones. The company stated the new poles "Jould be machine turned and then painted alum-
inum "lith repaintinp to be done at least every two years at a charpe of 85q per pole
monthly in place of the 35q that the City has been payin~. It was indicated that for
Del Oro Groves alone it would increase the payment for poles approximately $30.0G per
month. After rtiscussion, Commissioner Turner moved that Action be deferred to deter-
mine a rouph estimate of cost of makinp the switch throurhout the City. Motion was
seconded by Commiss~one~ Fielcts and c~rried unanimously.
A plat of Brentwood Estates was presented for approval. The City Manager stated
the Zoninr and Planninr Board and appropriate City officials recommend it for approval,
that the streets and other improveJnents are in and all requirements have been met.
The Mayor recommended sidewalks also be required for installation by the developer
but it was explained that work on this property had been planned and approved some time
aro so it would be unfair to set a new policy to start \~ith this particular subdivision.
Commissioner Turner moved the plat be approved. Motion was seconded by Commissioner
Fields and carried unanimously.
In reaard to the policy of requirinr sidewalks under the contract in accordance
with Ordinances 632 and 750~ the City Hanaper said he had discussed it with represent-
atives of Rutenbcrg, Inc., developer of a proposed new subdivision on property to be
annexed by the City in Section 24-29-15 and they are in ap,reement with the policy of
installing sidewalks. lIe pointed out if sidewalks were installed before the homes were
built they would be torn up by trucks and it would be expensive for the City to maintain
them, but it could be included in the deed restrictions that every lot in the subdivision
must have sidewalk built after comnletion of the house. Commissioner Insco moved the
City Attorney be requested to stud~ the subject and make a recommendation as to a fair
and equitable policy in enforcinp the requirements for sidewalks in new subdivisions.
Motion was seconded by Commissioner Turner and carried unanimously.
It was recommended by the City Nanager that Item 9,1I0rd. H917-City i1anager's
Recommendation for Delayll be deferred and discussed at some later time.
The City ManaRer reported that he had received petitions sipned by 211 persons re-
questing the City Commission to invoke the recapture clause of the lease for the Clear-
water Airpark held by Clearwater flyinp, Company with Hr. Robert Bickerstaffe as present
operator. The petitions stated the continued use of this property as an airpark con-
sti tutes a real danp,sr to lives and property ",hich will be of even p,reater concern when
the proposed junior high school is erected. Commissioner Insco moved the petitions be
received. 110tion was seconded by Commissioner Fields and carried unanimously.
The City Manager explained E. h. Fetters, operator of Garden Recreat~on Center
poolroom at 208 South Garden Avenue, is plunninn to move to 924 Pierce Street and oc-
oupy a 25 foot wide building on the same width lot, and althouph there is a require-
ment in the Plumbing Code for a grease trilp there is no place to install ~t. He stated
he had a letter from the State Ilealth Department approving the continuance of operating
an under the sink grease trap as a very small amount of food is served in the establish-
ment. Commissioner Turner moved that since this operation meets the approval of the
County and State Health Department that the request be granted. i1otion was seconded by
Commissioner Fields and carried unanimously.
The City Attorney presented for approval the follO\~inp nine easements necessary
for the installation of the Clearwater East Interceptor sanitary sewer line: one from
Florida Power Corporation (both temporary and permanent) in Section 19-29-16; one from
Trustees of the Internal Improvement Board in Section 17-29-16; one from Donald R.
Dyrenforth (permanent) in the SE 1/4 of Section 19-29-16 (Lot 6 and west 25 feet of Lot
5, Pinellas Groves); two from Arthur Larsen (one permanent and one temporary) in Lot 18
of Wm. Brown's Sub of Bay View; two from Archibald M. Reid (one permanent and one tem-
porary) in Lot 21 and 28 of Pinellas Groves in the ~E 1/4 of Section 19-29-16; two from
Wm. Ross Kirkpatrick (one permanent and one temDorary) in Lot 17 of Wm. Brown's Sub
of Bay View. Comndssioner Turner moved to accept the easements dnd that the proper
officials be author~ zed to record the same. ~1oti on vIas seconded by Cornmiss ioner Fields
and carried unanimously.
The City Attorney presented a quit claim deed from Daniel T. Hcl"lullen, \Jr., et al
dated December 5, 1962, to the north 50 feet of east 368 feet of SW 1/4 of NW 1/4, and
the east 40 feet of the north 288 feet of SW 1/4 of NW 1/4, both in Section 23-29-15,
as rights of way for Lakeview Road and Hip,hland Avenue. Commissioner Fields moved to
accept the deed. Motion was seconded by Commissioner Insco and carried unanimously.
Resolution #63-7 was presented dedicating a portion of acreage in SW 1/4 of NW 1/4
of Section 23-29-15 as rights of way for Lakeview Road and Highland Avenue as deeded by
Daniel T. McMullen, Jr. t et ale Commissioner Insco moved Resolution #63-7 be approved
and the proper officials be authorized to execute it. Motion was seconded by Commission-
er Smith and carried unanimously.

The Mayor call.ed the meetin� to order. The invocation was given by the Reverend
Paul M. K�nports of St. Paul's Lutheran Church, Clearora.ter. Cpmmissioner Fields moved
that the minutes of the reg,ular meeting of January 7, 1963, be approved as recorded and
submitted in written summation by the Clerk to each Commiscioner. Motion t�as seccnde;�
by rommissioner Turner and carried unanimously.
Comrnissioner Smith reported that this o�as thE 75th anniversary of the Amateur
Athletic Union in the Uniteci States and introduced i�2r. �ene Shea, Florida President of •
the Amateur Athletic Uniaia, and P4r. John Zenuch, a national officer, 4�ho �resented the
Mayor taith a commemorative pin�
Regarding bids for ona 750 BP;4 pumper typs tank truck for the Fire Department, the
City Manager recommended accepting the low bid of $18,997,36 from the Seagrave Corpora-
tion, Colum�us� Ohio, since the bid of $1.8,538,45, submitfied by Central Fire Truck Cor�-
oration, St. L��zis, did not meet thE City's specifications and was irregular, Fire �
Chief W, Manning was present. Commissioner Turner moved upon the joint recommendation
of the Fire Chief and the Assistant Purchasing Agent, concurred in by the City Manager,
that the bid of the Sea�rave Corporation, Columbus, Ohio, in the amount of $18,997,35
be accepted, said bid being the lowest and best bid meeting City sgecifications, that
the appropriate ofr"icials of the City be authorized to execute said contract which shall
be in accordance with plans and specifications and bid. Motion ��as seconded by Com-
missioner Fields and carried unanimously.
The City Manager recommended aceepting ths low bid of $2,998.30 from Oconee C13y
Products for elay sewer pi�e of various sizes �or the Publ.ic i•7orks Deaar��ment. Com=
missioner Fields moved on the joint recommendation of the Public '�7orks �u�erintendent
and the Assistant Purchasing Agent, which the City Planager concurred therein, that the
contract for clay sewer pipe be awarded to the Oconee Clay PiDe Produets, Milledgeville,.
Georgia, for the amount of $2,998.30 which is the lowest and best bid and t;ie appropriate
of.ficials of the City be authorized to e�ecute said contract which shall be in accord-
ance with the plans� spacificatiQns and bid. Motian was seconded by Commissioner Turner
and carried unanimously,
The �ity i�iana�er recommended the bid of $44,972.02 irom F,r. Robert Nic1y for con-
struction of 52 shuffleboard courts at Stevenson Creek Park be accepted as the lowest
and best bid rather than the bid of $43,657.65 from t�tr, J. H. Blankenship, Clearwater,
since Mr. ,1idy has had more ex�erience in construction of multiple unit shuffleboard
courts. Commissioner Turner moved upon the recommendation of the City Engineer whicn
was concu.rred in by the City Manager that the bid of $44,972.02 submitted by Robert �.
P1idy, Winter Park, rl.orida, which is the lowest anci bast responsible bid and that the
aupropriate officials of the Gity ba authorized to execute said contract whi�.h shall be
in accordance wit,1 pians and spacifications and bid. P�lotion was seconded bg Commission-
er Fields, Upon Cornmissioner Insco's request, Commissioners Turn�r and Fields �aithdrew
the motion tQ allow time far the Commissi�z to insDect other shuffleboard eourts, Mr.
John Bonner, attorney, representing Mr. B:iankenship, pointed out there �aoul� be con-
siderable saving in accepting his client's bid. Ptr. Robert Benson, and Clearwater
Shuffleboard Club President Tom Kirkwood, recommended Mr. Nidy's work. The City
Engineer explained that he had asked the bi�iders to submit proof of experience, that
actually the low bid was an irregular bid, and stated that if the Commissio� would con-
sider rejecting a11 bids he w*oul� change a few items in t;ne specifications and adverrise
the bids to be returned before the ne�t meetin�. Commissioner Turner moved that all
bids be r.eject�d and that the City EnginPer be instructed to draw new specifications on
the �huffleboard courts. I�otion was seconded by Commissioner Fields and carriad unanimously.
The City Manager recommended the low bicl o� $14,940.80 t�om W, L. Cobb Construction
Company, St. Petersburg, be accepted for resurfacing East Avenue from Turner to Drew and
Chestnut Street irom ACL Railroad to SAL Railroad. Commissioner Fields moved cn the
join-t recommendation of the Ci•�y Engineer and t]Ze Assistant Purchasing Agent wi-th the
City Manager concurring therein, that the contract for the sum of $14,940.80 submitted
by W, L. Gobb Constrtiction Company, St. Petersburg, be acce�ted which is the lotaest and
best respansible bicl and tha ap�ropriate officials oi the City be authorized to execute
said contract which sha7.1 be in accordance with the plans and specafications and bid.

It was reported by the Ci.ty Manager that a reques-t had been received from rtr, Joe
Evenett, attorneyy represen�ting Mr. John F. Gilber+ �aho nresently operates The Beer itart
at ].341 South P4issouri Avenue (Lot 5, Block A� Salls Second Addition;, ooraer Mr, fIoward G.
Warren), �ie rec�uested that his client's leased property be zoned to permit selling beer

An application ��as considered from PTrs. Betti Yerxa O�clen for permission to
operal:e a second hand store at 115 �lorth Osceola Avanue. The City Man�ger stateci the
Police Department 2iad checkeci and found no reason ta deny the �.icense. Commissioner
Fields moved the a�plication l�e agproved. Motion w�s seconded by Commissioner Smith
and carried unanimously.
The City Manaper reported he had received info�mation frcm the Fl,orida Power Corpo-
ration as to the cost of aluminum painted stree•t].ight poles versus tl�e ordinary black
ones. The company stated the new poles would be machine turned and �then painted alum-
inum with repainting to be done at least every two years at a char�e of 85� per nole
monthly in place of the 35� tha�t the City has been paVin�;. It t+ras indicated �that for
Del Qro 6roves alone it woul.ci increase the payment for poles ap�roximately $30.Q0 per
month. After �iscussiany Gommissioner Turner moved thai action be deterred to deter-
mine a rough estir�ate of cost of makin�? the switch throu�*hout the City. Motian was
seconded by Commissioner Fie]:d� and carried unanimously.

A plat of 5rentwood Estates was presented for ap�roval. The City Manager stated
the Zoning and Planning Board and appropriate City officials recommend it Por �oproval�
that the streets and other improvements are in and all require:nents have been met.
The Mayor recommended sidewalks also be required for installation by the developer
bt�t it was expl.ained that wcrk on this property had been planned and approved some time
ago so it would be unfair to set a new policy to start with this particular subdi�,rision.
Commissioner Turner moved the plat be ap�roved. 24otion was seconded by Commissioner
Fields and carri�d unanimously.
In regard to the policy of requiring sidewalks unc3er the contract in accordance
with Ordinances 632 and 750, the City Manager said he had discussed it with represent-
atives of P.utenbeig, Inc., �eveioper ef a proposed new subdivision on property to be
annexed by the City in Section 24-29-15 and tney are in agreement with the p�licy of
installing sidewalks. E3e �ointed out if sidewalks were installed before the homes were
built they would be torn up b,y ;trucks r.,rid it would be expensive for the �ity to maintain
them, �ut it couid be includecl in the deed restrictions that every lot in the subdivision.

Recommendation for Delay" be deferred and discussed at some later time.
The City Manager raported that hs had received petitions signed L�y 211 persons re-
questing the City Comma:ssioa to invoke the recapture clause of the ].ease for the Clear-
water Airpark held by Clearwater Flying Company with fir. Robert 13ickerstaffe as present
operator. The petitions stated the continued use of this proper.ty as an airpar:� con-
stitutes a real danger to lives and property which will be o� even greater concern when
the proposed junior high school is erected. Commissior_er Insco moved the petitions be
received. Motion was seconded by Commissioner rields and carried unanimously.
The Gity Manager explained E. H. Fetters, op�rator oF Garden Recreation Center
po�lroom at 208 South Garden �venue, is planning to move to 924 Pierce Street and oc-
aupy a 25 foot wide building on the same 4ri.dth lot, and although there is a require-
ment in the Plumbing Code for a grease trap there is nc place to install it. I3e stated
he had a letter from the State Health Uepartment approvin� the continuance of operating
an under the sizk grease trap as a very small amount of food is served in the estab�ish-
ment. Commissioner Turner moved that since this operation meets the aporoval of the
County and State Health Dspartment tnat the re�?aest be granted. t�totion was seconded by
Commissioner Fields and carried unanimously.
The City Attorney presented for ap�roval the follo�aing nine easements necessary
for the instaliation of. the Clearwater East Interceptor sanitary sewer line: one from
Flarida Power Cor�oration (both temporary and permanent) in Section 15-29-16; one f.rom
Trustees of the Internzl Improvement Board in Seetion 17-29-16; one from Donald R.
Dyrenfo�th �permanent) in the 5E 1/4 of Section 19-29-16 (Lot 6 and west 25 feet of Lot
5, ainellas Groves); 'two from Arthur Larsen (one permanent anci one temporary) in Lot 18
of Y7m. Brown's Sub of Bay Vzew; ta�o fr.om Archibald M. Reid (one permanent and one tem-
porary) in Lot 21 and 28 ot l'inellas �roves in the ?dE 1/4 of Section 19-29-1.6; two from
