The City Commission of the City of Clearwater met in regular session at the
City Hall, Monday, March 19, 1962, at 1:30 P.IIl., with the following members
presen t:

The r~ayor called the meeting to order. 'l'he invoc ati on was given by the
Reverend E. Armster of Mount Carmel Baptist Church, Clearwater. Commissioner
Insco moved that the minut es of t he regular meetin~ of If.arch 5, 1962, be approved
as recorded and as submitted in written summation by the Clerk to each
Commissioner. Motion was seconded by Commissioner Fields and carried unanimously.
Commissioner Smith indic ated his approval of the minutes of February 19th and 22nd.
Regardin~ bids to ~urchase or raze the buildin~ at 128 North Osceola Avenue
(the former Rogers home), the City Manager reported tIT ee bids had been received,
the hi~est being $1,010.00 from Mr. M. Luczynski to purchase the building. The
City Manager recommended that the bids be rejected since he did not consider the
high bid to be consistent with the replacement value of the buildin~. Commissioner
Smith moved to accept the recommendation of the City Manager and reject all of the
bids. Motion was seconded by Commissioner Insco and carried unanimously.
As to an actuarial study of the employees' pension plan and the firemen's
pension plan, the City Manager reported he had contacted the State Comptroller's
office in Tallahassee for recommendations as to firms qualified to do the work,
and had received a list of five firms of consultants. ~~. Gerald Weimer report-
ed that five proposals had been received for such a survey:

~w. Weimer explained he and the Ci~y Manager were recommending acceptance of
the proposal of the Wyatt Company as it included rour conference days in Clearwater,
some regional studies and the company will make studies for additional information
the City may request at a cost not to exceed $4, 000.00. Commissioner Smith moved
that the reconmendation accepting the pro posal of Vryatt Company be followed am
that the proper officials proceed. Motion was secom ed by Comnissioner Fields and
carried unanimously.
Mr. Wm. M. MacKenzie representing Mr. Harry W. Shepard, Sr., Mr. Harry W.
Shepard, Jr., and Mr. Gonzalo Garcia, presented a pm posal to lease for t\olenty-rive
years a tract bounded on the east by Coronado, on the north by Causew~ Boulevard
extended, on the west by Cle arwater Beach, on the south by South Gulf'view Boulevard
except a tract in the southwest corner, l4~' x 152' for the operation of a parking
facility, for $9,000.00 a year or $750.00 per month witl1 the City to receive one
half of gross revenues over $50,000.00 in any year. He explained if it became
economic ally feasible to add a second story, t he pro pas ed lessees we uld plan to do
so wit h City approval of plans and agreement on a revision of rent al payments. He
stated the area would be black topped, properly draire d, W) uld be enclosed by a
five foot chain link fence arx:l would be op~ for parking from $:00 A.M. to 12:00
midnight with space for 318 vehicles. Mr. MacKenzie explained it would be request-
ed that real estate taxes be paid by the City, the proposed lessee to pay any
personal property tax. Mr. Harold Wilson, representirg r.1r. George Volker and
others presented a proposal to Ie ase the sarne area far a parking facility of'fering
35% of the gross receipts with a minimum of $10,000.00 annually. Mr. Jesse Saunders,
Dr. P. C. Spengeman, Mr. A. D. Finch, !~. Leonard Merrell, Mr. Ernest Barger and
others objected to the proposals. ~~. Owen S. Allbritton, III representing
Clearwater Fishing ani Recreational Pier. Inc., opposed them. Mr. Robert Tench
representing Pier Pavilion of Clearwater, Inc., objected. Commissioner Turner
stated he felt wit h some of the f acts that have been pr esert. ed that it would not
be in the best interests of the City at this time to lease th is property for use
as a parking lot. Commissioner Turner moved that the property be retained :for
City purposes. Motion was seconded by Commissioner Fields and carried unanimously.
In response to an inquiry by the Mayor, the people in the audience indicated they
would like to have the property in question paved by City forces for parking rather
than have it left as it is.

The City Manager presented the request of Standard Development Company consider-
ed at the last meeting for a new zone on the east side of High1ani Aven ue from Lakeview to
Barry to permit sale and consumption of alcoholic beverages. Mr. Robert G. Mickens
repre~enting the company stated the request had been modified at the last meeting
~o include only Lots 5 and 6, Forrest Hill Estates, the proposed bowling alley to
be on Lot 6 and the proposed restaurant on Lot 5. Mr. A. H. Buchnan, 112g East
T~ner, and Mr. D. C. Johnson, 1109 Pineview, objected. A petition of objection
containing 169 names was presented but it was indicated the majority lived outside
. ~he City limits. Commissioner Smith suggested since the signers or the petition .

The City Attor ney present ed for it. s seco rd reading Ordinance #921 adopting
the plumbing code of the Citf of Clearwater, 1962. Mr. H. E. Ernst and Mr.
Bernard Shaw stated some of ~he problens and recommended minor changes and also
requested a delay before the third and final reading to clarify some questions.
Commissioner l'urner moved Ordinance #921 be read ani considered by title only on
its second reading by unanimous consen~ or the Commission. Motion was seconded
by Commissioner Fields and carried unanimously. The ordinance was read by title
only. Comnissioner Turner moved Ordinance ~2l be passed on its second reading by
title only. Mo~ion was seconded by Commissioner Fields and carried unanimously.
Commissioner Turner moved action be dererred on third reading of Ordinance
#921 un~il such time as committees rrom both the pool group and the plumbing group
have met with the City Engineer and have come back with a recommendati on. Motion
was seconded by Commissioner Fields and carried unanimously.
Resolution #62-38 was presented authoriz ing payment of $629 .00 to Briley,
Wild & Assoc iates, Consulting Engineers, for engineering servic es in connecti on
with ~he elevated tanks, water transmission mai n and uti lities reloc a~ion pro ject.
Commissioner Fields moved Resolution 1162-3S be approved ani the prop3r offic ials
be authorized to execute it. Motion \'Jas secord ed by Commissioner Insco and carried
unanimously.
Resolution #62-39 was presented assessing the sanitary sewer in Howard Street
from Madison to Missouri against the benefited propertie s. Commissioner Insco
moved Resolut.ion 1162-39 be approved and that the proper officials be authorized
to execute it. Motion was seconded by Commissioner Turner and carried unanimously.
'fhe City A~torney read on its 1'irst reading Ordinance 1/923 declaring the City's
intention to annex a part of Section 19-29-16. Commissioner Turner moved Ordinance
#923 be passed on its first reading. Motion ~as seconded by Commissioner Insco
and carried unanimously. .

and final reading at this meeti ng 01' the Commission by the unanimous consent of
the Commission. Moti on was secorded by Commissioner Fields and carried unanimously.
The ordinance was read in full. Commissioner Turner moved Ordinance #923 be passed
on its third and final reading and adopted and that the appropriate orficials be
authorized to execute it. Motion was secorded by Commissioner Insco and carried
unanimously.
Resolution #62-40 was present ed aut.horizing payment of $S,3l1.85 to J. E.
Greiner Company, Consulting Engineers, for engineering services in connection
with toll collection .facilities and construction supervision on Clearwater Pass
Bridge. Commissioner Fields moved Resolution #62-40 be approved and the appropri-
ate officials authorized to execute it. Motion was seconded by Commissioner
Turner and carried unanimously.
The City Attorney presented a proposed contract t.o purchase from the Estate
of Mary Edna Strawser by Rob ert Str-awser, Guardian, the north 30 feet of Lot 3
less the east 35 feet, Block 1, Wallace Addition, and also the 15 foot alley
adjoining, for a cost o.f ~2,500.00 for ChestnuG Street right of way. Commissioner
Fields moved the contract be approved as recommerd ed by the City Attorney and the
proper o.fficials authorized to execute it. Motion was seconded by Comnissioner
Turner and carried unanimously.
A proposed contract \'las preserrt.ed with Harold and Mary vlebb to purchase the
north 30 feet of Lot 4, Block 1, Wallace Addition, f'or $22,290.00 for Crestnut
Street right of way. Commissioner Turner m~ed upon the recommendation of'the
City Manager and the Citf Attorney that the contract be entered into between the
City of Clearwater am ~1r. and Mrs. Webb with regard to the property at the CClrner
of Fort Harrison Avenue and Cbastnut Street. Motion was seconded by Comnissioner
Fields ani carried unan imously.
A letter was read rrom Mr. John Meek, Presid ent of the Chamber of' Commerce,
suggesti~ that the Chamber of Conmerce of'f:ic es be relocated in a new building
to be built on City -owned property bet\ieen the City Library am Drew Street ex-
tension on too \'lest side of' Osceola Avenw in Secti on 16-29-15. It was explained
that the present building at 411 C~eveland Street could be sold am would provide
enough money f'or the ne~ building. The letter asked the Commission's approval of
such plans. Conmissioner Smith moved to accept the letter, end or se the request
of the Chamber of Commerce, authorize th EDl to pro ceed, subje ct to the approval of
this Board to all the proceedings, and that all legal matters be worked out with

The Mayor called the meeting to order. The invocation was givei� by the

Insco moved that the minutes of the regular meeting of N;arch 5, 19b2, be approverl
as recorded and as siabmitted in written summation by the Clerk to each
Commissioner. Mot ion was second ed by Commissioner Fields artl carried unanimous ly.
Commissioner Smith indicated his approval. of the minutes of February 19th and 22r_r�.
Regardin� bids to , urchase or raze th� buildin; at 12$ Nar�th Osceola Avenue
{the former Rogers 'home�, the City I�Ianager reported tYa�ee bids had been rec�ived,
the highest beir� �1,010.00 from t�Ir. ;�'t. Luczynski to purchase the building. The
City Manager recommended that the bids be rejected since he did no� consider the
high bid to be consistent with the replacement value of the huilding, Cammissioner
Smith moved to accept the recommendation of the City Manager and reject all of the
bids. Motion was seconded by Commissioner Insco and earried unanimously.
As to an actuarial study of the employees� pension plan and the firemenTs
pension plan, the City Manager reported he had co ntacted the State Comptrollerrs
office in Tallahassee for recommendations as'ta firms o,ualified to do the work,
and had received a list of five firms of consultant s. 'r•;r. Gerald Weimer re�ort-
ed that five proposals had been received for such a survey:
Bowles, Andrews & Towne, Miami �,3,500.00
John Ripandelli, �allahassee 3,125.00
Marsh and P�cLennan, i�'tiami 2, 500.00

I��Ir. tt�eimer �xplained he and the CiLy Manager were recommending acceptance of
the proposal �f the GTyatt Gom�any as it included four conference aays in GlEarvaatEr,
some regional studies and the company will make stud�.es for additional information
the Ci�y may request at a cost not to exceed �1�, 000.00. Connnissioner Smitll moved
that the recorr�nendation accepting the proposal of ?�dyatt Company be foaldwed and
that the proper officials proceed. Motion was secorxled by Co�nissioner Fields and.
carried unanimously.
Mr. Wm, M. MacKenzie representing P�Iz�. Harry W. Shepard, Sr., Mr, Harry W.
Shepard, Jr., and Mr. Gonzalo Garcia, presented a pmposal to lease £or twenty-five
years a tract bounded on the east by Coronado, on the north by Causeway Boulevard
extendPd, on the vaesc by Clearwater Beach, on the south by Soutli Gulfview Boulevard
except a tract in the southwest corner, i4la.► x 1�2� for the operation of a parking
facility, f�r �9,000,00 a year or �'750.00 per mon�� with the Git3r to receive one
half of gross revenues over �"50,000.00 in any year. He explained if it became
economically feasible to add a second story, the proposed lessees wt�uld plan to do
so with City approval of plans and agree�nent on a revision of rentaT payments. He
s�ated the area would b e black topped, properly draine d, �o uld be enclos ed by a
five foot chain link fence and would be opaz for parking fmm $c00 A.t�i, to 12;00
midnight with space for 31�' vehicles. Mr. �'IacKenzie explained it would be request-
ed that real e stat e taxes b e paid by t he City, t he pro pos ed less ee to pay any
personal property �ax. Mr. Harold Wilso:�, representi�g Nfr. George Volker and
others prasented a proposal to lease the same area far a parking facility offering
35�0 of the gross rec�ipts with a minimum of �10,000.00 annually. b7r, Jesse Saunders,
Dr. P. C. Spengeman, Nfr. A. D. Finch, ;�ir, Zeonard Merrell, Mr. Ernsst Barger and
others ob jected to the pro posals. hir. Otven S. Allbritton, III representing
Clearwai:er Fishing arrl Recreational Pier, Inc, , opposed theme Nr. Robert �ench
representing Pier Pavilion of (;learF�ater, Tnc., objected. Commissioner Turner
stated he felt with some of the facts that have been preser�ted that it would not
be in the best interests of the City at this time to lease th is property for use
as � parking lot. Commissioner Turner mov ed that the propert}t be retained for
City purposes. r�lotion wa� seconded by Gouunissioner Fields and carried unanimously.
In response to an inquiry by the Mayor, the people in the audie�ae indicated they
would like to have the property in question pavea by City forces for parkino ra,her
than ha�Te it left as it is.
' The City Nianager presented the request of Standard Development Company consider-
ed at the last meeting for a new zone on theeast side of Highland Avenue from Lakeview tio
Barry to permit sale and consumption of alcoholic beverages. Nir. Rabert G. Mickens
re�resenting the company stated the request nad been modified at the last meeting
to include on:ly Lots 5 and 6, Forrest Hill Estates, the proposed bowling alley to
be on Lot 6 and the proposeci restaurant on Lot 5, i�ir. A. fI. Buchnan, 112$ East �
Turner, and I�Tr. D. C, Johnson, 1109 Pineview, objected. A petition of objection
containing 169 names was presented but it was ir.dicated the majori ty lived outside
the City limitse Commissioner Smith suggested since the signers of t he petition
