CITY COMMISSION MEETING September 5, 1961 The City Commission of the City of Clearwater met in regular session at the City Hall, Tuesday, September 5, 1901, at 1:30 P.M., with the following members present: Robert L. Wea~herly Cleveland Insco, Jr. Amos G. Smith Kenneth vlalters Mayor-Commissioner Commissioner Commissioner Commissioner Absent: Herbert R. Fields Commissioner I - II Also present were: James R. Stewart Herbert M. Brown Willis Booth J. E. Anderson Tom Murphy City Manager City Attorney Police Chief' Acting Gi~y Engineer Engineering Division The Mayor called the meeting to order. The invocation was given by the Reverend William Parsons, Peace Memorial Presbyterian Church, Clearwa~er. Commissioner Insco moved that Commissioner Fields be excused from this meeting. Motion was seconded by Commissioner Smith and carried unanimously. Commissioner Insco requested that the Commission deviate rrom the agenda to hear from Colonel James Watkins, Civil Defense Director. By consent, the Comnission agreed to this. Colonel James Watkins, Civil Defense Director, distributed identification signs for the Mayor, Commissioners, City Manager and City Attorney to use on their automo- biles in case of an alert. He invited the Commissioners to meet with the directors of' Civil Defense for the State of Florida at a convention to be held on Septe~ber 8th in Clearwater. He also announced that t~o Civil Defense classes in the personal survival course would begin this week at Clearwater High School and that Colonel Parkington, State Civil Defense Director, was in Washington, D. C., at present try- ing to secure additional funds ~or this survival course. Commissioner Smith reported he had delivered the greetings from the Mayor or Clearwater and the key to the City to the Mayor of Bogota, Colombia, South America, on his trip accompanying the Clearwater representatives to a s~imming meet in that City. The Mayor suggested that the two Clearwater swimmers, Kay Walker and Gail Greenwood, should be given a citation from the City for a job well done as being ambassadors from this city. The Manager presented a letter from Mr. Harold Briley, Consulting Engineer, recommending the low bid of $12,448.75 rrom Boyce Company, Inc., be accepted for Part 1, Utilities nnprovement Project, the installation of the l6-inch subaqueous water pipe at the east bridge of Memorial Causeway. The Manager e~plained con- struction of the new east bridge by the State Road Department would start in a short time. Mr. Briley stated this contract would include the removal of old lines in the bay and an old abandoned line on the Causeway. Mr. lilarvin Boyce sug~ested an aban- doned 6-inch gas line should also be removed. The Mayor suggested Mr. Boyce ~ork that out with the City Manager. Commissioner Smith moved on the recommendation of the Consulting Engineer, with ~he City Manager concurring therein, that Fart 1 cover- ing the installation of l6-inch subaqueous pipe at the east bridge of Memorial Cause- way be awarded to Boyce Company, Inc., Clearwater, Florida, in the amount of' $l2,44g.7~ which is the lowest and the best responsible bid, and the appropriate officials of the City be authorized to execute said contract which shall be in accordance with the plans and specifications and the bid. Motion was seconded by Commissioner Walters and carried unanimously. A letter from Mr. Harold Briley, Consulting Engineer) recommended the low bid o~ $36,172.15 from Smith-Sweger Construction Company, Inc., be accepted for Part 2, Utilities Improvement Project, the furnishing of all materials and relocation of the utilities at the west bridge of Memorial Causeway. Mr. Briley explained all utility lines will be suspended from the new west bridge, then the center span of the old bridge can be removed. Commissioner Walters moved on the joint recommendation of the Consulting Engineer and the Assistant Purchasing Agent that the con~ract for the f'urnishing of the material and the relocation or the utilities at the west bridge of the Memorial Causeway be awarded to Smith-Sweger Construction Company, Inc., Clearwater, for the sum or $36,172.15 which is the lowest and best responsible bid, and that the appropriate officials of the City be authorized to execute this contract ~hich shall be in accordance with the plans and specifications and bid. Motion was seconded by Commissioner Insco and carried unanimously. Crabbe, Orlando, Florida, in the amount of $885.00, which is the lowes~ and best responsible bid, and the appropriate ofricials of the City be authorized to execute sucll contract which shall be in accordance ~ith the plans and specirications and bid. Motion was seconded by Commissioner Insco and carried unanimously. It was recommended by the Manager that the low bid of $2,473.10 rrom Martin's Uniforms, Tampa, be accepted for winter uniforms for the Police Department. Com- missioner Smith moved on the joint recommendation or the Police Chief, Finance Di- rector and Assistant Purchasing Agent, the City Mana~er concurring therein, that the contract for Police Department uniforms be awarded to the Martin's Uniform Company in the amount of $2,473.10 ~hich is the lo~est and the best responsible bid, and that the appropriate officials of the City be authorized to execute said contract which shall be in accordance with the plans and specifications and bid. Motion was seconded by Commissioner Walters and carried unanimously. ~he City Manager recommended accepting the lo~ bid of $1,427.75 from Consol- idated Pipe & Supply, Birmingham, Alabama, for 840 feet 4" and 255 reet 6" black steel pipe for Utilities Department, Gas Division. Commissioner Walters moved on the joint recommendation of the Utilities Manager, Gas Superintendent, Finance Director and Assistant Purchasing Agent, with the City Manager concurring therein, that the contract ror 840 feet of 4" and 255 feet of' 6" black steel pipe coated and wrapped for Utilities Department be awarded to Consolidated Pipe for the sum of $1,427.75 (less 2% discount) ~hich is the lowest and best responsible bid, and that the appropriate officials of the City be authorized to execute said contract which shall be in accordance with the plans and specifications and bid. Motion was seconded by Commissioner Insco and carried unanimously. It was recommended by the Manaeer that the lo~ bid of $1,209.62 (less 2% discount) from Ellis ~ Ford Supply Company, Dunedin, be accepted for 500 3/4" key curb stops and 300 3J~tl meter couplings for the Utilities Department, Water Division. Commissioner Smith moved it being the joint recommendation of the Utilities Manager, Water Superintendent, Finance Director and Assistant Purchasing Agent, the City r.-lanager concurring therein, that the contract for 500 3/4" key curb stops and 300 3/4" meter couplings be a'Warded to Ellis ~ Ford Supply Company in the amount of $1,209.62 which is, by app~ying the 2% discount, the lowest and best responsible bid, and that the appropriate officials or the City be authorized to execute said contract which shall be in accordance with the plans and specifications and bid. Motion 'Was seconded qy Commissioner Walters and carried unanimously. The Clerk read a list of the polling places and their locations ~or the special referendum election on September 26th. Commissioner Insco moved the list of polling places be approved as read. Motion was seconded by Commissioner Smith and carried unanimous!.y. The Clerk presented a list of election board workers for the s~ecial election on September 26th a~d reported that last year the clerks were paid $15.00 per day and the inspectors ~13.00 per day, but suggested an increase of $1.00 per day for each to bring the compensation closer to ~1.00 per hour. Commissioner Smith moved inasmuch as this is a special election and at this special election that the voters might decide there would be more than one election during the year, and since the City Clerk suggests there has not been a request for an increase in fee that the clerks and the inspectors in the polling places be accepted as recommended by the Cle~k with compensation of $15.00 for the Clerks and $13.00 for the inspectors for the special election on Septelnber 26, 1961.. Architect Eugene Beach presented the plans for the Northeast Branch Library and estimated the cost at $31,668.00 including air conditioning but excluding the architect's fee. Resolution #61-89 was presented authorizing the proper officials to execute an agreement with the Seaboard Air Line Railroad Company in which the railroad would permit the City to install a water pipe between Armston and Coachman, under a side track at the southwest corner of the NE~ of the NEi, SecCion 12-29-15, (Belcher Road extended and Co\mty Road 1-:0. 284.). Commissioner Insco moved to approve Resolu- tion #61-89 and the proper officials be authorized to sign it. Motion was seconded by Commissioner Smith and carried unanimously. Resolution #61-90 was presented authorizing payment of $1,528.71 to Caldwell, Marshall~ Trimble & Mitchell, bond attorneys, New York City, fron Construction Trust Fund, 19b1, with the Bank of Clearwater. Commissioner Insco moved to approve Resolu- tion #61-90 and the proper ofricials be authorized to execute it. Motion was seconded by Commissioner Smith and carried unanimously. The City Attorney presenCed for its second reading Ordinance #903 amending Ordinance #507, the E1ection Ordinance, concerning the number of voters ~or each vot- ing machine. Commissioner Insco moved to read Ordinance #903 by title only with the unanimous consent or the Commission present. Motion was seconded by Commissioner Smith and carried unanimously. The Attorney read the ordinance by title only. Com- missioner Smith moved Ordinance #903 be passed on its second reading. Motion was seconded by Commissioner Walters and carried unanimously. The City Attorney announced that Circuit Court Judge Collins had approved by declaratory decree the purchase by tpe City of part of the property to be used for a site o~ the St. Pet€rsburg Junior College Branch. He read on its rirst reading Ordinance #904 declaring the City's intention to annex acre~ge in Section 7-29-16 and Section 18-29-16 (Junior College Site). Commissioner Smith moved Ordinance #904 be passed on its first reading. Motion was seconded by Co~issioner Walters and carried unanimously. Resolution #61-91 was read requesting the District Engineer, U. S. Army Corps of Engineers, Jacksonville, not to issue a permit to the Atlantic Coast Line Rail- road Company for its fixed bridge across Stevenson's Creek unless there is a vertical clearance of at least nine fee~, Commissioner Smith moved Resolution #61-91 as amended b~ approved and the proper officials be authorized to e~ecute it. Motion was seconded by Commissioner Walters and carried unanimously. Conmissioner Insco sug- gested the City Manager write a letter to Nr. Warren Cason, Sta~e Road Board member, telling him that the City would like to go on record that if any replacement of the bridge over Stevenson Creek on Alternate #19 is considered by the State Road Board that they take into consideration the vertical clearance of nine feet which the City is requesting the ra~lroad to use for its bridge. Resolution #61-92 was presented amending Paragraph 2, Schedule C, of Resolution #59-75, by changing the service connection rees to both residential and commercial users where gas heat~ng appliances only are used. Commissioner Smith moved Resolu- tion #61-92 be approved and the proper ofricials be authorized to sign it. Motion was seconded by Co~issioner Walters and carried unanimously. Resolution #61-93 was presented requiring twenty-nine property owners to clean their lots of weeds and undergrowth. Commissioner Insco moved Resolution #61-93 be app~oved and the proper officials be authorized to execute it. Motion ~as seconded by Commissioner Walters and carried unanimously. Commissioner Walters inquired as to the status of the Keystone Manor sanitary sewer project. The City Manager stated the final public hearing had been delayed pending a decision to put the sewer in Cleveland Street, and since the Fair Oaks pro- ject has already been approved costing appro~imately $150,000.00 to $175,000.00, it would be necessary to complete that work and assess it in order to have enough money in the assessment F~nd to let a contract for the work in the Keystone Manor area. In answer to a question from Commissioner Smith regarding the coin-operated laundromats, the City Attorney reported sone cities have ordinances forbidding all night operation. The City Manager stated the League of Municipalities has not sent copies of any ordinances yet. Commissioner Smith suggested t.he City Nanager might confer with the owners of such businesses racher than pass an ordinance aC this time. Commissioner Smith suggested a work session be held to consider garbage and trash rates, street paving prioricies, etc. By consent, the work session was set for Thursday, September 7th, at 8:00 A.M. Commissioner Smith recommended that the Commission authorize a lighting survey of public beach areas and investigation of the possibility of having extra police patrol the beach. The Mayor pointed out that there wou~d be no money in the current budget for such a project and that when the pier-groin was erected at Mandalay Park that area would be ~ighCed. After discussion, it was agreed to instrucC the Manager to have such & survey made for discussion purposes and possible consideration in a new budget. The Mayor reported on a meeting with minor league baseball representatives who were suggesting a Class D baseball team in Clearwater to play in Jack Russell Stadium but stated he felt that it would compete too strongly with the Clearwater Bombers and the Men's World So~tball Tournronent and would hamper the chance for the success of both sports. The Commission concurred with the Mayor's recommendation but sug- gested further consideration might be given in the future. The Mayor brought up the request of City Prosecutor Robert Freeze ~or a salary increase considered at the last meeting. By consent, the Commission decided to dis- cuss the matter at a work session. The Commission now adjourned as the City Commission and acting as Trustees of the Pension Fund, heard a letter read from the Advisory Committee recommending that Frank Edmunds, Collector, Refuse Division, Utilities Department, be admitted to the Pension Plan. Commissioner Insco moved that this employee be accepted. Motion was seconded by Commissioner Smith and carried unanimously.
