The c~ty Commission of the City of Clearwater met ~n regular session at the City
Hall, Monday, November 2, 1959, at 1:30 P.M. with the following members present:

The Mayor called the meeting to order. The invocation was given by the Reverend
Kenneth Nordvall of Bethel Presbyterian Church, Clearwater. Commissioner Watk:tns
moved the minutes o~ the regular meeting o~ October 19, 1959, be approved as recorded
and as submitted ~n written summation by the Clerk to each Commissioner subject to the
approval of Cornmdssioner Insco. Motion was seconded by CommiSSioner Fields and
carr~ed unan~mously.
Comm1ss~oner Watkins moved Commissioner Insco be excused from this meet~ng due to
unforeseen c~rcumstances. Motion was seconded by Commiss~oner Fields and carr:ted
unanimously.
A Public Hearing was announced on the paving o~ drives and walks in a ten foot
north-south all~y and a ten foot east-west alley in Block 3, Earll & Tate Subd:tvision.
The Engineer said he thought it would not be ~a~r to assess on a front foot basis and
recommended the project be assessed by the number of square feet of paving in the half
o~ the alley in front of each property. He estimated the total cost at $1,745.00 or
$.25~ per square foot of paving. The Mayor asked if there were any objections and
there were none. Mr. Cy Lowery and Mr. Taver Bayly were present. Commissioner
Watkins moved since no valid objections have been filed that the construction of
pavement ~ncluding concrete drives and walks in the east and west alley between Cleve-
land Street and Laura from Osceola easterly a d~stance of 250 reet and in the Nor~h
and South alley between Osceola and North Fort Harrison Avenue from Laura Street
southerly a distance of 130 feet be authorized and accomplished and that the City
Manager and the Engineer be directed forthwith to proceed with such improvements.
Motion was seconded by Commissioner Fields and carried unanimously.
A continuat:ton o~ the Public Hearing considered on July 13th was announced on
construction of sanitary sewer in Drew Street from a point 150 feet west of Highland
to San Remo, in Grove Street ~rom a point 150 ~eet west of Highland to San Remo, in
San Remo Avenue ~rom Grove to Drew, ~n Laura street from a point 150 feet west o~
Highland to Hillcrest. A letter was read from Mr. George R. McCall, Associate Chie~
San~tarian, Pinellas County Health Department, stating that a sanitary survey of the
area was made and that out o~ a total of 41 premises, 8 were vacant and of the 33
remaining, 10 have recently experienced septic tank failure. The letter stated after
rnak:tng tests it was presumed that a septic tank or tanks were connected to the storm
sewer along Laura Street; therefore, it was recommended the sanitary sewer project be
approved. The Engineer estimated the total cost at $15,305.00 or approximately $4.85
per front foot. A telegram of objection from Mr. R. B. Langdon and a letter of
objection from Mr. Eric Pr~or were read. Mr. E. Lester ~rston, Mrs. H. D. Cranmer,
Mr. A. C. Grey and others objected. A letter of approval was read from Mrs. Naomi
S. Gard. Mr. E. R. Shead, and Mrs. L. J. Huff spoke in favor. Commissioner Fields
moved to deny the entire project. Mot~on was seconded by Commissioner Smith and
carried unanimously. The Commission requested the Engineering Department to make a
~urther study and work with the County Health Department to determine whether any
septic tanks are connected to the storm sewers.
The Mayor announced the cont~nuat~on o~ the Public Hearing on the appeal of Messrs.
G. T. McKernan and Louis Scimens from the approval by the Board o~ Adjustment and Appeal
on Zoning of the request of La Roea Corporation to erect a restaurant on Lots 13 and 14,
Block A, Bays~de #5, was not on the agenda as the La Roca Corporation was withdrawing
the request.
Commissioner Fields moved t.o deviate from the agenda to take up Item 11, "Request
for License, Second Hand Store". Motion was seconded by Commissioner Smith and carried
unanimously.
An application was presented from Mr. Richard W. Oosse for a license to operate
a new and used furniture store at 1310 South Missouri Avenue. The Manager reported
the Pol~ce Ch~ef arter investigation recommended the license be issued. Commissioner
Watkins moved the license be issued. Motion was seconded by Commissioner Fields and
carried unanimously.
Commdssioner Fields moved to deviate from the agenda to hear the people rrom
Clearwater Beach in regards to a pier. Motion was seconded by Co~ss1oner Smdth and
carried unanimously.

CITY COMMISSION MEETING

Mrs. L. M. Clark, Mrs. George Boschen, Mr. Leonard Merrell, Mr. Sam Roberts and
other Clearwater Beach residents asked that groins or a groin-type recreation pier be
buil6 on the Gul~ side o~ Clearwater Beach to control the erosion problem from Mandalay
Park to the Carlouel section. Mayor Finch stated money ~or the project was not
available in the budget but there is a posSibility the necessary money may be ~ound
be~ore the end o~ the fiscal year. By consent, the Engineer was instructed to continue
his study o~ the di~ferent sites and bring back estimated costs and recommendations.
The Manager recommended accepting the low bid of $633.00 less trade-in of $225.00
from the Lanier Company, Tampa, for dictating and transcribing equipment used by the
City Clerk's office for recording Commission meetings. COMnissioner Fields moved upon
the recommendation of the City Clerk and the Assistant purchasing Agent that the bid
of $408.00 submitted by Lanier Company of Tampa be accepted, this being the lowest and
most responsible bid, and the proper authorities be authorized to execute it. Motion
was seconded by Commissioner Watkins and carried unanimously.
It was reconwended by the Manager that the low bid of $1,745.00 rrom Peerless-
Florida, Clearwater, be accepted for water works brass fittings consisting o~ 500 3/4
inch inverted key curb stops and 500 .3/4 inch corporation stops for the Water Distri-
bution Division, utilities Department. Commissioner ~atkins moved the contract for
water works brass fittings be awarded to the Peerless-Florida Company in the amount
of $1,745.00, this being the lowest and best responsible bid, and the proper officials
of the City be authorized to execute said contract which shall be in accordance with
plans and specifications and bid. Motion was seconded by Commissioner Smith and
carried unanimously.
The Manager reported that several months ago a new cruiser had been involved in
an accident and settlement had recently been made with the insurance company for $900.00.
Regarding bids for replacement of the cruiser, he recommended accepting the low bid
of $2,000.00 from Larry Dimmitt, Inc., less a trade-in allowance on the wrecked car of
$752.00 or $1,248.00. Commissioner Fields moved on the recommendation of the Police
Chier Finance Director and Assistant Purchasing Agent that the lowest bid o~
$1,248.00 submitted by Larry Dinunitt for police cruiser be accepted and the proper
authorities authorized to execute it. Motion was seconded by Commissioner Watkins
and carried unanimously.
It was recoMnended by the Manager that the low bid of $5,972.50 ~rom Holcomb
Pipelines, Inc., Clearwater, be accepted for constructing sanitary and storm sewers
in Grant Street ~rom Greenwood Avenue easterly one block. Commissioner Watkins movBd
the contract for Grant Street sanitary and storm sewers be awarded to Holcomb Pipelines,
Inc., in the amount of $5,972.50, which is the lowest and best responsible bid, and
the appropriate officials of the City be authorized to execute said contract which shall
be in accordance with the plans and specifications and bid. Motion was seconded by
Commissioner Fields and carried unanimously.
Regarding the bids ~or the construction of paving in Union Street ~rom Broadway
to Douglas which were de~erred pending an agreement from the City of Dunedin to pay
one-half the cost, the Manager reported the City of Dunedin has placed the money in
escrow and the Attorney had prepared an agreement between the City of Clearwater an~
the A. A. Schultz, Inc., the low bidder at a cost of $5,760.40. Conunissioner Fieldls
moved the bid of A. A. Schultz Construction Company for the work according to the
advertised plans and specifications be awarded to said company provided that said
company shall only look to the City of Clearwater for one-hal~ of the cost of said
project; that said company shall look to the City of Dunedin for the other one-half
the cost of said project, and that the proper City officials be authorized to execute
it. Motion was seconded by Conunissioner Smith and carried unanimously,
In regard to the request to connect Ponce de Leon Elementary School to the City
sanitary sewer, the Manager reported receipt of a letter from Mr. Floyd T. Christian,
School Superintenderlt, that the Board of Public Instruction will pay the City for the
work estimated at $8,900.00 by the City Engineer. Commissioner Watkins moved the City
Engineer be instructed to request bids on this project as soon as possible; that the
Board of Public Instruction be authorized to make the connection whenever the work
is completed, and when the lift station is completed, the City will assume responsibility
for the upl(eep. Motion was seconded by Commissioner Fields and carried unanimOUSly.
The Mayor requested bids be brought back to a meeting on November 9th, if possible, as
it was an emergency situation.
A plat of Sunset Ridge Unit 1 was presented. The Man~ger reported the contract
in accordance with Ordinances 632 and 750 had been signed by the developer, Mr. Albert
P. Rogers, and bond had been posted to cover improvements. The Zoning and Planning
Board recommended approval. COlmmssioner Watkins moved the plat of Sunset Ridge Unit
1 be approved and the proper orficials be authorized to execute it. Motion was seconded
by Commissioner Fields and carried unanimously.
The Manager presented a plat of Bayside Subdivision No.6 Unit B and reported a
contract in accordance with Ordinances 632 and 750 had been signed by the developer,
Mr. H. H. Baskin. He stated all the improvements had been installed with the excep-
tion o~ the road that will be the connecting link to Little Pass bri~e and the City
has a letter from Mr. Al Rogero stating when the bridge is built, the state Road
Department will build the connecting roads without expense to the City or the
developers. Commissioner Watkins moved the approval o~ Bayside #6, Unit B, and that
the proper officials be authorized to execute it. Motion was seconded by Commissioner
Fields and carried unanimOUSly.

CITY COMMISSION MEETING

Regarding ~ill ~or area between Druid Road and Magnolia (Magnolia park, Blocks
29 and 32) involved in the e~change agreement with the Seaboard Air Line Railroad, the
Engineer reported he had advertised and sent invitations to bid to eleven contractors
but no bids had been rece~ved. He said he had been in~or.med it was because the time
was too short, and i~ two weeks were allowed some of the contractors would bid on it.
CommiSSioner Watkins moved the City Engineer be instructed to advertise ror bids to be
considered two weeks from today, November 16th. Motion was seconded by Commissioner
Fields and carried unanimously.
Resolution 59-101 was presented requiring twenty-rive property owners to clean
their lots of weeds and undergrowth. Co~ssioner Watkins moved Resolution 59-101
be passed and adopted and the proper officials be authorized to execute it. Motion
was seconded by Commissioner Fields and carried unanimously.
The Manager reported bids had been opened and read on construction of the
Memorial Civic Center on Clearwater Beach this afternoon. Mr. Arthur Kruse said it
was hoped a ground-breaking ceremony could be scheduled for Veterans Day on November
11th and hoped that the contract could be awarded be~ore that time. Commdssioner
Watkins moved the bids be received and they be rererred to the architect and
Assistant Purchasing Agent to report back as early as convenient. Motion was seconded
by Commissioner Fields and carried unanimously.
Regarding the closing on purchasing the Maurice Thayer property, Lots 2,7, part
of Lots 1 and 8, Block 5, Gould & Ewing 1st Addition, the Attorney reported Mr. Robert
W. Baker was present on Mr. Thayer's behalf. He explained there were no objections to
the condemnation proceedings and on October 29, 1959, Judge Jack White had entered an
order ofhfina1 decree and condemnation predicated upon the stipulation. He explained
the total purchase price df the property was $260,000.00, that a valuation of
$125,000.00 is being paid in property (Block 5, north of Park Street, Sarah McMullen
Subdivision, less east 50 feet; Lots 11 and 12, Block 2, Magnolia Park Subdivision),
the balance to be paid in cash or $135,000.00 plus a fee of $1,000.00 to Mr. Robert
Eaker as the de~endantls attorney to be paid by the City. Commissioner Watkins moved
to authorize the Mayor and appropriate orficials to execute the deed and deliver it
to Mr. Thayer as well as delivering the balance of the cash as called for in the
Court decree and that the mortgages be satisfied and recorded. Motion was seconded
by Commissioner Fields and carried unanimously.
The Attorney read on its rirst reading Ordinance 835 annexing acreage in Sections
2-29-15, Lot 13, Sunset Highlands Unit 112, Lots 17 and 18, Block D, Lots 1-4, Blgck E,
Pine Ridge Subdivision. Commissioner Watkins moved Ordinance 835 be passed on its
first reading. Motion was seconded by Commissioner Fields and carried unanimously.
Cornmdssioner Watkins moved Ordinance 835 be considered on its second reading by
title only with the unanimous consent of the Commissioners present. Motion was
seconded by Commissioner Fields and carried unanimously. The Attorney read the
ordinance by title only. Commissioner Watkins moved Ordinance 835 be passed on its
second reading by title only. Motion was seoonded by Cornmdssioner Fields and carried
unanimously.

the unanimous consent or the Commissioners present. Motion was seconded by Co~ssion~
Fields and carried unanimously. Ordinance 835 was read in full. Comrrdssioner Smith
rnoved Ordinance 835 be passed on its third and rinal reading and adopted and the proper
officials be authorized to e~ecute it. Motion was seconded by Commissioner Fields
and carried unanimously.
The Attorney reported in pavipg and extending Pierce Street it was round necessary
according to the Engineer's report to secure a portion of Lots 4,5,7, Block C, Hibiscus
Gardens, belonging to Mrs. O. S. Allbritton, Jr., and Lot 6, Block C, Hibiscus Gardens,
belonging to Mr. Nick Sagonias. He reported the owners were willing to give the right
of way necessary in exchange for the City cancelling special assessments against those
lots for work now in process. Commissioner Fields moved the City Attorney be authorized
to secure the right of way from Mrs. O. S. Allbritton and Mr. Nick Sagonias ~or Pierce
Street. Motion was seconded by Commissioner Watkins and carried unanimOUSly.
The Attorney reported Item #18, "Agreement with MuniCipal Code Company" could be
delayed if the Commission wished. Commissioner Fields moved Item #18 be postponed to
a later date. Motion was seconded by Commissioner Watkins and carried unanimously.
In regard to the proposed zoning rererendum, the Attorney reported the City Clerk
had recommended the Cornmdssion set a public hearing at a special meeting on November
9th on proposed items to be included in order that on November 16th the necessary
ordinances setting up the referendum can be passed. Commissioner Watkins moved the
recommendation be approved and that the proper ofricials be authorized to set up the
advertisements ror the various dates. Motion was seconded by Commdssioner Fields and
carried unanimously.
The Attorney read on its rirst reading Ordinance 836 amending Ordinance 821 con-
cerning the Municipal Parking Rev~nue Bond issue as recommended by the bond attorneys
in New York City. CommiSSioner Watkins moved Ordinance 836 be passed on its rirst
reading. Motion was seconded by Commissioner Fields and carried unanimously.

Commissioner Watkins moved Ordinance 836 be considered on its second reading by
title only with the unanimous consent of the Commissioners present. Motion was seconded
by Commissioner Fields and carried unanimously. The ordinance was read by title only.

adopted and the proper officials be authorized to execute it. Motion was seconded by

The Attorney reported he had received a letter from the Industrial Director
advising the City that Mrs. Flora J. Redmer was asking for a refund of the earnest
money of $1,181.25 deposited in escrow on a contract to purchase Lot 20, Clearwater
Industrial Park, under a clause stating if adequate financing could not be arranged,
the re~und would be made upon notification. Co~ssioner Watkins moved the matter be
tabled until the next meeting. Motion was seconded by Co~ssioner Fields and carried
unanimously.
The Attorney requested confirmation of his actions in closing the purchase of
Lot 23, Block C, Fairmont Subdivision, from Mr. Henry Ghiron. He stated it was necessary
for the City to pay for title insurance and this year's taxes ($6.20) and he had
instructed the City Treasurer to draw a check for $1,509.40 for the balance on this
contract. Commissioner Watkins moved the action be confirmed and payment of the funds
be made. Motion was seconded by Conmdssioner Fields and carried unanimously.
It was reported by the Attorney that there was a house on Lot 77, Glenwood, that
was in his opinion a public nuisance. He recommended notice be given to the owner to
have it removed within ten days. Co~ssioner Watkins moved the City Attorney and any
and all other City employees who nay properly administer this part of the Code be
authorized and instructed to bring suit under the appropriate City ordinance. Motion
was seconded by Commissioner Fields and carried unanimously.
The Attorney presented a proposed contract with Mr. James B. Nall to purchase a
part of Tract B, McMullen's Bayview Subdivision, the property being 300 feet wide on
Gulf to Bay Boulevard, for a price of $37,500.00. He explained the City plans to use
the site for a new sewer disposal plant to serve the east section of the City. Com-
rrdssioner Fields objected because of the high cost and thought it would be expensive
to fill. Commdssioner Watkins moved the contract be approved and the proper officials
be authorized to execute it contingent upon the City acquiring the submerged lands as
part of the purchase pricej contingent upon approval of the I. I. ,Board for the
necessary fillingj contingent upon approval of the U.S. Army Corps of Engineersj and
contingent upon the Consulting Engineer'S approval of the site for construction of the
contemplated improvement after making soundings. Motion was seconded by Commissioner
Sm:tth. Upon the vote being taken, Corrunissioners Watkins, Smith and Finch voted "Ayell.
Conunissioner Fields voted "Noll. Motion carried.
On the Mayor's suggestion, Commissioner Watkins moved the Mayor be instructed to
appear before the County Commission tomorrow and request that they put in writing their
agreement to put up $550,000.00 for the Myrtle Avenue project and that they authorize
the State Road Baa~~o charge that against their secondary rQad fund. Motion was
seconded by Commissioner Smith and carried unanimously.
Commissioner Watkins moved to recess for thirty minutes. Motion was seconded by
Commissioner Fields and carried unanimously.
The Mayor re-convened the meeting at 6:50 P.M. with Corrunissioners Watkins, Fields
and Smith present.
The architect and Assistant Purchasing Agent presented the tabulation of bids for
the Memorial Civic Center. Commissioner Smith moved that the bid for the Memorial Civic
Center be awarded to Bailey Builders, Clearwater, for $190,890.00 less Alternate #3 of
$27,500.00 which is the optional air conditioning machinery, this being the lowest and
best bid, and the proper officials be authorized to execute the same. Motion was
seconded by Commissioner Fields and carried unanimously.
The Attorney reported closing was set for November 3rd on all of the property for
Parking Lot #2 on Park and Pierce between the two railroads (Magnolia Park, Block 6,
Lots 1,3,4,5,14, part of Lgts 2 and 13) except Lots 10-12, belonging to Mr. Larry
Dimrrdtt and that was deferred on his request until after January 1st but the City has
a letter that the City can use the property before then if needed. Commissioner
Watkins moved the City Manager and the City ~reasurer be authorized to execute the
cnecks for the purchase of the Park Street parking lot on the request of the City Attorney.
Motion was seconded by Commissioner Fields and carried unanimously.
There being no further business, the meet~ng was adjourned at 7:00 P.M.

Dear Mr. Stewart:
Reference is made to your memoranda dated July 22 and September 23, 1959 pertaining
to the installation of sanitary sewers on L~ura St. from Highland to Hillcres~, in
Drew and Grove streets from Highland to San Remo and in Sam. Remo from Grove to
Drew St. By action of the Clearwater City Commission in the July 13 mee~ing, this
project ~as tabled for further study by the Pinellas County Health Department.
A sanitary survey of all homes and business establishments affected ~as completed
on October 2nd, 1959. Out of a total of 41 premises, g were vacant or the occupants
were unavailable for COUlltient on the history of t heir septic tank performance. Ot
the 33 prendses remaining, 10 have recently experienced septic tahk failure. Three
of the ten are apartment buildings containing a total of 15 living units. It may,
therefore, be concluded that a~ least 10 out of 41 (about 24.4%) of the premises
or that 22 out of 60 (abottt 27.2%) of the living units have experienced recent
sep~ic tank failure.
It was presumed from the high coliform bacteria count ~ound in a smnple of water
collected from a storm sewer at Laura St. and Hillcrest Ave. that a septic tank or
tanks were connected to the storm sewer along Laura St. During this study a tracing
dye ~as placed in the septic tanks serving several buildings on Laura St. and the
dye appeared in the storm sewer junction box within one hour.
Based on the above findings, ~e conclude that the use of septic tanks as a means
of sewage disposal in the subject area constitntes a definite threat to ~he health
of bo"'h- ,the area residents and to those who may come in contact with the polluted
storm water down stream from the point ot discharge. We. therefore, re~ommend and

The attached copy ot a letter is self-explana~ory. There is certainly no question
in the mind of the Florida State Board or Health that septic tanks are detrimental
to a community because it is a recognized fact ~hat septic tanks are not a sanitary
means or waste disposal in a modern and progressive built-up area.
It is our recommendation that all unsewered areas be covered with adequate sewage
collection and treatment at the earliest practical time and it is further recommended
that in order to prevent further conditions tha~ now exist, that your City Commission
or Building Department issue no ru~her building or construction per,mits ~thout the
carte blanche approval ot the Pine1las County Heal~h Department or State Board or
Health ot the sanitary ~acilities. This cooperative program is in ~orce in many
areas in Florida and is producing exce11en~ results.

The City Commission of the City oi' Clearwater met in regular session at the City
Ha11, Monda�r, November 2, 1959, at 1;30 P,M, vrith the #'ollowing members present;

The Mayor called the meeting to order. The invocation was given by the Reverend
Kenneth Nordvall of Bethel Presbyterian Church, Clearwater. Commissioner Watkins
moved the minutes of the regular meeting of October lg, 1g59, be approved as recorded
and as submitted in written summation by the Clerk to each Commissioner subject to the
approval of Commissioner 2nsco. Motion was seconded by Gommissioner Fields and
carried unanimously.
Commissioner Watkins ;noved Commissioner Insco be excused from this meeting due to
un£oreseen circumstances. Motion was seconded by Commissioner Fields and carried
unanimously.
A Public Hearing �vas announced on the paving of drives and walks in a ten foot
north-south alley and a ten foot east-west alley in Block 3, Ear11 & Tate Subdivision.
The Engineer said he thought it WouTd not be fair to assess on a front foot basis and
recommended the project be assesaed by the number of square feet of paving in the half
o.f, the alley in front of each property. He estimated the total cost at $1,745,00 or
$.25¢ per square foot of paving. The Mayor asked if there were any objections and
there were none. Mr. Cy Zowery and Mr, Taver Bayly were present. Commissioner
Watkirs moved since no valid objections have been filed that the construction of
pavement iriclu,ding concrete drives and walks in the east and west alley between Cieve-
land Street and Laura from Osceola easterly a distance of 250 feet and in �he North
and South alley between Osceola and Nor�h For� Harrison Avenue from Laura Street
southerly a distance of 130 feet be authorized and accomplished and that the City
Manager and the Engi.neer be directed forthwith to proceed with such improvements.
Motion was seconded by Commissioner Fields and carried unanimously.
A continuation of the Public Hearing considered on July 13th was announced on
construction of sanitary sewer in Drew Street from a point 150 feet west oi Highland
to San Remo, in Grove StrEet from a point 150 ieet west of Highland to San Remo, in
San Remo Avenue from Grove to Drew, in Laura Street from a point 150 feet west of
Highland to Hillcrest. A Tetter was read from Mr. George R. McCall, Associate Chie£
Sanitarian, Pinellas County Health Department, stating that a sanitary survey of the
area wa� made and that out of a total of 41 premises, $ were vacant and of the 33
remaining, 10 have recently experienced septic tank failure. The letter stated after
making tests it was presumed tnat a septic tank or tanks were connec�ed to th� storm
sewer along Laura Street; the-refore, it was recommendPd the sanitary sewer project be
approved, The Engineer estimated the tatal cost at �15,305.00 or approximately �,4.85
per front i'oot. A telegram of objection from Mr. R. B. Langdon and a letter of
objection from Mr. Eric Prior were read. N:v�. E. Lester Marston, Mrs. H. D. Cranmer,
Mr. A. C. Grey and othe�s objected, A letter of approval wa,s read from Mrs, Naomi
S. Gard. Mr. E. R. Shead, and Mrs, L. J. Huff spoke in favor. Commissioner Fields
moved to deny the entire project. Motion was seconded by Commissioner Smith and
carried unanimously. Th.e Commission requested the Engineering Department to m�'.�ce a
further study and work with the County Heal�ch Department to determ3.ne whether any
septic tanks are connected t� the storm se�aers.
The Mayor announGed the continuation of the Public Hearing, on the appeal of Messrs,
G. T. I�IcKernan and Louis Scimens from the appr�val by the Board of Adjustment and Appeal
on Zoning of the reques� of La Roca Corp'oration to erect a restaurant on Lots 13 and l4,
Block A, Bayside #5, was not on the agenda as the La Roca Corporation was withdrawing
the request.
Commissioner Fields moved to deviate from the agenda to take ixp Item 11, "Request
for License, Second Hand Store", Motion tivas seconded by Commissioner Smith and carried
unanimously.
An applica�ion was presented from Mr. Richard W. Oosse for a license to operate
a new and used furniture store at 1310 South Missouri Avenue. The Manager reported
the Po13.:ce Chief after 3nvestigation recommended the license be issued. �omm3,ss�?oner
Watkins moved the license be issued, Motion was seconded by Commissioner Fields and
carried unanimously.
Commission.er Fields moved to deviate from the agenda to hear the people from
Clearwater Beach in regards to a pier. Motion was seconded by Comamissicner Smith and
carried unanimously.

Park to the Carlouel section. Mayor Finch stated tnon�y for tne project was rot
available in the budget but there is a possibillty the riecessary mon�y may be found
before the end of the fiscal year. By consent, the Engineer t+ras instructed to continue
his study of the different sites and bring back estimated cos�s and recommendations.
The Mana�er recommended accept�.ng the low bid of $633.00 less trade-in of �225.00
from the Lanier Company, Tampa, for dictatir� and transcribing eqixipmez�t used by the
City Clerk's office for recording Commission meetings. Conunissioner Fields moved upon
the recommendaticn of the City Clerk and the Assistant Purchasing Agent that the bid
of $408.00 submitted by Zanier Company of Tampa be accepte�, this being the loWes� and
most responsible bid, and the proper authorities be authorized to execute it. Motion
was seconded by Commissioner Watkins and carrisd unanimously.
It was recommended by the PRanager that the lo�v bid of �1,745.00 from Peerless-
Florida, C1�arwater, be accepted for water works brass fittings consisting of 500 3�4
inch inverted kev curb stops and 500 3�� inch corporation stops for the Water Distri-
bution Division, Utilities Departmeni;. Commissioner Watkins moved the contract for
water works brass fittings be awarded to the Peerless-Florida Company in the amount
of �1,7�5.00, this being the lovrest and best responsible bid, and the proper officials
of the City be authorized to ex�cute Said contract which sha11 be in accordance wi�h
plans and specifications and bid. Motion was seconded by Commissioner Smith and
carried unanimously.
The Manager reported that se�ieral months ago a neS+r cruiser had been involved in
an accident and settlement had recently been made with the insurance company for �900.00.
Regarding bids for replacement of the cruiser, he recommended accepting the low bid
of $2,000.00 from Larry Dimmitt, Inc., 1�ss a trade-in allowance on the wrecked car of
$752,00 or �1,2�F8.00. Commissioner Fields moved on the recommendation of the Police
Chief, Finance Director and Assistant Pt.2�chasing Agent that the lowest bid of
$1,2�+8::00 submitted by Larry Dimmitt for police cruiser be accepted and the proper
authorities authorized to execute it;. Niotion was seconded by Commissioner Watkins
and carried unanimously.
It t+ras recoTrunended by the Manager that the 1ow bid of $5,972.50 from Holcomb
Pipelines, Inc., Clearwater, be accepted for constructing sanitary and storm sewers
in Grant Street from Greenwood Avenue easterly one block. Commissioner tiJatkins mo�r�d
the contrac� for Grant St�eet sanitary and storm sewers be awarded to Holcomb Pipelines,
Inc., in �he amoun.t oi $5,972.5Q, which is the lowest and best responsible bid, and
the appropriate officials of the City be authorized to execute said contract which shall
be in accordance with the plans and specifications and bid, Motion was seconded by
Cor.urLissioner Fields and carried unanimously.
Regarding the bids for the construction of paving in Union Street �rom Broadway
to Douglas which v�rere deferred pending an agreement from the City of 3�unedin to pay
one-half the cost, the Manager reported the City of Dunedin has placed the money in
escrow and the Attorney had prepared an agreement between the City of Clearwater ar%d
the A. A. Schultz, Inc., the low bidder at a cost of �5,760,40. Gommi:ssioner Field�s
moved the bid of A. A. Schultz Con.struction Company for the work according to the
advertised plans and sAecifications be awarded to said company prov3ded that said
company shall only look to the City of Clearwater for one-half of the cost of uaid
project; thai said company shall look �o the City of Dunedin for the other one-half
the cost of said project, and that the proper City officials be authorized to execu�e
it. Motion was s�conded by Gommissioner Smith and carried unanimously.
In regard to the request to connect Ponce cie Leon Elementary School to the City
sanitary sewer, the Manager reported receipt of a letter from Mr. Floyd T. Christian,
School Superin�ende�3t, that the Board of Public Instruction will pay the City for the
work estimated at $8,900.00 by the City Engineer. Commissioner C�latltins moved the City
Engineer be irstructed to �eyuest bids on this project a3 soori as possible; that �he
Board of Public Instruction b� atlth�rized to make tlze connection whenever the work
is completed, and when the lift station is completed� the City will assume responsibility
for t:�e upkeep. Motion Uras seconded by Commiss3oner Fi�lds and carried urianimously.
The iHa.yor requested bids be brought back to a meeting on November 9th, if possible, as
it was an emergency situation.
A plat of Sunset Ridge Unit l was presented. The P�ta.nager reported the contract
in accorrlanee t�rith Ordinances 632 and 750 had been signed by the �leveloper, Mr. Albert
P. Rogers, an_d band had been postzd to cover improvements, The Zoning and Planning
Board recommended approval. Comrnissioner ulatkins moved the plat uf Sunset Ftidge Unit
l be approved and the proper official� be authoriz�d to execute it. Motion was aeconded
by Commissioner Fields and carried unanimously.
The Manager presented a plat of Bayside Subdivision No. 6 Unib B and reported a
contract in accordance with Ordinances 632 2nd 750 had been signed 'oy the developer,
Mr. H. H. Baskin. He stated all the improvements had been installed w3th the excep-
tion of the road that v�.11 be the connecting linlc tA Lit�1e Pass bridge and the City
has a letter from Mr. A1 Rogero stating vrhen the bridge is built, the St��e Road
Department will build the connecting roads without �xpense to the City or the
developers, Comm3ssioner Watkins moved the approval of Bayside #6, Unit B, and that
the proper officials be authorized to execute it, Motion was seconced by Commissior�e�
Fields and carried unan3mously.

Regarding fi11 for area between Druid Road and Magnolia (Magnolia Park, B].ocks
2g and 32) involved in the exchan�e agr�ement with the Se�boarcl Air Line Railroad, the
En�ineer reported he had advertised and sent invitations to bid to eleven contr�,ctors
but no bid� had been received. He said he had been informed it was because the time
was too short, and if two weeks were allowed some of the contractors would bid on it.
Commissioner Watkins moved the City En�ineer be ins�ructed �Lo advertise for bid� to be
considered two weeks from today, November 16th. Motion was seconded by Commissioner
Fields and carried unanimously.
Regolution 59-101 was presented requiring �tv�enty-five property owners to clean
their lous of weeds and undergrowth, Commissioner Watkins moved Resolution 59-101
be passed and adopted and the proper officials be authorized to execute it, Motion
was seconded by Commissioner Fields and carried unanimously.
The Manager reported bids had been opened and read on construction of the
Memorial Civic Center on Clearwater Beach this afternoon. Mr. Arthur Kruse said it
was hoped a ground-breaking ceremony could be scheduled for Veterans Day on November
llth and hoped that the contract could be awarded before that time. Commissioner
Watkins moved the bids be received and they be referred to the architect and
AssiStant Purchasing Agent to report uack as early as convenient. Motion was seconded
by Commissioner Fields and carried �.nanimously.
Regarding the closing on purchasing the Maurice Thayer property, Lots 2,7, part
of Lots 1 and 8, Block 5, Gould &�a3.ng lst Addition, the P.ttorney reported Mr. Robeit
W. Baker was present on P�[r. Thayer's behalf, He explained there were no objections to
�he condemnation proceedinos and on October 29, 1959, Judge Jack White had entered an
order of::final decree and condemnation predicated upon the stipulai;ion, He explained
the �otal purchase price af the property was $260,00�.00, that a valuation o�
�125,000.00 is being paid in property (Block 5, north of Park Street, Sarah Mci'�fullen
Subdivision, less east 50 feet; Lots ll and 12, B7.ock 2, Magnolia Park Subdivision),
the b�lance to be paid in cash of �135,000.00 plus a fze of $1,000.00 to ratr. Robert
Baker as the dei'endant's attorney to be paid by the City, Commissioner Y7atkins moved
to aizthorize the M�yor anfl appropriate officia].s to execute the deed and deliver it
to Mr. Thayer as well as delivering the balance of t:�e cash as called for in the
Court decree and that the mortgages be satisfied and recorded. Motion was seconded
by Commissioner Fields and carried unanimouSly.

The Attorney reported in paving and extending Pierce Street it was found,necessary
according to the Engineer's report to secure a portion of I,ots 4,5,7, Block C, Hibiscus
Gardens, belonging to Mrs. 0. S, Allbritton, Jr., and Lot 6, Block C, Hibiscus Gardens,
belon�ing to Mr, Nick Sagonias. He reported the owners were willing to give the right
of way necessary in exchange for Lhe City cancelling special assessments against those
lots for work now :in process. Commissioner Fields moved the City Attorney be authorized
to secure the right of way from Mrs. 0. S. Allbritton and Mr. Nick Sagonias for Pierce
Street, Motion was seconded by Corrunissioner Watkins and carried unanimously.
The Attorney reported Item ,-�18, "Agreement with Municipal Code Company" could be
delayed if the Commission wished. Commissioner Rields ms�ved Item #18 be pastponed co

In regard to the proposed zoning referendum, the Attorney reported the Gity Clerk.
had recommended the Commission set a public hearing at a special meeting on November
9th on proposed items to be inc�uded in order that on November l6th the n�cessary
ordinances setting up the referendum can be passed, Commissioner Watkins moved the
recommendation be approved and that the proper officials be authorized to set up the
advertisemenzs for the various dates, Motion was seconded by Commissioner Fields and

The Attorney reported he had received a letter from the Industrial Direct�r
advising the City that Mrs, Flora J. Redmer tAras asking for a refund of the earnest
moneg of $1,181,25 deposited in escrow on a contract to purchase Lot 20, Clearwater
InduStrial Park, under a clause stating if adequate financing c�uld not be arranged,
the refund would be made upon notii'ication. Commissioner Watkins moved �he matter be
tabled until the next meeting. Motion was seconded by Commisaioner Fields and caxried
unanimously.
The Attorney requested confirmation of his actions in closir_g the purchase of
Lot 23, Block C, Fairmont Subdivision, from Mr. Henry Ghiron. He stated it was necessary
i`or the City to pay for Litle insurance and this year�s taxes ($6,20) and he had
instructed the City Treasurer to draw a cheek for �1,509.40 for the balance on this
contract. Commissioner Watkins moved the action be confirmed and payment of the funds
be made. Motion was seconded by Commiss3oner Fields and carried unanimously.
It was reported by the Attorney that there was a house on Lot 77, Glenwood, that
ivas in his opinion a public nuisance. He recommended notice be given to �he owner to
have it removed within ten days. Commi.ssioner Watkins moved the City Attorney and any
and all otr�er City employees �th� may properly administer this par� of the Code be
authorized and instructed to bring suit under the appropriate City ordznance. Motion
was seconded by Corrunissioner Fields and carried unanimously,
The Attorney presented a proposed contract with Mr. James B. Nall to purchase a
part of Tract B, MeMullen's Bayview Subdivision, the property being 300 feet wide on
Gulf to Bay Boulevard, f'or a pr3ce of �37,500.00. He explained the Ci�y plans to use
the site for a new sewer disposal plant to serve the east section'of the City. Com-
missioner Fields objected because of �;he high cost and thought it would be expensive
to fill. Commissioner Watkins moved �he contract be approved and the proper officials
be authorized to execute it contingent upon the City acqui.ring the submerged lands as
part of the purchase price; contingen� upon approval of the I. I..Board for the
necessary filling; contingent upon. approt,ral of the U.S. Army Corps of Engineers; and
eontingent upon the Consulting Engineer's approv�l of the site for construction of the
contemplated improvement after ma,king soundings. Motion was seconded by Commissioner
Smith. Upon the vote being taken, Commissioners Watkins, Smith and Finch voted "Aye".
Commissioner Fields voted °No". D4otion carried.
�n the Mayor's suggestion, Commissioner Watkins moved the Mayor be instructed to
apgear before the County Commission tomorrow and request that they put in writing their
agreement to put up �550,000.00 for the Myrtle Avenue projeet and tnat they authorize
the State Road Ba��d�o charge that against their secondary r6tad fund. Motion was
seconded by Commissioner Smzth and carried unanimously,

The Ma.yor re-convened the meeting at 6;50 P,M, with Commissioners Watkins, Fields

The architect and Assistant Purchasing Agent presented the tabulation of bids i'or
the Memorial Civic Center. Commissioner Smith moved that the bid for the Memorial Civic
Center be awarded to Bailey Builders, Clearwater, for $190,890.00 less Alternate �p`3 of
$27,500,00 which is the optional air conditioning machinery, this being the lowest and
'�est bid, and the pr�per officials be authorized to execute the same, Motion tivas
seconded by Commissioner Fields and carried unanimously.
The Attorney reported clo�ing was set for November 3rd on all of the pxoperty for
Parking I,ot 7�2 on Park and Pierce between the two railroads (Magnolia Park, B1ock 6,
Lots 1,3,4,5,z4, part of LgL's 2 and 13) except Lots 10-12, belonging to Mr, Larry
Dimmitt and that was deferred on hi� request tiritil after January lst but the City has
a letter that the City can use the propertq before thexi if needed. Commisaioner
Watkins moved the City Manager and the Ci�y,fireasurer be authorized to execut8 the
checks for the purchase of the Park Street parking lot on the request of the City Attorney.

Reference is made to your memoranda dated July 22 and September 23, �959 pertaining
to the installation nf sanitary sewers on L�ura St. from High��nd to Hillcrest, in.
Drew and Grove streets from Aighland to San Remo aiid in San Remo from Grove to
�rew S.L. By action of �he Clearwater Citp Commission in the July 13 �eeting, this
project was tabled for further study by ths Pinellas County Health Dspartment.
A sanitary survey of all homes and business establishments aifected w�s completed
on October 2nd, 1959. Out o£ a to�al of 41 premises, E3 were vacan� or the occupants
were unavailable for comment on the history �f t heir septic tank performance. Of
the 33 �remises remaining, 1�0 have recently experienced septic tank failure. Thres
of the ten are apartmpnt buildings containing a total oi 15 Iiving units. St may,
therefore, be ^onclud�d that at least ZO out o.f 41 (about 24.4�) of the premises
or that 22 aut of 60 (aboi�t 27.2�) of the living unit3 have experienced recent
septic tank failur�e.
Tt was presumed from the hzgh coliform ba�teria count found in a sample of water
collected from a storm sewer at Laura St. anri Hillcrest Avz. that a septic �ank or
tanks were connected to the storm sewer along Laura St. During this study a tracing
dye was placed �.n the septic tanks serving several build�ings on Laura St. and the
dpe appeared in the storm se�asr junction box within one hour.
Based on the above findings, �rue conclude that the use of septic tanks as a means
of sewa�e disposal in the subject area const�tz�tes a de�inite threat to Lhe health
of �oth the area residents at,d to those who may come in contact with the palluted
storm water down stream from the point o£ discharge. Wefl therefore, recommenti and
strongly urge that t his sewer extiension project be react3vated and carried through
without delay.

The attached copy of a letter is self-expl.anatory. Thez°e is certainly no question
in �he mind of the Flarida Stat� Board of Health that septic tanks are detrimental
to a cor�unity because iL is a recognized fact that septic tanks are not a sanitary
means of was�e dispnsal in a modern and progressive built-up area.
It is our recommendation that all unsewer�d areas be cnvered �aith adequate sewage
collectior� and treatment at the eaa^liest practical time and it is further reeommended
that in order to prevent further conditions that now exist, that your City Commissi,on
or Building bepartment issue no futher building or construction gexmits wlthout ths
carte blanche approval of the Pinellas County Health Department or State Board of
Health of the sanitary facilities. This cp�perative progra� is in force in many
areas in �lorida and is producing excellent results.
