The City Commission or the City of Clearwater met in regular session at the
C1.ty Hall, Monday, October 19, 1959, at 1:30 P.M. with the rollowing members present:

The Mayor called the meeting to order. The invocation was given by the Reverend
M. G. Argeaux of the Episcopal Church o~ the Good Samaritan, Clearwater. Commdssioner
Watkins moved the minutes of the regular meeting of October 5, 1959, be approved as
recorded and as submitted in written summation by the Clerk to each CommiSSioner
subject to the approval of Commissioner Smith. Motion was seconded by Comrndssioner
Insco and carried unanimOUSly.

A Public Hearing was announced an the appeal of Messrs. G. T.McKernan and Louis
Scimens ~rom the approval by the Board of Adjustment and Appeal on Zoning of the
request of La Roca Corporation to erect a restaurant and cocktail lounge on Lots 13
and 14, Block A, Bayside #5. Mr. Ben Krentzman, attorney, representing the appellants,
stated their objection was that the plans for the restaurant included a dance floor,
hydraulic stage and an orchestra shell which would fit into a night club operationJ
that it was not in the pUblic interest, that the parking provided should be immediately
adjacent to the proposed restaurant instead of across the street. He presented
petitions of objection signed by fifty-seven persons. Messrs. G. T. McKernan, L.
Scimens and others expressed opposition particularly to location in the R-M zone
instead of l~n the Business zone. Mr. Elmer Mylander read a resolution o~'-protest
from the Clearwater Beach Association. Mr. George Moon, President, La Roca Corpor-
ationJ presented a petition in favor signed by eleven persons in the immediate area.
Mr. H. H. BaskinJ Sr., and Mr. Joseph CogganJ architect, spoke on behalf o~ the
corporation. After having held this duly consitituted public hearing on the request
of the La Roca Corporation to erect a restaurant on Lots 13 and l4J Block A, Bayside
#5, zoned R-MJ with a parking lot on Lot 8, Block B, zoned Business, Commissioner
Insco moved that the Public'.Hearing be adjourned until November 2nd, the next regular
meeting of the Commission, when Commissioner Smith can be present. Motion was
seconded by Commissioner Fields and carried unanimously.
The Mayor asked i~ the Commission wished to deviate from the agenda to hear the
complaints on train whistles. Commissioner Watkins moved to deviate rrom the agenda
to hear the request for a hearing on train whistles of the two railroads. Motion was
seconded by Commissioner Insco and carried unanimously.
Mr. P. A. Davis, 530 Rogers Street, presented a petition signediiby an estimated
800 persons asking that the Commission enforce the following sections of the City CodeJ
Chapter 25, -- Sections 1,2,6J14,16. He stated he was opposed to the train whistlesJ
that it was against the City ordinance, but requested signal protection at crossings.
Comrnissioner Watkins stated the Commission had met with railroad of~icials and their
attorneys, together with electronic experts, to try to establish a safe warning device
that would be less expensive than the present cost of $17,000.00 to $20,000.00 for an
electric warning device at each crossing, that the State is also working to make it lega1~
but that prior to that time, he recommended the City Manager meet with the railroad
officials to see what can be worked out. Mrs. E. Burton Beers asked ror an electric
warning signal at the Betty Lane crossing and at the Palmetto Street crossingJ com-
plained of whistle blowing in residential areas and excessive speed. Mr. W. E.
Eigenmann asked that the Manager be instructed to designate which crossings need an
electric warning device and send notice to the railroads to have them installed.
Mr. Seth Cuykendall complained o~ excessive speed of A.C.L. trains and excessive
horn blowing by the S.A.L. engineers in the early morning hours. Mr. J. L. Kennedy,
District Superintendent, Atlantic Coast Line Railroad; Mr. A. B. Chipley~ local agent,
and Mr. E. B. CaslerJ attorney, representing the Seaboard Air Line RailroadJ were
present. Co~Ssioner Insco moved the petitions be received. Motion was seconded
by Commissioner Fields and carried unanimously.
A Public Hearing was announced on the construction of sanitary sewers in Betty
Lane from LaSalle Street to Engman Street. The Engineer estimated the total cost at
$2,234.00 or $3.47 per front foot. Mr. Robert Freeze, attorney, objected on behal~
of Mr. Frank Fisher, owner of Lots 13-16, Block E, Pinebrook Unit 2, stating the lots
would not be benefited enough to warrant the additional expense. Commissioner ~atkins
moved since no valid objections have been riled that the construction of sanitary
sewers in Betty Lane from Engman to LaSalle be approved and the Engineer be directed
to proceed with such improvements. Motion was seconded by Commissioner Fields and
carried unanimously.
Commissioner Fields moved to deviate rrom the agenda to hear Lt. Colonel Mary
Cuppy on a ltlrainage problem at Oxford and Magnolia. Mo'tion was seconded by

Lt. Colonel Mary Cuppy, owner of Lot 51, Druid Acres Unit 2, complained that
another property owner in the vicinity had cut a drainage trough that goes out to
the road and the water from underground drainage goes into Oxford Drive and drains
to Druid Road. Mr. T. H. ~nks also complained. Commissioner Watkins moved the
City Engineer be instructed to investigate and return the information to the City
Commission as soon as possLble. Motion was seconded by Commissioner Fields and
carried unanimously.
The Mayor announced a Pu~lic Hear~ng on construction of curbing and widening
in ~rcturas Avenue from Drew to Cleveland Street. The Engineer estimated the cost
at $2.51 per front foot. The Mayor asked ir there were any objections and there
were none. Having held this Public Hearing, Commdssioner Watkins moved that since
no valid objections have been filed that the construction of necessary curbing and
necessary widening and drainage in Arcturas Avenue from the south line of Drew
Street to the north line of Cleveland be approved and that the City bear the
expense of the resurfacing. Motion was seconded by Commdssioner Fields and carried
ynanimously.
Conunissioner Fields moved to deviate from the agenda to hear Item #10, "Letter
trom M. H. Quinn re Drew St. Drainage". Motion was seconded by CommiSsioner Insco
and carried unanimoUSly.
Mr. M. H. Quinn presented a petitLon signed by thirty-five personsrasking
relief from a drainage prob~em at Wood Drive, Smallwood Circle and Rosemere, and
asking that the City accept the $14,000.00 ofrered by the State Road Department as
its share of the cost of a drainage project. The Engineer reported the State Road
Department had offered to furnish the pipe at a cost of $14,000.00 or $~5,000.00,
that it would cost $4,000.00 or $5,000.00 for the construction of the storm sewer
main, but the:City would be obligated to dig out two small lakes and put in pipe to
connect the two, making a total of $40,000.00 to $45,000.00 for the project. He
stated the plans from the State Road Department have come but the details of the
contract have never been worked out. ffe felt the sanitary sewer replacement was the
most important and should be corrected first. Commissioner Watkins moved the petition
be received and filed with the City Clerk and that the City Engineer and City Manager
be instructed to carry out the necessary study of the situation. Motion was seconded
by Commissioner Fields and carried unanimously.
A letter o~ resignation was read f~om Mr. John C. Marceron, Director, Clearwater
Safety Council, to be effective October 23, 1959. Commissioner Watkins moved that
the resignation be accepted with regret and that he be informed that the City is
proud to have had him as ChLe~ or its Safety Council. Motion was seconded by
Commissioner Fields and carried unanimoUSly.
The Manager recommended accepting the low bid of $25,279.00 from Ray Birkbeck,
Dunedin, for construction o~ sanitary sewer in Bayside Drive. Commissioner Watkins
moved that the contract for Bayside Drive sanitary sewers be awarded to Ray Birkbeck,
Dunedin, for the sum of $25,279.00, which is the lowest and best responsible bid,
and that the appropriate officials o~ the City be authorized to execute said contract
which shall be in accordance with the plans and specifications and bid. Motion was
seconded by Commissioner Fields and carried unanimously.
Commissioner Insco moved that the meeting be recessed until 8:00 P.M. Motion
was seconded by Commissioner Fields and carried unanimously.
The Mayor re-convened the meeting at 8:00 P.M. with Comndssioners Fields, Insco
and Watkins present. Captain W. Beam was present representing the Police Chief and
the City Engineer was excused from attending this session.
It was recommended by the Manager that the low bid of $2,166.40 rrom Martin's
Uniforms, Tampa, be accepted fov winter uniforms for the Fire Department, 46 service
jackets, 120 uniform trousers and 60 uniform caps. Commissioner Watkins moved the
contract ror winter uniforms for the Fire Department be awarded to Martin's Uniforms,
Tampa, in the amount of $2,166.40, this being the lowest and best responsible bid,
and the appropriate orficia1s be authorized to execute Said contract which shall be
in accordance with the plans and specifications and bid. Motion was seconded by
Commissioner Fields and carried unanimously.
The Manager recommended the acceptance of the low bid or $16,337.28 rrom John
Daniels, St. petersburg, for construction or drainage, curbs and resurfacing in
Prescott Avenue rrom Belleview to Belleair. Cornmdssioner Watkins moved the Prescott
Avenue improvements be awarded to John Daniels Company in the amount of $16,337.28,
which is the lowest and best responsible bid, and the appropriate officials of the
City be authorized to execute said contract which shall be in accordance with the
plans and specifications. MDtion was seconded by Commissioner Fields and carried
unanimously.
It was recommended by the Manager that the low bid of $10,260.10 from Van
Orden & Van Ess, Tampa) be accepted for installation of gas mains in Montclair
Estates area. He explained the subdividers had agreed in writing to install gas
appliances in the subdivision. Comndssioner Watkins moved the contract for gas mains
for Montclair Estates be awa~ded to Van Orden and Van Ess, Tampa, in the amount
of $10,260.10, this being the lowest and best responsible bid, and the appropriate
officials be authorized to e~ecute said contract which shall be in accordance with
plans and specifications and bid. Motion was seconded by Commissioner Fields and
carried unanimously. The Mayor requested an easement or permission be received
from the County to install the mains in the County road right of way.

In regard to the plat of Sunset Ridge Unit #1, the Manager reported no bond
had been received and no arrangements had been made to meet the requirements ror
streetlight installation. Corrmdssioner Watk~ns moved the request for approval
of plat of Sunset Ridge, unit #1, be postponed until the next meeting. Motion
was seconded by Commissioner Fields and carr~ed unanimously.
The plat or Sunset Lake Estates Un~t 3 was presented. The Manager reported
the contract in accordance with Ordinances 632 and 750 had been signed by the
developer, Mr. T. TI. Constant~ne, as President of Norbh Point Corporation, and
that bond for improvements had been posted. The Zoning and Planning Board recom-
mended approval with a six~ root right o~ way ror street or court off Souvenir
Drive and designation of center area as lot or parcel, naming of st~eet to be
determined. Co~ssioner Watkins moved the plat of ~unset Lake Estat~s Un~t 3
be approved and the proper ofricials authorized to execute it. Motion was seconded
by Commissioner Fields and carried unan~mously.
The Manager reported the City Engineer had recommended that the name of
Byron Drive in Brookhill Subd~vision be changed to Emily Drive since it was being
confused with Byram Drive in the north section of the City. CommiSSioner Watkins
moved the name of Byron Drive in Er.ookh~ll Unit 4 and Brookhill Unit 4 Replat be
changed to Emily Drive prov~ded we do not receive written object~on from the owner
or developer of the subdivision or anyone owning property on that~street within
the next thirty days. Motion was seconded by Comrrdssioner Fields and carried
unan~mously.
Resolut~on 59-98 was presented requiring twenty-nine property o\~ers to clean
their lots o~ weeds and undergrowth. Commissioner Insco moved Resolution 59-98 be
passed and adopted and the proper orfic~als be authorized to execute it. Motion
was seconded by Commissioner Fields and carried unanimously.
A plat of Bayside Subd~v~sion No.6, Unit C, was presented. The Manager stated
the contract in accordance with Ordinances 632 and 750 was signed by the developer,
Mr. H. H. BaSkin, Sr., as President or Bayside Hotel Company, Inc., and since the
improvements were already installed no bond was needed. The Zoning and planning
Board recommended approval but noted that Gulfway Drive shoul~ be named South Gulr
View Boulevard and Bayway Drive should be Bayway Boulevard. Commissioner Watkins
moved the plat of Bayside Subdivision No.6, Unit C~ be approved and the proper
ofricials be authorized to execute it. Motion was seconded by Commissioner Fields
and carried unanimously.
The Manager reported the Engineer had estimated the amount of fill dirt needed
to complete the f~lling of the area between Druid Road and Magnolia Drive and the
two railroads in accordance with the exchange contract with the Seaboard Air Line
Railroad would cost approximately $10,520.00 By consent, the Ma~ager was directed
to instruct the Engineer to put the project out for bids as soon as possible.
Regarding the proposed new construction trust rund agreements, the Manager
reconunended the $630,000.00 utility Revenue C~rtif'icate f'unds be placed--with the
First National Baruc of Clearwater, that the $3,260,000.00 Utilit~ Tax Improvement
Cert~ficate runds be placed with the Bank of Clearwater and the $575,000.00
Municipal Parking Revenue Bond proceeds be placed with the City National Bank,
Clearwater. He explained the construction fund agreements had been prepared by
the bond attorneys in New York and the ree for services of the banks as trustees
would be $100.00 plus 1/10 of 1%. Commissioner \1atKins moved the construction
trust fund agreement for the proceeds or the $3,260,000.00 Utility Tax Improvement
Cert~ficates with the Bank of Clearwater be approved; that the construction trust
fund agreement for the proceeds of the $575,000.00 Munic~pal Parking Revenue Bonds
with the City National Bank be approved; that the construction trust fund agreement
with the First National Bank be extended to include the proceeds from the $630,000.00
Ut~lity Revenue Certificate issue; that the proper officials be authorized to execute
the three agreements. Motion was seconded by Cornmdssioner Fields and carried
unanimously.
The Ass~stant City Attorney presented an extension of the agreement with Mrs.
Lucile Harris, curator of' the Sea-Orama Museum~ providing that she be paid $3,300.00
for a period of' one year, plus $75.00 per month for the use of' her home as a
laboratory, and paying the cost of utilities at her home. Commissioner Watkins
moved the agreement between the City of Clearwater and the curator of the Sea-Orarna
be approved ror a period of one year starting today and the proper authorities be
authorized to execute it. Motion was seconded by CommiSSioner Fields and carried
unanimOUSly.
Resolut~on 59-99 was presented authorizing the proper off'icials to execute an
agreement from the Atlantic Coast Line Ra~lroad to permit paving, drainage and
culverts at the Union Street crossing. CommiSSioner Fields moved Resolution 59-99
be passed and adopted and the proper authorities be authorized to execute it. Motion
was seconded by Commissioner Watkins and carried unanimously.
Resolut~on 59-100 was presented assessing the cost of sanitary sewers to serve
an area bounded on the north by Gulf' to Bay Boulevard, on the east by Belcher Road,
on the west by a line parallel to and:'.110 feet west of' Florida Avenue, on the south
by a line 660 f'eet south of Gulf to Bay Boulevard except that parcel owned by the
Board of Public Instruction and except premises already served. Commissioner Watkins
moved Resolution 59-100 be passed and adopted and the proper authorities be authorized
to execute it. Motion was seconded by Commiss~oner Fields and carried unanimously.

PETITION
WE, the undersigned, do petition the City Commissioners to give us relief of the
serious drainage problem existing on Wood Drive, Smallwood Circle and Rosemere
brought about by the installation of the modern drainage s~stem installed by the
State Road Department when Drew St. was improved; namely b~ the installation of
the 36" pipe 1000 ft. long on Edgewood Drive and a 30" line on Ridgewood tied into
the oJ.d 24" pipe that has served the area since 1924. We further pray that the
City Commission ~J.l adopt the recommendations of the state Road Department
Engineers to create a pond in Glem'lood Parle and install a 4211 outf'lo\'l line
therefrom, and accept the $14,000 offered by the State Road Dept. as their share
of the cost. We are fearful if the $14,000 is not accepted before the change
of the present state Administration, we might be deprived of the $14,000 by faces
unfa~liar or un~riendly to Clearwater, namely a new State Road Board. Signed by
thirty-five persons.

PETITION
We, the undersigned Citizens of Clearwater, Florida, petition and appeal for the
enforcement of ~rdinances as contained in the Code of the c~ty of Clearwater,
Florida, 1950, concerning to and the regulating of locomotives and trains passing
thru the City for the protection and safty of life, limb and property and maintain
the persuit of quiet, peace and happiness or it's citizens and visitors; Rererence
Viz; Article 1 page 3l2,~13,314,316 of said code.
Sec.l--It shall be unlawful, except in cases of emergency, ~or any person operating
any railroad tra~n or locomotive through' the City to blow the whistle or horn
attatched to such locomotive at any point within the corp~rate limdts of the City.
Sec.2--No railroad train or locomotive shall be operated at a speed greater than
fifteen miles per hour within the area in the city bounded on the north by Palmetto
Street, on the east by Greenwood Avenue, on the SQuth by Druid Road and on the west
by 'the Gulf of Mexico. No train or locomotive shall be ope~ated at a speed exceeding
thirty miles per hour in any part of the city lying outside the area above mentioned
and described.
Sec.6~-It shall be unlawful ror switch engines or cars in the process of switching
,or be~ng switched, to pass over any paved street in the cit~ unless such switch
engine or car sha11 be preceeded across such street by some person to give proper
warr.dng of the approach of such engine or car.
Sec.14--The City Manager; whenever in his opinion it is nessessa~ to the safty
of l1fe~ limb andpropertYi ahall have the rull right and authority to order and
direct any Railroad Company running through~ along or across any of the streets in
the o~ty, to bui~d~ erect, maintain and operate gates or g~rds at such streets
cross~ngs and other places as he shall designate in the Cit~.

The Mayor called the meeting to order. The invocation was given by the Reverend
M. G. Argeaux of the Episcopal Church of the Good Samaritan, Clearwater. Commissioner
Watkins moved the minutes of the r�gular meeting of October 5, 1959, be approved as
recorded and as submitt�d in written summation by the Clerk to each Commissiones
subject to the approval of Commissioner Smith, Motion was seconded by Commissioner
Insco and carried unanimously.
A Public Hearing was announced an the appeal of Messrs. G. T.1VfeKernan and Louis
Scimens from the approval by the Board of Adjus�ment and Appeal on Zoning of the
request of La Roca Corporation to erect a restaurant and cocktail lounge on Lots 13
and 14, Bloek A, Bayside #5. Mr. Ben Krentzman, attorney, representing the appellants,
stated their objectian was that the plans for the sestaurant included a dance floor,
hydraulic etage and an orchestra shell which would fit into a night club operation,
that it was noz in the �ublic interest, that tihe parking provided should be immediately
adjacent to the proposed restaurant instead of across the street. He presented
petitions of objection signed by fifty-seven persons. Messrs, G. T. McKernan, L.
Scimens and others expressed oppo�ition particularly to location in the A-M zone
instead of,;�n the Business zone. Mr. Elmer Mylander read a resolution of protest
from the Clearwater Beach Association, r2r. George Moon, President, La Roca Corpor-
ation, pre�ented a petition in favor signed by eleven persons in the immedia�e area,.
Nlr. H, H. Baskin, Sr., and Mr. Joseph Coggan, architect, spoke on behalf of tihe
corporation, After having held this duly consitituted public hearing on the request
of ;he La Roca Corporation to erect a restau�ant on Lots 13 and 14, Block A, Bayside
,-�5, zoned R-M, with a parking lot on Lo� 8, Block B, zoned Business, Conun:tssioner
Insco moved that the Publio:.Hearing be adjourned until November 2nd, the next re�ular
meeting of' the Commission, when Commjssioner Smith can be present. Motion jaas
seconded by Commts�ioner Fields and carried unanimously.
The Mayor aske3 if the Commission wished to detTiate from the agenda to hear the
complaints on train whistles. Commissioner Watkins moved to deviate from the agenda
to hear the request for a hearing on train whistles of the two railroads, Motion taas
seconded by Commissioner Insco and carried unanimously.
Mr. P. A, Davis, 530 Rogers Street, presented a petition signed".by an estimated
800 persons asking that the Commis�ion 8nforce the following sections of tn� City Code,
Chapter 25, -- Sections 1,2,6,1�F,16. Ae stated he was opposed to the train tvhistles,
`�hat it was against the City ordinance, but requested signal protiectiion at crossings.
Commissioner Watkins stated the Commissi.on had met with railroad officials and their
attorneys, together with electronic exp�rts, to try to establish a sa�e warning device
that would be less expensive than the present cost of $17,000,00 to �20,OOQ.00 for an
eleci:ric warning device at each croasing, that the State is also working to make it legal,
but that prior to that time, he recommended the City Manager meet �vith the ra�lroad
officials �o see what can be worked out. Mrs, E. Burton Beers asked for at? electric
warning signal at the Betty Lane crossin� and at the Palmetto Street crossing, com-
plain�ed of whistle blowing in residential areas and exeess3ve speed. Mr. W. E.
Eigenmann asked that the Manager be instructed tu d�signate which crossings need an
electric warning device and send notice to the railroads to have them instal'led.
Mr. Seth Cuykendall complained of excessive speed oi' A.C.L, �c�azns and excessive
horn blowl.ng by the S.A.L, engineers in the early morning hours, Mr, J. L'. Kennedy,
Distriet Super3.ntendent, Atlantic Coast I�ine Railroad; Mr. A. B. Chipley, local agent,
and Mr. Eo B. Casler, attorney, representing the Seaboard Air Line Railroad, were
present. Comm��sioner Insco mo�ved the petitions be reaeived. Motion was seconded
by Commi.ssioner Fields and carried unanimously.
A Pub13c Hearing was announced on the construction of sanitary sewers in Be�ty
Lane from LaSalle Street to Etzgman Street. The E.hginee.r estimated the total cost at
$2,234.00 or $3.47 per front foot. Mr. Robert Freeze, attorney, objected on behalf
of Mr. Frank Fisher, owner of Lots 13-�b, �lcek E, Pinebrook Unit 2, stating the lots
tvould not be benefited enough to warrant the additional expense. Commissioner [Jatl�ins
moved since no valid objections have been filed that the construetion of sanitary
sewers in Betty T�an.e from Engman to LaSalle be approved and the Engineer be directed
to proceed with such improvements. Motyon was seconded by Commissioner Fie�ds and
carried unanimouslye
Commissioner Fields moved to deviate f'rom the agenda to hear Lt. Colonel Mary
Cuppy on a drainage problem at dxfor� and Magnolia. Motion was seconded by
Commissioner Watkina and carried unanimously,

to Dru.id Road. Mr. T. H. Banks also complained, Commissioner Watkins moved the
City Engineer be 3nstructed to investi�ate and return the informati�n to the City
Corr¢nission as soon as pc�ssible. Motion was seconded by CommissionEr Fields and
carried unanimously.
The Mayor announced a PuIDlic Hearing on construction of curbing and widening
in Areturas Avenue from Drew to Cleveland Street. The Ehgineer estimated the cost
at $2.51 per front foot. The Mayor asked if there tiaere any objections and there
we�e none. Havino held this Fublic fiearing, Conunissioner Watl�ins moved that since
no valid objections have been fil�d that the construction of necessary curbing and
necessarg widening and drainage in Arcturas Avenue from the south line of Drew
Street to the nor�h line of Cleveland be approved and that the City be�r the
expense of the resurfacing. Motion was seconded by Commissioner Fields and carried
unanimously.
Gommissioner Fielcls moved to deviate from the agenda to hear Item �10, "Letter
�rom M. H. Qui;nn re Drew St. Drainage". Motion tivas seconded by Commiss3_oner Insco
and carried unanimously.
N1r. M. H. Quinn pres�nted a petition signed by thirty-five persons:asking
relief irom a drainage problem at Wood Drive, Smallwood Circle and Rosemere, and
asking that the City accept the $14,000.00 offered bf the State Road Department as
its share of the cost o#' a drainage project. The Engineer reported the State Road
Department had offered to furnish the pipe at a cost of $14,000.00 or $I�5,000.00,
that it would cost $4,000.00 or $5,000.00 for the construction oz the storm sewer
main, but the:City would be cbligated to dig ou� two small lakes and put in pipe to
connect the two, making a total of $40,000,00 to $�45,000.00 for the project. He
stated the plans from the State Road Department have come but the details of the
contract have never been worked out. He felt the sanitary sewer rep7.acement was the
most iniportant and shauld be correctEJ first. Commissioner Watkins moved the petition
be received and filed with the City Clerk and that the City Engineer and City Manager
be instructed to carry out the necessary study of the situation. Motion was seconded
by Commissioner Fields and carried unanimously.
A letter of resignation was read froM NIr. John C. Marceron, Director, Clearwater
Safety Council, to be effective OctoUer 23, 1959. Commissioner Utatkins moved that
the resignation be accepted with regret and that he be informed that the City is
proud to have had him as Chief of its Safety Council. Motion was seconded by
Commissione.r Fields and carried unanimously.
Tfle Mana�er recommended accepting the low bid of �25;279.00 from Ray Birkbeck,
Dunedin, for construction of sanitary aewer ii1 Bayside Dri:,re. Commissioner Watkins
moved that the contract for Bayside Drive san3tary sewers be awarded to Ray Birkbeck,
Dunedin, for the sum of $25,279.00, tivhich is the lowest and best responsible bid,
and that the appropriate officials of the City be authorized to execute said contract
�vhich shall be in accordance with the plans and specifications and bid. Motion was
seconded by Commissioner Fields and carried unanimously.
Commi.ssioner Insco moved that the meeting be recessed until 8;00 P,Nt. Motion
was seconded 'by Commissioner Fields and carried unanimously.
The Mayor re-convened the meeting at 8s00 P,M, wlth Commissioners Fields, Insco
and Watkins present. Captain W. Beam was present representing the Police Chief and
the City Engineer was excused from attending this session,
It was recommended by the Manager that the low bid of $2,166.40 from Martin'�
Uniforms, 7?ampa, be accepted f�� winter uniforms for the Fire Department, 46 �ervice
jackets, 120 uniform trousers and 60 uniform caps. Commissioner Watkins moved the
con�ract for winter uniforms for the Fire Department be awarded to Martin�s Uniforms,
Tampa, in the amount of $2;,166.�+0, this being the lovrest and best responsible bid,
and the appropriate officials be authorized 'co execute �aid contract whieh shall be
in accordance with the plans and specifications and bid, Motion was seconded by
Corrrmissioner Fields and carried unanimously.
The Manager recommended the acceptance of the low bid of $16,337•28 from John
Daniela, St, Petersbtu g, for construction of drainage, curbs and resurfacing in
Prescott Avenue from Belleview to Belleair, Commissioner Watkins moved the Prescott
Avenue improvements pe awarded to �ohn Daniels Company in th� amount of $16,337.28,
whhtch is the lewest and beat responsible bid, and the appropr3ate officials of the
City be authorized to execute said contract which shall be in accordance with the
plans and specifications. Motion was seconded by Commissioner �'ielda and carried
unanimously.
It was recommended by �he P/Ianager that the 1ow bid of $1C,26�.10 from STan
Orden � Van Ess, Tampa, be accepted for installation oi gas mains in Montclair
Estates area. He explained the subdiv�?ders had agreed in writing to install gas
appliences in the subdivision. Commissione� 4Jatkins moved the contract for �as mains
for Montclair Estates be awarded to Van Orden and Van Lss, Tampa, in the amount
of �10,260.10, th�.s being the lovreat and best responsible bid, and the appropriate
offi�ials be authorized to execute �aid contiact which shall be in accordance with
plans and specifications and bid. Motion was seconded by Commissioner Fields and
carried unanimously. The Mayor request�d an easement or permis�ion be �eceived

was seconded by Commissioner Fields and carried unanimously.
The plat of ,Sun�et Lake Estates Unit 3 was presented. The Manager re�orted
the contract in accordance vrith Ordinances 632 and 750 had been signed by the
developer, Mr. T. :J. Constantine, as President of Nox�i�kt Point Corporation, and
that bond for improvements had been posted. The Zoning and Planning Board recom-
ment3ed approval v�ith a sixt3� foot right of way f�r street or court ofz Souvenix
Drive and designation of center area as 1ot or parce�;�, naming of street to be
determined. Comm��sioner 4Jatkins moved the plat oF 5unaet Lake Estat�es Unit 3
be approved and the proper officials authorized to eate���:te it. Motion was seconr�ed
by Commissioner Fields and carried unanimously.
The Manager reported the City ��ineer had recommended that the name of
Byron Drive in Brookhill subdivision be chan�;ed to Emily Drive sirice it was being
confused with Syram D'rive in the north section oi the City. Commissior_er Watkins
moved the name of Byron Drive in �:ookh311 Unit 4 and Brookhill Unit 4 Replat be
changed to Emily Drive provided we do not receive written object3on from the owner
or developer of the subdivision or anyone ownin� property on that�street within
the next thirty days. Motion vras seconded by Commissioner Fields and carried
unanimously.
Resolution 59-98 vras presente� requiring twenty-nine proper�y orrmers to clean
their lots of weedt� and undergrowth. Commissioner Insco moved Resolution 59-98 be
passed and adopted and thP proper officlals be authorized to execute it. Motion
was seconded by Commissioner Fields and carried unanimously,
A plat of Bayside Subdivision No. $, Unit C, was presented. The Manager stated
the contract in accordance w1.th �rdinances 632 and 750 was signed by the developer,

The Manager re�orted the En�ineer had estimated the amount of fill dirt needed
to complete the filling of the area between Druid Road and Ma,gn�lia Drive and the
two railroads in accordance with the exchange contract wi'ch the Seaboard Air Line
Railroad would.cost approximately $10,520.00 By consent, the Ma�ager was directed
to instruct the Engineer to put the project out for bids as soon as possible,
Regarding tY�e pz�oposed new construction trust fund agreements, the Manager
recommended the y�630,000.00 Utility Revenue Certifi,cate funds be placed-with the
First National Bank of Clearwater, that the �3,26Q,000.00 Utilit Tax I�nprovement
Certificate funds be placed vrith the Bank of Clearwater and �he �575�000,00
Municipal Parking Revenue Bond proceeds be placed cvith the City Na�ional Bank,
Cleartiaater. He explained the construction furi�. agreements ha� been prepared by
the bond attorneys in New York �nd the fee for services of the banks as trustees
��rould be �100.00 plus 1�10 of 1�. Commissioner WatT�ins moved the construc�ion
trust fund agreement fcr the proceeds of the y�`3,260,000.00 Utility Tax Improvement
Certifioates tivith the Bank of Clearwater be approved; that the construction �rust
fund agreement for the proceeds of tYie �575,000.00 Municipal Parking Revenue Bonds
with the City National Ba� be approved; that the construction trust fund agreement
with the First National Bank be extended to include the proceeds from the �630,000,00
Utility Revenue Certificate issue; that the proper officials be authoz�ized to execute
the three agreements, Motion was seconded by Commissioner Fiel�is and carried
unanimously.
The Assistant City Attorney presented an extension of the agreement with Mrs,
Lucile Harris, curator of the Sea-Orama Museum, providing that she be �a-a,id $3,300.00
for a period of one year, plus �75.00 per month fc,r the use of her home as a
laboratory, and paying the cost of utilities at her home. Commissioner Watkins
moved the agreement betjaeen the City of Cleartaater and the curator of the Sea-Orama
be approved for a psri�d of one year starting today and the proper authorities be
au�;horized to execute it. Motion was seconded by Commissioner Fields and carried
u:nanimously.
Resolution 59-99 was presented authorizing the proper officials to execute an
agreement from the Atlantic Coast Line Railroad to permit paving, drainage and
culverts at the Union. Street crossing. Comm3.ssioner Fields moved Resolution 59-99
be passed and adopted and the proper authoritiea be authorized to execute it. Mot;ion
was seconded by Commisaioner Watk�.ns and carried unanimously.
Resolution 59-100 �vas presented assessing tre cost of sanitary sewers to serv�e
an area bounded on the nor�h by Gulf to B2y Boulevard, on the east by Belcher Road,
on the west by a line para11e1 to and_:110 ieet w'est of Florida Avenue, on ths south
by a line 660 feet south of Gulf to Bay Boulevard except that parcel owne� by the
Board of ?ublic �nstruction and except premises already served. Gommissioner Watkins

c?etobPr ly 1959. Commissioner Watkins moved Miss Darothy Grant be granted a pensi�n
as rec�uested; that a certificate of award be given for good and faithful service
and the Mayor be authorized to present it to her at an appropriate time. Motion

the 35" pipe 1000 ft, long on Edgewood Drive and a 30" line on R3.dgewood tied 3nto

City Commissio:� will adopt the recommendations of the State Raad Department
Engineers to create a pond in Glenwood Park and install a 42" outflow line
