The City Commission of the City o~ Clearwater met in regular session at the
City Hall, Monday, September 10, 1962 at 1:30 P.H. with the following members

The Mayor called the meetinp to order. The invocation was given by Rev.
Hueh Powell, Trinity Presbyterian Church. Commissioner Turner moved that the
minutes of the rerular meetinr of Aupust 20, 1962 be approved as recorded and as
submitted in written summation by the Clerk to ertch Commissioner. Motion was
seconded by Commissioner fields and carried unanimously.
The M~vor. nresented a Citation to John E. Anderson, retiring, in appreciation
for public ~ervice as civil enrineer of the City of Clearwater durin~ the years
1949-62.
A Public Hearinr was announced on the appeal of Richard N. Wilder from a
decision of the Board of Adjustment and Appeal on zoning prantin~ Pat~ick J.
Doherty a 10- foot se tback for Lot 5, :31oc1< A Bayside Ii 5 Subdi vis ion. f'1r. Ben
Krentzman, Attorney for Mr. Doherty pave a history of the case~ showed pictures
of the area and presented a consent form from A property owners in the area. He
reauested the Commission to confirm the decision of the Hoarn. !1r. \'lilder was
Dr~sent and snoke in oenosition. Commissioner rields moved to confirm the deci-
sion of the Board of Adjustment and ^nneal on Zoninp. for the 10-foot setback.
Motion was seconded by Commissioner Tu~ner and carried unrtnimously.

Cornmissione:r Fields moved upon the joint recommendation of the City Enp.:ineer,
Finance Director and Asst. Purchasing Arent thflt the bid of $7,478.18 by Burn up
and Sims, Inc., West Palm Beach be accepted w}lich is the lowest and best responsible
bid and that the appropriate officials of the City be authorized to e:xecute said
contract which shall be in accordance with Dlans and s?ecifications and bid. Motion
was seconded by Commissioner Turner and carried unanimously.
The City Hanager recommended acceptinp the bid of farniln Brass :dorks Co. for
500 3/4 inch Key Cu~b Stops and 500 3/4 inch Cornoration Stops for the Utilities
Dept. , 'dater. Division. Commissioner Turner moved UDon the -joint recommendation of
the Utilities Manager, Water Supt. and Asst. Purchasinr ^pent~ concurred in by the
City Manaper that the lowest and best responsible bid for $1,815.00 less 2% discount
by Farnan Brass Works Co~, Cleveland, Ohio be accented and that the appropriate
officials of the Citv be authorized to execute said contract which shall be in
accordance with the ~lans, specifications and bid. Motion was seconded by
Commissioner Fields and carried unanimOUSlY.
The City Hanager stated thnt J. I:. r,reiner Company Consulting Enr;ineers had
revie\oJed the bids received for the Toll Plaza Faci Ii ties faT' "the Bridpe across
Clearwater Pass and recommended the acceptance of the low bid which was submitted
by Alfred C. \.'yJlie, Inc. for $1~8,707.00. Commissioner Fields moved upon the joint
recommendation of the Consulting En~ineers and the City Manaper that the contract
for the Toll Plaza for Clearwater Pass BridRe be awarded to Alfred C. Wyllie Inc.
of Clearwater for $48,707.00 which is the lowest and best res~onsible bid and that
the appropriate officials of the City be authorized to execute said contract.
Motion was seconded by Commissioner Turner and carried unanimously.
The City Manaf,er presented a request from the Artificial Fishing Reef Committee
of the Chamber of Commerce for an advance of $800.00 to be paid to the Corps of
Engineers for engineering and survey after completion.. Commissioner Turner moved
subject to approval of the City auditors that the sum of $800.00 be disbursed to
the Corps of Enp,ineers for the advance required for enrineering and survey after
placine the artificial reef, it being understood that this money ~lil1 be repaid by
the Artificial Reef Committee of the Chamber of Commerce when their drive for funds
is finished. Motion was seconded by Commissioner Fields and carried unanimously.

The City Manager presented a letter from William CAstapnn, representing
the Lions Club, requesting use of the Beach Area west of the C~ndlelight Inn on
May 2, 1963 from 8 P.M. to midnipht for a picnic in connection with the state
convention of the Lions Club. The letter stnted there would be no fire, and
no beer or liquor permitted. Commissioner rields moved th<1t the request of the
Lions Club be approved as requested. Mot;on VIas seconded by CommiGGioner Turner
and carried unanimously.

The City Attorney presented Resolution 1162-100, authorizinr the oxocution of
contract with the Seaboard Air Line Rnilroad Co., reparding the instnllatinn ~r
gas main under the Railroad nroperty in the Safety Harbor area. Cnmmissi0ncr rields
moved that Resolution #62-100 be approved and that the nroper orricial5 he c,uthoriz-
ed to execute it. Motion was seconded by Commissioner Turner and c~rrlcrl un~nimously.
The City Attorney presented an 2f'reement with the TOHn of Be1) Ce1 ir for the
removal of sludEe from their seware plant. He stated the town of De] lcair would
pay $9.31 per tllousand pallons of sludge removed. Commissioner Turner moved that
the aRreement, for the removal of sludre, with the Town of 3el],eair be approved
and that the proper City officials be authorized to execute it. ~otion wa~ Gec-
onded by Commissioner Fields and carried unanimously.
The City Attorney read in full on its first readinp Ordinance #943 amcndinR
Section 4-18 of City Code, 1962~ by creating Zone 19, on East CI~veland Street
from Myrtle to Prospect for liquor on premises. Commissioner Turner moved to pass
Ordinance #943 on its first readin~. Motion was seconded by Commissioner Fields
and carried unanimously.
The City Attorney read Resolution #62-101 requiring 157 lots be rno~ed.
Commissioner Fields moved that Resolution #62-101 be approved and that the proper
City officials be authorized to execute it. Motion was seconded by Commissioner
Turner and carried unanimously.
The City Attorney reread Ordinance #941 in full annexing part of Section
17-29-16 & 18-29-16, for the purpose of readoptinp. and repassing, as it was not
published as required within 5 days. Commissioner Fields moved to repass and re-
adopt Ordinance #941 on its third and final reading. Motion was seconded by
Commissioner Turner and carried unanimously.
Attorney
The City/reported thnt he had received the Attorney Seneral's opinion re8nrd-
ing the passage of ordinances on more than one reading, vlhen 1ess than 'the full
Commission Has present. The Attorney reneral had cited court cases which indicated
that ordinances could be passed on second and/or third reading the same day as long
as a quorum of the Commission was present and by unanimous consent of that quorum.
I1rs. Rosalie Day reported that the underwater lights at the Marina were not
workinp, and asked that they be repaired.
Commissioner Fields reported that the Railway Express Office in the City will
be closed and that it will hurt Clearwater, and asked the City to file an appeal.
Commissioner Fields then moved to have the City Attorney notify them immediately
