I The City Commission of the City of Clearwater met in regular session at the City Hall, Monday, February 19, 1962, at 1:30 P.M., with the following membors present: Robert L. Weatherly Cleveland Insco Herbert R. Fields Amos G. Smith Joseph K. Turner, Sr. Mayor-Commissioner Commissioner Commissioner Commissioner Commissioner Also present were: James R. Stewart Herbert M. Brown Max Battle W. Booth City Manager City Attorney City Engineer Police Chief The Mayor called the meeting to order. Attorney. The invocation was given by the City Commissioner Insco moved to deviate from the agenda to present a citation and to take up such items that require full Commission presence. Commissioner Fields seconded the motion which carried unanimously. The Mayor presented a citation prepared for Walter R. Ellis for his public service as a member of the Library Board for the years 1961 to 1962. The City Attorney read on its first readine Ordinance #919 amending Section 4, Article I, Chapter 15, City Code, 1950, regarding intoxicating liquors by adding Zone 16, Unit 5 of Island Estates of Clearwater. Commissioner Turner moved to pass Ordinance #919 on its first reading. Motion was seconded by Commissioner Fields and carried unanimously. Mrs. L. C. Davis protested this liquor zone change and presented a petition on the same signed by 21 persons. Commissioner Fields moved that Ordinance #919 b~ read and considered by title only on its second reading with the unanimous consent of the Commission. Motion was seconded by Commissioner Insco and carried unanimously. The ordinance was read on its second reading by title only. Commissioner Fields moved to pass Ordinance #919 on its second reading by title only. Motion was seconded by Com- missione~ Turner and carried unanimously. The Mayor suggested the record show that the~e were no objections from Island Estates residents concerning this liquor zone change. Commissioner Fields moved to read and consider Ordinance #919 on its third and final reading at this meeting of the Commission with the unanimous consent of the Commission. Motion was seconded by Commissioner Insco and carried unanimously. The ordinance was read in full. Commissioner Turner moved to pass Ordinance #919 on its third and final reading and adopted and the proper officials be authorized to execute it. Motion was seconded by Commissioner Fields and carried unanimously. The City Attorney presented Ordinance #918, an intent to annex a portion of Section 17-29-16, to be read and considered on its third and final reading. Mr. John R. Bonner representing Mr. Robert Stetler stated that this property was zoned by the County for trailer park and it was requested that it be annexed into the City with the same zoning. Mr. Bonner also pointed out the advantages to the City in annexing this land. Mr. Alex D. Finch representing Miss Mary Drew and Mrs. Alan Drew, owners of the property adjacent to the proposed trailer park, stated that there is a question as to the legality of the zoning of this property. He stated that when the County Commission dealt with the zoning of this property, Mrs. Drew did not receive any notices of the public hearing as her name was not on the list of people notified by the County. Mr. Finch stated that he hoped to establish a decision within a week as to the legality of the County zoning of this property. Commissioner Fields moved to defer the third reading of Ordinance #918 to the next meeting of the Commission in two weeks. Motion was seconded by Commissioner Turner and carried unanimously. The City Attorney read on its first reading Ordinance #920, an intent to annex a portion of Section 18-29-l6 (Sunny Grove Trailer Park). Commissioner Smith moved that Ordinance #920 be passed on its first reading. Motion was seconded by Commissioner Insco and carried unanimously. Commissioner Fields moved to consider Ordinance #920 on its second reading by title only with the unanimous consent of the Commission. Motion was seconded by Commissioner Smith and carried unanimously. The ordinance was read on its second reading by title only. Motion was seconded by Commissioner Fields and carried unanimously. The City Manager announced that a hearing will be held Tuesday, February 20, before the County Commission to determine the feasibility of establishing the Keene Forest Sanitary Sewer District. This district would include areas that the City of Clearwater may wish to annex and a survey has been made. The City Manap'cr stated there is a definite need for a sewer in this area and urged that as many Commissioners as possible attend this hearing. Commissioner Fields moved that the City Manager. City Attorney and City Engineer be present at this meeUng at the Court House on Tuesday, February 20th. Motion was seconded by Commissioner Insco and carried unanimously. Commissioner Insco moved that Commissioner Smith be excused from the City Commission meeting of March 5, 1962, as he will be out of the City. Motion was seconded by Commissioner Fields and carried unanimously. The City Manager recommended accepting the low bid of $7,043.64 submitted by Pucketts of Clearwater for 3 new police motorcycles with radios and less trade-ins. Commissioner Fields moved upon the'joint recommendation of the Police Chief and Assistant Purchasing Agent that the bid of $7,043.64 submitted by Pucketts of Clearwater be accepted, which is the lowest and best responsible bid and the appropriate officials be authorized to execute said contract which shall be in accordance ~th the plans and specifications and bid. Motion was seconded by Com- missioner Turner and carried unanimously. The City Manager read a letter from the Historical Committee Chairman, Mrs. Nancy Meador, which requested that the City add five additional names to this committee, so that they will be assured of having a quorum at most of their meetings. The letter suggested that the following be included on the comn'i ttee: Mr. Joseph Padgett, Mr. William Goza, Mrs. Edward Guy, Mr. Herbert Blanton, Jr. and Mr. Lester Plumb. Commissioner Smith moved that the recommended persons be appointed to the Historical Committee. Motion was seconded by Commissioner Fields and carried unani- mous ly . The City Manager presented a recommendation from the Civil Service Board that 60 days' additional sick leave be granted to G. W. Sculley, Parks and Recreation Department. Commissioner Fields moved that additional sick leave be granted to G. W. Sculley of Parks and Recreation Department. l1otion was seconded by Commissioner Smith and carried unanimously. The City Manager recommended the appointlnent of the Reverend C. M. Harris of the Church of God as the Ministerial Association's ~epresentative to the Charities Solicitation Board. Commissioner Fields moved that the appointment of the Reverend C. M. Harris to the Charities Solicitation Board be approved. Motion was seconded by Commissioner Insco and carried unanimOUSly. The City Manager reported that a drainage problem has arisen between Prospect and Myrtle Avenue on Park Street where a storm sewer line collapsed and it was dis- covered that the old concrete pipe had deteriorated. The Manager requested per- mission to replace the concrete pipe at a cost of $975.00. Commissioner Insco moved to grant the request of the City Hanager to replace the old concrete pipe on Park Street between Prospect and Myrtle Avenue at a cost of $975.00. Motion' 'was seconded by Commissioner Turner and carried unanimOUSly. 8lock K, A request was presented to~vacate an easement in order to build a home on the south half of Lot 6, Lots 7 and ~ Hillcrest #2 Subdivision. This property is on the corner of Drew Street and Highland Avenue. The owner will pay all expenses to relocate a manhole and sanitary sewer line. Commissioner Insco moved to grant the request for vacation of easement in Hillcrest Subdivision #2. Motion was seconded by Commissioner Fields and carried unanimously. Resolution #62-16 was presented dedicating the Drew Street right of way at Drew Street and Fern. Commissioner Smith moved to pass Resolution #62-16 and that the proper officials be authorized to execute it. Motion was seconded by Commissioner Insco and carried unanimOUSly. Resolution #62-17 was presented authorizing payment to Pinellas County Title Company for title services rendered in the amount of $10.00 concerning pumping station site in Section 24-29-15 with the money to come from the Construction Trust Fund of 1960 with the First National Bank. Commissioner Insco moved that Resolution #62-17 be approved and that the proper officials be authorized to execute it. Motion was seconded by Commissioner Fields and carried unanimously. Resolution #62-18 was presented authorizing payment to Briley, Wild and Asso- ciates from The 1960 Construction Trust Fund at First National Bank in the amount of $541.00. Commissioner Insco moved to pass Resolution #62-18 and the proper officials be authorized to execute it. Motion was seconded by Commissioner Fields and carried unanimously. Resolution #62-19 was presented assessing the construction of an 8-inch sanitary sewer in Y~lvington Avenue from Gulf to Bay north approximately 460 feet. Commissioner Fields moved to pass Resolution #62-19 and the proper officials be authorized to execute it. Motion was seconded by Commissioner Insco and carried unanimouay. Commissioner Turner moved to pass Resolution #6'2-21 and the proper officials be authorized to execute it and that the Commission Attend thl! maelinE of the Trustees of the Internal Improvement Fund on February 27th. Motion waG Dcconded by Commissioner Fields and carried unanimously. Resolution #62-22 was presented requesting a district Sociill Security office be established in Clearwater. Resolution #62-23 was presented approving a Construction Truot Fund ^Rreement with the Bank of Clearwater for the funds of the Bridee Revenue Bonds. Commissioner Smith moved to pass Resolution #62-23 and the proper officiuls be authorized to execute it. Motion was seconded by Commissioner Fields anu carried unanimously. The City Attorney submitted an easement agreement between the City and Marie E. Lloyd outlining the conditions for granting an easement to the City for part of Lot 93, Glenwood Subdivision. Commissioner Turner moved on the recommendation of the City Manager that the agreeJrentand easement with Marie E. Lloyd be accepted and the proper officials be authorized to execute it. Motion was seconded by Commissioner Smith and carried unanimou~ly. The City Attorney presented an agreement with Ldith Coughlan for Chestnut Street right of way in the amount of $3,412.00 for part of the west 55.2 feet of Lot 1, Block 1, Wallace Addition. Commissioner Fields moved that the purchase of land from Edith Coughlan in the amount of $3,412.00 be approved and the proper officials be authorized to execute it. Motion was seconded by Commissioner Turner and carriad unanimOUSly. Resolution #62-24 was presented requ~r1ng two property owners to clean their lots of weeds and undergrowth. Commissioner Smith moved to pass Resolution 062-21. and the proper officials be authorized to execute it. Motion was seconded by Commissioner Fields and carried unanimOUSly. Resolution #62-25 was presented assessing the construction of 30-foot pavement, curbs and drainage on Somerset Street beginning at Mandalay and extendinc weutcrly approximately 320 feet. The City Manager read a letter from Mrs. Louisa Duvoisin protesting the sandwall at the end of the street. Commissioner Turner moved to pass Resolution #62-25 and the proper officials be authorized to execute it. Motion was seconded by Commissioner Fields and carried unanimOUSly. The City Manager requested that a resolution be drawn vacating the easement at Drew Street and Highland Avenue which had been approved earlier in the meeting (part of Lot 6, Lots 7, 8, Block K, Hillcrest #2). Commissioner Turner moved that Resolution #62-26 be drawn and passed and that the appropriate officials be authorized to executa it.
