Tne City Commission o~ the City of Clearwater met in regular session at the City Hall, Monday, September 18, 1901, at 1:30 P.M., with the following members present.: Robert L. Weatherly Cleveland Insco, Jr. Amos G. Smith Kenneth \valters Mayor-Commissioner Commissioner Commissioner Commissioner Absent: Herbert R. Fields Commissioner Also present were: James R. The invocation was given by the City Attorney. Commissioner Insco moved the minutes or the regular meetings of August 21st and September 5th, 1961, be approved as recorded and as submitted in written summation by the Clerk to each Commissioner subject to approval o~ Commissioner Fields. Motion was seconded by Commissioner Smith and carried unanimously. The City Manager recommended accepting the low bid of $7,994.44 from Campbell Paving Company, Clearwater, for paving, curbs and drainage in Sunnydale Drive, Industrial Park. Commissioner Walters moved upon the joint recommendation of the Acting City Engineer, Finance Director and Assistant Purchasing Agent that the con- tract ror paving, curbs and drainage in Sunnydale Drive, Industrial Park, be awarded to Campbell Paving Company for the sum of $7,994.44 which is the lowest and best responsible bid and the appropriate officials o~ the City be authorized to execute such contract which shall be in accordance with the plans and speci~ications and bid. Motion was seconded by Commissioner Smith and carried unanimously. Regarding the bids for fire hose, the Manager recommended accepting the low bid of $2,620.00 (less 1%) from Fountain Fire Equipment, Tampa, and that additional ~oot- age of hose be purchased up to amount of budget appropriation ($4,600.00) at the same rate. Commissioner Smith moved on the joint recommendation of the Fire Chie~, Assistant Fire Chie~s, Finance Director and Assistant Purchasing Agent with the City Manager concurring therein, ~ith sufficient funds available1 that the bid for ~ire hose, expressly requesting 2,000 feet 2i" and 400 feet of 1." double-jacket dacron rubber-lined fire hose, be awarded to the Fountain Fire Equipment Company in the amount o~ $2,620.00 which is the lowest and best responsible bid, and the appropriate o~ficials or the City be authorized to execute said contract which shall be in accord- ance with the plans and speci~ications and bid. Motion was seconded by Commissioner Insco and carried unanimously. The City Manager presented a letter from Mr. Harold Briley, Consulting Engineer, which recomnended that the low alternate bid of $62,911.50 from Edelblut Construction Company, Fort Myers, be accepted for installation of water transmission main in Belleair Road connecting the new ~ater tank on Greenwood with the Pinellas County Water system and also connecting the new water tank in the north end with the trans- mission main in Sunset ,Point Road. A second letter from Mr. Briley recommended accepting the low alternate bid of $108,765.00 rrom U. S. Pipe & Foundry Company, Birmingham, Alabama, ~or 17,000 feet of 16 inch pipe for water transmission main. A~ter discussion as to why the alternate bid was preferred, the Commission by con- sent decided to delay awarding the contracts until after a conference with Mr. Briley. The City Manager reported six bids had been received to print the Annual Report for the City as a color brochure, the lowest being from Meinders & Noble, Clearwater, for $2,795.00 (less 2% discount). He explained this does not include the distribution cost and after checking ~ith Clearwater Sun representatives an estimate of $2,361.00 was given to print and distribute the report as a tabloid section. Commissioner Insco moved all bids to be rejected as submitted for the printing of the Annual Report and that the City Manager be instructed to negotiate with the Clearwater Sun ror the Annual Report as a special tabloid section in the amount of approximately $2,361.00. Motion was seconded by Commissioner Walters and carried unanimously. The City Manager presented a priority list for street resurfacing projects divided into ~irst, second and third priorities with projects in each division listed according to need. He explained that the list was drawn up on recommen- dation of the Engineering and Street Divisions, Public Works Department. A~ter discussion it was decided to add Corona Avenue north of Drew Street as the last item under Priority #2. It was mentioned that improvements ~or Betty Lane and part o~ Lakeview Road had been given top priority in the County road budget starting October 1st. Commissioner Insco moved to adopt the priority list for street re- surfacing dated September 18, 1961, with Corona Avenue added as the last item under Priority #2, subject to revisions for emergency situations. By consent, the request was referred to the City Mana~er for a decision. A request from Mr. Robert Freeze, City Prosecutor, for a $1,200.00 yearly in- crease in salary was discussed. It was pointed out that his duties were increased and he was spending many more houI's on the job than was anticipated when he was appointed. Commissioner Walters moved to increase the salary of the City Prosecut- ing Attorney to the extent of $600.00 per year. Motion was seconded by Commissioner Smith and carried unanimously. A request was presented from Decks, Inc., ror approval of a 220 x a5 foot ad- dition to its present building on east halr, Lot 19, Industrial Park. Commissioner Smith moved the plans be approved. Motion was seconded by Commissioner Walters and carried unanimously. The City Manaser reported he had received a request from the Shrine Club of Clearwater to waive the license fee for the perf'ormances of the Clyde Beatty-Cole Brothers Circus to be sponsored by the club on November 10th, 1961, at Green Field. He stated the club would put up the necessary guarantee to clean up the park, etc. Commissioner Insco moved to waive the license fee. Motion was seconded by Commissioner Walters and carried unanimously. 'fhe Mayor expressed appreciation to the employees in the Engineering Division for the way they carried on their duties during the illness of the late City Engineer, Sidney Lickton. The City Manager explained the two new sewage disposal pumps for lift stations on the north end of the beach had arrived. He asked permission to have the pumps inst~lled by force account at an estimated cost of $1,450.00 for one pump and $1,400.00 for the other, money for which is budgeted under sewage disposal plant appropriation. Commissioner Smith moved to approve the Manager's request. Motion was seconded by Commissioner Walters and carried unanimously. Commissioner Smith moved to vary from the agenda to take up Item #16, "Ord.#902 - Revised Charges for Garbage Collection - Jrd Reading." Motion was seconded by Commissioner Walters and carried unanimously. The City Manager said that Mr. Fred Taylor, Utilities Manager, was on the way to the meeting and suggested waiting until he arrived. Commissioner Insco moved to proceed with the regular agenda until Mr. Taylor arrives and then go to Item #16. Motion was seconded by Commissioner Walters and carried unanimously. Resolution #61-94 was presented vacating the north eight feet or Lots 5 and 9, Replat of Blocks 80 and 81, Unit 5, Mandalay Subdivision. The City Attorney ex- plained a motion to that effect had been passed at the meeting of January 19, 1959, but it was necessary that it be done by resolution. Commissioner Insco moved to pass Resolution #61-94 and the proper ofricials be authorized to execute it. I~otion was seconded by Commissioner Walters and carried unanimously. The City Attorney presented a resolution authorizing payment of $12,753.70 to Briley, Wild and Associates, Consultin~ Engineers, for engineering services in con- nection with the $600,000.00 Water Improvement Project. The City Manager explained this fee included the two projects which the Commission postponed at this meeting and that it might be best to delay this payment until the contracts were awarded. Commissioner Insco moved that the resolution be set aside. Motion was seconded by Commissioner Walters and carried unanimously. Resolution #61-95 was presented authorizing payment of $644.00 to Keppie Travel Bureau, Inc., for travel expenses for those city officials who went to New York City to sisn the bonds for the $840,000.00 bond issue of 1960. Commissioner Insco moved to pass Resolution #61-95 and that the proper ofricials be authorized to execute it. Motion was seconded by Commissioner \valters and carried unanimously. Resolution #61-96 was presented authorizing the proper City officials to borrow the sum of $375,000.00 from three banks as f'ollows: ~125,OOO.OO from Bank of' Clear- water, ~125,000.00 from First National Bank of Clearwater and $125,000.00 from City National Bank for one year at interest of not more than 3~%. The City Attorney ex- plained these funds were to make a loan to the State Road Department to help finance the construction of the new east bridge on r~emorial Causeway as set out in an agree-. ment dated Hay 31, 1961. The City Manager read a letter from Nr. Hubert E. Heldron, Comptroller, State Road Department, requestin~ payment according to the agreement. Commissioner Insco moved to pass Resolution #01-96 and the proper officials be authorized to execute it. Motion was seconded by Commissioner Walters and carried unanimously. Ordinance #902 amending Ordinance #773 by revising refuse collection rees was presented for its third reading. Mr. Leonard Merrell objected to the proposed rates stating that average occupancy of motels was 30% to 50% and average occupancy or apartments was 50% to 80%. He suggested a monthly base rate for both or $1.75 to cover the first anitj for additional motel units 40~ each for the next 9 units and 30~ each for allover 10; for additional apartment units 80~ each for the next 9 units and 60~ each for allover 10. Mr. Fred Taylor, Utilities Manager, indicated his study showed that the City would lose $500.00 per month on Mr. Merrell's proposal. 'rhe question was raised as to how it would be determined whether a rental facility comes under the motel or apartment classification. By consent, the Commission agreed to defer the matter for further study of the proposal made by Mr. Merrell and Commissioner Smith. The City Attorney read on its third reading Ordinance 11903 amending Ordinance #567, the Election Ordinance, concerning the number of voters for each machine. Commissioner Smith moved Ordinance #903 be passed on its third and final reading and adopted and the appropriate officials be authorized to execute it. Motion was seconded by Commissioner Walters and carried unanimously. The City Attorney presented for its second reading Ordinance #904 declaring the City's intention to annex acreage in Sections 7-29-16 and le-29-l6 (Junior College branch site). Commissioner Walters moved Ordinance #904 be read and con- sidered by title only on its second reading by unanimous consent of the Commission. Motion was seconded by Commissioner Smith and carried unanimously. The Ordinance was read by title only. Commissioner Smith moved Ordinance #904 be passed on its second reading by title only. Motion was seconded by Commissioner Insco and car- ried unanimously. The Attorney read on its ~irst reading Ordinance #905 annexing Lot 37, Sunset Highlands Unit 2, acreage in Section 13-29-15 (Constantine) and acreage in Sec- tion 23-29-15, (7th Day Adventist Church), Commissioner Smith moved Ordinance 11905 be passed on its first reading. Motion was seconded by Commissioner Insco and carried unanimously. Ordinance #906 was read by the City Attorney on its first reading which declared the City's intention to annex acreage in Section 2-29-15 (to be known as Windsor Park Subdivision). Commissioner Smith moved Ordinance #906 be passed on its first reading. ~lotion was seconded by Commissioner Walters and carried unan- imously. The City Attorney read on its ~irst reading Ordinance #907 amending Ordi- nance #742, Charitable Solicitations Ordinance, by providing~or five members in- stead of seven members. Commissioner Insco moved Ordinance #907 be passed on its first reading. Motion was seconded by Commissioner Walters and carried unanimously. Resolution #61-97 was presented requiring forty-two property owners to clean their lots of weeds and undergrowth. Commissioner Smith moved Resolution #61-97 be approved and the proper officials be authorized to execute it. The City Attorney presented a drainage easement from ~lr. W. C. Overcash in Section 35-28-15 north of Union Street and the proposed Windsor Park Subdivision for the Commission's approval. By consent, it was decided to defer acceptance of the easement until the plat of Windsor Park was approved. The City Attorney reported a letter had been received from Colonel J. V. Sollohub, U., S. Army Corps of Engineers, Jacksonville, acknowledging receipt of Resolution "61-91 and reporting that the Atlantic Coast Line Railroad Company had revised its plans to provide a vertical clearance of nine feet above mean low water in the new bridge over Stevenson Creek and had promised that all debris such as old pilings, etc., will be removed. Commissioner Insco moved the letter be received and made a matter of record. Motion was seconded by Commissioner Smith and carried unanimously. The City Manager stated that Howard Douglas Smith, taxicab driver, had been arrested and found guilty in I~unicipal Court on September 13th of immoral use of a taxicab. The Police Chief and the City Manager recommended that his taxi permit be revoked immediately. Commissioner Insco moved the permit be revoked. Motion was seconded by Commissioner Smith and carried unanimously. I~. Edward A. Stillman complained about the recent ten day suspension of Miss Sarah Byers, City Librarian. After discussion, it was suggested that Mr. Stillman contact the City Manager at his office and the members of the Library Board. Commissioner Insco moved Commissioner Fields be excused from this meeting. l~otion was seconded by Commissioner Walters and carried unanimously. Commissioner Smith questioned the organization plan of the City particularly relating to understudies for possible promotion to department head in case of retirement or death. The City Manager stated there was no such provision in most departments. Commissioner Smith announced that he would be out of the City for one month starting September 25th. Commissioner Insco moved that Commissioner Smith be ex- cused from Commission meetings during that period. Motion was seconded by Com- missioner Walters and carried unanimously. The City Attorney reported he had been unable to find that any other cities had ordinances relating to 24 hour coin-operated laundries and the Florida League of Municipalities did not have knowledge of any. Commissioner Insco moved the dedication of the new Police Station and Jail be set for Friday, September 22nd. at 10:00 A.M., and that all the Comnlissioners be notified of the time of dedication. Motion was seconded by Commissioner Walters and carried unanUnously. The Commission now adjourned as the City Commission and acting as Trastees of the Pension Fand heard a letter read from the Advisory Committee recommending that Ira S. Roasseau, Meter Reader II, Utilities Department. be retired at a pension of $200.a) per month effective September 11, 1961. Commissioner Insco moved the pension of $200.$3 per month to Ira S. Rousseau be approved. Motion was seconded by Commissioner Walters and carried unanimously. Other 1et~ers from the Advisory Committee recommended that Robert Austin, Serviceman I, Utilities Department; Jessie Jackson, Collector, Refuse Division, Utilities Department; Jimmie T. Miller, Collector, Refuse Division, Utilicies Department; Paul W. Schaffer, Patrolman, Police Department; Betty Russell, Secretary IV, Legal Department, be admitted to the Pension Plan. Gentlemen: This ,dll acknowledge the receipt of your letter of 11 September 1961 and the accompanying resolution having to do with the construction of a new bridge across Stevens (3tever.son) Creek at Clearwater. The resolution of' the City Cornmission requests that the bridee not be approved unless a vertical clearance of 9 feet is provided and unless concrete footi~gs and other debris are removed from the channel. The resoll1tion further requests that a public hearing be held in connection with the application of the Atlantic Coast Line Railroad Company. The applicant has revised the plans to increase the vertical clearance by 1 foot. this will provide a vertical clearance of 9 feet above mean low water which is one foot more than the clearance provided by the nearby highway bridge. Representatives o~ the Atlantic Coast Line have also assured this office that all debris, parts of the old bridge structure, footings, pilings, etc. will be completely removed from the water- way. They state that they propose to do a small amount of dredging under the bridge to improve the navigable capacity thereof. It appears, then, that the applicant has met the first two requirements which ~ere covered by the resolution. With respect to a public hearing, I must decline to take favorable action. Public hearings are very expensive and are held only in connection with major construc- tion a~f€cting a large segment of the public, or in cases ~here it is clear that the necessary facts cannot be reduced to writing. ITI the case at hand you will recognize that the s~am is a rather minor stream and that there is no reason that full facts cannot be developed by means of public notice. You are assured that any information developed pursuant to the notice procedure is given the same weight as if it were developed at a public hearing.
