The City Commission of the City of Clearl-latcr met in repular session at
the City Hall, Monday, September ]7. 1962 at 1:30 P.M. with the following
members present:

The Mayor called the meetinr to order. The invocation was given by the
City Attorney. Commissioner Fields moved that the minutes of the reRular
meeting of September 10, 19G2 be ar~roved as recorded and as submitted in
written summation by the Clerk to each Commissioner. Hotion 1-1aS seconded by
Commissioner Turner and carried unanimously.
A public hearinr was an~ounced on the a~peal of Cmil Metz, from a deci-
sion of the Board of Adjustment nnd ^~oeal on Zoninr denyinr Business Use
(to construct 15 stall storape pnrage) of J 100 feet of S 300 feet of E 188.93
feet of SC 1/4 of SW 1/4 of SW 1/4 of SW 1/4. Section 12-29-15, zoned R-lE and
R-2. The bui1din~ was set Lack 250 feet instead of 150 feet as shown on plot
plan filed with a~plication for builrlinp permit. Wm. MacKenzie and Ben Krentzman,
Attorneys for Mr. Metz spoke in favor. Mr. Roy Ahlerim also snoke in favor. Mr.
John Bonner, Attorney spoke in onDosition for himself and representing others in
the area. /1r. Ken T.tla 1 ters. Mrs. \<1i Iburn llel-lbi 1]. Col. Georpe Power and Mrs.
Arthur Shaw spoke in opposition. Commissioner Smith moved that havinp heard no
valid reason why the action of the Board of Acjustment and ADpeal on Zoninp should
be chanp,ed, that therefore the action of the Board be affirmed. Notion was sec-
onded by Commissioner Turner and carried unanimously.
The City Hanap;er recommended acceptinp, the lOvJ bid of the Lanier Systems, in
the amount of $616.42, for one microfilm reaner-Drinter. Commissioner Turner
moved upon the joint recommendation of the City Clerk and Asst. Purchasin? Arent,
concurred there in by the Ci ty f1anaper that the 101-leS t and bes t responsible bid of
$616.1~2 submitted by Lanier Systems, of Tampn be accepted and that the appropriate
officials be authorized to execute said contrAct which shall be in accordance with
plans and specifications and bid. Motion was seconded by Commissioner Fields and
carried unanimously.
The City Hanaper recommended acce::>tinp: the low bid of Clayton Op:les in the
amount of $860,00 for removal of the smoke st~ck o~ the Gas Plant. subject to
furnishing proper insurance ancl that insurance be anproved by the City Attorney.
Commissioner rields moved upon the recommendation of the City Enpineer, Asst.
Purchasinp Ap;ent and the City Hanaper concurrinp therein that the contract for
the sum of $8GO.OO submitted by Clayton O?les of Clearwat8r be acce~ted which is
the lowest and best responsible bid and that the a~pro?~iate officials of the
City be authorized to execute sa:.d c0ntract which shall be in accordance with plans,
specifications and bid. Motion was secon(~ed bv Commissioner Turner and carried
unanimously.
The City ManaRer presented a request from Robert h. NadeRu. et al for annex-
ation of the northerly half more or less or lots 11 and 12 Hanousek's Sub. subject
to the land being zoned for business and the sale of package liquors, beer and wine
for consumption off the premises. Commissioner Insco moved that the City Attorney
be instructed to prepare an ordinance for intent to annex Sears Town area. Motion
was seconded bv Commissioner Turner and carried unanimously.
The City Manager read a letter from Fred J. Wilder representine the McMullen
heirs and others, requestinp, the annexation of acreaGe of about 1-3/4 acres at
the SW corner of Lakeview and Hiphland. Mrs. A. S. Deerine requested deferment
of action and stated the request to place a ?as station on the corner had been
denied by the County on August 21st. Commissioner Insco moved that the request
be approved and the City Attorney dra\o1 up the prODer ordinance. 110tion Has sec-
onded by Commissioner Fields and carried unanimously.
The City Manager presented an a~plicat~on for a service station site near
the entrance to Clearwater Pass Bridpe, Lot 2. Blk D Bayside Shores by Sun Oil Co.
Commissioner Insco moved that the site be annroved sub~ect to the approval of plans
by the City Engineer. Motion was seconded ~~ Cornmissi~ner fields and carried
unanimously.
The City Manager presented a request for vacation of that portion of the
alley between Lots 3, 4, 5 and 6. Block 6 Jones Sub. of Nicholson's Addition. ' He
stated that there are no utilities in the alley and no objections had been received.
Commissioner Insco moved that the alley as described be closed and the City
Attorney prepare the proper resolution ~o be numbered 62-102~ that this resolution

The City Hanap.:er reported that Fire Chief Manninr: had served his probationary
period and recommended that he be certified in his position. Commissioner Turner
moved that Walter r. Manning be certified as Fire Chief of the City of Clearwater
and the proper officials be authorized to execute his certification. Motion was
seconded by Commissioner Insco. Upon i1 Doll of the vote beinr: taken it was deter-
mined that f1ayor Weatherly, Commissioners Turner and Insco voted "Aye",
Commissioners Fields and Smith "l'lo". ~10tion carried.

The City ManaRer presented the name o~ Warren Brown, Director of the Better
Business Bureau of the Chamber of Commerce for annointment as a member of the
Charity Solicitations Board. Commissioner rield~ moved that Warren Brown be appoint-
ed to the Charity Board. Motion was seconded by Commissioner Turner and carried
unanimously.
The City Hanarer reported that Eddie Rodpers had requested re],ease of his lot
mowin~ contract with the City And recommended that Mr. M. E. Johnson he given the
contract. Mr. Johnson's bid previously was $4.00 for 6~OOO square feet and $1.00
additional for each 1,500 square feet. The Mayor also stated that while Mr. Johnson
was not the next Jowest hidder At the time the bids were taken~ that he had done
excellent work previously. Commissioner rields moved that Mr. M. E. Johnson be
employed to do the lot mowinr. Motion was seconded by Commissioner Turner and
carried unanimously.
The City Hanaper reported that the Junior Chamber of Commerce expressed their
interest in usinp Crest Lake Park for their Christmas Holiday Scene project rather
than the Memorial Causeway, beCatlSc of heavy traffic and difficulty of installation.
Commissioner Insco moved to approve the use of Crest Lake Park if found feasible by
the City Manap,er. Motion was seconded by Commissioner Fields and carried unanimOUSly.
The City Attorney presented Ordinance #943 crcatinp a new Zone 19 for sale of
alcoholic beverapes on premises for its serond readinp.. Commissioner Turner moved
Ordinance #943 be read and considered by title only on its second reading with the
unanimous consent of the Commission. Hotion was seconded by Commissioner Fields
and carried unanimOUSly. The ordinance was read by title only. Commissioner Turner
moved to pass Ordinance #943 on its second readinE by title only. Motion was second-
ed by Commissioner Fields And carried unanimously.
Commissioner Turner moved to consider Ordinance #943 on its third and final
readinp with the unanimous consent of the Commission. Motion was seconded by
Commissioner Pields and carried unanimously. The ordinance was read in full.
Commissioner Turner moved that Or~in~ncc #943 b~ nassed on its third and final read-
ing, as amended.. and adopted And that the appro~rl.:Jte officials be authorized to
execute it. Motion was seconded by Commissioner Fields and carried unanimOUSly.
The City Attorney read PesoJution #52-103 for payment to J. E. Greiner Co. ,
Consu1tinr Engineers the sum of C940.00, invoice fiG dated September 12, 1962 and
the sum of $3,359.94, invoice #9 dated September 12. 1952 for a total of $4~300 .74
from Construction Trust Fund~ Bridp,e Revenue Bonds, Series of 1960. Commissioner
Fields moved that Resolution #52-103 be annrovcd and that the ~rODer officials be
au~horized to execute it. Motion was secb~ded by Commissioner'In~co and carried
unanimOUSly.
The City Attorney read Resolution #52-104 requiring 96 property owners to
clean their lots of Heeds and unc1e-rp:rmlth. Commissioner Fields moved that Resolution
#62-104 be approved and that the a~propriate officials be authorized to execute it.
Motion was seconded by Commissione-r Turner, and carried unanimOUSly.
Commissioner Smith reported receivinG draina~e complaints on North Clearwater
Beach. The City Engineer reported that he would make recommendations at the next
meeting.
There being no further business the meetin~ was adjourned at 4:50 P.M.

The Mayor called the meetin� to or�er. The invocation ctas given by the
City Attorney. Commissianer Fields moved that the minutes of the regular
meeting of Sentember 10, 1962 be apnroved �s recorded an�' as submitte3 in
wriiten summation by the C1erk to each Commissioner. I�Iotion was seconded by
Commissa.oner Turner and carried unanimously.
A public hearing was annauncesi on the a�peal of Er�il �r�atz, from a deci-
sion of the Board of P.d�ustment and P.�neal on ��nin� d�nying Business t?se
(to construet 15 sta11 stora�e gar.a�e) �f _'d 100 feet of S 300 feet of E 188.93
feet of SE 1/4 af Sa7 1/4 of SW 1/4 oF SL•J 1/4, Section 12-29-15, zoned R-1E and
R-2. The buildin�? c•ras set back 250 feet instead of 150 feet as shawn on plot

John ner, Attorney spoke in onposition for himself and re�resenting others in

Arthur 5h.aw spokz in oppositior.. Commissioner Smith moved that having heard no
valid reason why the action of the Board of 'r.diustment and P.ppeal on Zoning should
be chan�?ed, that therefore the action or" the Board be affirmed. Mction was sec-
onded by Commissioner TurnPr and carried unanimously.
The City Ttana�?er recommended accepting the loG� bid of the Lanier Systems, in
the amount of $616.42, for one microfilm reader-�rinter. Com�issioner Turner
moved upon the joint recommendation of the City Clerk and P.sst. Purchasing Agent,
concurr.ed therein b�,r the City Manager that the lowest and best responsible bid of
$615.42 submitted by I�anier Systems, cf Tampa be accepted and that the approoriate
ofCicials be authorized -co execute said contract which shall be in accordance with
plans and specifications and bid. Motion was seconded by Commissioner Fields and
carried unanimously.
The City Manager recommended acce�ting, the low bid of Glayton Ogles in the
amount of $860,00 for removal of the smoice stack at the �as Plant, subject to
furnishing prooer insurance znd that insurance be a�proved by the City Attorney.
Commiss-ianer Pi�lds moved upon the recommendation of the City Engineer, Asst.
Purchasin� Ap,ent and the Citj1 Mar.ager concurrin� therein tihat the contract for
the sum of $860.00 submitted by Clayton Ogles of C�earcaater be aeee�ted cahien is
the l.owest and best responsible bid and th�t the appro�riate officials of the
City be authorized to execute said contract which shall be in accordance with plans,
specifications and bid. i�ation was secon�ed bv Commiss�.one� Turner and carried
unanimously.
The City T4�nag,er presented a request from R�bert f�, i3adeau, et al for anaex-
ation of the northerly nalf more or l.ess cf ].ots 11 and 12 Hanousek's Sub, subject
to the land being zoned far businsss and the sale af packaga liquors, beer and wine
fox consumption off the premises. Commissioner Insco moved that the City l�lttorney
be instructed te prepare an ordinance for intent to annex Sears lown area. Motion
was seconded by Commissianer Turner and carried unanimously.
The City Manager read a letter from Fred J. i4ilder representin� the McMullen
heirs and others, requesti.ng the anne:cation af acreage �f about l-3/4 acres at
the SW corner of Lakeview and Hi�liland. Mrs. A. S. Deering requested deferment
of action and stated the request to place a gas station on the corner had been
denied by the County on August 2'lst. Commissioner Insco moved that the request
be approvecl and the City Attorney draw up the �roper ordinance. P%otion y�as see-
onded by Commissioner Fielcls an�i carried unanimouslv.
The City Mana�er presented an anplic�t;on for a service station site near
the entrance to Cleartaater 1'ass Bridge, Lot 2, Blk D Bavside 5hores by Sun Oil Co.
Commissioner Insco moved tha't the site be approv�ed sub�ect to the approval of olans
by the City Engineer. Mota,on was seconded by Commissioner Fiel.ds and carried
un3nimously,
The City Manager presentad a request for vacation of that portion of the
alley betw�en Lots 3, 4, 5 and 6, Block 6 Jones Sub. of Nichol.son's Addition. He
stated that there are no utilities in the a11e� and no objections had been r�ceived.
Commissioner Insco moved that the allev as described be closed and the City
Attorney prepare the pro�er resoluiion to be numbered 62-102, that this xesolution

seconded by Commissionex Fields and carried unanimously,
The City Manager re�orted that Fixe Chief Mannin� 11ad served his probationary
period and recommended that he be certified in his position. Commissioner Turner
moved that [4alter F. Manning be ceztified a, Fire Chief of the City of Clearwater
and the proper officials be authorized to execute his certification. Motion was
seconded by Commissioner Insco. Upon a poll of the vot� bein�? talcen it was deter-
mined that Mayor GJeatherly, Commissionexs Turner and Insco voted "Aye",
Gommissioners Fields and 5mith "No". Motion carried.
The City Manager presented the n�me of Warren Brown, Direator of the Setter
Business Bureau of the Chamber af G�mmerce far anpairtment as a member of the
Charity Solieitations Board. Commissionei Pields maved that G7arren Brown be aApoint-
ed to the Charity Board. Motion was secondsd by Commissioner Turnes� and carried
unanimously.
The City Manager re�ortad that Eddie P.od�ers had requested rel.ease of his lot
mowing, contract taith the City and recommended that Mr, I�1. E. Johnson be �?iven the
contract. Pir. Johnson's bid nreviously was '$4.�0 tor 6,000 square _Peet and $1.00
additional for each 1,500 square feet. The i�fayor alsa stated that while T1r. Johnson
was not the next lowest bidder at the time the bids were taken, that he had r�one
excellent work previously. Commissionar I'ields noved tnat Mr. M. E. Johnson be
employed ta do the lot rnowin�. rioti�n caas seconded by Commissior.er Turner and
carried unanimously.
The City Manag_ar reported that the Junior Chamber of Commerce expressed their
interest in using Crest Lake Park for their Christmas Holiday Scene praject rather
than the I�Iemorial Causeway, because of h2avy traffic and difficulty of installation.

and carried unanimously. The or�dinance was read by title only. Commissioner Turner
moved to pass Ordinance ir943 on its sec�nd readin� by title only. Motion was second-
e�3 by Commissioner Fields and carried unanimously.
Commissioner Tur.ner moved to consider Ordinance �'943 on its third and final
reading with the unanimous ecnsent of th�� Commission. rtotion was seconded by
Commissioner Fields and carried unanimously. The ordinance w�s read in full,
Commissioner Turner moved that Ordinance 1�943 be nassed on its third and final read-
ing, as amended, and adopted and th�t the a�propriate officials be �uthorized to
execute it, Motion was seconded bv Commissioner. Fields and carr.ied unanim�usly.
The City Attorney read ??esolution #62-103 For payment to J. E. Greiner Co.,
Consultir�� Engineers the sum of $940.00, invoice #6 datec] SentamDer 12, 1962 and
the sum of $3,359.94, invoice 7�9 aa-rPa September 12. 1962 for a total of $4,300,74
from Construction Trust Fund, Bridge Revenue Bonds, Series of 1960. Commissioner
Fa.elds moved tha� P.esolution i�62-103 be a�proved and that the proper o.fficials be
authorized to execute it, Motion was seconded by Commissioner Insco and carried
unanimously.
The City Attorney read Resolution #62-104 requiring 96 property owners to
clean their lots of weeds and undergrowth. Commissioner Fields moved that Resolution
�#�62-104 be approved and that the approoriate officials be authorized to execute it.
Motion �ras seconded by Commissioner Turner, and carried unanimously.
Commissioner Smith reported receiving drainafie comnlaints on North Clearwater
Beach. The City Engineer reported that he would make recommendations at the next
meeting.
