CITY COMMISSION MEETING ~ovember 14, 1960 The City Commission of the City or Clearwater met in special session at the City Hall, Monday, November 14, 1960, at 3:30 P.M. with the following members present: ~ayor-Commissioner Commissioner Commissioner Commissioner Commissioner City Manager City Attorney City Engineer Representing Police Chier The Mayor called the meeting to order. Mrs. Rosalie Day of the League of Women Voters pre sented the r.layor with a copy of a pamphlet entitled "Know Your City" which was prepared by the League. Regarding the request of r~. Robert Bickerstaffe to construct ten additional hangars a~ the Clearwater Air Park, the Mayor announced the Commission had met in executive session with Mr. Bickerstaffe and his attorney, Mr. Lloyd Phillips. By consent, ~he Manager ~as instructed ~o comply with the terms of this lease in granting the request since all of the details have been worked out. The Mayor announced the consideration of the following items for inclusion in the zoning ordinance to be submitted to referendum vote on December 20, 1960. Item 1 was a request that Lots 5,6,7 and 8, Block 10, Pine Crest Subdivision, be changed rrom R-2 to Business. Mr. Ed Whitson, attorney, submitted a petition from John F. Kottler, owner of Lot 3, Block 10, Pine Crest, asking that Lots 1,2, 3 and 4 also be rezoned from R-2 to Business. He stated he would reach the other owners before final approval of the ordinance. Commissioner Watkins moved that the proposal to change all of ~he lots in Block 10, Pine Crest Subdivision, from R-2 to Business, be included in the ordinance and submitted in the referendum on December 20th. Notion was seconded by Commissioner Smith. Upon the vote being taken, Commissioners Watkins, Smith, Insco and Weatherly voted "Aye". fw'Iayor Finch voted "No". Motion carried. The Mayor explained he was opposed because no notice ~as given to the homeowners along Vine Street. The Zoning and Planning Board recommended disapproval of Item 2, a request to change Lot 4S, Drew Manor Subdivision, from R-4 to Business zoning. Commissioner Watkins moved based on the recommendation of the Zoning and Planning Board that this item be disapproved and not placed in the zoning referendum. Motion was seconded by Commissioner lnsco and carried unanimously. Item 3 was a request that Lot 1, Block F, Fairburn Addition, be changed from R-4 to Business zoning. The Zoning and Planning Board recommended it be denied. Commissioner Insco moved based on the recommendation of the Zoning and Planning Board for disapproval that it not be placed in the zoning referendum. Motion was seconded by Commissioner Watkins and carried unanimously. The Zoning and Planning Board recommended disapproval of Item 4, the request to change Lot 6$, Carolina Terrace Annex, from R-2 to Business zoning. Commissioner Insco moved that Item 4. not be placed in the zoning referendum on the recommendation of the Zoning and Planning Board. Motion was seconded by Commissioner Watkins and carried unanimously. . Item 5 was a request from Mr. & Mrs. W. E. Crown that Lot 6, Block 7, Mandalay Subdivision, be changed from R-l to R-M zoning. The Zoning and Planning Board recommended it be denied. ~~s. W. E. Crown was present. Commissioner Watkins moved based on the recommendation of the Zoning and Planning Board that this matter be disapproved and not placed on the zoning referendum. Motion was seconded by Commissioner Weatherly. Upon the vote being taken, Commissioners Watkins, Weatherly, Insco and Smith voted "Aye". Illlayor Finch voted "No". Motion carried. The Commission considered Item 6, a request that all of Blocks 2,4 and 5 of Starr and Savery's Subdivision, be changed from R-2 to R-4. Commissioner Watkins moved based on the recommendation of the Zoning and Planning Board for approval that Item 6 be included in the ordinance and submitted in the referendum on December 20th. Motion was seconded by Commissioner Weatherly and carried unanimously. Item 7 was a request that Lots 19 and 20, Longview Subdivision, be changed from R-2 to R-4 zoning. The Zoning and Planning Board recommended it be denied. Commissioner Watkins moved based on the recommendation for disapproval from the Zoning and Planning Board that the matter not be placed in the ordinance. Motion ~as seconded by Commissioner Smith. Commissioner Watkins moved based on the recommendation of the Zoning and Planning Board that Item a be disapproved and not placed in the zoning ordinance for the referendum. Motion was seconded by Commissioner Weatherly. Upon the vote being taken, Commissioners Watkins, Weatherly, Insco and Smith voted "Aye". Mayor Finch voted "No". Motion carried. Motion was seconded by Commissioner Watkins and carried unanimously. Item 10 was a request that Block Y, Hibiscus Gardens Subdivision (Y.W.C.A. site) be changed rrom UZ to R-4. Commissioner Watkins moved that Item 10 be included in the ordinance and submitted in the referendum on December 20th, based on recommendation of the Zoning and Planning Board. Motion was seconded by Commissioner Weatherly and carried unanimously. Item 11A was a request that the east 165 feet of the SEi of the SEi of Section 11-29-15 (Fire Station #4 site extending north to the Air Park), be changed from R-2 to R-4. Commissioner Watkins moved that this matter be placed in the zoning ordinance and submitted in the re~erendum on December 20th. Motion was seconded by Commissioner Smith and carried unanimously. Item IlB was a request that the following area be changed ~rom m~ to P; an area southerly from Drew Street extended including Lot 1, but excluding Lot 2, Jef~ords and Smoyer's Subdivision, and westerly from Osceola to Clearwater Bay and submerged land adjacent thereto. Commissioner Smith moved on the recommenda- tion of the Zoning and Planning Board that Item lIB be included in the ordinance and submitted in the referendum on December 20th. Motion was seconded by Commissioner Insco and carried unanimously. Item llC was a proposal that the north hal~ of the NWi of the swi of Section 22-29-15, be changed from R-4 to Public (Ross Norton Park). Commissioner Insco moved Item llC be placed in the ordinance and submitted in the rererendum on December 20th. Motion was seconded by Commissioner Watkins and carried unanimously. Item 12 was a proposal that Section II (A) be amended by adding definition of "Home Occupation", and "Model Home" and adding to the de~inition of a "Lot". Minor amendments to the proposal were suggested and noted by the City Attorney. Commissioner Watkins moved Item 12 as amended be included in the ordinance and submitted in the re~erendum on December 20th. Motion was seconded by Commissioner Insco and carried unanimously. Item 13 was a proposal that Section III be amended by re-classifying all existing R-l districts as R-IE, and establishing R-1A, R-IB, R-1C and R-1D as additional single family residence district classifications. Commissioner Watkins moved that Item 13 be included in the ordinance and submitted in the referendum on December 20th. Motion was seconded by Commissioner Insco and carried unanimously. Item 1~ was a proposal that Section IV be amended to permit customary Home Occupations, as defined, in R-l Residence Districts. Commissioner Insco moved that Item 1~ be included in the ordinance and submitted in the rererendum on December 20th. Motion was seconded by Commissioner Watkins and carried unanimously. Item 15 was a proposal that Section V be amended to permit customary Home Occupations, as defined, in R-2 Residence Districts. Commissioner Insco moved that Item 15 be included in the ordinance and submitted in the rererendum on December 20th. Motion was seconded by Commissioner Weatherly and carried unanimously. Item 16 was a proposal that (7) and adding Home Occupations, Commissioner Insco moved Item 10 the referendum on December 20th. and carried unanimously. Item. 17 was a proposal that Section V (A) (9) (c) be amended by deleting the words "in all use districts", and thereby providing that no lots located in R-l and R-2 use districts shall be capable of use for non-commercial public parking lots as defined. Mr. E. M. Sanford objected to the proposal on the basis that many business locations had R-1 or R-2 abutting them and this would prevent the use or these lots for of~street parking by the businesses now in operation. Commissioner Insco moved Item 17 be placed on the ordinance and submitted in the referendum on December 20th. Motion was seconded by Commissioner Watkins. Upon the vote being taken, Commissioners Insco, Watkins, Smith and Finch voted "Aye". CODllJ1issioner Weatherly voted "No". Motion carried. Section V (A) be amended by deleting sub-section as defined, in an R-4 Residence District. be included in the ordinance and submitted in Motion was seconded by Commissioner Watkins . ;,. ,r-. .___....__ --:-. -)- CITY COMMISSION MEETING November 14, 1960 Item 16 w~s a proposal that Section V (B) be amended by adding the words "or apartments" after the words "guest rooms" for the purpose of clarification of use regulations in an R-M district. Commissioner Smith moved Item 18 be included in the ordinance and submitted in the referendum on December 20th. Motion was seconded by Commissioner Weatherly and carried unanimously. Item 19 was a proposal that existing Section XI entitled "Location, Height and Area Regulations" be repealed and that the new Section XI, entitled "E\111ding and Lot Regulations" be enacted in place thereof. Mr. John Hunter and Mr. Ed ~itson objected to Paragraph 7 of Item 19 relating to building setbacks for structures in an M or B zone when such structures face a residential zone, such building setback to be the same as that for the residential zone it abuts or faces. Commissioner Insco moved that all paragraphs except Paragraph 7 under Item 19 be included in the ordinance and submitted in the referendum on December 20th. ,Motion was seconded by Commissioner Watkins and carried unanimously. Item 20 was a proposal that Section XII be amended to establish R-l zoning for all property in Clearwater Bay, located beyond the bulkhead line established by the City Commission and approved by the Pinel1as County Commission. Commissioner Insco moved that Item 20 be included in the ordinance and submitted in the referen- dum on December 20th. Motion was seconded by Commissioner Weatherly and carried unanimously. Item 21 was a proposal that Section XVII be amended by addition of Subsection 5 (A) (7) providing for the exception of model home use to be permitted in R-l, R-2 and R-4 districts and setting up requirements and standards pertaining thereto. Commissioner Insco moved that Item 21 be included in the ordinance and submitted in the referendum on December 20th. Motion was seconded by Commissioner Watkins and carried unanimously. Item 22 was a proposal that Section XVII, Subsection 7, be amended to provide that the City Commission shall after due notice hold a public hearing not less than twelve (12) days and not more than forty-five (45) days after the filing of an appeal from the decision of the Board of Adjustment and Appeal. Commissioner Smith moved that Item 22 be included in the ordinance and submitted in the referendum on December 20th. Motion was seconded by Commissioner Insco and carried unanimously. Item 23 was a proposal for a 62 foot setback line from the center line of Gulf to Bay Boulevard from Highland Avenue to a point 1,845 feet east of the west line of Section 16-29-16. Commissioner Insco moved that Item 23 be included in the or- dinance and submitted in the referendum on December 20th. Motion ~as seconded by Commissioner Watkins and carried unanimously. Commissioner Insco commented the Zoning and Planning Board and the City Planner should be complimented for the many long hours spent on recommendations for amend- ments to the zoning ordinance. Commissioner Insco moved a vote of appreciation be given to the City Planner and the entire Zoning and Planning Board for their contri- butions to the City of Clearwater.
