Brown J. E. Anderson T. Murphy W. Booth City Manager City Attorney Acting City Engineer Engineering Division Police Chief The Mayor called the meeting to order. The invocation was given by the Oity Attorney. Commissioner Smith moved that the minutes of the meeting of November 14th, 20th and 21st, 1961, be approved as recorded and as submitted in written summation by the Clerk to each Oommissioner. Motion was seconded by Commissioner Fields and carried unanimously. The City Manager reported a letter from Mr. Frank T. Callahan of J. E. Greiner Company, Consulting Engineers, recommended accepting the low bid of $263,339.49 from W. L. Cobb Construction Company, Tampa, for construction of approach roads to proposed Clearwater Pass Bridge. The letter recommended the contract be awarded subject to sale of the bridge revenue bonds by the City. Commissioner Fields moved that the low bid of W. L. Cobb Construction Company in the amount of $263,339.49 be accepted inasmuch as it is concurred in by the City Manager and the J. E. Greiner Company, the City's (Consulting) Engineers in this regard, subject to the Little Pass Bridge bonds bang sold, and in the event that they are not sold, the City of Clearwater will incur no liability under awarding this bid; that the proper officials be authorized to execute same after the bonds are sold. Motion was seconded by Commissioner Walters and carried unanimously. It was recommended by the City Manager that the low bid of $7,287.00 from U. S. Pipe & Foundry Company, Birmingham, Alabama, be accepted for 4,200 feet of 6 inch cast iron pipe for the Water Division, Utilities Department. Commissioner Walters moved on the joint recomnendation of the Utilities Manager, Water Superintendent and Assistant Purchasing Agent, that the bid for cast iron pipe be awarded to the U. S. Pipe & Foundry Company for the amount of $7,287.00 which is the lowest and best responsible bid, and the appropriate officials of the City be authorized to execute said contract which shall be in accordance with the plans and specifications and bid. Motion was seconded by Commissioner Fields and carried unanimously. The City Manager recommended accepting the lo~ bid of $2,069.55 from L. L. Stone, Clearwater, for construction of sanitary sewer in Yelvington Avenue from Rainbow to Gulf to Bay. Commissioner Fields moved on the recommen- dation of the Acting City Engineer and Assistant Purchasing Agent that the con- tract for the sum of $2,069.55 submitted by L. L. Stone be accepted which is the lowest and the best responsible bid, and the appropriate officials of the City be authorized to execute said contract which shall be in accordance with the plans and specifications and bid. Motion was seconded by Commissioner Walters and carried unanimously. It was recommended by the City Manager that the low bid of $2,797.20 from L. L. Stone, Inc., Clearwater, be accepted for construction of sanitary sewers in Howard Street from Madison to Missouri. Commissioner Walters moved on the joint recommendation of the Acting City Engineer and Assistant Purchasing Agent that the bid for Howard Street sanitary sewers, Madison to Missouri, be awarded to L. L. Stone, Inc., for the sum of $2,797.20 which is the lowest and best responsible bid, and that the appropriate officials of the City be authorized to execute said contract which shall be in accordance with plans and specifications and bid. Motion was seconded by Commissioner Fields and carried unanimOUSly. The City Manager announced the City has been cooperating with a committee of the Chamber of Commerce and other interested people to obtain a permit to construct an artificial fishing reef offshore from Clearwater Beach. He explained a letter indicating approval of the project had been received from the Trustees of the Internal Improvement Board but now it was necessary to submit a formal request for action; then it would be necessary to apply to the U. S. Army Corps of Engineers for approval. Commissioner Fields moved that application be made to the Trustees of the Internal Improvement Fund of the State of Florida for the purpose of constructing artificial fishing reef offshore some 5,400 yards from Clearwater Beach; that the proper City officials process this application through the Manager's office, and that after permission of the I. I. Board has been obtained that the Man~ger proceed with the application to the U. S. Corps of Engineers to get their final approval on the project. Sever, owner of property known as Fair Oaks Addition, which would provide that Mr. Sever would grant the City an easement for sanitary sower transmission main through acreage in Section 24-29-15 which is prosently outside the City limits with the provision that the property \tJOuld not be assessed for tbe sewer until it was platted and brought into the City and that no taps would be made until that time. Commissioner Fields moved upon the recol~endation of the City Manager and the City Attorney that the easement and agreement of M. E. Sever be approved, that the proper officials be authorized t,o execute it, and t h3t the easeli:ent from r-1. E. Sever be accept ed at no cost to the City. f1otion was seconded by Comr.1issioner VJalters and carried unanLnously. The City Attorney presented a deed to the United States of America for 2.3.26 acres of submerged land in Section 17-29-15 VJhich had been used as a spoil area for some of the dredgir.g for the deepening of ClearvJater Pass. He explained this was some of the acreage which had been deeded to tbe City by tbe Internal Improvement Board recently. Commissioner Insco moved to approve the deed to the United States of America for Spoil Arua U5 and the proper officials be authorized to execute it. Motion was seconded by Cotn:Tdssioner Fields and carried unanimously. The City Attorney read a proclamation designatine the month of December, 1961, as beautification and clean-up monLh and urging all or~anizations and citi- zens to cooperate. Commissioner- Insco moved that the r.1ayor be authorized to send this proclamation to the various a~encies and service clubs of the City to give a City-wide impact on this program. Notion was seconded by Commissioner ','lalters and carried unanimously. Resolution #61-120 was pr8sented approving a franchise to supply natural gas within the Town of Largo as set out in its Ordinance #C165. Commissioner Fields moved Resolution #61-120 be approved and the proper officials be authorized to execute it. Motion was seconded by Co~nis5ioner Smith and carried unanimously. Resolution #61-121 was presented requiring nine property owners to clean their lots of weeds and underi;rowth. Commissioner Insco llloved to pass Resolution #61-121 and the proper officials be authorized to execute it. Motion was seconded by COD~issioner Fields and carried unanimously. The City Attorney stated he had received a letter from County Attorney Joseph Rodriguez requesting that tbe City execute a quit claim deed to the County to clear the title to acrease located at the northwest corner of Gulf- to-Bay and Bayshore Boulevard deeded to the County by B. L. McMullen January 19, 1925, with the provision that if the area ever came within the City limits the title would be transferred to the City. The letter explained the County was contemplating leasing the area to the Unlled Daughters of the Confederacy for a museum and clubhouse site. By consent, the City Attorney was instructed to con- tact the McMullen heirs and their atLorney, Mr. C. B. McMullen, Jr., and report back to the Commission. r-1r. H. H. Baskin, Jr., presented an addendum to the contract vdth !vIr. Ed C. Wright and Bayside Hotel Company, Inc., dnted November 1.3, 1961, amending Sections .3 and 4, and adding Sections 7 and 8 concerning the contingency fund of $100,000.00 in negotiable bonds to be set up by Mr. Wright and the bond of $16,000.00 in U. S. government bonds from Bayside Hotel Company, Inc., to cover any costs that mi~ht go beyond the amount of the proposed revenue bonds for Clear- water Pass Bridge. He said Mr. Wright has the bonds now ready to turn over to the City. Commissioner Insco moved that the addendum to that certain recently executed contract between the City of Clearwater and Bayside Hotel Company, Inc., and Ed C. Wright, as just read to the Commission, be approved and that the proper authorities be authorized to execute the same. Motion was seconded by Commissioner Fields and carried unanimously. Mr. H. H. He presented a contract for that amount signed by the Hardaway Company and also an agree- ment supplemental to 'the contract \'l/hich would shorten the working time from 540 to )65 calendar days shown or. addendum C-2 under Item 6, and which would decrease the price by ~12,578.20 due to revision of the superstructure details. He recommended the execution of 1:.he contract be conditional upon funds being made available through sale of the bridge revenue bonds. Commissioner Fields moved thAt the supplemental agreement bet\'l/een Hardaway Contracting Company 'together with the original a~reement between the City of Clearwater and Harda- way Contractin8 Company in the total amount of $802,928.90 less the amount mentioned in the supplemental agreement in the amount of $12,578.20 be approved and that the proper officials be authorized to execute the same it being subject to the sale of the bonds as mentioned in Paragraph 6, Page C-2, of the said con'tract. Baskin, Jr., as special attorney and Mr. Herbert Brown as City Attorney, for their work on this project. Mr. H. H. Baskin, Sr., expressed appreciation to the City. · Mr. Al Roberts of Goodbody & Company, fiscal agents, reported bids could be received for sale of the brid~e revenue bonds to finance Clearwater Pass Bridge in abou~ 'two weeks and su~gested Decelober 20th. By consent, the date of December 20th at 2:00 P.M. was set to advertise for receipt of bids on the bonds. ~!r. H. H. Baskin, Jr., reported in regard to the guarantee of $100,000.00 in negotiable bonds from 1.1r. Ed. C. \vright for annexation of lands which he owns on Sand Key, that Mr. Wright had had his attorney in Tallahassee prepare a standard bond form and that this is set up for deposit of the bonds with the Bank of Clearwater as escrow agent. Commissioner Fields moved that the bond of Mr. Ed.C. WriGht with reference to the annexation bond providing for $100,000.00 be approved subject to the ap~roval of the City Attorney and the Bank of Clear- water :1cting as escrow aGent. Kruse of the Zoning and Planning Board for recon~endations and bring them back to the Commission as soon as possible. The City Illanager recommended the Commissioners view the site before taking any action on it. Commissioner T/Jalters inquired at'out the proposed 40-hour week for City employees. The City Manager stated the necessary additional employees were in the process of bein~ approved by the Civil Service Board and that the 40-hour week would start January 1st with the exception of hourly-paid employees and the Fire Department employees who \\'ill go on a 56-honI' ",,>,eek. Commissioner Walters asked if there was an ordinance against a flashing type sign on Clearwater Beach. The City Attorney stated a flashing beacon type ~ign was prohibited by the sign ordinance but a flashing type sign was permitted ~n a Business zone. Commissioner Insco urged the Commission and the City Attorney to look into substandard negro housing in Clearw~ter and find out what legal means can be used to condemn some of the places ur:ifit for habita'tion. The Mayor stated the letter had been acknowledged by Mr. Leonard L. Farber, shopping center developer, of Hartsdale, New York, in a letter which said that the request follows his company's usual practice to use local workers. Commissioner Insco moved the letter be received for the record. Motion was seconded by Comnissioner Fields and carried unani- mously. The Mayor stated the Belmont Civic Clubhouse needed repair and requested the Manager investigate and take whatever action is necessary. The ~Iayor requested the Manager to investigate the drainage situation in the Industrial Park near the building of' Decks, Inc. Commissioner Fields requested some action be taken relative to Towers rr. V. Service, 2119 Gulf' to Bay Boulevard placinf:; empty packing cartons on the sidewalk and street. Commissioner Insco moved that t he first of'ficial meeting of' the City Commission ror the year 1962 be on Tuesday, January 2nd. Motion was seconded by Commissioner Fields and carried unanimously. The Commission now adjourned as the City Commission and acting as Trustees of' the Pension Fund heard letters read from the Advisory Committee recommending that William E. Spain, Driver, Refuse Division, ULility Department; John W. Monyhan, Attendant, Sewage Treatment Plant; Patrick S. Goakley, Patrolman, Police Department, be admitted to the Pension Plan. Commissioner Insco moved the three employees be accepted in the Pension Plan. Motion was seconded by Co~nissioner Fields and carried unanimously.
